Commercial broilers comprise the largest segment of Georgia's agricultural industry with a value of production of $3.4 billion in 2009; when combined with egg production, the value of production increased to almost $4 billion last year.
With so much of Georgia's economy dependent upon, and affected by, the state's poultry and egg production, it is imperative the industry have timely, upto-date marketing and statistical information.

division distributes complete, timely and accurate market information to poultry producers, processors, distributors, fast food operators, chain store buyers, as well as other interested parties from the food industry and the consuming public. This information is reported in Georgia and all areas where Georgia Poultry products are traded both domestically and internationally.
It is the responsibility of Market News to statistically compile, analyze and report on a daily basis the established prices of dressed broilers and fryers, line run tenders, skinless boneless breasts, whole breasts, boneless skinless thigh meat, thighs, drumsticks, leg quarters and wings processed in Georgia. Notice of Intent to Consider the Repeal of Rules Promulgated Under the
Boll Weevil Eradication Act of 1985
TO ALL INTERESTED PERSONS AND PARTIES:
Pursuant to the Official Code of Georgia Annotated,
O.C.G.A. 5 2-7-154, notice is hereby given that the
Georgia Department of Agriculture will hold a public hearing on September8,2010, at 9 a.m. in Room 201 of the Agriculture Building, located at 19 Martin Luther King, Jr. Drive, Atlanta, Georgia 30334. Such hearing will be for the purpose of considering the adoption of amendments to Rule 40-24-1 and the repeal of Rules 40-24-2,40-24-3,40-24-4, 40-24-5,40-24-6,40-24-7, 40-24-8, and 40-24-9, relating to Boll Weevil Eradication. The Department will also be accepting written comments from August 2, 2010, to close of business (4:30 p.m. EDT) on September 2,2010.
SYNOPSIS, MAIN FEATURES AND DIFFERENCES:
The Boll Weevil Eradication rules were adopted in 1985 to eradicate a serious problem with the boll weevil, the chief pest of cotton at the time. Since then, however, the boll weevil has been eradicated from Georgia. The proposed rules will address the posteradication status of Georgia and provide current cotton harvesting and assessment collection practices. The Department is proposing to consolidate nine (9) separate rules into one rule, specifically rule 40-24-1.
It is proposed to change the title of the Rule from "Boll Weevil Eradication" to "Boll Weevil Quarantine."
It is proposed to change the numbering for 40-24-1.O1 entitled "Administration" and replace this subsection with a new subsection 40-24-1-.O1 to be

slaughter, number of loads and / or pounds sold, along with weighted average, are gathered daily from many sources within the state's broiler industry. There has been tremendous response to the markets on the various poultry parts due to increased consumer interest in purchasing selective parts and further processed products. Quotations at farm on heavy breeder type hens as well as supply and demand factors also are gathered from industry sources and reported weekly.
Once all data and factors relative to market conditions are compiled, and the nine different market prices are computed, the information is analyzed and

assimilated into the division's daily report, which is prepared in a concise form of analytical and statistical information. Both buyers and sellers in the poultry industry, as well as consumers, have access to these daily reports in order to enhance their knowledge of the poultry industry as their marketing and purchasing decisions are made.
Reports are distributed daily by various methods for maximum exposure. The information is reported to numerous state market news services and / or poultry associations. In addition, each day's report is made available by

The Fall Farmland Edition of the Market Bulletin will be published Sept. 8, 20 10; deadline for this issue is August 18, 2010. Please adhere to the following guidelines when submitting farmland advertisements for the farmland edition.
* Only farmland may be advertised.
Land tracts must be at least five acres in size and located in Georgia.
* Indicate acreage and county where
your property is located.
* All property must be for sale by
owner; no real estate brokers or agents are allowed to advertise; property under
contract with a real estate agent or broker is not eligible for advertising. Consumers are encouraged to call the Market Bulletin office toll-free 1-800-282-5852, to report ads not in compliance with this requirement.
* Descriptive terms should be limited
to those characterizing farm property or agricultural structures. such as barns,

When is the best time to pick tomatoes for the best taste?
The best time to pick your tomatoes for best taste is when they are ripe. There is not one specific signal that will tell you this. Some tomatoes will still have green shoulders when fully ripe. Others can have turned completely red or yellow but still need to ripen a day or two more to a somewhat deeper color for maximum flavor. It takes some practice and intuition to recognize when this is. There is not one particular time of day to harvest tomatoes for maximum flavor. Another tip for the best-tasting tomatoes: Do not refrigerate them if you are planning on using them fresh. Refrigerating them destroys that highly-desired fresh flavor.

