Recent Legislation - Senate Bill 433
Senate Bill (SB) 433 was passed on April 4, 2008 and signed by Governor Sonny Perdue on April 9, 2008. Senate Bill 433 represents the largest reform of the Certificate of Need (CON) law since 1979. Please refer to the link below to access the complete text of SB 433.
The Department has received many inquiries regarding the impact of SB 433, including how the new law will be implemented and applied. The CON changes outlined in the bill go into effect on July 1, 2008. As a result, the Department has decided to offer a 30-day free determination period to answer specific written questions about the applicability of SB 433.
Beginning May 1, 2008, through May 31, 2008, the Department will accept written questions about the applicability of SB 433 to specific situations from interested parties. There will be no filing fee for the determination requests, and the Request for Determination form does not have to be completed and submitted with the question. The question(s) must be specific to SB 433, its impact and applicability to specific proposed projects leading to and beyond July 1, 2008. If the questions are determined to be of a general nature not specific to SB 433, the determination request will be returned and the party will be asked to submit the request according to the prescribed process with a filing fee and on the form referenced above.
Please address all questions to Clyde L. Reese, III, General Counsel, Department of Community Health, 2 Peachtree St., 5th Floor, Atlanta, Georgia, 30303. The Department will review and respond in writing to the requests as quickly as possible. All requests will be posted on the Department website upon receipt, or shortly afterward. The Department responses will also be posted on the website for general reference.
The Department is beginning to draft all necessary new and amended administrative rules required by SB 433. When ready, these rules will be presented to the Department of Community Health Board pursuant to the normal rule-making process. The Department respectfully requests that inquiries regarding SB 433 be addressed through the 30-day free determination period rather than by phone or e-mail to the extent possible. Thank you.
