Businesses and Neighborhoods win with SB 190

ATLANTA--The 37 th day of the legislative session was marked by the House's passage of Senate Bill 190. The House version of SB 190 included several provisions that make it more environment and citizen friendly. The additional amendments were put in place in order to make sure that both consumers and neighborhoods had their day in court. The bill limits the time that legal appeals can delay work on landfills, power plants and other facilities that require environmental permits while balancing citizen's rights to their day in court.
Representative Lynn Smith (R-Newnan) presented the piece of legislation to her fellow House Members and urged their support for its passage. In a great display of bipartisan support, SB 190 passed 132-21.
The changes allow these groups to have more time to properly research the affects that a new facility would have on the area. . The new law also helps businesses and local governments have an idea of when they can begin construction on these new facilities. Prior to this bill's passage, opposition could oftentimes delay construction indefinitely.
"I was glad we came up with a good compromise that created a win-win for all sides," Representative Smith remarked following the passage of the bill. Smith serves as the Chairman of the House Environment and Natural Resources Committee.
