Speer, July, 1911, to REPORT OF COMMITTEE The committee appointed by the Legislature, session of 1914, as required by law, made the following report of the condition of the State Treasurer's office: "We, the committee required by law to examine the accounts and vouchers of the State Treasurer's office as to all moneys received into and paid out of the treasury during the fiscal year, beg leave to make the following report: "We have thoroughly examined the office of the State Treasurer and find the books and all vouchers neatly and accurately and correctly kept. We have counted the money on hand and have verified the accounts of all State depositories, and find that they are also correct. We have carefully examined the report of the State Treasurer and find that he is sustained by the true condition of his office. "In this connection we desire to commend the incumbent in office, the Hon. W. J. Speer, for the efficient manner in which he has conducted the affairs pertaining to the treasury." ANNUAL REPORT ATLANTA, GA., December 31, 1914. HON. J. M. SLATON, Governor of Georgia. DEAR SIR: I submit herewith the annual report of this de- partment showing the transactions of same for the fiscal year ending December 31, 1914. This report, as the law requires, includes the report of the State Bank Examiner showing the condition of the banks operating under laws of this State, as indicated by their reports made to this department under call of December 4, 1914, and by the last examination made of such banks for the six months ending December 31st. On the first day of January, 1914, my report of that date showed a balance in the Treasury of. .$ 739,625.75 Since that date I have received and certified to the Comptroller-General, as shown by table 1 of this report, the sum of 6,015,482.10 Making the amount chargeable to the Treasurer in this office and the office of the Comptroller- General $ 6,755,107.85 The disbursements for the same period from January 1st to December 31st, 1914, both in- clusive, were 5,967,651.97 Leaving balance in the Treasury January 1, 1915. .$ 787,455.88 In this balance is included the Sinking Fund of $100,000, to be used tomorrow (Jan. 1, 1915) in paying off the eighteenth installment of bonds issued under Act of 1887, which mature on that date. It also includes $153,812.50 of funds from the sale of public property to be applied to that part x TREASURER'S REPORT of the public debt which matures on the first day of next May, also the advances to the various officers of the State on account of salaries for the quarter ending on this date, for which warrants to cover same will be asked in the near future. BONDED DEBT. The last report of this department for the fiscal year ending December 31, 1913, showed the bonded indebtedness of the State to be $ 6,630,702.00 On the first day of January this year (1914), the seventeenth installment of bonds, issued under the Act of 1887, became due and were paid off with the Sinking Fund, then in hand, amounting to 100,000.00 Leaving the valid interest bearing debt at this date $ 6,530,702.00 Of this amount of bonds, constituting the bonded debt of the State, $3,679,000, will mature next year (1915), to-wit.: 3% Per cent, bonds, issued under Act of 1894, will mature May 1, 1915 287,000.00 4% per cent, bonds, issued under Act of 1884, mature July 1, 1915 . 3,392,000.00 $ 3,679,000.00 The Legislature at the last session provided for the payment of this part of the debt by a new issue of bonds, which will be offered at the proper time, and, no doubt, will bring a price in keeping with previous bond sales and the splendid credit which the State has so long maintained and enjoyed in commercial circles. DIFFERENCE IN ACCOUNTS. It is very important that the Legislature at the next session fake some action to bring about an adjustment of the accounts between this office and the office of the Comptroller-General, TREASURER'S REPORT xi which are now largely out of balance, the difference at this time amounting to $83,795.92. The splendid accounting system, under which the finances of the State Treasury, for perhaps a hundred years, have been so safely administered through an audit by the ComptrollerGeneral of all disbursements made by the Treasurer and his account credited with same before payment, has been disorganized and the State left without adequate protection in the method adopted of paying out State money. The accounting procedure in the office of the State Treasurer, under the system provided by the first Constitution, requires that all disbursements made from the Treasury, except the orders of the President of the Senate and Speaker of the House for per diem and other expenses of the Legislature, shall be made only upon the warrants of the Governor when countersigned by the Comptroller-General. The accounting for all money paid into the Treasury is also made through the Comptroller-General, to whom official notice must be given by the Treasurer and his account charged with same. This procedure keeps the accounts of the State, as it was intended, in perpetual balance and is in every way well adapted to the safe administration of the State's finances. Under an Act of the Legislature, passed in 1913, this system has to some extent been changed, and certain funds in the Treasury are now payable upon the warrants of the Commissioner of