The minutes of the last (meeting) were read and a communication from the President on the state (219) of the University, which was refered to a Committee consisting of Messrs Clayton, King, & Daniel of Chatm The Treasurers statement of the fund was submitted, read and refered to a committee, consisting of Messrs Harden, Cobb, & Sayre. A Report of the Board of Trustees in relation to the late distruction of the Building by fire, was read & referred to a committee consisting of Messrs Schley, Branham, and Singleton. The Senators were then called alphabetically, who made reports on the condition of academies & poor schools in their respective counties: Which reports on motion of Judge Clayton, were refered to the House of Reps with a request, that the same be refered to the Committee of the Legislature on Public Education and Free Schools. On motion of Mr. Clayton - Resolved that the appointment of William Schley Esq. & Doctor Tomlinson Fort, to be Trustees of the University be & the same is hereby confirmed. The Board them adjourned till to-morrow evening 3. O.clock. Tuesday Evening The Board (met) pursuant to adjournment, Mr. Reese appeared in his seat as a member, of the Senate, and Mr. Cuthbert as a Trustee. On motion of Mr. Clayton, (220) Resolved, That the appointment of John A Cuthbert Esquire to be Trustee of the University be & the same is hereby confirmed. Mr. Clayton from the Committee appointed made a Report which was read, & ordered to lie on the Table, and 300 copies thereof to be printed. The Senators from the Counties of Lincoln, Upson Early, Walton, Wilkerson, (sic) Troup, & Jasper, made additional Reports, on the academies & schools, in their respective Counties which were recd and refered. Mr. Sayre from the Committee appointed, made the following Report which was agreed to. viz: The Committee to whom was refered the Treasurers Statement of the funds of the University, have carefully examined the same, and find it correct. The receipts are equal to former estimates, and the Expenditures are such as have been authorised by resolutions of the Board of Trustees, and are all covered by sufficient & satisfactory vouchers. Your Committee are convinced, that the Board in all their appropriations, have has a due regard to that economy, which is so necessary in the management of Public funds. By the report, it appears that balance in the Treasurers hands, at this time amounts, to five thousand five hundred & fifty eight Dollars, & 1 3/4 cents -which is a much larger sum, than will be reported at the next, or future periods,: Because the present amount has been swelled much beyond the usual size, by the saving of a Professors (221) salary during the vacancy of the chair of Moral Phiy and Belles Lettres, and the fortunate collection of an old and doubtful debt. -and because during the adverse situation of the Institution, resulting from the late deplorable conflagration, the item of funds, arising from Tuition Bills, may be very materially diminished. Mr. Schley from the Committee appointed made a report, which was read, laid on the Table, & 300 copies ordered to be printed. The Senatus Academicus then adjourned till 3 O.clock to-morrow evening. Wednesday Evening 3. O.clock. The Board convened pursuant to their adjournment, On motion of Mr. Schley, Resolution That the appointment of Alfred Cuthbert Esq. as a Trustee of the University, be (and) the same is, hereby confirmed. The Senators from the Counties of Butts, Bibb, Chatham and Troup, made additional Reports, which were received and refered as the former reports were. The Report made on yesterday by Mr. Clayton, and laid on the Table, was called, considered, discussed, and adopted, and is as follows, to wit: The Committee to whom the Communication of the President of the University has been refered, beg leave to report, That upon a careful examination of that Document but two leading subjects, will be found worthy at this (222) time, of the attention of the Senatus Academicus. 1st The establishment of two additional Professorships, to wit: one of Modern Languages, and the other of Nat History -2dly The destruction by fire, of one of the College Edifices, together with the Library & Mathematical Instruments of the College. -Upon these subjects there can be but one opinion. By every consideration of the blessing of knowledge to every community -by all its advantages in the support, of our civil & religious privilledges -by the respect due the character of the State, both at home & abroad, and the implied pledge, to our Sister States, that we will promote every thing that will strengthen our Union, increase our affections for each other, and add to our repuration in foreign countries, so much opposed to our growth, in useful literature, & refinement, the College of Georgia ought to be liberally supported with one mind. But the Committee regret to say, that the University of Geo. from causes whether true or false, is not now material (,) has not enjoyed the full & entire confidence of the good people of Georgia -It is not at present necessary to investigate that subject; such is the fact, and it certainly becomes the imperious duty of the Guardians of the literary concerns of the State, to lode not a moment of time in removing all obstacles, that