SUPPLEMENTAL DEBATE CALENDAR
SB0096 Halal Foods; regulate preparation, marketing, sale, and serving; punishment for violations
- There are situations where persons wishing to sell homemade products may not be able to do so because their kitchen/ operation is not licensed and subject to the inspection requirements of food preparation establishments under the Department of Agriculture. Currently there are some provisions in the code that would exempt such operations if the sale of products takes place at fairs, etc. as long as such operations do not run for more than 120 hours. This legislation would allow persons to sell their products at farmers' markets, roadside stands and church bake sales (and other similar types of sales) as long as their gross receipts do not exceed $10,000 per year. There are provisions in the bill that would exclude state-run/operated farmers' markets. There have been instances in the past where state inspectors may have overzealously shutdown church homemade food items sales and fair sales because the persons' operations were not licensed under the food preparation establishment licensing and inspection requirements. This bill seeks to address that and allow these folks to sell their goods so long as they do not exceed $10,000 per year and are not being sold at state-run/operated farmers' markets. - Authored By: Sen. Steve Henson - Presented By: Rep. Tom Graves - Special House Rules Applied: Open - House Committee: Agriculture & Consumer Affairs - Yea: 156 Nay: 0
