EXECUTIVE ORDER

BY THE GOVERNOR:

The State of Georgia holds title to, and the Department of Behavioral Health and Developmental Disabilities is the custodian of, two. tracts known as the Boland Building and tract, totaling approximately 6.92 acres of real property in Land Lots 260 and 287 of the 1st District of the 341st G.M. District of Baldwin County, Georgia, (hereinafter the "Premises"), as more fully depicted as Tracts 1A and 1B in that survey attached hereto as Exhibit "A" and incorporated herein by reference; and

Said property is a portion of the approximately 2,134 acres of State property being on file in the offices of the State Properties Commission and inventoried as Central State Hospital campus/Property ID # 51710 as of February 3, 2014 (hereinafter "Central State Campus"); and

The Depa1tment of Behavioral Health and Developmental

Disabilities, by resolution dated August 20, 2015, declared a certain

portion of the Central State Campus to be surplus to its needs and

requested that the State Properties Commission take steps to surplus

a certain portion of the Central State Campus which includes the

Premises; and



The Georgia Department of Defense, in a letter dated July 29> 2015, resolved to accept custody of the Premises for use as a Youth Challenge Academy; and

The State of Georgia, acting by and through the Georgia State Financing and Investment Commission ("GSFIC"), previously issued General Obligation Bonds shown on the attached. Exhibit "B" (the "Tax-Exempt Bonds") for the purpose of financing capital projects for various State Agencies, a portion of such bonds were used to finance improvements on the Premises; and

The Georgia Department of Defense has certified that it shall not take, or fail to take, any action which would cause such Tax Exempt Bonds to be deemed private activity bonds or arbitrage bonds under Section 103 of the Internal Revenue Code of 1986, as amended ("Tax

ORDERED:

Code"); and further, shall not use the Property for any nongovernmental purpose, or any purpose that would give rise to private business use (including, without limitation, ce1tain management contracts, leases, service contracts or incentive pay contracts with non-governmental entities), within the meaning of the Tax Code.
NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN MEAS GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY
That custody of the above-defined Premises located in Baldwin County, Georgia is hereby transferred from the Georgia Department of Behavioral Health and Developmental Disabilities to the Georgia Department of Defense, and the Georgia Department of Defense is further ordered not to take, or fail to take, any action which would cause such Tax Exempt Bonds to be deemed private activity bonds or arbitrage bonds under the Tax Code and further, shall not use the Property for any non-governmental purpose, or any purpose that would give rise to private business use within the meaning of the Tax Code until the Tax Exempt Bonds are retired.
