New dealer license rule to protect business, act as farmer `safety net'

Georgia farmers lost an excess of $2 million last year selling to unlicensed dealers, according to reports made to the Department of Agriculture.
House Bill 268, which goes into effect next year, aims to change that.
The new law, passed in the 2013 legislative session, requires agricultural product dealers to pay for an annual license, which Department leaders say is a good thing for both business and producers.
HB 268 is similar to the original 1931 rule, which required dealers to be licensed and bonded if they weren't paying cash.
"The problem with that law ... you showed proof of surety and there was no expiration date on that license. It was forever," said Jack Spruill, the Department's Marketing Division director. "There was zero charge, so you received a license that cost you nothing and it was good for the lifetime of business or person."
He said lifetime licenses made it impossible for officials to police bonded and licensed agricultural product dealers. Under HB 268, licenses will be renewed annually, which allows

better tracking, Spruill said. A nominal fee of $50, $75 or $100 depending on the dealer's or company's surety will also be charged.
"Surety" is a an instrument such as a bond, letter of credit or CD put on file with the Department being listed as a co-owner.
"It is a blanket insurance policy to protect the buyer in case [a dealer] does something unscrupulous, such as issuing a bad check," Spruill said. "It gives the farmer a safety net."
The new surety calculations are "a huge change in favor of the dealers," Spruill said. Under the previous rule, dealers were required to give the Department a surety bond for the amount they bought during their busiest month. For example, if a watermelon dealer purchased $5 million in August, his surety bond would be for $5 million.
"It was punishing business," Spruill said. "Every adjoining state with this type of law has a maximum cap on those bonds. We had no cap."
Now, dealers who buy fruits and vegetables which fall under the US Department of Agriculture's Perishable Agricultural Commodities Act, or PACA, have a maximum bond of $230,000. Products not under PACA have a bond cap of $500,000.

"Annual license renewals will also mean annual surety review," said Jeffrey Harvey, Georgia Farm Bureau Legislative Department assistant director. "This will assure adequate surety based on business volume for the dealer's current purchasing practices."
When a producer does business with a licensed dealer and doesn't receive payment, a claim is filed against the dealer's surety agreement, and a prorated amount of what the dealer owes will be issued to those filing claims.
"That number will vary all over the board," Spruill said. "It's based on how many claims are out there."
Ensuring product dealers are legitimate is a two-way street, Spruill said.
In addition to the Department implementing a better tracking system, farmers should ask buyers about their licenses and double-check with the Department before loading products on the trucks. Dealers and businesses that lose their agricultural product license will be unable to renew for a number of years, he said. The Department does not have the power for criminal prosecution, but can pursue surety dollars for the farmer.
The rule covers dealers over such crops as fruits, vegetables, nuts and cotton. It also ap-

plies to out-of-state dealers who buy from Georgia farmers, unless they are paying cash or wiring a transfer of legitimate funds before receipt of product.
Information on how to apply for the dealer license is expected to be available on the Department's website later this month, and a database of licensed dealers will begin being built early next year.
Reactions to the changes are mixed. "Dealers have said, `We think it's a burden to have to do it yearly,' and we totally understand that because it's something they've never had to do. Produce sellers have questioned that we have sufficiently required enough surety. In comparison to other states, we're upper median in terms of what we require," Spruill said. "Nobody tended to want to change. This is where honesty is the policy, and if you're honest with us, we can help keep farmers paid." On the other hand, Harvey said, he's heard positive feedback from growers. "No farmer wants to be in a situation where they do not get paid for their commodities," he said. "HB 268 won't totally eliminate unethical or insolvent buyers, but making sure these buyers are licensed and bonded will reduce the likelihood of the occurrence."

Market Bulletin Advertising Guidelines

Only subscribers with a current subscription number are allowed to advertise in the Market Bulletin. Advertisers are limited to one ad per issue per subscriber number. Out-ofstate subscribers are only allowed to publish ads in the Out-of-State Wanted category.

GUEST COLUMN: Farm CDL exemption changes

Farmers have many decisions to

make at the beginning of a new year.

Financial preparations and land use

decisions typically dominate producers'

thoughts, but this year, farmers must

register to receive the farm exemption

from commercial driver's license, or

CDL, requirements.

Beginning Jan. 1, 2014, farmers will

have a much broader CDL exemption than they have had in the past. The pri-

or exemption was only within 150 miles of the farmer's base

of operation, and there was no farm CDL exemption when

state lines were crossed. The new law will enable farmers

to operate within the entire state of Georgia and across state

lines within 150 air miles from the farm location.

