THE STATE OF GEORGIA
EXECUTIVE ORDER
BY THE GOVERNOR:

WHEREAS:

The General Assembly passed House Bill 310 during the 2015 Legislative Session, which provides that the supervision of felony probationers and parolees shall be assigned to the newly created Department of Community Supervision; and

WHEREAS: The new agency, Department of Community Supervision, will operate under the direction of the newly created Board of Community Supervision per House Bill 310; and

WHEREAS: House Bill 310 further provides that the Governor's Office ofTransition, Support and Reentry is statutorily created and assigned to the Department of Community Supervision for administrative purposes; and.

WHEREAS:

House Bill 310 provides in O.C.G.A. 42-3-7 for the transfer of all personnel, equipment and facilities previously employed by the Department of Corrections and the State Board of Pardons and Paroles in their respective felony probation and parole supervision functions to the Department of Community Supervision and the Governor's Office of Transition, Support and Reentry; and

WHEREAS:

House Bill 310 further administratively assigns to the Department of Community Supervision any personnel who are required by the terms of his or her employment to comply with the requirements of the Georgia Peace Officer Standards and Training (POST) Act, though these personnel will remain with their respective employing agency for the performance of their duties; and

WHEREAS:

It has been determined that it is in the best interests of the state for efficiency and transparency to transfer personnel as whole departmental units from their respective agencies for the creation of the Department of Community Supervision's Field Supervision Program rather than split civilian administrative staff and Georgia POST certified staff into transfers over two fiscal years; and

WHEREAS: It has also been determined that it is in the best interests of the state for efficiency and transparency that federal grant administration and positions funded by those grants remain at their respective agencies; and

WHEREAS:

Building maintenance and renovation and vehicle procurement are aceomplished through capital bond funding that is devoted to multiple programs vvithin the Department of Corrections and the Board of Pardons and Paroles.
NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS
GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY

ORDERED:

That, as of July 1, 2015, the Department of Community Supervision shall be created and have three budgetary programs - Departmental Adn1inistration, Field Supervision, and Misdemeanor Probation. The Department will also have two administratively attached budgetary prcgrams: Governor's Office of Transition, Support and Reentry and the Georgia Commission on Family Violence.

The members of the newly created Board of Community Supervision shall meet as soon as practical to organize and adopt an organizational structure and to review and adopt any matters necessary for the iinplementation of the agencies and entities embodied in House Bill 310. The Commissioner of Cornmunity Supervision will call the meetings of the Board until a Board Chair is elected.

ORDERED: That Jay Neal is hereby appointed as Director of the Governor's Office of Transition, Support and Reentry to serve at the pleasure of the Governor.

Pursuant to O.C.G.A. 45-12-90 and effective July 1, 2015, $21,851,578 and associated positions and assets are transferred to the Field Supervision program within the Department of Community Supervision from the foHowi.ng agencies and budgetary prograrns in the Fiscal Year 2016 budget:

The Department of Corrections' Probation Supervision program shall transfer $15,380,979 in state funds, all vehicles, and associated equipment and buildings;

The Department of Corrections' Health program shall transfer $128,142 in state funds, two positions, and associated equipment and buildings;

The Department of Corrections' State Prisons program shall transfer $1,251,734 in state funds, five positions, 3 vehicles, and associated equipment and buildings;

The Department of Corrections' Administration program shall transfer $52,248 in state funds, one position, and associated equipment and buildings;

The Department of Corrections' Offender Management program shall transfer $2,000 in state funds and associated equipment and buildings for responsibilities related to the Probation Interstate Compact.

The Board of Pardons and Paroles' Parole Supervision program shall transfer $5,036,475 in state funds, 240 vehicles, and associated equipment and buildings.

Pursuant to O.C.G.A. 45-12-90 and effective July 1, 2015, $8,213,943 and associated positions and assets are transferred to the Administration program within the Department of Community Supervision from the following agencies and budgetary programs in the Fiscal Year 2016 budget:

The Department of Corrections' Probation Supervision program shall transfer $1,700,000 in state funds;

The Department of Corrections' State Prisons program shall transfer $847,164 in state funds;

The Department of Corrections' Administration program shall transfer $924,991 in state funds, 15 positions, and associated equipment and buildings;

The State Board of Pardons and Paroles' Board Administration program shall transfer $3,849,785 in state funds, 25 positions, and associated equipment and buildings;

The State Board of Pardons and Paroles' Parole Supervision program shall transfer $697,304 in state funds, six positions, and associated equipment and buildings;

The State Board of Pardons and Paroles' Clemency program shall transfer $194,699 in state funds, two positions, and associated equipment and buildings.

ORDERED:

Pursuant to O.C.G.A. 45-12-90 and effective July 1, 2015, $3,741,443 and associated positions and assets are transferred to the Governor's Office of Transition, Support and Reentry program from the following agencies and budgetary programs in the Fiscal Year 2016 budget:

The Department of Corrections' Administration program will transfer $3,168,988 in state funds, 24 positions, 1 vehicle, and associated equipment;

The Department of Corrections' Probation Supervision program will transfer $292,438 in state funds, one position, and associated equipment;

The State Board of Pardons and Paroles' Parole Supervision program will transfer $280,017 in state funds, one vehicle, three positions, and associated equipment.

IT IS FURTHER

ORDERED:

Until June 30, 2016, 1,634 positions from the Department of Corrections' Probation Supervision program, 9 positions from the Offender Management program, 7 positions from the State Prisons program, and 1 position from the Administration program in the budgetary amounts of $90,050,550; $458,707; $406,678; and $43,429, respectively will remain under the Department of Corrections employment. Additionally, 490 positions from the Parole Supervision program and 2 positions in Board Administration program in the budgetary amounts of $29,694,718 and $110,920 will remain under the employment of the Board of Pardons and Paroles until June 30, 2016. All of the respective personnel funded by these budgetary amounts are administratively transferred to the Department of Community Supervision. Additional employees who are hired prior to July 1, 2016 by the Department of Corrections or by the Board of Pardons and Paroles utilizing these budgetary amounts will be immediately administratively transferred to the Department of Community Supervision until June 30, 2016.

IT IS FURTHER

ORDERED:

Until June 30, 2016, two positions from the Georgia Department of Corrections' Administration program in the budgetary amount of $280,057 and four positions from the Georgia Board of Pardons and Paroles' Parole Supervision program in the budgetary amount of $392,362 shall remain under the employment of each respective agency. All personnel funded in this manner are administratively transferred to the Governor's Office of Transition, Support and Reentry. Additional employees who are hired prior to July 1, 2016 by the Department of

Corrections from this budgetary amount or by the Board of Pardons and Paroles from its identified budgetary amount shall be immediately administratively transferred to the Department of Community Supervision until June 30, 2016.

IT IS FURTHER

ORDERED:

The Department of Corrections and the Board of Pardons and Paroles will complete vehicle purchases and building maintenance and/or renovation with the dedicated FY 16 Bond funds prior to transferring these assets to the Department of Community Supervision. The three agencies shall enter into a Memorandum of Understanding to adequately address this issue, as well as to address any additional issues resulting from administratively attached employees and other shared services, thereby promoting efficient and effective government.

ORDERED:

The Department of Community Supervision will enter into Memorandums of Understanding with the Administrative Office of the Courts for the determination of the transfer of assets and budgetary amounts to be included within the Executive Order budget amendment for responsibilities that are transferred to DCS but are currently within the Judicial Branch operations.
