2007 Session finishes with a budget veto and a promise for a Special Session . . .

n the evening of the 39th Legislative Day, Gov. Sonny Perdue vetoed the Fiscal Year 2007 Amended Budget under the threat of a veto override by the House of Representatives. He said he vetoed a budget proposal which would have "let up on
internet predators, led to furloughs for prosecutors, stopped toxic waste cleanup and halted
health screening for newborns."
Neglecting critical needs such as these, Gov. Perdue said, "will not happen on my watch."
The FY 2007 Amended Budget called for $175 million in new education funds, $11 million for disaster relief (tornadoes in south Georgia), $81 million for PeachCare for Kids and $8.5 million for the Public Defender Standards Council. It also called for $142 million in property relief that the Governor did not support. He stated that the money could have better been used elsewhere.
The vetoed budget was never transmitted back to the legislature, so the Senate did not vote on the override following the House's vote of 163 to5 to do so. Instead, the Senate went about its business on the final day of the Session and passed a flurry of bills that now await the Governor's signature.
At exactly midnight, Lt. Governor Casey Cagle banged his gavel in unison with Speaker Glenn Richardson in the House, and declared the 2007 Legislative Session one of the longest in history to a close. Within minutes, Gov. Perdue announced he would call a Special Session to pass a balanced 2007 Amended Budget that meets the needs of Georgia's citizens.

early three weeks later, on May 8, the Governor, citing a two percent revenue decline for the month of April reported by the Georgia Department of Revenue, and an unwillingness by House leadership to craft a responsible
budget compromise, reversed his veto on the entire bill and line-item vetoed the addition to
the Homeowners Tax Relief Grant that he said "would put the needs of Georgians at risk."
Now, any surplus funds remaining at the end of the 2007 fiscal year will go to the state's rainy
day fund. So, there was no Special Session.
"Leadership is about stepping forward with solutions in situations where compromise seems beyond reach. The Governor exercised strong character and courageous leadership today, and I am proud to be on his team," Lt. Gov. Casey Cagle said following the Governor's announcement.
"By decisively concluding a hopelessly stalemated debate, Governor Perdue has ensured that the urgent needs of students, kids on PeachCare, and communities devastated by natural disaster will not take second place to political posturing.

Sen. Eric Johnson of the 1st said: "With a slowing economy, it is fiscally responsible to change directions and allow whatever excess revenues come into the state's coffers in the next few months to be used to build up our reserves. Governor Perdue has the right and the responsibility to put this matter to rest in a manner that he believes best serves the interest of all of Georgia. The General Assembly is preparing to consider dramatic tax reforms next session, and a healthier reserve account will help us be in a position to permanently cut taxes.
"We have witnessed an unusually public family debate about what to do with a budget surplus. If a parent came home with a nice bonus, the family would not buy a new house or move a child to private school. They would decide whether they should pay off their credit cards, take a vacation, or put it into savings. The Governor, the House and the Senate have all agreed that we should not expand the bureaucracy or government spending, but we had a healthy debate on what to do with excess revenue fill up the reserves, pay down debt or provide tax relief. This legislation authorizes the Governor to delay compliance with certain provisions of the federal REAL ID Act until the Department of Homeland Security expressly guarantees that implementation of the Act will not compromise the economic and biological privacy of Georgia's citizens. This provision does not limit the Governor's discretion or authority to delay compliance with the REAL ID Act for any other reason. The bill also prohibits the Department of Driver Services from issuing an identification card, license, permit or other official documents to non-citizen applicants unless such applicants have been confirmed
through the Systematic Alien Verification for Entitlements (SAVE) program to be lawfully
present in the U.S. This provision will become effective upon the Department's full implementation of the SAVE Program, but no later than January 1, 2008. However, this provision does not apply to instances when a federal law mandates acceptance of a document.

