ATLANTA--Representative Lynn Smith (R-Newnan) addressed fellow House Members on the Floor last Thursday asking for their support in the passage of Senate Bill 277, concerning Georgia's Hazardous Sites and their Reuse or Redevelopment. The bill received much support from members of both political parties and passed 148-7.
This bill addresses certain components of Georgia's Brownfield Laws, which went into effect on July 2, 2002. The Brownfield Legislation was designed to encourage the purchase, cleanup and redevelopment of environmentally impacted properties. However, the Brownfield Laws left out the sites of former gas stations and other petroleum sites.
SB 277 will create an amnesty period for those who have already purchased property that was not originally covered under the Brownfield laws to get into the program if they apply by the end of 2005. What this will basically do is make areas where abandoned gas stations and other such sites used to stand become more appealing to buyers by eliminating their added liability risks.
"This legislation is aimed at making sure that all of these purchasers have an equal playing field. It is a great way of promoting economic development by encouraging the redevelopment of unusable sites." Rep. Lynn Smith, Chairman of Natural Resources and Environment Committee of the House