Farmers must register online to claim the exemption. The

registration process is free and easy, but it is important for

farmers to register. Without it, farmers are required to follow

all the strict regulations of commercial carriers whose trucks

are on the road every day. Regulations for commercial

truckers include medical cards, drug tests and mileage logs

for drivers. Farmers hauling their own products are exempt

from these provisions within certain parameters.

For years, farmers who lived near borders needed the

CDL exemption to extend into neighboring states. This

broader CDL exemption is the result of federal legislation

that was signed into law in summer 2012. The legislation,

"Moving Ahead for Progress in the 21st Century Act,"

known as MAP-21, is a $105 billion federal surface trans-

portation bill with widespread impacts.

Under MAP-21 requirements, a producer must carry a special tag or distinction on the vehicle in order to take advantage of the MAP-21 CDL exemption. Over the last several months, Georgia Farm Bureau worked with the Georgia Department of Public Safety to make sure that acquiring this special designation is easy and free of charge.
The Department of Public Safety created a "Covered Farm Vehicle Designation" form, DPS TR0025, which will serve as the special designation that is required under MAP-21. The form can be accessed at http://gamccd.net/ FarmVehicle.aspx.
To register, farmers will need the vehicle identification number, make, model, year and owner information for the vehicle being registered for the exemption. When the information is entered, the DPS TR0025 form will come on the screen for printing. Simply print the form and keep it in the vehicle.
There is no cost, but each affected vehicle must be registered separately. The exemption is for the vehicle, so it will suffice for family members and farm employees so long as the drivers have the proper class of driver's license.
Preparing for a new year requires making many important decisions, but don't overlook this change in the law. It takes only a few minutes to register and you'll be glad you did!

GUEST COLUMN: State beef referendum coming in 2014

Now is the time for all cattle producers in Georgia to make your voice heard! You have until Dec. 31 to request a ballot to vote in the beef referendum that will be held in early 2014. In case you are unaware of what is happening with regards to the referendum, I would like to give you a brief summary of how this all came about.
The Georgia Farm Bureau Beef CALLAWAY Commodity Committee was meeting
in August 2011. During the meeting the need for more dollars for valuable research and product promotion was discussed. After much conversation it was suggested that a study committee of stakeholders be formed to look at a producer investment program. The idea was put into official policy and passed by the general membership at the annual meeting in Jekyll Island.
Fast forward about four months and a similar policy was passed by Georgia Cattlemen's Association at its annual meeting at the Beef Expo in Perry during April 2012. It was just a matter of time before the Georgia Milk Producers and the Georgia Livestock Marketing Association came on board also. Three people from each organization were appointed to a 12-member study committee.
The study committee met through the summer and fall at various locations throughout the state. In the end it was unanimous among the committee that a referendum be held and let the producers decide if they wanted a state beef checkoff.
This checkoff should not be confused with the National Beef Checkoff that has been law since 1986. The national Checkoff of $1 per head can be spent only for promotion, research or education. Fifty cents of every dollar collected is administered by the Cattlemen's Beef Board at the national level. The other 50 cents of every dollar is returned to the state where it is collected and here in Georgia is administered by the Georgia Beef Board. Both the state and national boards are comprised of beef farmers, ranchers, dairymen and livestock market operators.
Meetings were held with the commissioner of agriculture and other key members of the Department of Agriculture.

They were supportive and offered their help in any way. After much work by all involved, Senate Bill 97 was introduced in the 2013 legislative session of the General Assembly. The bill, passed and signed into law by the governor, called for a referendum to be held with all Georgia cattle producers eligible to vote their wishes as to whether or not to fund the Georgia Agricultural Commodity Commission for Beef. Anyone in Georgia who owned cattle in the last 12 months is eligible to vote. Ballots will be mailed sometime after the first of the year.
If passed, the Agriculture Commodity Commission for Beef would be run by cattlemen. This five-member producer board would determine how the funds would be spent. The commission must also be reaffirmed every three years by a vote of all cattle producers in the state.
The original legislation that created the foundation for commodity commissions in Georgia was passed in 1961. There are 12 other such commodity commissions in our state, all of which are administered by the Department for a nominal fee of less than 5 percent of the dollars collected.
If the state beef checkoff assessment of up to $1 per head passes, it could in essence triple the amount of money that could be spent in our state to support the beef industry with funds for promotion or advertising, vital research or education of our consumers and health professionals about the value of beef in a healthy diet.
With a 10 million-plus population, we only generate three cents per Georgian through the national Checkoff. According to a study at the University of Florida, researchers found that for every $1 invested in the national Checkoff, cattlemen receive a $5.50 return. I don't know of anything else that even comes close to that.

