Senate approves expansion of tax cuts for senior citizens, measure moves to House

bill that Sen. Casey Cagle of the 49th says will encourage senior citizens to relocate and move to Georgia passed the Senate this week, extending the income exclusions on income tax for those over age 62.
Sen. Cagle's measure, Senate Resolution 1085, which passed by a vote of 49-2, is a Constitutional Amendment and needed at least 38 votes for passage. The legislation originally would have given taxpayers over the age of 62 a break on the first $50,000 of income in 2009. Starting this year, seniors will not have to pay taxes on the first $25,000 of retirement income. Next year the amount increases to $30,000 and in 2008 to $35,000.
"This is the right decision," Sen. Cagle said. "We lose a lot of people, particularly retirement age individuals, who are moving out of our state. They are selling their homes and business and moving to Florida or another state in which they are not penalized for their personal income."
Sen. Tim Golden of the 8th amended SR 1085 to increase the amount for those 62 to 69 to $75,000 and for those 70 and older to exclude all income retired and other. However, Sen. Doug Stoner of the 6th was successful in amending Sen. Golden's legislation to cap the income level at $100,000 for those over the age of 70. He said the $100,000 cap would cover 95 percent of all Georgians of retirement age.
"We don't need to give tax breaks to millionaires," Sen. Stoner said. "Ted Turner and Bernie Marcus don't need tax cuts."
"This is a good carrot to attract retirees to Georgia," Sen. Golden said.
If the House passes the Constitutional Amendment and Gov. Sonny Perdue, who supported the current exemptions, signs the legislation, it will be on the ballot in November to be approved by a majority of the voters.
"This is a great step to put this before the voters and allow them to change the tax code," Sen. Cagle said.

Senate passes introduces umbilical cord blood initiative

aying he wants Georgia to be the "center of ethical research," Sen. David Shafer of the 48th, proposed Senate Bill 596, legislation creating the newborn umbilical cord blood initiative for stem cell research. He amended the legislation on the
floor for Keone Penn, a young man from Snellville who may have been cured of sickle-cell
anemia with non-embryonic stem cells.
"Stem cell research efforts have been hampered by the controversy over embryonic stem cells," Sen. Shafer said after the bill, which will be known as "Keone's Law," passed 54-0. "But stem cells are not found only in embryos. Umbilical cord blood is rich in stem cells, which can be used for research without destroying embryos. Using the cells from cord blood already has resulted in treatments for a wide range of diseases," he went on to add. "Tragically, after most births, the umbilical cord is thrown away as medical waste."
The measure creates the Georgia Commission for the Newborn Umbilical Cord Blood Initiative, and directs it to create a newborn cord blood bank in partnership with one or more of the state's public colleges or universities. The legislation also will provide counseling and information to pregnant women about the initiative, and how they can donate the newborn's umbilical cord blood.
Senators agree, respect should be shown for dead

egislation prohibiting people from protesting or otherwise disrupting a funeral passed the Senate in a bi-partisan manner, 55-0. Sponsored by Sen. John Douglas of the 17th, the measure forbids anyone from conducting a public
assembly, parade, demonstration or other like event, either fixed or processional, within 500
feet of the ceremonial site or location being used for a funeral or memorial service at any time one hour prior to, during or one hour after the posted time for said funeral or memorial service.
"We need to be able to look these familes in the face when we leave here this year, and this is a good way to tell them that we are with them," Sen. Douglas said.
"It doesn't trash the first amendment. But it does protect those families who have lost a child or a father a mother or a son fighting for our freedom. We should guarantee them the ability to have that service. They can protest all they want, but this bill should pass."

Sen. Douglas introduced the legislation after a Kansas church staged protests at funerals across the nation, including those of fallen soldiers and Coretta Scott King.
"It should not be necessary to address this issue, when it comes to the passing of a loved one, someone standing on the side of the road when you are at your highest level of grief, and saying despicable things about them," Sen. Robert Brown of the 26th said. "There comes a point at which we have to look inwardly.
"I cannot look into the eyes of a family who has been subjected to this type of behavior, and say that I am not willing to do something in response to that."

