Dear Sir:
I submit herewith supplemental report on individual samples of fertilizer which have shown shortages subject to penalty during the season of 1928.

On July 13, a report was submitted in Bulletin No. 109 covering 555 samples which had shown under-1'UllE subject to penalty out of the first 5,012 samples analyzed.

This report covers an additional 733 samples which have shown shortages subject to penalty out of 6,544 additional samples analyzed since the publication of the Bulletins Nos. 109 and 110.

During the season, out of a total of 12,556 samples analyzed a total of 1,288 which was a little more than 10% have shown shortages subject to penalty.

It is desired to call the attention of the public to the fact that analyses shown in this Bulletin and in Bulletin No. 109 are analyses of individual sampIes and have no significance as to fertilizer which was not sampled and analyz-
ed. Bulletin o. 110, published last spring and Bulletin No. 112, which is
being published along with this bulletin, shows the average analyses of the different brands and is the bulletin which should be consulted by purchasers of fertilizers who did not have their fertilizer sampled because the analyses shown in Bulletins Nos. 110 and 112 is the average of all analyses made on each brand. And all fertilizer which was not sampled, oLany brand shown subject to penalty in Bulletins Nos. 110 and 112, are subject to the penalty shown if they were not sampled.

On each sample analyzed, reports were made out in triplicate, one copy



going to the manufacturer, one copy to the farmer using the fertilizer and

one copy retained on file in this office. The letters received from the con-

sumers of fertilizers seeking information as to penalties indicate a widespread

lack of understanding of the Fertilizer Law. The Law provides that if a ferti-

lizer sample shows an under-run of 3% in commercial value that the purchaser

is entitled to a penalty of 25% of the purchase price. The Jaw further provides that if a sample shows an under-run of 10% in either one or more of the principal plant foods, that it is misbranded and the purchaser is entitled to receive a penalty of 25% of the purchase price. The penalties are cumulative and in the event a sample is subject to penalty for misbranding and penalized for shortage in commercial value, the purchaser is entitled to receive a penalty of 50% of the purchase Wice.
In either Cll.SC, the purchaser is entitl ed to recei ve the actual shortage in commercial value in addition to the penalty.
As before explained, it is impossible under the present law to accurately determine the co=ercial value of a fertilizer because the present law does not require the amount of each source of plant food to be given and without knowing the amount of each source the real commercial value cannot be determined.
For this reason, the method used m calculating the commercial value is by taking the cost per unit of the various plant foods when derived from various materials and average this cost and using this average in figuring the commercial value of the plant food contained in the mixed goods.
To illustrate, if nitrogen in nitrate of soda is worth $4.00 per uni t, nitrogen in sulphate of a=onia is worth $3.00 per unit and nitrogen in cyanamid is worth $2.50 per unit then, the average cost of nitrogen per unit in mixed goods would be $3.17 pet unit.
To illustrate further, if the cost of nitrogen m cotton seed meal IS $7.00 per unit and the cost of nitrogen in dried blood is 87.00 per unit and the cost of nitrogen in tankage is $5.00 per unit then, the average cost of nitrogen in the mixed goods containing these three elements would be calculated at $6.33.
Of course, in fixing the average cost of nitrogen to cover the wide field of mixed fertilizera in the State, it is necessary to use both organic and inorganic sources and prices in arriving at the average to be used.
The average prices of the different plant foods- for the current aeason were fixed by the Commissioner of Agriculture as follows: Available Phosphoric Acid SO per unit, Nitrogen $4.00 per unit and Potash 70 per unit. These prices were calculated at the port and a charge of $5.00 per ton is allowed to cover the cost of bagging, mixing, freight, etc.) on mixed goods.
It is impossible to determine correctly the co=ercial value of any fertilizer without knowing the sources of plant food, especially the sources of nitrogen which is by far the most expensive plant food and which is derived from the greatest number of sources. The commercial value of nitrogen varies from $2.00 per unit to $7.00 per unit according to the source from which derived.
Since a great many consumers of fertilizer use relatively small quantities (two to fifteen tons), a penalty of 25% involves an amount of money which

ill insufficient to pay the cost of litigatIon and leave very much to the con8umer entitled to the penalty.
The Law should be changed 80 as to give the Commissioner of Agriculture authority to collect these penalt,ies for the consumers and relieve them of this trouble and expense. especially since the funds derived from the fertilizer tax, which is paid entirely by the con umer, is amply sufficient to defray any necessary expense in this connection.
The analysis of all brands given in Bulletin No. 110 represents a composite analysis of all samples of that brand and is the official analysis on that brand and covers all of that brand of fertilizer sold in the State so that any con8umer of fertilizer using a brand which is shown subject to penalty in Bulletin No. 110 is entitled to receive the penalty on the amount of that brand of fertilizer which he used if he did not have his fertilizer sampled.
