Georgians Discuss Jury Reforms

The Georgia Jury Summit took place in Augusta on May 9-11, 2002. The Institute of Continuing Judicial Education and the NCSC Center for Jury Studies coordinated the program, speakers and panels. The idea for the Georgia Jury Summit was put forward by superior court judges and others who attended the 2001 National Jury Summit in New York. The Georgia meeting was funded by the Council of Superior Court Judges.
An 18-member planning committee was headed by Chief Justice Norman Fletcher, Judge Carlisle Overstreet of Augusta and Mr. Ben Studdard III, Chair of the State Bar Futures Committee. Many of the reforms discussed by the 146 participants would not require revisions to court rules or state statutes.
Participants voiced solid support for and belief in the jury system; most agreed that initiating minor changes could result in significant improvement of current practices and a better experience for those who serve as jurors.

Jury Issues Discussed:
v Balancing the jury box;
v Elimination of preemptory challenges;
v Suggested procedures for jury deliberations;
v Allow discussion of witnesses and testimony among jurors during trial;
v Allow lawyers to reopen argument to avoid mistrial when the jury is hung.

People, Places and Events ...

In Memoriam
Judge Robert L. Stevens, Sr., of Thomson, died May 12, 2002. Judge Stevens became a senior judge of the Toombs Judicial Circuit in 1996, after serving 32 years on the bench. He obtained his law degree from Cumberland University in Lebanon, Tennessee, in 1939.
Judge Franklin H. Pierce, of Augusta, died May 14, 2002. Judge Pierce served the Augusta Judicial Circuit for eighteen years as a superior court judge until his retirement in 1991. Judge Pierce passed the bar in 1937, he served in the Army Air Corps during World War II, and for 23 years was county attorney for Richmond County.
Administrative Judges
New Superior Court Administrative Judges have been elected as follows:
Judge Michael L. Karpf First District;
Chief Judge Wallace A. Cato Second District;
Judge G. Bryant Culpepper Third District;
Judge George H. Kreeger Seventh District;

Superior Court Judgeships
The Paulding Circuit becomes the 49th judicial circuit on July 1, 2002. Judge William A. Foster has been named as Chief Judge for the newly created circuit. A second judge will be appointed for a term beginning July 1, 2002.
A newly created judgeship for the Alcovy Circuit also becomes official on July 1, 2002.
State Court Judges
On June 25, Gov. Barnes appointed J. Antonio "Tony" DelCampo to the State Court of DeKalb County to fill the seat left by Judge Denise Majette. Mr. DelCampo is a native of Lima, Peru, and moved to the Atlanta area in 1979. He is a 1991 graduate of Emory University and a 1994 graduate of the Georgia State University Law School.
New Location
The Georgia Commission on Family Violence moved to new quarters in the Floyd Building on July 1. The Commission will be attached to the Department of Corrections for administrative purposes. Julie Koob can be reached at 404-657-3412.

The Georgia Indigent Defense Council will hold its annual awards luncheon Friday, August 9, at the Carter Center in Atlanta. GIDC will host the Third Annual Statewide Symposium on Indigent Defense at the Carter Center on Friday, September 13.

AOC Internet Services
Beginning on August 1, 2002 the AOC will be able to provide courts, judicial administrative offices, and court-related organizations with Internet services. The services will include e-mail and access to the world-wide-web. The end user will need a computer and a telephone line to access these services. There is no charge for Internet access.
In addition, the AOC has a limited number of computers available to provide courts that do not have a computer. The AOC will distribute the computers on a "first come, first served basis." The AOC will be able to provide the Microsoft Suite of software applications on a limited basis. The software suite includes Microsoft Word, Excel, and PowerPoint. The end user would need to enter into an agreement to obtain access to the software; the price is typically around $200. Please contact Gregory W. Arnold at 404-656-6413 for additional information.

HB 357 Magistrate Certification OCGA 15-10-137 Requires that magistrates who are active members of the State Bar complete the mentor program within 12 months of taking office and complete 20 hours annual training in the first full calendar year after taking office. HB 1547 Magistrates: Minimum Salary OCGA 15-10-23 Provides that each full-time magistrate other than the Chief Magistrate shall receive a minimum monthly salary of $3,412.84; magistrates who serve in less than a full-time capacity shall receive a minimum monthly salary of the lesser of $19.69 per hour for each hour worked, or 90% of the monthly salary of a full-time chief magistrate. HB 642 Juvenile Cases: Discovery OCGA 15-11-43; 15-11-8 Provides for regulation of discovery and inspection in delinquency cases according to specified conditions, limitations and procedures; specifies that the cost of care and support of a child temporarily placed in or committed to the legal custody of the Department of Juvenile Justice shall be provided by the Department. VETO NUMBER 11 House Bill 642 began its progress through the General Assembly as a laudable effort to update and clarify our laws governing discovery and inspection of evidence in juvenile proceedings. Along the way, an unrelated amendment was added which would shift the cost to the Department of Juvenile Justice of care and support of a child temporarily place din or committed to the custody of the Department. Currently the estimated cost of such temporary commitment is borne by the child's county of domicile. The estimated cost to the Department for this amendment is in excess of $3.7 million per year and no budgetary provision has been made for such costs. Therefore, with great reluctance on account of the good work which has gone into the discovery proceedings portion of the bill, I VETO House Bill 642 and encourage the General Assembly to reenact it without costly riders.

Grant Report
The AOC assists courts in securing funds for special projects, pilot programs, and other resources.
The Taylor Foundation approved a grant of $45,000 for development of a Document Imaging Management System for the probate courts. The system will create a computerized index of all marriage records dating back to the 1830's. Probate Courts in Bibb and Chattahoochee counties are participants in this pilot project.
The Georgia Civil Justice Foundation has awarded $73,486 to the Pan Asian Law School to fund a series of seminars on the American legal system for Atlanta's Asian immigrant population. An additional $55,000 goes to the Latino Law School provided for the Hispanic community.
The Children & Youth Coordinating Council has provided $44,195 for a Juvenile Court Mediation Project in the 7th Judicial District. CYCC also funded purchase of 28 kiosks placed in Juvenile Courts around the state (see photo).

Architectural Services
The AOC has entered into a contract with Atlanta architect Judson S. Bryant for consultation services regarding courthouse facilities. Mr. Bryant is available to work with judges, court administrators, and county personnel to determine local facility needs and consult on architectural design of judges' chambers, courtrooms, jury rooms, etc. To request architectural services contact Marla Moore or David Ratley at the AOC.

Drug Court Coordinator
James Banks, former administrator of the Bibb County Drug Court,
has joined the AOC as Drug Court Coordinator. Mr. Banks will work with drug courts around the state, establish Mr. James Banks standards, and conduct evaluations. He can be reached in Atlanta at 404-463-4155.
