High Volatility Commercial Real Estate
Beginning January 1, 2015, revisions to calculating risk-weighted assets went into effect for FDIC-supervised institutions. The Department has received some questions from the industry about the new capital rules and the applicability of risk-weighting for High Volatility Commercial Real Estate ("HVCRE"). The new capital rules apply to all banks with the only distinction being between those that must follow the advanced approach ($250 billion or more in total assets) and those that must follow the standardized approach (less than $250 billion in total assets).
The Federal Reserve Bank has created a carve out for small holding companies from certain capital rules, but there is no companion exemption for banks. Therefore, the rules regarding risk-weighting for HVCRE apply to all banks. If you have questions, contact your case manager at the FDIC for clarification.