Agriculture and the Board of Barber Examiners without the authority of the Governor or credit to the Treasurer in the Comptroller-General's office. As above stated there is now a difference in the books of the two departments of $83,795.92, which should be adjusted by suitable legislation, and the law so changed as to make all warrants issued against the Treasurer subject to an audit by the Comptroller-General before payment. This large shrinkage is due, of course, to the very unexpected and unusual conditions brought about by the European war, which have affected very seriously all classes of business in the South, especially the banking and cotton interests. Collections of bank maturities for the fall months Were almost entirely suspended, which brought about a steady drain upon the bank deposits to meet necessary expenses, resulting in the large reduction of deposits as shown at the close of business of last year. The small country banks have had a pretty hard time of it, and a few of them, for the lack of ready money and their inability to collect debts due them, have been forced to close their doors, but the demoralization of the cotton business, which was the main trouble in the South, there being practically no market for cotton until since the first of January, this demoralization having disappeared and confidence generally restored, it is generally believed that the bottom has been reached and from now on the banks will rapidly regain their normal condition. Money is much easier at lower rates. The bond market has become more active. We are receiving many inquiries about the new State bonds to be issued this year; a great many of the XIV TREASURER'S REPORT holders being anxious to exchange maturing bonds for the new issue upon a basis of 4 per cent, interest. A demand is springing up also for Municipal and Industrial securities, all of which is very encouraging to a more optimistic outlook and indicates a general improvement all along the line. CHANGES NOTED. At the beginning of the year there Were 693 banks in active operation. During the year 25 banks have been chartered and 4 branch banks have been opened by the parent banks. Nine banks have liquidated, namely, Peoples Bank & Trust Company, Blue Ridge; Bank of Crosland, Crosland; Gilmer County Bank, Ellijay; Bank of Garfield, Garfield; Capitol Savings Bank, Macon; Harrold Banking & Loan Company, Macon; Bank of Riverdale, Riverdale; State Bank, Rome; and the Citizens Savings Bank & Trust Company, Atlanta. American Trust & Savings Bank, Albany, merged or consolidated with the Georgia National Bank of Albany; Commercial & Savings Bank, Macon, merged with the Continental Trust Company of Macon; Farmers Bank, Nashville, consolidated with the Berrien County Bank of Nashville; Chatham Bank, Savannah, consolidated with the Savannah Trust Company of Savannah; Citizens Bank, Sylvania, and the Screven County Bank, Sylvania, consolidated and procured a charter under the name of the Citizens & Screven County Bank. The Citizens Bank & Trust Company, Athens, placed themselves in the hands of this department for investigation, which revealed the fact that there was a large shortage in their accounts. The stockholders of this bank rallied and covered the impairment by assessment, which was paid in cash, and the bank allowed to re-open for business. Shortly after the reorganization of said bank an amendment was made to its charter changing its name to the Commercial Bank. The Bank of Auburn, Auburn, surrendered its charter and became a branch of the North Georgia Trust Company, Winder; the Bank of Dahlonega reorganized and procured a new charter under the same name. The Bank of Folkston, branch of the Liberty Banking Co., Ludowici, ceased to operate as a branch; the branch of the TREASURER'S REPORT XV Travelers Bank & Trust Company, Atlanta, ceased to operate on account of the parent bank being placed in the hands of a receiver. Receivers were appointed for the Americus Trust & Savings Bank, Americus; Empire State Bank, Atlanta; Travelers Bank & Trust Company, Atlanta; Irish American Bank, Augusta; Bank of Denton, Denton; Farmers State Bank, Hazlehurst; Bank of Rentz, Rentz; and the Uvalda Bank, Uvalda. A charter was granted to the Bank of Bridgeboro, Bridgeboro, but on account of the incorporators of said bank allowing parties, who had not been elected or qualified as officers, to draw checks on said bank, when same had not been established or opened for business, and procure money on said checks, causing several banks to lose funds, and on account of the refusal of said incorporators to pay these obligations after being served each with an official notice by this department, as provided by law, we petitioned the Governor to request the Attorney-General to take the necessary steps to have their charter forfeited, which, we are advised, is being done. This leaves 695 banks in active operation, including 26 branches. HON. W. J. SPEER, State Bank Examiner, Atlanta, Georgia. DEAR SIR : Complying with your request we take pleasure in furnishing herewith statement of the Neal Bank as under date of January 30, 1915. Since filing our report a year ago no dividends have been paid to depositors, and we see no likelihood of a dividend during xviii TREASUEEE 'S REPOET the current year. As indicated in our report of February 4, 1914, we can expect