HB 60 - Education; service cancelable loan; State Veterinary Education Board; provisions
- BILL SUMMARY: The legislation amends Code Section 20-3-374 of the Official Code of Georgia Annotated, relating to a service cancelable loan fund and authorized types of service cancelable loans.
The bill provides for the creation of a State Veterinary Education Board, which would consist of five members: the Commissioner of Agriculture or his or her designee, the dean of the College of Veterinary Medicine of the University of Georgia or his or her designee, the dean of the College of Agricultural and Environmental Sciences of the University of Georgia or his or her designee, a person actively engaged in the production of livestock in this state who would be appointed by the Governor, and a person who is actively engaged in the private practice of veterinary medicine in this state and whose practice includes but is not necessarily limited to food animals, also to be appointed by the Governor. The primary goal of the bill is to increase the number of large animal/food animal veterinarians in the state. The newly created Board would enter into loan purchase agreements with no more than five people per year. The applicants must be residents of Georgia for educational purposes, must have completed a program of study in the field of doctor of veterinary medicine or its equivalent, and must be authorized to practice veterinary medicine in this state. The applicant shall receive a loan purchase at a rate equivalent to $20,000.00 per 12 months of service, with no loan purchase agreement exceeding a total of $80,000.00 per person. - Authored By: Rep. - BILL SUMMARY: This legislation states that no additional fees or moneys shall be added to the cost of filing an affidavit relating to lien foreclosures on abandoned vehicles except where a full hearing is requested and granted. HB 186 - High school students; expand career pathway options; provisions
- BILL SUMMARY: House Bill 186 is relating to the "Quality Basic Education Act" and to provide and expand options for high school students to ensure their career and college readiness. This bill will require a stronger coordination between high schools and institutions of higher education to ensure the readiness of students wanting to continue their education and lessen the need for remediation when entering an institution of higher education.
The State Board of Education (SBOE), the Board of Regents of the University System of Georgia and the Board of Technical and Adult Education will develop policies to ensure that student's core curriculum will be accepted at any institution of higher education beginning with students entering school in the fall of 2011. The Department of Education and State Board shall approve models and curriculum framework for 16 specific career clusters of study no later than July 1st 2012.

House Bill 186 also requires SBOE to embed, to the extent possible, academic standards in CTAE courses and to provide for course credit in both the academic course and the CTAE course. Requires the DOE to develop forms and information for students in 8th-12th grades relating to the availability of dual enrollment courses.
The State Board of Education will adopt a state wide plan implementing methods for students to earn units of high school credit based on demonstration of subject area competency, instead of in combination with completing hours of classroom instruction.
The Governor's Office of Workforce Development will establish a certification in soft skills for students. Some of the areas that will be included in the soft skills are: punctuality, ability to learn, working in a team, reading for information applied mathematics and more. This soft skills certification will help the students be even more prepared for the workforce on top of the education they have received. - Authored By: Rep. HB 227 - Student health; school personnel administer auto-injectable epinephrine; authorize
- BILL SUMMARY: House Bill 227 will amend the current Code that allows students to carry and self-inject auto-injectable epinephrine. The bill will allow a teacher, school administrator, school nurse, or other appropriate school system employee to administer auto-injectable epinephrine to a student in the event they are unable to self-inject.
The legislation also will allow schools to receive and store epipens (epinephrine) for students who cannot self-administer due to age and/or other reasons. Parents or guardians will provide the epipen.
Additionally, the bill will require school systems to provide information on the symptoms of anaphylaxis and the proper administration for auto-injectable epinephrine.
Furthermore, the legislation will provide immunity to teachers, school administrators, school nurses, or other appropriate school system employees who administer the auto-injectable epinephrine in good faith and in an emergency situation. - Authored By: Rep. HB 110 - Mortgages and liens; vacant property registry; provisions
- BILL SUMMARY: The bill provides uniform standards for the local government requirement of owners to register vacant real property.
