This represents one of the services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. Other services include bill drafting, research, statutory and Code revision, rendering of opinions, counseling, legislative reference, interim committee staffing, and preparation of reports. The Office of Legislative counsel drafted a total of 4,124 bills, resolutions, and amendments for the 1982 session. Of this number, 616 had been prepared by the conveninq date of the session, leaving a total of 3,508 which were drafted during the session. The other members of the committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who use it. If we may be of service, please feel free to call upon us. ~ Chairman Legislative Services Committee TBM:ml FOREWORD This booklet contains a summary of the general statutes of statewide application which were enacted at the 1982 regular session of the General Assembly of Georgia. No resolutions, ''population'' Acts, or Acts with special application have been included. It would be impractical to minutely analyze each statute because to do so would defeat the main purpose which it is hoped that this booklet accomplishes. It is intended that it be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of each Act without the necessity of reading it in its entirety. It should be pointed out that for specific, detailed information on any particular law, the Act itself should be examined. A notation of the effective date is listed after each Act. I would like to give special credit to Sewell Brumby, Deputy Legislative Counsel, for the preparation of this booklet. The many long hours involved in this project are evidence of his outstanding work and his meticulous attention to detail. This summary is not to be deemed in any manner as an opinion from the Office of Legislative Counsel, and the question of constitutionality has not been considered in any respect. It is hoped that this booklet will benefit all who have occasion to use it and comment and suggestions for improvement are welcomed. Frank H. Act 1541; HB 1110; p. 2306 Requires persons who own or operate agricultural irrigation systems which use in excess of 100,000 gallons of ground waters per day to monitor, record, and report the amount of water withdrawn. Amends 0.C.G.A. Section 12-105. Effective November 1, 1982. Act 1540; HB 1109; p. 2304 Requires persons who own or operate agricultural irrigation systems which use in excess of 100,000 gallons of surface waters per day to monitor, record, and report the amount of water withdrawn. Amends O.C.G.A. Section 12-5-31. Effective November 1, 1982. Act 1501; SB 735; p. 1804 Changes the amount of bond required to be posted by livestock dealers and market operators. Prohibits the licensing of dealers and operators who have previously been involved in the operation of a dealership or market and who have ceased operations without satisfying all liabilities. Amends O.C.G.A. Chapter 4-6. Effective November 1, 1982. - 1- ALCOHOLIC BEVERAGES Act 1359; HB 1437; p. 1111 Increases from 40,000 liters to 378,000 liters of wine the amount which may be produced by wineries which are authorized to sell wine at retail on their premises. Fixes the annual license tax for such wineries at $50.00 per year. Provides that wineries may be so licensed if their wine is made from at least 40 percent of Georgia grown agricultural products and changes the amount of tax levied on wine so produced. Amends O.C.G.A. Sections 3-6-21.l and 3-6-50. Effective April 13, 1982. Act 1438; HB 1252; p. 1463 Provides that state alcoholic beverage license hearings shall not be subject to the "Georgia Administrative Procedure Act." Requires a separate retail license for each place of business dealing in distilled spirits. Specifies procedures to be followed in conducting referendum elections as to the authorization of sales of distilled spirits by the drink. Amends O.C.G.A. Sections 3-2-3, 3-4-91, and 15-13-2 and enacts O.C.G.A. Section 3-4-21.1. Effective April 16, 1982. Act 1508; HB 1906; p. 1855 Provides that the special election as to the authorization of sales of alcoholic beverages by the drink in an area where package sales are not lawful shall be held at the time of holding any other primary or election. Amends O.C.G.A. Section 3-4-92. Effective April 20, 1982. Act 1260; HB 1752; p. 890 Provides that the governing authority of any county or municipality may prohibit the sale of alcoholic beverages on Christmas Day. Amends O.C.G.A. Section 3-3-20. Effective November l, 1982. Act 1219; HB 870; p. 782 Changes from July 1, 1982 to July 1, 1983, the effective date of Official Code of Georgia Annotated Chapter 37-8 - 2- ALCOHOLIC BEVERAGES (continued) relating to comprehensive treatment of alcoholism and intoxication. Enacts O.C.G.A. Section 37-8-53. Effective April 13, 1982. AUTHORITIES Act 1484; HB 1249; p. 1706 Changes the conditions under which the cost of repayment of loans may be included as a part of the 'cost of project' of a project undertaken by a development authority. Provides that development authorities may deal with a director of the authority if the director's interest is disclosed and the director abstains from taking part in the authority's action in the matter. Authorizes development authorities to acquire and develop industrial parks without the existence of a lease contract for the project. Eliminates the requirement that the notice of a