I saw perilla (Perilla frutescens) seeds offered in a seed catalog. It sounded attractive with its purple leaves. I planted it and it is thriving with my flowers. When my neighbor (who raises cattle) saw it, he said the plant is toxic to cattle and asked if I would pull the plants up or at least keep them from going to seed. Is perilla

Yes, perilla causes a respiratory problem that usually kills cattle. Typically, when cattle have plenty to eat they do not consume it, but when food is scarce they may. Perilla, also called perilla mint, is native to Asia but naturalized throughout the eastern U.S. (including Georgia) and Canada. Perilla is sometimes grown as an ornamental. Perilla can be purple or green depending on the strain. It is not the best ornamental as it sows itself around rather freely, which is why it has naturalized such a large area - and why your neighbor is concerned it will spread to his pastures. The odor of the leaves is unpleasant to many people. There are other more attractive (and more useful) purple plants to grow such as one of the purple-leaved basil varieties.

titled "Purpose and Identification of Pest." This will be general statement of purpose for the current rule, i.e. to help prevent the reintroduction of the boll weevil. The proposed new language states that the boll weevil is a destructive pest that nearly destroyed Georgia's cotton industry and cost in excess of $100 million dollars to eradicate from the state. The Commissioner of Agriculture has determined that the boll weevil is no longer an established pest in the State of Georgia, but is a serious pest that is injurious to the agricultural interests of the state.
As for the proposed new numbering of the "Administration" subsection to 40-24-1- .02, the terms "Southeastem Boll Weevil Eradication Foundation, Inc." shall be removed and language added to reflect that the Commissioner is authorized to enter into agreementsfor the purpose of implementing boll weevil detection and eradication activities or administering and enforcing the provisions of the Act and Departmental Rules.
It is proposed to repeal rule 40-24-2 relating to "Definitions," and encompass all definitions in new rule 40-24-1-.03. Many of these terms and definitions contained in the current rule are not used or included in the current andlor proposed regulations. We are proposing to eliminate the following definitions:ASCS, Certificate, Compliance Agreement, Exemption, Grower, Host, Infested, Inspector, Move, Northeast Eradication Zone, Northwest Eradication Zone, Original Eradication Zone, Person, and Regulated Article. The Department is proposing to add definitions for several other terms including Cotton Producer, Program, and Waiver.
It is further proposed to add rule 40-24-1-.04 entitled "Regulated Articles" to list the articles regulated under the provisions of the chapter. These articles include the boll weevil, gin trash, seed cotton, used cotton equipment, cotton plants, and any other products, articles or means of conveyance when a hazard is present. This rule also prohibits the sale or distribution of cotton seed (when used for non-commercial purposes) and individual potted specimens of cotton plants, unless a permit has been issued.
The Department is proposing to add new rule 40-241.05 titled "Program Participation Required" to require all cotton producers, ginners and non-commercial cotton growers to participate in the boll weevil eradication program. The rule outlines what participation includes and provides that any cotton producer or non-commercial cotton grower will be in violation of this Chapter for failing to comply with the requirements of this rule. Grower participation is currentlyrequired under rules 40-24-7-.Dl,40-24-7-.02, 40-24-7-.03, and 40-24-7-04,
Statutory changes in 2009 to the Boll Weevil Eradication Act of 1985 (O.C.G.A. 2-7-152 and 2-7156) now require the fust handler of cotton from cotton growers in this state to collect the assessments and remit to the Commissioner within 30 days of the date of purchaseof the cotton. Therefore,it is proposed that the Department will add rule 40-24-1-.06 entitled "Responsibilities of Gins" to give each gin operator the responsibility of collecting the assessment when imposed, filing reports as prescribed by the Commissioner, remitting assessments collected to the Commissioner, and ensuring all used cotton harvesting equipment has been thoroughly cleaned and certified according to the requirements of rule 40-24-1-.08.
The Department proposes the repeal of ~ l 40e-24-4 concerning "Compliance Agreements" since there is no eradication zone in Georgia.
The Department is also proposing to add rule 40-241-.07, "Assessments and Penalties," to require the Commissioner to publish the program costs per bale or acre on or before July lSt of each growing year. The new rule provides that the Commissioner may assess penalties as set by the Board of Directors of the Boll Weevil Eradication Foundation of Georgia for failure to make full andlor timely payment. Assessments and penalties are currently required under rules 40-24-7-.01, 40-24-7-.02,40-24-7-a.n0d34,0-24-7-04,
The Department proposes to repeal rule 40-24-3-.02 and adopt a new rule 40-24-1-.08 concerning "Movement of Regulated Articles into Georgia." We are proposing to allow regulated articles from noninfested areas to enter Georgia without restriction as long as the state of origins' department of agriculture, plant regulatory agency, or certified growers' organization is actively monitoring for the presence of live boll weevils. The Department is proposing to prohibit the movement of all regulated articles from infested areas into Georgia with the exception of used cotton harvesting equipment or regulated articles moved under a scientific permit.
It is furtherproposed to adopt a new rule, rule 40-241L.09, titled "Exemptions," to exempt certain articles and commodities from the certificate or permit requirements. The new rule would exempt samples of trade size cotton lint and cotton linters (if free from cotton seed and cotton trash), baled cotton, linters, and lint cleaner waste when the products have been given standard compression and are free from surface contaminants capable of harboring boll weevils. Current boll weevil regulations do not exempt these items.
The Department proposes to repeal rule 40-24-7-.04 and adopt new rule 40-24-1-.lo, "Cotton Stalk Destruction." Cotton stalk destruction is critical to boll weevil eradication; however, current no-till or low-till cotton practices reduce soil erosion and improve soil organic matter content. This proposal allows the Commissioner to require stalk destruction when