It provides a definition of vacant real property and would allow local governments to charge a fee of no more than $25 in each instance to register or remove a vacant property from the registry.
The registry would include: Vacant real property owner's name, street address, phone/fax number and email address; (If applicable) Vacant real property owner's agent's name, street address, phone/fax number and email address; Street address and tax parcel number; and Recording information of deed book and page numbers of the instrument conveying the property to the owner.
An owner of vacant property may request exemption of registration if certain requirements are met and may challenge a county's determination.
A county or municipal corporation's sole remedy for a property owner's failure to register would be to institute a civil action against the owner. If the owner resides outside of the state, he or she must provide an authorized agent who resides within the state to accept service or process as well as notice of fees due on behalf of him or her. - Authored By: Rep. HB 277 - Hunting; baiting and hunting of deer and feral hogs; regulate; change provisions
- BILL SUMMARY: HB 277 enhances the management of game in Georgia, attempts to control the feral hog population, and provides for both economic development and public safety.
The sub passed by the subcommittee (LC 25 5871S) is different from the original in that it adds definitions for the "northern" and "southern zones." In the northern zone, hunters must be at least 200 yards away from the deer and not within sight of feed or bait. In the southern zone, hunters must have written permission of the landowner to hunt upon, over, or near feed or bait.
HB 277 gives the board the ability to restrict feeding, baiting, or hunting deer where there is a documented occurrence of a communicable disease in the deer population.
HB 277 also states that it shall be unlawful to hunt feral hogs without first obtaining permission from the landowner or lessee and strikes the lines that previously prohibited hunting feral hogs upon, over, around, or near bait. It also gives the board the authority to restrict the feeding, baiting, or hunting of feral hogs in areas where there is a documented occurrence of a communicable disease in the deer population. HB 62 - Scholarship program; special needs students; provide additional notification
- BILL SUMMARY: The legislation amends Code Section 20-2-2113 of the Official Code of Georgia Annotated, relating to the notification of the scholarship program for special needs students, application deadlines, and deadlines for scholarship payments to parents.
The bill calls on the resident school system to annually, prior to the beginning of each school year, provide a notice by letter or email to the parents of all students who have an Individualized Education Program (IEP) notifying them of the possible eligibility of their child for the scholarship. The bill stipulates that the Department of Education (DOE) shall provide application deadline opportunities on August 1, October 1, and March 1 of each school year for a student to transfer. Upon receipt of the proper documentation, the DOE shall make quarterly scholarship payments to the parents of scholarship students on or before November 1, January 7, April 1, and May 1 for quarterly periods corresponding, respectively, to August 1 through September 30, October 1 through November 30, December 1 through the last day of February, and March 1 through May 31 during each academic year in which the scholarship is in force. As nearly as practical, the quarterly payments shall be equal; however, payments may be adjusted due to budgetary midterm adjustments. - Authored By: Rep. HB 176 - Credit Articulation Agreements Act; enact
- BILL SUMMARY: The legislation amends Article 1 of Chapter 1 of Title 20 of the Official Code of Georgia Annotated, relating to general provisions for education, so as to enact the "Credit Articulation Agreements Act."
