ONLINE LICENSE RENEWALS - FY 2005
The ANNUAL LICENSE RENEWAL process will soon be underway, and beginning with this FY2005 licensing period, on-line web-based renewal applications will be available to qualifying renewal applicants.
Qualifying applicants generally are those who do not have any outstanding issues, fees or fines, and who have a current surety bond or letter of credit as a means of qualifying for their license, not a qualifying minimum net worth.
If you qualify, an access code will be generated for you to use in accessing the on-line application system. Information regarding the website and the access code will be provided to qualifying licensees along with this year's paper copy application. This package will be mailed in early February. Please contact the office at renewal@dbf.state.ga.us if you do not receive your renewal forms.
Renewals, whether completed on-line or in hard-copy format, are due by April 1, 2004. Failure to properly file the renewal application will result in a $300 late fine. As in prior years, and for all licensees whether renewing on-line or by mail, all outstanding issues such as any fines, fees, stale audits, complaint resolution, etc. must be resolved before your renewal license will be granted. Licensees who do not complete the renewal process by June 30, 2004, will have their licenses expire, and will have to cease operations.
The Department encourages licensees who qualify for the on-line renewal to take advantage of this process, which will reduce processing time, eliminate mailing concerns, and ensure quality data entry. Hopefully, a successful renewal program will enable the Department to provide more on-line functions regarding your license, such as address changes, fee payments, other license changes, etc., and we would like to thank you in advance for supporting the on-line automation efforts of the Department.
GRAMM-LEACH-BLILEY ACT
The Gramm-Leach-Bliley Act requires that financial institutions protect the security and confidentiality of their customer's data. In that regard, the Safeguards Rule which applies to any business that is significantly engaged in providing financial products and services to consumers has been adopted by the Federal Trade Commission (FTC) It does apply to Mortgage Brokers and non-bank lenders and others. It is suggested that persons read the
article detailed at http://www.ftc.gov/bcp/conline/pubs/buspubs/safeguards.htm and also view the content of www.ftc.gov/privacy/glbact . To find out whether your company is considered a "financial institution" under that act review Section 313.3 (k) of the FTC's privacy Rule.
COUNTERFEIT LICENSE FOR #13177
Someone is using a counterfeit FY 2004 "license" for #13177 - Carteret Mortgage Corporation. So far as we can determine, the person circulating this document is not affiliated with Carteret. The document is easy to spot as a fake since it, in no way, resembles an authentic license issued by this Department for 2004. Carteret did not receive any license for 2004 because they withdrew from operations in Georgia in May 2003. Please be on the lookout for this document (as well as other forgeries) and report any attempts to use it to this Department.
VERIFYING LICENSED ENTITIES
Rule 80-11-4-.05 of the Mortgage Division Rules states, in part, that it is the licensee's responsibility to "know" that it is conducting business with a licensed entity.
You run the risk of conducting business with an unlicensed entity if you do not verify the license. The fine for "dealing with unlicensed persons" under Rule 80-11-3-.01 (4) is $1,000 per transaction and your license shall be subject to suspension or revocation. Anyone who purchases, sells, places for processing or transfers a mortgage loan or loan application to or from a person who is required to be licensed but is not properly licensed will be fined.
You can check the license status of any licensee by going to the Department's web site at http://www.ganet.org/dbf/mortgage.html . From there you can check by entering the licensee's name, license number, or city, or leave the selection box blank and you will get a complete listing of licensees. There is also an option to download the entire list into an Excel spreadsheet.
RECORD RETENTION
The Department has recently received several inquires regarding the acceptability of electronic record retention. Rule 80-11-2-.01(5) of the Department of Banking and Finance states that "Any books, accounts or records required to be maintained by Chapter 80-11-2 of the Department may be maintained in their original form, on microfiche or other electronic media, provided: (i) that the records shall be made available to the Department as provided in this Rule; and (ii) at the request of the Department, the records shall be printed on paper for inspection or examination." Therefore, electronic record retention (such as imaging) is acceptable provided items (i) and (ii) listed above are met.
BACKGROUND CHECKS - "MULTI-SOURCE" OFFENDER
The Department has recently been notified by the GBI that they have changed the verbiage that appears on criminal history reports regarding multi-state offenders since the information could be from local, state or federal convictions or warrants. (NCIC, the National Crime Information Center, is the computerized index of criminal justice information maintained by the FBI.)

The multistate notation on Georgia criminal history really means multi "source". Therefore, the verbiage on the Georgia criminal history will now read multisource offender instead of multistate offender.
The "multisource offender" statement will appear on a Georgia criminal history if: (1) the individual has criminal history records in 2 or more states; (2) has at least one criminal history record and an active warrant on NCIC; (3) has at least one criminal history record and is on the NCIC convicted sex offender file.
Please be aware of this when performing background checks on your covered employees. If you receive a report which now indicates "Multi-Source" you will need to obtain fingerprint cards from that individual for submission to the Department for processing with the GBI and FBI. Please visit the Department's website at www.state.ga.us/dbf/mortgage_forms.html to obtain the Fingerprint Card request form, instructions, and payment information.
