Wednesday, March 2, 2005 Legislative Day # 26 Today on the Floor:
Speaker of the House Glenn Richardson (R-Hiram) gaveled the House into session this morning at 10:00 am. Rep. Sheila Jones (D-Atlanta) was recognized to introduce the Devotional Speaker of the Day, Pastor Randy Glover, who spoke to the full House and then led it in devotion. Pastor Glover is from the Norwood Tabernacle Missionary Baptist Church in Atlanta. The first official vote on the House floor this morning was the adoption of the Local Calendar, which was adopted with only one dissenting vote. The Speaker then recognized Representatives Sheila Jones (D-Atlanta), Jim Cole (R-Forsyth), Earnest "Coach" Williams (D-Avondale Estates), Gail Buckner (D-Jonesboro), Nikki Randall (D-Macon), Joe Wilkinson (R-Sandy Springs), Speaker Pro Tem Mark Burkhalter (R-Alpharetta), Al Williams (D-Midway) who spoke from the well during Morning Orders. HB 240 - Law enforcement officer or firefighter; temporary disability; filing claim - This bill extends the time within which law enforcement officers or firefighters must file an application for compensation with respect to a claim for temporary disability. The filing period is extended from thirty days to sixty days. HB 279 - Highways; vehicles hauling certain products; weight limitation variance - This legislation allows farmers to haul farm products within a 100 mile radius from point of origin and with a variance on the weight of product of 5%.
- Amends 32-6-26(g) Relating to weight of vehicles hauling forest, agricultural, or farm products, this legislation states that before law enforcement issues a violation citation, the violator is given a 5 percent variance on the weight of product they are carrying within a 100 mile radius of the farm or point of origin.

HB 301 - Fishing; authorize taking by hand under certain conditions - This bill would make it legal to spearfish for channel and flathead catfish in the Savannah River only. Currently, residents of South Carolina are allowed to spearfish in the Savannah River, and it presents an enforcement problem to keep up with those who are legally allowed to spearfish and those who are not. This would make it legal to spearfish ONLY in the Savannah River and sets forth conditions by which fish may be legally taken with spears. This bill also makes it legal to take fish by hand, also known as `grabbling' or `noodling', and sets forth conditions by which fish may be legally taken by hand.

HB 496 - Dams; locations and information; DNR provide to superior court clerks - This bill would require the director of the Georgia Environmental Protection Division to supply information about Category I and Category II dams to the clerk of the superior court of each county. The information shall include the exact location of the dam, and the owner's name and address. The clerk of the superior court shall maintain the information in an easily accessible location near the county's land records. The director is to supply this information not later than December 31, 2005, and annually thereafter.

Public Safety HB 465 - Loitering on school premises; failure to leave when requested; penalty - This bill would add language that requires a person to check in at a designated location upon entering school premises. Further, if a person were unauthorized to be on school premises and asked to leave, that person could then be arrested and, upon conviction, guilty of a misdemeanor of a high and aggravated nature. HR 341 - Electronic Control Device ad hoc committee; urge continuation - In recognition of recent concerns, the Georgia Association of Chiefs of Police have responded by creating an ad hoc committee (which consists of law enforcement professionals, academic advisors, attorneys, and physicians) on the use of electronic control devices (ECD's - also known as tasers or stun guns). This resolution seeks to allow the work product of the ad hoc committee on the use of ECD's to serve as an objective evaluation of the safety of such devices, and to provide a sample model law enforcement policy pertaining to when ECDs may be appropriately used. - This resolution comes as a compromise to House Bill 29 and House Resolution 6 - which both regard the discontinuation of the use of such devices.

Regulated Industries HB 558 - Alcoholic beverages; counterfeiting, forging, or reuse of tax stamps; repeal provisions This legislation repeals Georgia Code Section 3-3-28 in its entirety. SB 124 - Licensing Board for Residential/General Contractors; method of appointing members This legislation changes the method of appointing board members. It follows the uniformed statewide standard for appointments to boards in the State of Georgia. SB 133 - Fireworks; definitions; certain combustible compositions; prohibit sale to 16 year olds; penalty - This legislation would allow the sale of wire/wood sparklers in Georgia. It also prohibits the sale of sparklers to persons under 18 years of age, prohibits the selling of sparklers over the gram weight of 100 grams, and makes it unlawful to use sparklers over 100 grams of weight indoors. - Authored by Sen. Retirement HB 492 - Judicial Retirement System; dates and election for participation; amend - Bill provides that as of July 1, 2005, membership to the Judicial Retirement System will be closed to persons who become employed by the Office of Legislative Counsel or the Attorney General's Office in a full-time position requiring admission to the State Bar of Georgia as a condition of employment.