The bill provides for state-wide degree transfer agreements between state institutions of higher education, which for the purposes of this new Code section means the University System of Georgia and the Technical College System of Georgia. These transfer agreements are for associate of arts and associate of science degrees and applies to common degree programs, specifying the common terms, conditions, and expectations for students enrolled in the state-wide degree transfer programs. The Board of Regents of the University System of Georgia and the Board of Technical and Adult Education will establish and enforce the transfer agreements between two-year and four-year state institutions. A student, who completes an associate of arts or associate of science degree that is the subject of such a transfer agreement and who transfers to a four-year state institution shall, if admitted, be enrolled with junior status. The four-year institution that admits the student who holds the associate degree may not require any additional lower-division general education courses unless the additional courses are necessary for preparation in the degree program. Beginning July 1, 2011, the Board of Regents of the University System of Georgia and the Board of Technical and Adult Education shall negotiate state-wide transfer agreements and ensure that there are at least four such agreements in place no later than July 1, 2013, and that by July 1, 2017, there are a total of at least 14 such agreements in effect. - Authored By: Rep. HR 495 - Joint Higher Education Finance Study Committee; create
- BILL SUMMARY: This bill creates the Joint Higher Education Finance Study Committee, which will study the funding formula for the University System of Georgia and higher education funding to determine if adjustments are needed to provide a high quality and affordable system of higher education in the state. The committee shall be composed of 14 members to be appointed as follows: five members shall be appointed by the Governor to include a member of the Governor's staff, a representative from the system office of the University System of Georgia, a representative from the Technical College System of Georgia, and two parents of children currently enrolled in an institution of the University System of Georgia; three representatives from the business community, one each appointed by the Governor, the Lieutenant Governor, and the Speaker of the House of Representatives; three members of the House of Representatives, appointed by the Speaker of the House of Representatives to include the chairperson of the Higher Education Subcommittee of the House Committee on Appropriations or his or her designee; and three members of the Senate, appointed by the Lieutenant Governor to include the chairperson of the Higher Education Subcommittee of the Senate Appropriations Committee or his or her designee. The chairpersons of the Higher Education Subcommittee of the House Committee on Appropriations and the Higher Education Subcommittee of the Senate Appropriations Committee or their designees shall serve as co-chairpersons. The cochairpersons may designate and appoint subcommittees from among the membership of the committee and shall only vote to break a tie. The committee shall have the following powers: to request and receive data from and review the records of appropriate agencies and entities to the greatest extent allowed by state and federal law; to accept public or private grants, devises, and bequests; and to conduct studies, collect data, or take any other action the committee deems necessary to fulfill its responsibilities.
The committee shall meet at the call of the co-chairpersons and shall do so at least quarterly. A quorum for transacting business shall be a majority of the members of the committee. Any legislative members of the committee shall receive the allowances provided for in Code Section 28-1-8 of the O.C.G.A. Citizen members shall receive a daily expense allowance in the amount specified in subsection (b) of Code Section 45-7-21 of the O.C.G.A. as well as the mileage or transportation allowance authorized for state employees. Any members of the committee who are state officials, other than legislative members, and state employees shall receive no compensation for their services on the committee, but they shall be reimbursed for expenses incurred by them in the performance of their duties as members of the committee in the same manner as they are reimbursed for expenses in their capacities as state officials or employees. The committee is directed to make a report of its findings and recommendations to the General Assembly and the Governor, with suggestions for proposed legislation, if any, not later than December 31, 2011. HB 415 - Jury Composition Reform Act of 2011; enact
- BILL SUMMARY: The bill calls for the Council of Superior Court Clerks to establish and maintain a statewide master jury list. The bill is a proposal of the Supreme Court's Jury Composition Committee, appointed in 2003, which studied whether an inclusive juror source list could replace Georgia' balanced box juror selection system. Since the 1960s, Georgia has used "forced balancing" to ensure that demographic groups within counties are proportionally represented in the jury pool. This bill ends forced balancing, and sets up a series of procedures and rules to compile a statewide, inclusive juror source list.
The bill requires the Department of Driver Services and the Secretary of State to provide certain information to the Council of Superior Court Clerks and to the Administrative Office of the Courts. The Council will screen drivers' license records, vital records, and voter registration records to create an inclusive source list of eligible jurors. The database will be cleaned of duplicates, bad addresses, and the names of felons and deceased people. Then the Council of Superior Court Clerks will certify and distribute an inclusive list to each individual county's Board of Jury Commissioners. The Council will assess each county board of jury commissioners a fee not to exceed 3 cents per name on the list.
A new list will be prepared and distributed annually. The quality and integrity of these jury lists will be regulated by Georgia Supreme Court Rule.
This legislation will result in local court officials having an inclusive jury list consistent with the intent behind our constitutional right to equal protection and a jury of one's peers.