Classroom teachers will not be required, coerced, intimidated or disciplined in any manner by the local board of education, superintendent or any local school administrator to change the grade of a student. This provision will not apply when a teacher has failed to comply with grading policies adopted by the local board or written procedure established by an individual school that are applicable to the grading process, unless such policy would require a student be given a grade different than the actual grade achieved.

The Department of Education is authorized to administer the "Georgia Special Needs Scholarship" for students with disabilities who attend public schools in Georgia. The purpose of the scholarship program is for the tailoring of a student's education to that student's specific needs and enabling families to make genuine and independent private choices to direct their resources to appropriate schools. The legislation allows the parents of students with disabilities to apply for a scholarship for their child to attend a participating school.

Provides that all persons who drive on Georgia highways have a valid driver's license for the type of vehicle being driven, and new residents of this state must obtain a Georgia driver's license within thirty days of moving here. The first offense for driving without a valid driver's license is a misdemeanor punishable by imprisonment for two days up to 12 months, and/or a fine of up to $1,000. This bill creates an exception for new Georgia residents. A second or third offense within five years of the first offense is an aggravated misdemeanor, punishable by 10 days up to 12 months, and/or a fine of up to $2,500. This bill increases the penalty for a fourth offense within five years, making such offense a felony punishable by one year to five years in prison and/or a fine of not less than $2,500 nor more than $5,000.

This legislation allows optometrists to prescribe certain oral and topical medications to treat conditions and diseases of the eyes. Optometrists using such medications will be held to the same standard of care as physicians who perform similar acts, provided, however, that a doctor of optometry is not authorized to treat systemic diseases.

Any person who is imprisoned in a penal institution or other facility under the jurisdiction of the Board of Corrections, and who was convicted under the statutes governing either crimes against persons or sexual offenses, is prohibited from possessing or maintaining any photograph, picture or depiction of a victim of the crime for which he/she has been convicted. The Charter Systems Act authorizes the State Board of Education to enter into a charter with a local board of education to establish a local school system as a charter system. A local school system now will be able to operate under the regulations of a charter with charter system schools.

Establishes the Georgia Trauma Commission and the Georgia Trauma Trust Fund. The Commission will study the provision of trauma care in Georgia, establish a statewide trauma network, develop a trauma transportation system to provide immediate transport for trauma victims where other options are not available, develop and administer a compensation system for providers of uncompensated trauma care, facilitate trauma education and prevention, and act as the accountability mechanism for the entire Georgia trauma system.

This legislation provides that a majority of the members of a school council must be composed of parents or guardians of students enrolled in the school with at least two of such parents/guardians being businesspersons, and the chairperson of the school council must be a parent member. Local boards of education will be authorized to employ school administrative managers, in lieu of or in addition to assistant principals, and school administrative manager must, at a minimum, possess a bachelor's degree but will not be required to be certified by the Professional Standards Commission.

Increases the maximum prison sentence for criminal attempt to commit a crime punishable by death or life imprisonment to 30 years, up from the original maximum of 10 years. The bill also clarifies that a person convicted of criminal attempt to commit a felony other than a felony punishable by death or life imprisonment may receive imprisonment for at least one year, and at most one half of the maximum time that the defendant would have received if he or she had completed the underlying crime.

Current law prohibits minors from purchasing or possessing cigarettes or tobacco products, and this measure will prohibit minors from attempting to purchase cigarettes or other tobacco products. Violation of this provision will result in up to 20 hours of community service and/or attendance of a lecture regarding the hazards of smoking. Additionally, businesses are prohibited from dispensing any non-tobacco products, other than matches, in vending machines that dispense cigarettes and other tobacco products.

This bill includes the criminal use of cellular phones or any other electronic device used in furtherance of these crimes: sexual exploitation of children, electronically furnishing obscene material to minors, computer pornography, stalking, or forgery and fraudulent practices that involves the use of a computer; so that providers of cellular and other electronic communications must also comply with disclosure requirements. It also allows the GBI director, assistant director, and deputy director for investigations to issue subpoenas, with the consent of the Attorney General, to compel production of electronic or remote communication service records, or other information about a customer of such service in an investigation into these violations.