necessary to control boll weevil re-infestation and establishes that stalks must be destroyed by February 1. This proposed rule also provides for a hardship waiver due to emergency.
The Department proposes the adoption of rule 4024-1-.11, titled "Movement for Scientific Purposes." This rule establishes the permit application process and allows the Commissioner to issue permits to import live boll weevils and other regulated articles for experimental or scientific purposes. The applicant must provide the specific article to be imported, the safety measures taken to ensure that boll weevils are not accidently released, the location where the regulated article will be held or used, the length of the experiment, and any additional information requested by the Commissioner or the Board of Directors of the Boll Weevil Eradication Foundation of Georgia. Currently, Rule 40-24-3-.02 provides for the issuance of scientific permits, however this rule does not specify what information is required.
The Department proposes to repeal rule 40-24-5-.O1 and adopt rule 40-24- 1-.12 "Inspection and Enforcement," to authorize the Commissioner to stop and inspect any cotton harvesting equipment or other means of conveyance moving into or within the State of Georgia when there are reasonable grounds to believe that such means of conveyance or articles may be infested with the boll weevil. The rule further allows the Commissioner to seize, treat, destroy or otherwise dispose of articles found to be moving in violation of the requirements for boll weevils.
The Department proposes to repeal rule 40-24-6-.O1 and replace with the adoption of rule 40-24-1-.13, "Non-Commercial Cotton." The proposed rule would require non-commercial cotton to be planted with a permit approved by the Board of Directors of the Boll Weevil Eradication Foundation of Georgia and issued by the Commissioner. Non-commercial Cotton includes all cotton for purposes other than commercial production for lint, including cotton planted for educational purposes, tourist attractions, retail or wholesale sales as a growing or dried plant, for individual use or for personal satisfaction,cotton plants resulting from spilled seed, animal feed, and plants that have sprouted from inadequate herbicide application, mowing, disking, or other mechanical means of destruction. It is proposed to change the approval of permitting non-commercial cotton from the Commissioner to the Boll Weevil Eradication Foundation of Georgia, Inc. Board of Directors. The Commissioner will still issue permits which shall include a brief description of the acreage, the purpose for such planting and its value to cotton producers of the state. The rule provides that the Board of Directors of the Boll Weevil Eradication Foundation of Georgia will base their decision on the benefit to agriculture and cotton producers, the location of the growing area, the size of the intended planting area, pest conditions in the growing area, costs incurred to the Board, and the applicant's willingness to follow any stipulations or requirements set forth in the permit. Any person, business or entity growing non-commercial cotton without a permit will be in violation of this Chapter. The Commissioner may destroy or require the destruction of non-commercial cotton plants at cost to the grower.
The Department proposes the repeal of rule 40-24-7 "Program Participation" since the Department has proposed to include Non-Commercial Cotton in new rule 40-24-1-.13.
The Department proposes the repeal of all rules found in current rule 40-24-8 relating to "Boll Weevil Treatments." Since the boll weevil has been eradicated from the state, treatments are no longer necessary. The Boll Weevil Eradication Foundation of Georgia, Inc. is authorized to conduct treatments for boll weevil reinfestation.
The Department proposes the repeal of rule 40-24-9, "Solicitation for Bids," due to the fact that this process is no longer needed.
The Department proposes the adoption of rule 4024-1-.14, "Georgia Interior Quarantine Requirements." This proposed rule will authorize the Commissioner to establish quarantine boundaries and regulate the movement of Regulated Articles as necessary to eradicate the boll weevil should any re-infestations occur and establishes criteria to declare eradication. It further authorizes the Boll Weevil Eradication Foundation of Georgia to act upon the Commissioner's behalf for boll weevil eradication activities within the state. The new rule would require landowners or tenants to provide access to properties and maintain the property in a condition which allows the Department or Boll Weevil Eradication Foundation of Georgia employees to conduct surveys and other necessary actions to eradicate boll weevil in quarantined areas. If no boll weevil has been detected for two consecutive years, the new rule would allow the Commissioner to declare the boll weevil to be eradicated and remove the quarantine from the area.
The Department proposes the adoption of rule 4024-1-.15 for "Organic Treatments to Control Weevil Infestations." The current boll weevil rules do not address organic cotton production. The boll weevil eradication programs prefer to use Malathion, a synthetic insecticide; however, the Department is proposing to permit an organic cotton grower to control any infestations of boll weevils with organic approved methods with oversight by the Commissioner and the Boll Weevil Eradication Foundation of Georgia, Inc. This proposed rule allows the Commissioner to require the Boll Weevil Eradication Foundation of Georgia to

