ECONOMIC REGULATION OF lRUCKING TO END JANUARY 1, 1995
ATLANTA --The Federal Aviation Authorization Act of 1994, which goes into effect on January 1, 1995, effectively ends economic regulation of intrastate trucking transportation as it has been known for the past fifty years. Beginning in january 1995, motor carriers (other than household goods movers and passenger carriers) will no longer file tariffs and gain approval of rate changes from the Public Service Commission. Shippers and carriers will be able to negotiate rates and services.
For shippers the economic deregulation of trucking means more opportunities to choose who will transport their property. However, it also means that shippers can no longer rely upon the Commission to serve as a watchdog over rates, routes, and services. Since the freight bill will be the final billed rate, not a filed tariff, shippers must obtain from carriers the price and rules that are applicable for each transaction.
Carriers' state-issued operating authorities will have no value, except as a tax write-off and the last remnants of protection from competition will be removed.
Under the new law, the Commission still has the authority to issue certificates, to require proof of insurance and to inspect motor carriers for compliance with the Federal Motor Carrier Safety Regulations.