to realize but very little further from item of Loans and Discounts and Stocks and Bonds. At the moment we see no prospects for disposing of the Cuban property in the near future. As to the item of $258,473.44, Alabama Sulphur Ore & Copper Company, we think this of very little value, nor are we able to report any immediate prospects for disposing of this property. Nothing will be realized on items Sundry Collections, Estate of John Neal and Due from Eastern Banks. It would be impossible at this time to state with any accuracy the amount which will be finally realized on assets remaining uncollected. The progress of which has been very slow because of the unusual financial conditions that exist and the fact that some of it was paper that had to be sued in TREASURER'S REPORT xix counties having only two terms of court a year and will probably take twelve months to get judgment and some not due for probably a year and a half yet. A great deal of this paper held by bank was given in, settlement for stock and is of doubtful collection. At this time it is unable to indicate when the affairs of the bank will be ready for liquidation because of the long time paper and because of the assets in other counties that are now pending that may take a year or two to get judgment. Messrs. Felder and Hohenstien, attorneys for the receiver, have charge of the matter and are pushing it as rapidly as conditions and circumstances seem to justify. Respectfully submitted, M. M. Your petitioner would further show that he has attached hereto a list of depositors who have verified their accounts of deposit in said Bank, by properly swearing to the same, in the manner and form as heretofore ordered by the court, which list of depositors and the amount due them is marked schedule "A" and attached hereto. Your petitioner as Receiver, would further show, that he now has in hand more than enough cash to pay ten per cent, of all the aforesaid proven claims as the first dividend. This petitioner would further show, and represent to the court, that in his opinion the total deposit account, after being verified, will not exceed $18,000.00; or, if so, not much more that that, and he therefore has enough cash in hand to pay ten per cent, on all accounts that may be hereafter proven up to that amount, or even more, and he feels that he can safely pay ten per cent, dividend to the depositors whose claims have already been verified and proven. To the Treasurer of the State of Georgia: Bryson Crane, Receiver of Citizens Trust Company, (as successor of James P. Armstrong), appointed by order of the Superior Court of Richmond County, Georgia, respectfully submits this report as to his actings and doings as such Receiver. The sum collected by Bryson Crane, as Receiver of Citizens TREASURER'S REPORT XXV Trust Company, since his appointment, January 7, 1914, to date amounts to $9,298.30, practically this entire sum being realized from collections made on bills receivable, except $1,000 collected as purchase price from sale of an equity in real estate. The amount paid out under proper orders of court since the appointment of the said Bryson Crane, as Receiver, amounts to $7,455.91, and out of this sum practically all the amount of the first dividend of 20 per cent, unpaid at the time of his assumption of the Trust has been paid off, except certain small dividends due depositors that have removed from the city, and who cannot be located. Suit has been instituted against J. P. Armstrong, the predecessor of the present Receiver and the surety on his bond for a sum aggregating $16,906.86, it having been found that the sum mentioned in my previous report of $17,313.13 was a sum somewhat in excess of the amount still owing by the said Receiver, J. P. Armstrong. This suit was instituted almost immediately after the appointment of the undersigned as Receiver, and demurrer has been heard thereon and decided in favor of the Receiver, and the case is on trial in the Superior Court of Richmond County, Georgia, this week. Another suit has been instituted against the directors of the Citizens Trust Company, and after careful preparation, in fact, two suits have been brought, one in the name of the Receiver and another in the name of certain depositors of Citizens Trust Co. This suit is for $100,000.00, and was filed on Feb. 23, 1915. Nearly all the assets of the Citizens Trust Company represented by bills receivable that are collectible have been collected, except that out of the remaining bills receivable still remaining in the hands of the undersigned, on some of which judgments have been obtained and on others of Which suits are pending, there will be collected not less than $3,500.00 and probably the sum of $7,000.00, the $7,000.00 estimate, however, being the ultimate amount that can be hoped for out of the bills receivable still in the hands of the Receiver. This estimated amount of from $3,500.00 to $7,000.00 still in all likelihood collectible on the bills receivable will be increased by such judgments as will be finally obtained on the two suits named above. The amounts xxvi TREASURER 'S REPORT that will finally be realized on these suits, it is impossible at this time to estimate with any degree of accuracy. Beginning with August and for 90 days thereafter, owing to the depressed conditions of business affairs, collections could