oppose a renewal of the affections of the whole for this hitherto favoured Institution. (223) This they believe can be done by suffering the whole community to be represented in this Institution. Division of opinion in political affairs ever has, existed, and doubtless will continue. Perhaps it is right as it produces a vigilance highly favorable to the preservation of free institutions and the best interests of the people. This division should not, however, be carried, into literary institutions - upon that important subject there should exist the utmost cordiality of feeling and oneness of mind - Every cause of jealousy should be removed. Every impediment standing in the way of Universal Confidence, should be made to yield to an open, liberal policy, on the part of the administrators of these vital interests. Without intending any reflection whatever upon those who have managed the affairs the affairs (sic) of whose labors have doubtless been arduous and delicate; whose decisions have been conscientious and well intended, yet we may (say) its management, has been altogether in the hands of one political party; and this of itself is calculated to inspire the belief, that the great persevering principles just laid down, of united concert in the support of science, may not be duly regarded, and consequently defeat the great ends promised and expected, from that interesting source of public strength and private happiness (224) If then this difficulty can be removed the Committee have no doubt, (for they found their belief upon the intelligence and liberality of the people of Georgia, repeatedly manifested towards this same institution, as well as all others having for their object, the interest of the sate and the elevation of its character) that an endowment every way suited to the exigencies of the University may be obtained from the Legislature of Georgia. - When then this shall be accomplished they earnestly recommend that an application be made to the present general assembly, to make such appropriations as will afford the relief so much needed, and so affectingly (sic) required by the Presidents Communication. And the Committee are grateful in saying this relief may be extended in a great degree, without any considerable draft upon the funds of the State. -Some facts & information submitted to the Senatus Academicus, will explain this suggestion. - The College was originally endowed with lands -From the great quantities of lands unappropriated in the State, the support of the Institution by rents, was found to be not only very precarious, but insufficient - Consequently the Trustees asked of the Legislature to permit them to sell their land and to suffer them to vest their proceeds in profitable Bank Stock. This was granted by an Act passed in Decr 1815, to which we bed leave to refer (225) By this Act, the Trustees were directed to sell their lands on a long credit, and to deposit the Bonds for which they might sell in the State Treasury, as a pledge, for two thirds of their amount in the Stock of the State Bank, owned by the State, which was then about to go into operation - The lands were sold, and Bonds to the amount nearly of One hundred & forty thousand Dollars, were lodged in the Treasury of the State, and for which the State granted to the University $100.000. in the Bank Stock. This left $40.000, over & above the amount of Stock; and the Committee are informed, that the State has been fully paid her $100.000, both principal & interest, and that this residue has been transfered to the Central Bank as State funds. The Committee believe that every candid mind will readily perceive that the University is entitled to this forty thousand Dollars, or so much at least of it as has been collected. This is a part of the original endowment, because it is a apart of the proceeds of the College Lands. The Committee recommend that an application be made to the Legislature, not to suffer the Trustees to withdraw this amount, but to let it remain in the said Bank, and to permit the Trustees to have the use of its semi-annual interest for the benefit of the College - and they would respectfully ask the Legislature, so to increase that fund in the Central Bank, as to make the annual interest thence (226) arising amount to Eight thousand Dollars. This sum with the present endowment, would be fully sufficient, to meet all the wants of the Institution, and place it upon a footing with any other institution in the United States. The Committee are the more emboldened to this measure, from the belief the State has resources which will amply justify it, and that they represent a people who, from their intelligence liberality and patriotism, are, unwilling to be behind any community in the praise worthy and honorable support of learning & virtue. Mr. Schley from the Committee appointed made the following report, which was agreed to. viz: The Committee to whom was refered the report, of the Board of Trustees, on the subject of the destruction of one of the College Edifices and the Library of College beg leave to Report, that under the expectations that an appropriation will be made in accordance with a request of the Senatus Academicus, as contained in a report just agreed to, setting apart certain funds in the Central