For the first offense of knowingly manufacturing, selling, possessing with the intent to sell, etc., an identification document of someone else without written consent of the owner, or knowingly possessing or using an identification document issued to another person without permission or consent, the person will be guilty of a misdemeanor. For a second or subsequent offense, the defendant will be guilty of a felony and will receive imprisonment up to three years and/or a fine up to $25,000. Any person, 21 years or older, who commits a fraud offense dealing with identification documents will receive a prison sentence of one to five years and/or a fine. This bill provides an exception to the above sentencing requirements for persons under 21 who commit any of the above crimes: they will only be guilty of a misdemeanor.

Current law prohibits a forest products processing plant from becoming a public or private nuisance as a result of changed conditions in or around the locality of the plant, if the plant has been in operation for one year or more. This legislation redefines the term "forest products processing plant" to include a commercial operation that manufactures, packages, labels, distributes or stores any forest products or that manufactures, packages, labels, distributes or stores any material made from gypsum rock.

This legislation provides that a school must place twins or other multiples from the same family in the same classroom if the children are in the same grade level and the children's parent or guardian requests the placement. Such placement must be requested by the parent or guardian within 14 days after the first day of the school year, or 14 days after the first day of attendance of the children during the school year, if they are enrolled after the school year begins. Beginning with the 2007-2008 school year, each local board of education will be allowed to exceed the maximum class sizes set by the State Board of Education for general education programs for grades 9 through 12. In addition, local boards may establish maximum class sizes that will not exceed the funding class size by more than 39 percent.

This legislation requires the Department of Community Affairs to establish a grant program to fund the costs of E-85 projects. The term "E-85 project" is defined as the installing, replacing or converting of motor fuel storage and dispensing equipment at sites where motor fuel is stored and dispensed for retail such that the equipment will be used exclusively for storing and dispensing E-85 gasoline for retail sales for period of not less than five consecutive years. The Department is also required to contract with the Georgia Environmental Facilities Authority (GEFA) to implement, administer and disperse grant money, as well as implement and administer such a program subject to the following minimum criteria:
Each grant applicant must submit a project plan that will be subject to approval by GEFA;
A grant for any approved project will not exceed 33 1/3 percent, or $20,000, whichever is less, and the applicant will be required to pay for the remainder of the project. However, the grant applicant is not prohibited from using grants or loans from the federal government or private sources to pay for such remainder of the project cost;
Construction for any approved project must begin no later than six months after the date of the grant; and
Grant money will be refunded to the state with interest at the legal rate no later than two years after any failure to meet the above requirements.

While developing an individualized education program (IEP) for a deaf or hard-of-hearing child, the local school system must consider the related services and program options to provide the child with an appropriate and equal opportunity for communication access. The school system must consider the child's specific communication needs and address those needs as appropriate to the child's IEP.

This legislation provides that a demonstrated proficiency in American Sign Language will be accepted as foreign language credit toward a college preparatory diploma for any student. Such student will earn two or more units of elective credits or two or more units of foreign language credit.

The foster parent bill of rights applies specifically to foster parents who care for children in the custody of the Department of Human Resources through direct approval and placement by DHR. However, it is in the best interest of Georgia's child welfare system for the Division of Family and Children Services to recognize the bill of rights, with reasonable modifications, by incorporating them into contracts with private agencies serving children in the custody of DHR.

This bill revises Georgia law on absentee ballots. Among its changes, it requires election officials to compare the signature on the ballot's oath with the absentee elector's voter registration card's signature and would allow for the absentee ballot tabulation process to begin upon the opening of the polls on Election Day. It also provides that poll workers participating in the tabulation be sequestered during this process and that absentee ballots sealed in an outer envelope, but not an inner envelope could still be counted. Additionally, the bill revises the process for the cancellation of an absentee ballot. The House passed this bill by House Rules Committee Substitute. This substitute added to the bill provisions, originally contained in House Bill 487, that change Georgia's date for the presidential preference primary to the first Tuesday in February of the year of a presidential election (this primary is currently held on the first Tuesday in March). The Senate agreed to the House substitute.