not be pressed with any degree of success, but since the expiration of this 90 days period collections have become fairly satisfactory. The amount on hand, $1,842.39 when increased by the amount still collectible from bills receivable, which amount is estimated between $3,500.00 and $7,000.00, and when increased by amounts finally realized from the suits named above, against J. P. Armstrong former Eeceiver and his surety, and also that against the directors, less administrative expenses, will form the sum available for the second and final dividend. This dividend should fall somewhere between the percentums of 12 and 20, with reasonable success in collections on notes due the trust estate still collectible and fair success in the outcome of suits pending. However, it is difficult to estimate with any degree of accuracy the amounts that will finally be collected on the two suits described above, especially in regard to the suit for $100,000.00 against the directors of Citizens Trust Company. There will not be a sufficient amount collected until final conclusion of both suits mentioned above to warrant a second dividend, on account of the clerical labor and expense necessary for the disbursement of the comparatively small amount available, until increased by the sums finally realized from the conclusion of these law suits now pending. Any statement as to the time when these suits will be finally concluded would be bare surmise and without value. All of which is respectfully submitted. To the Honorable Henry C. Hammond, Judge of the Superior Court of Richmond County, Georgia-. Irvin Alexander, as Receiver of the Irish American Bank, appointed under order of the Superior Court in the above stated case on January 26, 1913, respectfully presents herewith to your Honor, in accordance with Section 2351 of the Code of Georgia, his returns of receipts and disbursements as such Receiver up to January 1, 1915, properly sworn to and accompanied by vouchers for all items paid out. On November 17, 1914, your Receiver filed a report giving as full information with reference to the condition of the bank as could be had at that time. It is difficult to make a more accurate report now. So far as the Receiver is able to ascertain, the following statement of the face value of the assets and of the liabilities is approximately correct. The actual value of the assets is not given, for reasons stated below. The statement of liabilities will change because some of the banks are making collections on collaterals held by them, and these collections will lessen the item in the statement of assets under "notes pledged to banks,'' and also lessen the liabilities under the item '' due to banks." The amount due to depositors on the verified list may also be changed because some of the depositors may off-set their deposits against indebtedness due to the Receiver. The liability to depositors on the unverified list may change. This list is made up of parties who may claim to be depositors, but who have not turned in their books to be checked up against the books of the bank. It is proper to make this statement in order to show that the statement of assets and liabilities which the Receiver now gives is subject to change. ASSETS. The amount paid for this land was nearly $1,000.00, and responsible local parties in Edgefield estimate its value to be between $1,200.00 and $1 500.00. The bank also owns fourteen vacant lots in the City oi Augusta, on a plat known as Nellieville, which would be worth under normal conditions about $150 a lot. TREASURER'S REPORT ixxix The Receiver is in possession of certain contracts, some of which were executed by the Industrial Lumber Company and some by J. P. Armstrong, and which the Receiver has been contending he has a right to collect. There may be also a few small items of but very little importance from which some collections may be made, but which are difficult to itemize. Taking into consideration, therefore, the assets even at their face value, and deducting the liabilities, there will be a shortage of assets over liabilities of more than $100,000. No one would consider however that the assets are actually worth anything like the face value; and it is impossible to approximate their value. Many of the notes are in suit, some have been reduced to judgment, and the Sheriff has returned "nulla bona" on some of the executions. The Receiver has made diligent efforts for a year now to collect the notes and overdrafts; and some notes, as will be seen, have been in attorneys' hands prior to the failure of the bank in 1913. Their actual value therefore must necessarily be very small. It is proper to state that efforts are now being made to collect from stockholders of the bank their statutory liability to depositors. Some $3,500 has been already collected, notes have been taken from others, while suits have been filed against those who deny their liability or who claim to have the legal right to off-set their deposits against this statutory liability. None of this cash appears on the statement of receipts filed herewith for the reason that all of it was collected after January 1st, and the return is made only up to that time. Your Receiver respectfully asks this his return and report may be passed upon by the Judge and entered on the Minutes by the Clerk, as provided under the statute.