On Tuesday, March 14, Chairman Casey Cagle of the 49th called the meeting to order to discuss eight bills. Rep. Tom Graves of the 12th presented House Bill 1272, which provides a sales and use tax exemption on supplies purchased by non-profit volunteer health clinics. Following questions from Sen. Tommie Williams of the 19th, Sen. Eric Johnson of the 1st and Chairman Cagle, the bill passed unanimously. Rep. Jeff Lewis of the 15th introduced HB 1018, which would remove the sales and use tax for biomass material used to generate electricity. Tom Harrell with Summit Energy also spoke on behalf of the legislation. The bill passed unanimously. HB 1293 was introduced by sponsor Rep. Richard Royal of the 171st and affects bona fide conservation use property, providing for additional acts which constitute a breach of a conservation use covenant, but incur a reduced penalty. Rep. Royal noted that the legislation would be of particular benefit to senior citizens. The bill passed unanimously. Rep. Fran Millar of the 79th discussed his bill, HB 1012, which would require additional bond performance audits for cities, counties and authorities. Clint Mueller with the Association County Commissioners of Georgia spoke on behalf of the bill, which then passed unanimously out of committee. Rep. Larry O'Neal of the 146th introduced HB 1310, which provides for the comprehensive revision of provisions regarding revenue and taxation. He noted that the legislation brings Georgia in line with federal law and, in addition, is good for the State's small businesses. The bill passed unanimously out of committee. HB 834, introduced by Rep. Jay Roberts of the 154th, provides for a sales tax exemption on fuel purchased by swine raisers. The bill passed unanimously out of committee. Rep. Martin Scott of the 2nd presented HB 1120, which would make an inflationary adjustment to sales tax law. The bill passed unanimously. Chairman Cagle introduced HB 1219 on behalf of Rep. Lynn Ratigan Smith of the 70th who was unable to attend the committee meeting. He explained that the bill would extend the annual sales tax holiday for school supplies and related purchases, as well as the purchase of energy efficient products for non-commercial use. The bill passed unanimously.
Health and Human Services
On Tuesday, March 14, the Committee was called to order by Chairman Don Thomas of the 54th. Rep. Bob Smith of the 113th introduced House Bill 1112, which updates current law for speech-language pathologists and audiologists. Rep. Smith noted that the bill makes five changes: upgrade the educational requirement; grandfather currently licensed audiologists; adds one audiologist to the state licensing board; provides licensure for audiology assistants,

and regulates telehealth consulting by audiologists. Sen. Johnny Grant of the 25th, sponsor of the bill in the Senate, emphasized that this is not a scope of practice bill. Helena Solodar and Katherine Pollard with the Georgia Academy of Audiology spoke in favor of the legislation. The bill passed unanimously. Wayne Garner, representing Georgia physical therapists, introduced Dr. Anne Thompson, president of the Physical Therapists Association of Georgia, who introduced HB 801. The bill would allow a physical therapist to treat a patient without consulting a licensed physician when services provided are not related to the treatment of an injury or ailment or the patient was previously diagnosed and received treatment and the patient returns to therapy within 60 days of discharge. Chairman Thomas assigned Sens. Judson Hill of the 32nd, Greg Goggans of the 7th and Horacena Tate of the 38th to a subcommittee to study the bill further, and said that the Committee will vote on SB 801 at a later date.
Rep. Judy Manning of the 32nd then introduced two bills, HB 1066 and HB 1092. Gina Simpson, Deputy Director with the Georgia Department of Human Resources (DHR) explained that HB 1066 would increase the number of tests for newborn screening from nine to 26. Dr. Stuart Brown, Director of the Division of Public Health, DHR, joined Ms. Simpson and both emphasized the need to expand the number of tests, all of which are considered treatable if caught immediately after birth. Following questions from Sens. Goggans, Don Balfour of the 9th and Steve Henson of the 41st, Mary Ann Henson, program manager of the Div. of Public Health's Newborn Screening Program, also discussed the need for the testing. Mike McConnell, a parent and a representative of the March of Dimes, talked about the child he nearly lost because her disorder was not diagnosed at birth, and urged support of the bill. Amy Hughes with Memorial Health Hospital in Savannah spoke in favor of amending the bill to allow provider choice, and to look at outsourcing the program. Sen. Goggans introduced an amendment to allow other labs to perform the tests, and that no later than January 1, 2007, DHR issue a Request for Proposals (RFP) and subsequently award a contract to a Georgia laboratory to conduct tests, based on the bidding process. After additional discussion, the amendment was passed. Chairman Thomas presented an additional amendment regarding the fee, which also passed. The bill then passed unanimously as amended.
Rep. Manning then introduced Ellyn Jeaager with the National Mental Health Association who spoke on behalf of HB 1092. The bill would create the Suicide Prevention Program, to be managed by DHR's Division of Public Health. Attorney and Inner Harbor representative Stan Jones also spoke on the need for this program. The bill passed unanimously.

Insurance and Labor
Chairman Ralph Hudgens of the 47th called the meeting to order on Tuesday, March 14. Rep. Richard Smith of the 131st presented House Bill 1291, which exempts automobile club services from state insurance regulations. Allan Hayes, Deputy Commissioner of Insurance, testified about the regulation of automobile clubs and voiced support for the legislation. The bill passed unanimously. Sen. Seth Harp of the 29th will carry HB 1291 in the Senate. Rep. Tom Knox of the 24th introduced HB 1257, which eliminates a $25.00 fee for insurers when filing a change of address. The bill also defines the qualifications of insurance counselors. The bill requires the business addresses of every licensed agent, subagent, counselor and adjustor to appear on the business license. Sen. Don Balfour of the 9th introduced a Committee Substitute, which allows insurers to pay emergency medical providers directly instead of billing the payee. The bill passed unanimously. Sen. David Shafer of the 48th will carry the bill in the Senate.