OUT OF STATE BROKERS
The Official Code of Georgia Section 7-1-1003.1 states, in part, that if the applicant for a new or renewal mortgage broker license does not have a physical place of business in Georgia, then a license or a renewal may only be issued if the applicant's home state also does not require that in order to be licensed a mortgage broker must have a physical place of business in their home state. This location must be staffed by at least one supervised employee. It can not be a post office box or any other place where the public receives mail, deliveries, or messages. Currently the states of Alabama, Kentucky, Massachusetts, New Jersey, Pennsylvania, South Carolina and Texas have the requirement that brokers have a physical place of business in their home state.
ENFORCEMENT ACTIONS
From time to time, the Department has to resort to enforcement actions against those brokers and lenders who are unable or unwilling to comply with the Georgia Residential Mortgage Act (GRMA). These actions come in a variety of forms, have differing consequences, and are often used to achieve a desired goal. Some actions are used as a preventative or corrective measure, while others are more punitive in nature when it is determined that the licensee deliberately or through negligence violated our law.
The most useful tool available to the Department is the "Memorandum of Understanding". While many applicants object to entering into a MOU with the Department, these documents are often beneficial to them. A well written MOU allows the Department to say "Yes" where the circumstances would normally call for a "No" answer. MOU's are used in situations where there are questionable background issues (such as credit issues subject to legal action or appeal), employment issues, or situations where the proof required for a more punitive adverse action has not been fully developed. The Department benefits from an MOU because the applicant has to sign the form and acknowledge their responsibilities under the MOU. In addition, the applicant has to acknowledge the consequences for failing to provide the desired corrective measures. Since the document represents understanding among the parties, the existence of an MOU is usually not published in the Monthly Summary of Mortgage Activities.
Consent Agreements have a similar effect to the MOU; however, they are usually considered to be more serious and restrictive. They are often drafted by legal counsel and sometimes lenders will choose not to do business with a broker who is subject to a Consent Agreement. The existence of a Consent Agreement is published in our Monthly Summary.
A review of Rule 80-11-3-.01 will reveal a variety of monetary fines that are often levied for infractions of GRMA. Licensees never want to pay fines so it would be wise to review this regulation to become familiar with the types of infractions which carry fines. Some infractions receive a one-time fine, others are "tiered" in that each instance of the infraction results in its own separate fine. Some fines (such as the employment of felons) are accompanied by further actions such as a Cease and Desist Order (see below) and/or License Revocations. Fines levied by this Department are published in our Monthly Summary.
Cease and Desist Orders (C&D) are issued in cases of greater concern. These documents represent an order by this Department for a person who is performing acts covered by GRMA to immediately stop engaging in illegal activities such as employing felons, operating without a license, or doing business with unlicensed persons. Generally, licensed companies (partnerships, LLC's, sole proprietors, and etc.) who are issued a C&D must refrain from the prohibited activity, but their license remains active. However, many of these activities may or could also result in monetary penalties and revocation of the license. Individuals who receive a Cease and Desist Order for engaging in activities requiring a license under GRMA but who do not have one will be barred from working in the residential mortgage industry for THREE YEARS. A listing of those persons receiving a Cease and Desist Order are published in each Monthly Summary. Licensees are prohibited from doing business with individuals who have outstanding C&D Orders.
The most punitive enforcement action is a revocation of the mortgage license. Revocation of a license is pursued against companies whose actions (business activities) pose a threat to Georgia consumers and generally prove to fall into those acts prohibited by the code.
HIRING EMPLOYEES
As a licensee, it is important to realize that you are responsible for the persons you employ. That is why it is very important that, prior to employment, you conduct proper pre-employment checks with previous employers of the prospective employee, conduct Georgia Crime Investigative Center (GCIC) background checks on covered employees, and verify that the person is qualified to work in the mortgage industry. By qualified, in this instance, it means that the individual does not have an outstanding Cease and Desist order issued against them by the Department. Regulation 80-11-.01 (10) states that: "Any licensee or registrant who employs any other person against whom a final Cease and Desist order has been issued within the preceding three (3) years, if such order was based on a violation of Code Section 7-1-1013 or based on the conducting of a mortgage business without a required license or exemption....shall be subject to a fine of $1,000 per such employee and their license or registration will be subject to revocation or suspension."
In order to determine if a prospective employee has an outstanding Cease and Desist order, please check the Department's listing of outstanding Orders at http://www.state.ga.us/dbf/cdorders.html. For individuals, you may enter last name first or part of a name, for example "jo" only for Jones, Johnson, etc. To see all outstanding Cease and Desist orders, simply leave the selection box blank and press "Submit Query".
This is a comprehensive listing of companies that have outstanding orders. It also lists individuals who, because of the outstanding order, are generally not permitted to be employed in the industry for a period of 3 years. Please review this list prior to hiring individuals to work for your business.
