House Bill 496, "Dams, Locations and Information" Unanimously Passes House
Atlanta- Representative Lynn Smith (R-Newnan), the Chairman of the Natural Resources and Environment Committee, addressed fellow House Members on the floor in regards to House Bill 496 on Thursday. The bill requires that the director of the Georgia Environmental Protection Division provide the clerk of the superior court of each county with information relating to dams, and that such information is easily accessible to the public.

The Bill passed the House with unanimous approval, showing strong bipartisan support. The required information shall include the exact locations of Category I and Category II Dams, as well as the owner's name and address. Category I Dams have been defined under the Georgia Safe Dam Act as dams that will cause a probable loss of life in the event of sudden failure or due to improper action. Category II Dams are also defined by the act, but pose no probable loss of life in the event of sudden failure.

The Bill's aim is to address the problem that occurs when development is allowed to take place in areas below certain types of dams, which may cause changes in a dam's status or categorization under Georgia's Safe Dam Act. Through this piece of legislation, prospective land buyers, zone administrators and dam owners will have local access to vital information used in their decision making process.
