Bill Summary: House Bill 676 shall be known and may be cited as the 'Accountability, Change Management, and Process Improvement Act of 2015.' It provides that all state agencies, boards, authorities, and commissions shall provide a written business case for every information technology project that exceeds $1 million in value. It provides what information shall be included in the business case.
Further, it provides that all state agencies, boards, authorities, and commissions shall provide for a change management plan and resources necessary for plan execution for projects that exceed $1 million in value, projects that directly involve two or more state agencies, or service delivery changes in existing programs that significantly impact more than 10,000 citizens in Georgia.

"Appellate Jurisdiction Reform Act of 2016"; enact
Bill Summary: HB 927 amends Title 15, relating to certiorari and appeals to appellate courts generally. Specifically, the bill enables the Georgia Supreme Court and Georgia Court of Appeals to hire law students as full- time clerks, provided those clerks pass the bar within one year of their hiring. The Court of Appeals is empowered to create by court rule the manner in which it is composed, divided, hears cases, and creates precedent. Further, the Court of Appeals is granted appellate jurisdiction over cases involving titles to land, non-death penalty equity cases, wills, extraordinary remedies not involving the death penalty, divorce and alimony cases, and all other cases not reserved to the Supreme Court or conferred on other courts.
The Superior Courts are also empowered to grant immediate effect to judgments rendered by the Court of Appeals. Additionally, receivership powers and procedures are amended to include appellate courts having appellate review. Mandamus cases, contest petitions, review of decrees in will or contract matters, recordation and registration of deeds and other instruments, will all include appellate courts having appellate review and not just the Supreme Court, this change is also reflected in sections regarding when a judge recommits the record to the examiner, to reflect the changes made in the preceding provisions.
Additionally, the number of Supreme Court justices is increased from seven to nine. The bill empowers the governor to appoint the additional justices created in 2016, for a term beginning January 1, 2017, and continuing through December 31, 2018, and until their successors are elected and qualified. Their successors shall be elected in the manner provided by law for the election of Supreme Court justices at the nonpartisan judicial election in 2018 for a term of six years beginning on January 1, 2019, and until their successors are elected and qualified. Future successors shall be elected at the nonpartisan judicial election each sixth year after such election for terms of six years. They shall take office on the first day of January following the date of the election.
Lastly, the bill changes the dates of the session terms of the Supreme Court.

HB 579 Motor vehicles; operation of certain vehicles upon highways when used in connection with agricultural pursuits; provide
Bill Summary: The legislation creates a new Code section for uniform rules of the road. It defines "farmer" to mean the owner, employee or family members of the owner of a commercial agricultural or silvicultural operation and allows a "farm vehicle," defined as an all-terrain or personal transportation vehicle, on a public road, street, or highway when it is being operated by an adult in connection with agricultural pursuits and has a slow-moving vehicle emblem. The legislation also provides in Code Section 40-6-307 that any municipality may prohibit the operation of a farm use vehicle on public roads and highways within its jurisdiction, if such operation is determined to endanger the safety of the traveling public.

HB 381
Revised Georgia Law on Notarial Acts of 2015; enact
Bill Summary: HB 381 repeals Chapter 17, relating to notaries public, and creates the 'Revised Georgia Law on Notarial Acts of 2015' with much of the same language remaining intact. The substantive changes include modernizing notary laws of Georgia. Currently Georgia law does not authorize electronic notarial acts, and this legislation would render Georgia's notary laws more uniform with other states. Additionally, the bill increases protections against fraudulent notarial acts and allows for electronic notarial acts and licensing and registry with a database created and managed by the Georgia Superior Court Clerk. Every notary public would be required to comply with the act after July 1, 2016 (with the exception of replacing an official seal prior to renewal).
The bill requires a notary to maintain an electronic journal in which he or she must chronicle all notarial acts he or she performs, with entries describing the parties involved, date, time, and fee (if any). Entries must be made contemporaneously with the notarial act. The notary must retain the journal for 10 years after the performance of the last notarial act chronicled in the journal. The bill provides requirements for lost or stolen journals, and procedures for when a notary's commission is suspended or revoked, or the notary dies or is adjudicated incompetent. The bill requires a notary to pass an examination administered by the Georgia Superior Court Clerks' Cooperative Authority (GSCCCA).
GSCCCA must adopt rules and regulations to implement the requirements laid out in the Act including among other things: regularly offer a course on becoming a notary; approve a notary's requested use of technology if it conforms to the standards adopted by such authority; and maintain an electronic database of notaries for individuals to verify the authority of a notary. The GSCCCA must also keep a record of certain personal information for each notary: his or her name, address, signature, age, sex, and commission term, and whether he or she has been approved to perform notarial acts on electronic records.
The bill provides for recognition of other state's or federally-recognized Indian tribe's notaries if the laws of the state or tribe are substantially similar to Georgia laws and the act is performed by a notary public of such state or tribe or by any other individual authorized by the law of the state or tribe to perform a notarial act. The bill also recognizes that a notarial act performed under authority and in the jurisdiction of a foreign state (excluding Cuba, Iran, Sudan, or Syria) or under the authority of a multi-national or international governmental organization has the same effect as though performed by a Georgia notary.

Bill Summary: House Bill 736 will establish a special license plate promoting marine habitat conservation. The funds raised by the sale of this special license plate shall be disbursed to the Coastal Resources Division of the Department of Natural Resources to supplement marine habitat conservation, restoration, and enhancement projects undertaken to increase the abundance of marine fish and invertebrate species.
It also so contains provisions creating a special license plates for female veterans and the Omega Si Phi Fraternity.
Further, it provides that a spouse of a veteran is eligible for a free veterans' tag.

Bill Summary: House Bill 806 is the annual "housekeeping" bill for the Department of Driver Services (DDS). It removes the option for a driver's license with a five-year renewal. It creates a two-year statute of limitations for citations that have been adjudicated in a local court and require the suspension of an individual's driving privileges, but the citations have not been processed with DDS.