The Woman's Right to Know Act. Women who are seeking an abortion will be offered the opportunity to undergo an ultrasound if the imaging is available and be given the chance to view the ultrasound image and listen to the fetal heartbeat. As part of the informed consent process to an abortion, at least 24 hours before the procedure, a woman must be given a geographically-arranged list of clinics that perform ultrasounds free of charge. In all cases in which an ultrasound is performed prior to an abortion, a woman must be offered the opportunity to view the ultrasound image and listen to the fetal heartbeat. If an ultrasound is performed, the woman must certify in writing (prior to the abortion) that she was given the opportunity to view the image and listen to the heartbeat and whether or not she chose to do so. The physician performing the abortion (or his or her agent) must receive a copy of the written certifications, and they must be kept on file with the woman's medical record for at least three years.
Physicians who do not comply with this legislation (by offering a chance to view the ultrasound image and listen to the heartbeat) will be reported to the Composite State Board of Medical Examiners for disciplinary action.

Provides additional judicial oversight in regards to the placement of delinquent and deprived juveniles. Georgia's policy is for all children in custody of the Division of Family and Children Services should have stable placements. The new language requires DFCS to give a notice to the court, a child age 14 or older, parents, guardians and attorneys of record, five days prior to the placement change of a child. All parties involved will have the right to request a hearing in regards to the change in location of the child. At the hearing, the court must consider the case plan and permanency plan recommendations made by DFCS, including the child's placement location.

Pursuant to this legislation, the owner of a personal care home, private home care provider, community living arrangement or child welfare agency is prohibited from operating such facility if he or she possesses a criminal record.

Authorizes a sales tax exemption for goods utilized in the construction of performing arts amphitheater that has more than 60,000 square feet and will cost more than $30 million. Also, sales of admission tickets, food, beverages and concessions are exempt. An additional sales tax exemption is authorized for nonprofit volunteer health clinic that treats indigent persons within 200 percent of federal poverty level.

House Bill 214 extends the Jekyll Island-State Park Authority's lease, as well as it existence as an instrumentality of the state, for an additional 40 years. This legislation also provides for appointment of two advisory members to the Authority. However, this provision will stand automatically repealed on December 31, 2009. The legislation also creates a Jekyll IslandState Park Authority Oversight Committee to advise the General Assembly regarding the Authority's compliance with the provisions of this legislation. In addition, the Authority is prohibited from selling any residential lost or commercial property unless obligated to do so under the terms of a valid lease agreement entered into prior to the effective date of this legislation. On and after such date, the Authority is further prohibited from entering into, extending or renewing any agreement providing for the sale of any residential lot on Jekyll Island. The southern portion of the Island always is to be included within the 65 percent of the land area that the Authority is prohibited from developing. Those properties used for the Jekyll Island 4-H center and soccer complex may continue to be used and improved for the same or similar purposes under an extension or renewal of an existing lease or under a new lease. This legislation does not prohibit the construction and use of any public bicycle trails, public nature trails or public picnic areas on the southern portion of the Island.

The Consumer Choice for Television Act authorizes video service providers to obtain a franchise to provide the service by the Secretary of State or by the local government. The statewide franchise fee is five percent of gross revenues, and the fee will apply to local governments who provide written notice to the Secretary of State showing that their jurisdiction is within the provider's designated service area. The franchise fee is paid directly to the local government; moreover, no other fees are permitted. The Secretary of State may charge up to $500 for a statewide franchise and up to $250 for a franchise amendment. Statewide franchise holders will be prohibited from discriminating on the basis of income by denying service to a specific area; moreover, there are no build-out requirements on statewide franchise holders.

