Current Status Hearing Officer: John A. Sibley. Life Care Center ofGwinnett and Gwinnett Sun Nursing Center filed motions for dismissal 09-16-92; the review board granted the motions for dismissal 05-31-93; William M. Foster filed a Petition for Judicial Review in Twiggs County Superior Court on June 30, 1993, in an attempt to overturn the review board's granting the motions for dismissal. On May 23, 1994, Twiggs County Superior Court upheld Mr. Foster's legal standing to appeal the planning agency's decision on Gwinnett Sun Nursing Center, and the court remanded the projectto the planning agency for a joined review with Lilburn Health Care Center, Project Number 052-92. The planning agency subsequently denied both Gwinnett Sun Nursing Center and Lilburn Health Care Center on October 17, 1994. Both applicants appealed these denials November 14, 1994. On April 17, 1995, the review board hearing officer remanded both projects to the planning agency for a secondjoined review. The planning agency subsequently approved Gwinnett Sun Nursing Center and denied Lilburn Health Care Centeron May 15, 1995. Lilburn Health Care Center withdrew from the appeals process on July 11, 1995, and the hearing officer conducted evidentiary hearings on Gwinnett Sun's application on July 24-25, 1995, and August 8-9, 1995. On September 14, 1995, the hearing officerupheld the October 17, 1994, decision ofthe planning agency denying a Certificate-of-Needto Gwinnett Sun. However, Gwinnett Sun appealed the hearing officer's decision on October 16, 1995.
