The petitioners argue that they have attempted to comply with the conditions of an act passed by the Georgia Assembly on December 21, 1789 for disposing of "vacant land or territory within this State."  They insist that recent protests among Georgia legislators against the sale of these lands violates their contractual agreement and they demand that the state accept payment for the lands as previously agreed.  Of particular note is that the various land companies were expected to eliminate all existing Indian title to the lands, a proposition frustrated by the Treaty of New York with the Creek Indians (August 7, 1790).  The petitioners strenuously assert that their rights are being violated by both the actions of the federal government and the state government of Georgia with respect to the western territory of that state.