It's sleeting outside right now. It's cold. It's kind of miserable

outside. It's making me question my dream of wanting to live in

New York.

But it also reminds me how fortunate I am. I have food in my

pantry, a family to call when I get off work and heat I can turn on in

my apartment. Many Georgians don't have those blessings. Some

are considered "shut-ins," some are in nursing or personal care

homes. Others don't have a home to call home in the first place. No

matter what time of the year it is, I cannot imagine how hard that

must be, and the Christmas season is the perfect time to open our

hearts to those who do not share in our creature comforts.

The Market Bulletin once published a list of elderly, shut-ins and

others who wanted to receive Christmas cards and holiday greet-

ings. This practice was ended a few years ago for privacy reasons

publishing names and addresses of people who live alone unfortu-

nately opens the door for Grinches and unsavory characters to scam

or otherwise take advantage of them. And no one wants that ... but

it appears that many Market Bulletin readers want to reach out to

folks in these situations and wish them a merry Christmas.

So in lieu of publishing a Special People List, I brainstormed

and put together some ideas for ways that you, your friends, stu-

dents and family can help the needy, shut-in and anyone else who

facilities about opportunities to work with residents or patients

during the holidays. Though full names might not be available,

kitchens, food banks, Habitat for Humanity and all kinds of

other groups specialize in making holidays merry and bright by

got kids, make gifts to give to nursing home residents, hospi-

tal patients, families at the Ronald McDonald House, etc. A

spicy-scented gingerbread ornament is easy to make with some

cinnamon, glue and a cookie cutter, and a small gesture like this

can make the heart grow three sizes bigger.

Spreading Christmas cheer makes me feel happy. I love having

the ability to not only enjoy celebrating this time of year with my

family and friends, but being able to help others and their families

celebrate it, too.

FEATURED RECIPES: Christmas cookie showcase

Easy peanut butter oatmeal cookies
Editor's Note: This recipe makes about two dozen cookies, enough to feed plenty of little elves on Christmas morning.
Ingredients: cup crunchy peanut butter cup packed light brown
sugar 1 egg, beaten 1.25 cups quick cooking oats teaspoon baking soda
Instructions: 1. Preheat oven to 350 de-
grees Fahrenheit. 2. Cream peanut butter and
brown sugar together in small bowl until fluffy. Add egg. 3. Add oats and baking soda. Mix well. 4. Drop tablespoons of batter about two inches apart on a prepared cookie sheet. Bake for six to eight minutes.

Molasses cookies
Editor's Note: These cookies come to us from Jack Spruill of Hoschton, Ga. The recipe makes five dozen, but they were such a hit with our taste-testers that a second batch was called for!
Ingredients: 2/3 cup vegetable oil 1 cup sugar 1 egg, beaten 4 tablespoons molasses 2 cups flour teaspoon salt 1 teaspoon ginger 1 teaspoon cinnamon 2 teaspoons baking soda Sugar for coating cookies
Instructions: 1. Preheat oven to 350 de-
grees Fahrenheit. 2. Combine oil, one cup sugar,
egg and molasses in a large bowl. 3. In a separate bowl, combine flour, salt, ginger, cinnamon and baking soda. Add the flour mixture to the oil mixture and stir to combine. 4. Roll one teaspoon dough into a ball and roll in remaining sugar to coat. Repeat for the rest of the dough. 5. Place coated dough balls on a prepared cookie sheet and bake for six to eight minutes.

Chocolate caramel bars
Editor's Note: Trying to decide whether to bring cake or cookies to that holiday function? Here's the perfect combination. Makes about 20 bars.
Ingredients: 14-ounce package of cara-
mels 2/3 cup evaporated milk,
divided 18.5-ounce box German
chocolate cake mix 2/3 cup butter, melted 6-ounce package chocolate
chips 1.5 cups chopped pecans
Instructions: 1. Preheat oven to 350 de-
grees Fahrenheit. 2. Melt caramels in a bowl in
the microwave for about two minutes. Stir in onethird cup evaporated milk and set mixture aside. 3. Combine cake mix, butter and remaining milk in a large bowl. Press half of this mixture in a prepared 9x13inch baking pan and bake for six minutes. 4. Remove cake mix from oven. Sprinkle with chocolate chips and pecans. Pour the caramel mixture over and gently spread it. Note that the caramel mixture will not go all the way to the sides of the pan. 5. Spoon remaining cake mix on top of caramels, and return to the oven and bake for 20 minutes. Let cool and cut into one-inch squares.