Bank, founded on University Bonds, as a permanent fund for the University -The sum of ten thousand Dollars be requested as a loan of the Legislature, to be reimbursed out of the proceeds of the fund aforesaid for the purpose of rebuilding the College Edifice and repairing other losses accompanied by the fire. (227) On motion of Mr. Cobb Resolved that the Board of Trustees of Franklin College, be & they are hereby requested to take into consideration the subject of admitting the poor of this State to participate in the benefits of receiving Education at Franklin College, and to report to the Senatus Academicus at their meeting in 1831, such plan or plans as they may think most expedient to accomplish this desirable object. Resolved that the Secretary of the Board, furnish each of the Members of the Board of Trust, with a copy of this resolution. Postscript The following Resolution of the Board of Trustees was read and approved by the Senatus Academicus, viz: Resolved that in the opinion of this Board of Trustees, it is expedient& proper, that the Board should be increased to the number of Twenty Eight, and that the Legislature be requested to appoint Eleven Trustees, which added to the present number will constitute the number of Twenty Eight. (229) An Extract from the proceedings of the Board of Trustees on the subject of the Education of one poor as from each County was read and refered to a Committee consisting of Messrs Burch, Prince, Harlow, Wofford and Fort. The Treasurers Statement of the Finances, was then read and refered to a committee consisting of Messrs Harden, Branham, Anderson, Daniel, & Murray. The Senators were then called alphabetically, who presented such reports on the condition of County Academies & poor school operations, as had been furnished them -After the reports had been received Mr. Henley offered the following resolution which was agreed to: to wit: Resolved that the Reports of the Senators made to the Senatus Academicus, be laid before the Senate, with a request that they be refered to Joint Standing Committee in Public Education & Free Schools. The Senatus Academicus then adjourned till, Tuesday evening 3. P. M. The Board Convened pursuant to adjournment. The Senators from Baldwin, Franklin, Hancock, Upson, & Muscogee made additional returns. Mr. Wood from the Committee appointed made the following reports which was read and concurred in. viz. The Committee to whom the Report respecting the state of the University was refered, beg leave to express their approbation of the general view which has been presented of it. The Progress of this great (230) literary Institution of our State, to the elevated station anticipated by its supporters, cannot but tend to ensure to it the confidence of the public. The various subjects contained in this exposition are so connected, as to render it unnecessary for the Committee to go into detail; while it obviously appears that nothing has been omitted which lead the Institution to prosperity. The destruction by fire of half the College buildings during the sitting of the last legislature, and the erection of an elegant building on the cite (sic) of the one destroyed, in the short space that has intervened, indicate a prompt & indefatigable attention, in those to whom its interests have been confided. It appears also, that two additional Professorships have been raised, and those chairs already filled with selected talents, offering now ample means, to those who are desirous of embracing a full collegiate course. The introduction of order & decorum, and the inculcation by the Faculty of useful & practicable knowledge certainly is very commendable. - Your Committee therefore duly appreciate the progressive state of this Institution & offer the following resolution. Resolved that the report, relative to the present situation of Franklin College, holds out the most cheering prospects, in relation to its future usefulness, & that it be accepted as meeting the approbation of the Senatus Academicus (231) Mr Prince from the committee appointed made a Report which was read, amended, & agreed to and is as follows, to wit. The Committee to whom was refered the Resolution of the Board of trustees, relative to the education at the College of the indigent youth of the several Counties of this State, concur in the sentiment expressed by the Trust of the importance of that object to the people individually, and to the character and future welfare of the State, the great objects of the existence of the Institution. The immediate effects of such a measure be to carry the benefits of education in as great a degree as possible, home to the people who are least able to obtain it.