Defines the role of a Court Appointed Special Advocate as a community volunteer who has been screened and trained regarding juvenile deprivation, child development and juvenile court procedures; has met all requirements of an affiliate court appointed special advocate program; is actively supervised by an affiliated court appointed special advocate program; and has been appointed as a lay guardian ad litem by a juvenile court in a deprivation proceeding. A CASA must be sworn in by a juvenile court judge in the court where he/she wishes to serve before executing any CASA duties, and after completion of the requirements set forth by the affiliated court appointed special advocate program. The most important duty of a CASA is to advocate for the best interests of a child.

The Georgia Shared Parenting Bill calls for minor children to have frequent and continuing contact with parents who have shown the ability to act in the best interest of their children, and to encourage parents to share the responsibility of raising their children after separation or divorce. Provides for a direct appeal to the Georgia Court of Appeals or the Georgia Supreme Court for all judgments or orders in divorce, alimony, child custody and other domestic relations cases, including holding or declining to hold a party in contempt. In addition, this statute will require parents to submit a parenting plan to the court for permanent custody and modification actions, and in additional circumstances based on the judge's discretion. This shared parenting plan will help parents to make joint decisions relating to the child's education, health, extracurricular activities and religious upbringing. If the parties cannot agree on a permanent parenting plan, each party will file and serve a proposed parenting plan by a certain date set by the judge, who will determine which plan is in the best interests of the child. There will be no presumption in favor of legal or physical custody for either parent. The judge may grant sole custody, joint custody, joint legal custody or joint physical custody as appropriate to the circumstances. Custody matters will not be decided by a jury.

Children who serve as pages of the General Assembly will be credited as "present" by their school of enrollment in the same manner as an educational field trip. Furthermore, such participation as a page must not be counted as an absence, neither excused nor unexcused.

This bill creates the Georgia Tourism Development Act which provides for a tax refund program for "incremental sales and use taxes" paid by companies creating or expanding certain tourism attractions. Tourism attractions include: cultural or historic sites; recreation and entertainment facilities; and, commercial lodging if located on the property of the tourism attraction. "Incremental Georgia sales and use tax" means those state sales and use taxes generated by the project above the amount of sales and use taxes generated by the previous use of the property on which the project is located.

It requires pregnant women to be tested for HIV during pregnancy or at the time of delivery, unless a woman refuses to have the test. Every Georgia public institution of higher education must adopt and implement a policy to grant undergraduate course credit to entering freshmen students who have successfully completed the international baccalaureate diploma program in high school. At least 24 semester credit hours or equivalent course credit must be granted by the institution to an entering freshman for the completion of the diploma program. If a student received a score of less than four on an examination administered as part of the diploma program, the institution may grant fewer than 24 semester credit hours with respect to courses that are substantially related to the subject area of that examination.

Allows a biological father, who is not the legal father of a child, to surrender his rights prior to the child's birth, for adoption purposes. When signed under oath by the alleged biological father, a pre-birth surrender will relinquish the father's rights to the child, including the right to notice of any proceedings regarding adoption, custody, or guardianship. A pre-birth surrender will not be valid for use by a legal father, or for a man who has voluntarily acknowledged the child's legitimacy or paternity. Once the final adoption order has been entered, the responsibilities of the biological father are permanently terminated. However, the father has the right to withdraw the pre-birth surrender within ten days of executing the surrender document, regardless of the child's date of birth. If a final adoption order is never entered, and if paternity is established, the alleged biological father will be responsible for child support and other financial obligations to the child and/or the child's mother.

Ensures that disabled children who are eligible for medical assistance receive the medically necessary therapy services to which they are entitled under the Medicaid Early Periodic Screening, Diagnostic and Treatment Program (EPSDT Program). It seeks to simplify the process and paperwork by which occupational, speech, and physical therapy services are applied for and received by eligible children. All eligible Medicaid beneficiaries 21 years of age and younger, who are eligible for services under the EPSDT Program will now receive basic therapy services that are recommended as medically necessary by a physician without prior approval pursuant to the provisions of this legislation.
