THE STATE OF GEORGIA
EXECUTIVE ORDER
BY THE GOVERNOR:
WHEREAS:
The State of Georgia leases approximately 1,775.74 acres of improved real property in Bartow County (the "Property") from the United States Secretary of the Army pursuant to a twenty-five year lease which commenced September 15, 2006, which lease is recorded in the State Properties Commission Real Property Records as RPR# 010293, which lease replaced that certain Department of Army Lease entered into between the Secretary of the Army and the Department of State Parks, State of Georgia, effective July 1, 1965; and
WHEREAS: Said Property is in the custody of the Department of Natural Resources and is operated as Red Top Mountain State Park; and
WHEREAS:
The Property is improved with a 3,278 sq. ft. beach house (the "Beach House") which is owned by the State of Georgia and is more particularly identified in an aerial photo attached hereto as Exhibit "A" and incorporated herein by reference; and
WHEREAS:
The Georgia Board of Natural Resources declared that the Beach House is deemed to be structurally unsound and a threat to public safety, recommended the removal of the Structure, and requested an Executive Order to authorize the demolition, and disposal of the Beach House.
NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY
ORDERED:
The Georgia Department of Natural Resources is hereby authorized and directed to provide for the razing, demolition and disposal of said Beach House under the terms and conditions which are deemed to be in the best interests of the State of Georgia.