- And 2dly to diffuse these advantages as equally as possible to every portion of the State. The Committee carrying out the principle farther than seems heretofore to have been suggested would distinctly recommend that the plan should include, not merely a course in the University as heretofore contemplated, but that it should include the elementary education preparatory to that course. For it must be apparent that those parents whose destitute circumstances bring them within the policy of the government, cannot be able at their own charge to fir their sons for entrance into the College And it further seems to the Committee that the plan in its operation, will be more just, equal, efficient, and satisfactory to the people in the preparation (232) that the selection of beneficiaries be left with the people themselves, or those most intimately acquainted with those, from whom the selection is to be made. In pursuance of these views of the subject, the Committee recommend to the Senatus Academicus the adoption of the following resolutions. Resolved that it be recommended by the Senatus Academicus to the Legislature to provide by Law, -that the Justices of the peace in each Captains district, nominate to the Inferior Court of the County one or two such poor Boys of the district not under fourteen years of age, as are in their opinion best entitled to the benefits of the act. That the Justices of the Inferior Courts of the Counties shall select from those thus nominated such one Boy on whom in their opinion the public will be best bestowed, judging of his talents, habits, disposition, & circumstances of his parents, giving them the power to determine by lot when they feel otherwise unable to decide. These beneficiaries to be entered at the Grammar School at Athens and to be taught cloathed and boarded at the public expense, until they shall have completed the full course of studies, taught at the University. That when there shall from any cause a vacancy in the scholarship in any county (occur) the Faculty shall notify the Inferior Court thereof, who shall cause such vacancy to be filled, as before pointed out. And that a permanent annual appropriation of Fifteen Thousand Dollars, be asked of the Legislature for the purpose aforesaid. (233) Mr. Harden from the Committee appointed, made the following report which was read and concurred in. The Committee to whom was refered the Statement of the Receipts and Expenditures of the University of Georgia from the 1st of November 1830, to the 31st of October 1831, Report that they have carefully examined the same, and find that the charges are properly supported by the necessary vouchers, and the credits correctly made, leaving a Balance in hand of Four Thousand Nine Hundred & Eighteen Dollars 19 1/4 cts. The Following Resolution of the Board of Trustees was presented and read -to wit: Resolved that the Senatus Academicus be requested to appoint annually, fifteen persons as a Board of visitors, to attend the examinations of the classes in the University preceeding the annual Commencement, the duty of any three or more of whom, shall be to report to the ensuing meeting of the Senatus Academicus -which was approved and on motion of Mr. Paine, it was resolved, That the President of the Senatus Academicus, President of the Senate, & the Speaker of the House of Representatives, be a Committee to make the appointment of the said Board of visitors. It appearing that there was not a majority of the (241) Board of Trustees, Present, Mr. Liddel offered the following Resolution which was adopted, viz, Resolved That the Board of Visitors in connexion with the Trustees now present, proceed to the ordinary business of the meeting, trusting to future legislation to legalize the proceedings. The President of the University presented a communication embracing the condition & prospects of the College, together with a catalogue of the Students their names, classes, & residences, which was read. The Treasurers Statement of the Receipts, and Expenditures of the Institution from the 1st Novr 1833 to Nov. 1st 1834, was also read. The Governor then presented the Report of the Board of Examiners who attended the examination, of the late Senior Class, and also the examinations of the three lower classes preceding the last commencement, signed J. G. McWhorter as chairman, which was also read. A code of Laws for the Government of Franklin College, revised by the Faculty, and recommended by the Board of Trustees, being presented, for the ratification of the Senatus Academicus, the same was taken up, amended, and Enacted for the future Government of the Institution. The Senators were then called upon to present their Reports upon the condition of County Academies, Poor Schools, and other Seminaries of learning in their respective Counties, which being done without reading. Whereupon, the President appointed Messrs Harden, Liddel, Saffold, Floyd of Morgan, McAllister, Mitchell of Baldwin, & Reese to be that committee, & report to-morrow afternoon at 4. o.clock On motion Genl. Harden, it was resolved That the appointment of Chas J. McDonald and Thomas F. Foster Esquires to be Trustees of the University of Georgia, be and the same is hereby confirmed. The Senators were then called alphabetically who laid on the Table, reports from their several Counties on Academy & Free Schools. (247) On motion of Mr. Saffold Resolved That the Reports, presented, by the Senators to the Senatus Academicus be refered to the Senate, with a request that Body, will refer the same to a Select Committee or to the Committee on Public Education and Free Schools, and it is hereby recommended to the Legislature thru their committee to ascertain & report all delinquent Counties, that the Law now existing, may be enforced in relation to said Counties. Tuesday Evening Nov. 15 The Board met pursuant to