HB 1092 Georgia Women's CARE (Child Care Alternatives, Resources, and Education) Act, enact
Bill Summary: House Bill 1092 is the 'Georgia Women's Child Care Alternatives, Resources, and Education (CARE) Act.' The bill requires every woman who is not released on bond within 72 hours of an arrest to submit to the pregnancy testing protocols of the facility. Unless denied by a judge due to safety risks or declined by the pregnant woman, the judge will determine the eligibility of a pregnant woman sentenced to a period of confinement in a penal institution to have the sentence deferred until six weeks after delivery.

During the deferred time, the offenders are required to maintain perinatal health care, treatment, and assessments, as well as participate in education and resource programs. If the court finds that the offender is not compliant with perinatal health care requirements, the court may rescind the deferred sentence and order immediate confinement.

Commencing January 1, 2023, and annually thereafter, the Department of Public Health will report the following: data collected pursuant to subsection (f) of Code Section 42-1-11.3; and the total number of women who are pregnant, incarcerated, or declined deferred sentencing. This report excludes patient-identifying information.

By October 1, 2022, each local board of education and charter school governing body will adopt an acceptable-use policy with the purposes of preventing and prohibiting any computer or network from accessing obscene materials. Each system shall take necessary steps to implement and enforce the acceptable-use policy. The report includes recommendations regarding whether the alternative evaluation system should be implemented throughout the state.

The government for the city is composed of a city council consisting of a mayor and six council members each serving four-year terms. The city council members are elected through a non-partisan municipal general election held biennially in odd years.

The city council is authorized to appoint a city manager to act as the chief executive and administrative officer of the city. The charter creates the Municipal Court of the City of Mableton to be presided over by a chief judge. The charter provides enabling legislation for the creation of one or more community improvement districts within the city.