control the infestation if there is evidence that organic methods are not effective or if the infestation is likely to spread to other farms. Treatment records must be maintained by the grower and must be made available for inspection. Treatment cost shall be the sole responsibility of the farm operator.
It is further proposed to adopt rule 40-24-1-.16 relating to "Prohibited Actions." The following will be considered prohibited actions: (1) bringing any living stage of boll weevils into the state without a pennit issued by the Commissioner; (2) failure of any cotton grower to participate in the boll weevil eradication program; (3) failure of any gin to collect assessments when required, file prescribed reports, remit assessments collected as described; (4) failure to destroy cotton stalks or non-commercial cotton when notified by the Commissioner; (5) bringing used cotton harvesting equipment into the state that has not been thoroughly cleaned, inspected and certified free of regulated articles; (6) planting or growing noncommercial cotton without a permit approved by Board of Directors of the Boll Weevil Eradication Foundation of Georgia, Inc. and issued by the Commissioner; and (7) obstructing the Commissioner or his inspector in the performance of his duties.
The Department proposes the adoption of rule 4024-1-.17 "Penalties". The proposed rule lists the penalties specified in O.C.G.A. $2-7-158 for violations of the Boll Weevil Eradication Act of 1985. Any person found violating any provision of the rules or Act shall be guilty of a misdemeanor and punished by a fine of not less than $50.00 and no more than $1,000.00 or imprisonment not exceeding 12 months, or both as determined by a court of competent jurisdiction. Any cotton grower or fust handler of cotton who fails to pay any assessment levied under this article shall be subject to a penalty of not more than $25.00 per acre or $12.50 per bale to be determined by the Commissioner upon recommendation of the Board of Directors of the Boll Weevil Eradication Foundation. The proposed rule further provides that any cotton grower who fails to pay all assessments, including penalties, within 30 days from the date of notice shall be required to destroy all cotton plants growing on his or her property which are subject to assessment. Plants that are not destroyed shall be deemed a public nuisance and the Commissioner may apply to any court for the issuance of judgment and order condemnation and destruction of such nuisance. The rule makes the grower liable for all court costs, fees, and other expenses incurred in such action. Additionally, pursuant to O.C.G.A. $ 2-7154(5)(e), the Department is proposing a $1,000.00 penalty per violation for those cotton growers who fail to comply with the rules; each violation shall constitute a separate offense.

No representation is made regarding any registration or possible registration neither of said equine nor of the physical condition of said equine. Any documentation in possession of the Department of Agriculture regarding registration, physical condition or past veterinary treatment of said equine is available upon request; however, not withstanding the availability of such documentation, or lack thereof, or verbal information given to the Department, said sale is for the equine on an "as is" basis without any representation regarding registration, physical condition or acceptable use of the animal. The Department reserves the right to add or withdraw equines to or from any auction. The successful bidder must be prepared to tender the price by cashiers check, money order, cash, or with personal check (accompanied with letter of bank approval) and move the animal from the facility by 3 p.m. on August 28, 2010. Payment MUST be made at the time the animal is picked up. If a successful bidder fails to tender the price as required, the Georgia Department of Agriculture may refuse to accept any other bids made by the successful bidder at this auction or any future auction.
These horses are subject to periodic inspection by the Georgia Department of Agriculture for a period of 12 months.
Purchaser agrees that helshe will not transfer ownership of equine purchased at this sale to anyone who has had equines impounded by the Department, or a case under investigation for a violation of the Humane Care for Equines Act, O.C.G.A. Sec.4-13-1, et seq. If the Georgia Department of Agriculture determines that this agreement is violated, the equine may be subject to immediate impoundment.