adjournment Mr. Harden from the Committee appointed made the following Report. The Committee to whom the Report of the President of the University & the Resolved of the Board of Trustees, was refered, find but two subjects which would appear to require the action of the Senatus Academicus. The Committee therefore in accordance with the recommendation of the President & the Board suggest for the determination of this Body the following resolutions. Resolved, That the Recommendation of the Trustees & President of the University relative to the exemption of Students in the various literary Institutions (248) of the State, from military duty in time of peace is a subject which merits the consideration of the Legislature to whom they would respectfully refer the Subject 2ndly Resolved that a smaller number of Trustees should constitute a quorum for the purpose of uniting with the Senators of the State of Geo. in forming the Senatus Academicus, and therefore it is recommended to the Legislature to provide by Law, that seven members shall constitute a Quorum of the Board of Trustees, at the annual meeting in Milledgeville which it is believed, will attain the desired object, without endangering the interest of the Institution. The Annual Communication of the President of the University was read, and on motion of Mr Haralson, was refered to a committee, consisting of Messrs. Berrien, McDonald, McAllister, Patterson and Camak to report thereon to-morrow afternoon. (251) Mr Harris of Baldwin offered, the following Resolution which was agreed to. Resolved as the Sense of the Senatus Academicus, that a Professorship for instruction in civil Engineering, should at once be established in Franklin College, and that the General Assembly be respectfully invited to make provision for the payment of suitable salary to the Professor. The Treasurers Report of the finances of the College was presented and read. The Senators were next called alphabetically who generally, presented Reports of the condition of Academies & Poor Schools in their respective Counties, which on motion of Mr King of Glynn, was refered to the Senate, with a request that they be laid by that body, before the joint Standing Committee on Public Education and free Schools. The Senatus Academicus then adjourned to meet again, at 3. O.Clock, P. M. to-morrow. Tuesday Nov. 14. 1837 The Senatus Academicus convened pursuant to adjournment. A Report from the Board of visitors who attended the final examination of the late Senior Class was read and refered to the Senate. Mr Berrien from the Board of visitors who attended the final examination of the late Senior Class was read and refered to the Senate. The Committee to whom was refered the Communication of the President of the University to the Senatus Academicus beg leave to report. That they have attentively considered (252) the several subjects which this communication embraces -They have examined the laws of the College, and especially the Second Chapter, which relates to the admission of Students, and the studies of the different classes, and concurring with the President in the views which he has taken on this subject, they recommend the adoption of the following resolution Resolved: That so much of the 2d Chapter of the Laws of College, established by the Senatus Academicus on the 10th November, 1834, as relates to the qualification of candidates for admission into College, and the Studies of the several Classes be repealed, and in lieu thereof the following, regulation be established The qualifications of candidates for admission into College, as well as the Studies of the several Classes, shall be prescribed, and may from time to tome be modified by the Faculty of College and shall be published under the direction of the President; provided that every alteration of the existing regulations, shall be reported by the President to the Board of Trustees, at their first regular meeting thereafter, and shall be communicated to the Senatus Academicus at their next regular meeting, and provided also that until such alterations are made, the existing regulations shall be in force The Committee have given their attention to that portion of the communication of the president which suggest the importance of endeavouring at once to secure the most important early Historical Works, relating to the discovery settlement of this Country, and entirely agree with him in in (sic) the propriety of such a measure. (253) The records of our common origin ought to be accessible to all and to (be) found therefore in the archives of each of the members of that great confederacy of Republics of which we constitute a part. - Many of them are now to be procured at comparatively small expense, but they are rapidly disappearing - To collect and preserve them is a duty which we owe to ourselves, and to the generations which are to succeed us; and in the view of the Committee, no more appropriate place of deposite can be selected, than the Library of our State University They therefore recommend the following Resolution, viz Resolved, That the Legislature be respectfully recommended to appropriate Five Thousand dollars to be expended under their direction of the president, and Librarian of the University in the purchase of Books, and other