Judiciary
The Committee met on Tuesday, March 14. Chairman Preston Smith of the 52nd asked Representative Mark Hatfield of the 177th to present HB 1496, which changes the term of court in Bacon, Brantley, Charlton, Coffee, Pierce and Ware counties in the Waycross Circuit. The bill passed unanimously. Rep. Ellis Black of the 174th and Sen. Greg Goggans of the 7th then presented HB 692, which ensures that a court does not banish a probationer to an area of the State that does not consist of at least one entire judicial circuit. The bill passed unanimously. HB 376 was presented by Rep. Barry Loudermilk of the 14th. The bill would allow primary caretakers of children six years of age or younger and primary teachers in home study programs to be excused from jury duty. Sen. Kasim Reed of the 35th cautioned the Committee on the number of similar bills and the danger of reducing the jury pool. The bill passed unanimously. Sen. Judson Hill presented HB 1421 on behalf of Rep. Barry Fleming of the 117th. The bill states that a demand for speedy trial in a criminal case must be filed as a separate pleading with the court where the case is pending. Fulton County Assistant District Attorney Marc Mallon walked the Committee through the bill. Sen. Hill of the 32nd made a motion to amend the bill and the bill, passed unanimously by Committee Substitute. The Committee then held a hearing on HB 239, which makes significant changes to the consequences for not accepting reasonable settlement offers in tort cases.

State and Local Governmental Operations
The meeting was called to order on Tuesday, March 14, by Chairman John Wiles of the 37th. Rep. Clay Cox of the 102nd presented a Committee Substitute for House Bill 950. The bill prohibits state and local agencies from preventing any employee or student from engaging in the constitutional right of free speech, including the observance of any public or legal holiday. Rep. Cox said that the legislation was developed after some schools told their students that they were not allowed to use the phrase "Merry Christmas". Sen. Ronnie Chance of the 16th told the Committee that the bill received bipartisan support in the House. Maggie Garrett of the ACLU stated that she supports the bill, but does not believe that it goes far enough to protect free speech. The substitute was approved unanimously by the Committee. Sen. Chance will carry the bill in the Senate. Rep. Sue Burmeister of the 119th presented HB 1435, which is designed to make changes to Georgia's election laws to facilitate voting for the disabled. The legislation allows caregivers to help cast ballots, and eliminates language that requires a disabled person to sign a statement swearing that they are disabled. The Committee Substitute for the bill changes the effective date to January 1, 2007, to allow more time to implement the changes. It was approved unanimously. Sen. Whitehead of the 24th will carry this bill on the Senate floor.
State Institutions and Property
Chairman Johnny Grant of the 25th called the meeting to order on March 14. The Committee heard from Rep. Terry Barnard of the 166th, presenting House Resolution 1259. The resolution is the annual easement bill for state property sales. Sen. Regina Thomas of the 2nd expressed her concerns about easements for a natural gas pipeline in Chatham County, requesting more time to look over the bill. Chairman Grant tabled the resolution until the next meeting, so the information can be presented to the Committee. HR 1395 was presented by Rep. Barry Loudermilk of the 14th. The resolution changes the name of the Capitol Post Office to the Wiley T. Nixon Capitol Post Office. The resolution was approved unanimously, and Chairman Grant stated that he would carry the resolution on the Senate floor.
Transportation
The Senate Transportation Committee will meet on Thursday, March 16, 2006 at 1:30 p.m. in the Capitol Mezzanine.

Joint Senate Economic Development and Tourism and Lottery Oversight Committee
On Wednesday, March 15, Chairman Jeff Mullis of the 53rd called to order a Joint Senate Economic Development and Tourism and Lottery Oversight Committee meeting to hear a report on the Georgia Lottery. Sen. Mullis recognized Rep. Roger Williams of the 4th, Chairman of the House Regulated Industries Committee, and Rep. Tom Dickson with the House Economic Development and Tourism Committee, who offered an opening prayer. Chairman Mullis introduced Margaret DeFrancisco, President and CEO of the Georgia Lottery Corporation, who gave a brief update of the newest games and the success of the program. She noted that this year's numbers should break last year's record, both in sales and in funding for both HOPE and pre-K. Rick Gates, Vice President for Business Development and Public Affairs, and Charlie Scannella, Senior Regional Director, with Scientific Games then spoke, expressing their appreciation for the continued support of the legislature. They gave a brief overview of the company, noting that they had 3500 employees in Georgia. They also discussed the technology and security involved in making the games virtually fraud proof. Jim Tudor with the Georgia Association of Convenience Stores noted that 70 percent of all lottery sales are made in the convenience stores and praised the success of the program.
