EXAMINATIONS
As noted in last month's Mortgage Summary, the Department will be participating in the Nationwide Mortgage Licensing System (NMLS) as contemplated by the Secure and Fair Enforcement for Mortgage Licensing Act of 2008 ("SAFE") (H.R. 3221). Title V requires that each state enact minimum standards regarding the supervision of mortgage originators and adopt the NMLSR, or the U.S. Department of Housing and Urban Development will assume the responsibility for the regulation of mortgage originators (as defined in SAFE) in that state.
The Department is moving forward working with NMLS to develop a plan that will provide a smooth transition of licensee records to the new system.
A transition announcement letter, detailing steps you will need to take to get your record to the NMLS will be sent via e-mail to all licensees and registrants later in the near future. It will outline what you need to do. In addition, there is to be a webinar for those transitioning to the system. This is provided to allow users to see the functionality of the system and gain familiarity with the menus, etc. NMLS and NDFI personnel will be on the conference call/webinar to answer your questions from a system perspective and a regulatory perspective of what you can expect. This is currently planned for December 10, and more information will be sent to licensees.
Since late 2003, most examinations have been conducted on a "targeted" basis. Targeted examinations result from any number of reasons, but are often scheduled as a result of information provided to the Department from a consumer complaint, a company insider indicating operational or problematic issues, or other industry insiders reporting questionable operations. If any of these reasons exist, you can expect to see examiners at any time, without prior notice.
Even a first examination can result in fines and revocation of the license. It is essential that each licensee know and abide by the Georgia Residential Mortgage Act (GRMA) and corresponding Mortgage Division Rules, and prevent the "deadly sins" that will cause revocation. Included are the following:
Hiring a Felon
Hiring a Person with a current Cease and Desist Order
Dealing with Unlicensed Entities
Pattern of Misrepresentation
Making False Statements or Refusing to allow an Examination
The licensee should also ensure that all books and records are in compliance with GRMA.

Loan Docs--Signed Applications
In the course of conducting examinations of mortgage licensees, the Department is finding a large number of loan applications that are not signed and dated by the loan officer and borrower.
Mortgage Division Rule 80-11-2-.04 lists a signed mortgage loan application as one of the many items required to be included in a loan file.
In the event that the loan application is taken in person, there is no excuse for not having both the signature of the borrower and loan officer. If the application is taken via phone, mail, or internet, the loan officer must sign and mail the application to the borrower for them to sign and return.
Some licensees have expressed concern about borrowers failing to return the disclosure packet, and they cite this as a reason that their loan officers do not sign or date the application. Not maintaining a signed loan application is a violation. Additionally, Rule 80-11-1.01(6)(b) states that the licensee is responsible for keeping a copy of the acknowledgement letter that is mailed out to the borrower. This letter can serve as proof that the licensee mailed the disclosure packet out within the allotted timeframe regardless of whether or not the borrower returned it as requested.
REMINDER: Identity Theft "Red Flags" Rule Mandatory Compliance Date Ap-
proaching
The Identity Theft "Red Flags" rule, as required under the Fair and Accurate Credit Transaction Act (FACTA), was issued jointly on November 15, 2007 by the federal bank, credit union and thrift regulators and the Federal Trade Commission. The regulation and guidelines were effective on January 1, 2008, and mandatory compliance is required by November 1, 2008. This regulation ap- plies to mortgage licensees. See "Red Flags" link on the FTC website for definitions, explanations and guidance. As a reminder:
The regulation and guidelines implement sections 114 and 315 of the Fair and Accurate Credit Trans- actions Act of 2003.
The regulation requires each financial institution or creditor to develop and implement a written Identity Theft Prevention Program to detect, pre- vent, and mitigate identity theft in connection with the opening of certain accounts or certain existing accounts.
Supplement A to the guidelines contains a list of 26 "red flags" that financial institutions and credi- tors may consider incorporating into their identity theft prevention programs.
The guidelines are intended to assist financial insti- tutions in implementing the regulation.
The regulation requires card issuers to assess the validity of change of address requests before issu- ing additional or replacement debit or credit cards.
The regulation requires users of consumer reports to reasonably verify the identity of the subject of a consumer report in the event the user receives a notice of address discrepancy from the consumer reporting agency.

As a reminder to licensees during the renewal period, O.C.G.A. 7-1-1007 requires reporting to the
Department on certain actions brought against licensees, and states the following:

The Department often obtains information regarding judgments and claims from public sources or other regulators, not from the licensee. It is important to remember that such notification to the

must report details to the Department according to the law as noted above.