Documents, relating to the discovery and settlement of this Country, and that the same when obtained, shall be deposited in the Library of the University The Committee concur likewise with the Prest, in the view which He has taken in securing the originals or copies of our Colonial Records Some of these will be found to relate probably, to the title to real property in those parts of the State which were settled during the existence of the Provincial government, and being useless to Great Brittian the originals of these may be surrendered to us. Most of them it is presumed will be important to the narrative of our colonial History. -It seems however to the Committee, that the nature & degree of the importance of these Documents, and the fact whether original or copies can be prcured (sic) ought first to (be) ascertained, together with the cost of procuring them, and that for this purpose (254) all that will be necessary is the appropriation by the Legislature of such an amount as will be sufficient to defray the expense of an examination through some of the Public Agents of our Government who are resident in Great Brittian They therefore recommend, the adoption of the following resolution Resolved That the Legislature, be respectfully requested to appropriate the sum of four thousand dollars, for the purpose of causing an examination to be made of the Colonial records of this State which may yet exist in Great Britian -of procuring a descriptive list of such Documents, and of ascertaining the expense of obtaining the originals or copies of the same, and that such sum or so much thereof as may (be) necessary shall be expended under the direction of the Governour of the State. The Report of the Committee on the important subject of establishing in the University of Geo. a Professorship of Civil Engineering, has been rendered unnecessary by the establishment of that Professorship, by a resolution of the Board of Trustees, and by the direct & prompt action of this Body upon this subject - They cannot however forbear to express their belief, that all who desire to promote the great works of internal improvement, that are in progress in our state will cordially concur in a measure, which is calculated to enlighten the Public Mind, upon this interesting subject, and to provide among our own Citizens competent agents for the completion of these noble enterprizes They trust moreover that the liberality of the Legislature will if necessary supply any deficiency in the funds of the University to sustain this professorship, as the experiment will have been made for the (255) attainment of an object in which all classes of our citizens have so deep an interest, and under the previous sanction of the Senatus Academicus -The foregoing Report was on motion of refered to the Senate, to be by that Body brought to the consideration of the Genl. On motion of Gene Harden, Resolved that the appointment of Col Jno Billups Vice, Edward Paine Esq resigned, to be Trustee of the University of Georgia be and the same is hereby confirmed. The communication of President Church and the report of the Treasurer of the University on the condition of the funds were severally presented & read, and on motion of Mr. Echols were refered to the Senate, with a request that they be printed for the use of the Legislature. Senators were then called alphabetically, to make report of the county academies & common Schools in their respect(.) counties, which being received was on motion refered to the Senate (268) with a request that they be referred by the Senate to the Joint Standing Committee on Public Education & free Schools. The Senatus Academicus then adjourned until tomorrow evening 3 O.clock. Tuesday Nov. 9. 1841 It having been communicated to the Senate by the Board of Trustees that the Board had no further, communication to lay before the Senatus Academicus, it was considered that it was unnecessary that the joint board should again assemble, and in consequence the Senatus Academicus stood adjourned Sine Die. (270) A Report of the Board of Visitors who attended the late examination of the Graduating Class and also the examination of the under classes, was read which together with the Treasurers Statement of the funds, & the Presidents communication, was refered to the Senate with a request that they be laid before the Joint Standing Committee on Public Education & Free Schools. On motion of Mr. Dawson Resolved That the appointment of Howell Cobb & William L. Mitchell Esqrs to be Trustees of the University of Georgia, in place of Thomas W. Harris & Jacob wood resigned, be & the same is hereby ratified and confirmed. The Senators were then called alphabetically to make report of the condition of Education in their respective Counties, after which Mr. Stephens offered the following resolution which was adopted to wit -Resolved That the Reports from such Counties, as have not been received & that may hereafter be received, may be presented to the Senate, during the present session of the Legislature Resolved That the Several Reports of the Poor School fund of the respective Counties be referred to the Senate, with a request that the same be referred to the Senate, to be by that Body referred to the Joint Standing Committee on Public Education.