development authority's bond issue specify the rate of interest the bonds will bear. Amends O.C.G.A. Chapter 32-62. Effective April 19, 1982. Act 1496; HB 1308; p. 1782 Provides that downtown development authorities may deal with a director of of the authority if the interest of the director is disclosed and the director abstains from participation in the authority's decision as to the transaction. Enacts O.C.G.A. Section 36-62A-l. Effective April 19, 1982. Act 1265; HB 634; p. 906 Provides that in the selection of a depository for funds of a housing authority any commissioner who has a financial interest in the depository under consideration shall disclose his interest and abstain from taking any part in the decision. Amends O.C.G.A. Section 8-3-52. Effective July 1, 1982. - 3- 'AUTHORITIES (continued) Act 1527; SB 550; p. 2228 Authorizes local housing authorities to purchase mortgage loans and make loans for purposes of financing dwelling units suitable for occupancy by persons and families of low and moderate income. Allocates the federally imposed state ceiling on single family residential housing bonds between the Georgia Residential Finance Authority, urban residential finance authorities, and local housing authorities. Enacts O.C.G.A. Sections 8-3-3.l and 8-3-34 and amends 0.C.G.A. Section 8-3-176. Effective April 22, 1982. Act 1213; HB 686; p. 712 Authorizes local hospital authorities to make loans or extend credit to others for the carrying out of projects and to accept and retain security for such advances. Authorizes hospital authorities to provide to and receive from other hospitals and health care facilities management, consulting, and operating services. Amends O.C.G.A. Section 31-7-75. Effective April 13, 1982. BANKING AND FINANCE Act 1455; SB 523; p. 1603 Eliminates the former 12 percent annual interest rate ceiling on bonds issued under the "Revenue Bond Law." Amends O.C.G.A. Section 36-82-122. Effective April 16, 1982. Act 892; SB 666; p. 488 Exempts loans of $5,000.00 or more which are secured by secondary security deeds from all regulation of interest rates and provides that the parties to such a loan transaction may agree upon any interest rate. Amends O.C.G.A. Sections 7-4-31 through 7-4-34 and enacts O.C.G.A. Section 7-4-34.1. Effective April 12, 1982. - 4- BANKING AND FINANCE (continued) Act 852; HB 1447; p. 420 Provides that the parties to a loan having first priority on real estate may agree that past due interest shall be added to the unpaid principal balance and that interest shall be charged thereon. Amends 0.C.G.A. Section 7-4-17. Effective March 11, 1982. Act 1256; HB 1634; p. 879 Increases from $2.50 to $3.50 the fee charged by clerks of the superior courts for filing and indexing financing statements. Amends 0.C.G.A. Section 15-6-77. Effective November l, 1982. Act 1565; HB 1533; p. 2496 Authorizes state chartered credit unions to charge interest rates equal to interest rates charged by federal credit unions. Amends 0.C.G.A. Section 7-1-4. Effective April 22, 1982. Act 1495; SB 650; p. 1781 Provides that state savings and loan associations shall no longer be subject to the laws and regulations applicable to commercial banks with respect to the establishment and operation of branch banks and bank facilities. Provides that the application of a financial institution for conversion to a commercial bank shall be approved only if the financial institution divests itself of all branches which do not conform with the branch banking laws. Amends 0.C.G.A. Section 7-1-293. Effective November 1, 1982. Act 1339; HB 1550; p. 1085 Provides that minors may have third-party payment accounts in building and loan associations and savings and loan associations. Amends 0.C.G.A. Section 7-1-789. Effective april 13, 1982. - 5- BANKING AND FINANCE (continued) Act 1524; SB 480; p. 2219 Requires financial institutions to keep records of and report to the Department of Banking and Finance currency transactions in excess of $10,000.00. Provides that the Georgia Bureau of Investigation and the Department of Revenue shall have access to such reports. Enacts O.C.G.A. Sections 7-1-910 through 7-1-915. Effective November l, 1982. Act 1378; HB 1693; p. 1178 Authorizes the Commissioner of Securities to create by rule a limited offering transactional exemption from state securities regulations and provides for related procedures. Amends O.C.G.A. Section 10-5-9. Effective November l, 1982. CIVIL PRACTICE Act 1385; HB 1838; p. 1187 Changes the rules governing competency of witnesses so as to provide that in any civil proceeding a husband and wife shall each be competent to testify to the adultery of the other. Amends O.C.G.A. Section 24-9-2. Effective April 14, 1982. Act 1555; HB 1352; p. 2374 Provides that depositions and other discovery material in civil actions shall not be required to be filed with the court unless required to be so filed by local rule of court, court order, request of a party to the action, or necessity of use at trial, at a hearing, or to settle a discovery dispute. Enacts O.C.G.A. Section 9-11-29.1. Effective November 1, 1982. Act 1220; HB 883; p. 784 Provides that the dismissal of a civil action for failure of the plaintiff to prosecute does not operate as an adjudication upon the merits. Amends O.C.G.A. Section 9-11-41. Effective July 1, 1982. - 6- CIVIL PRACTICE (continued) Act 1411; SB 505; p. 1262 Provides that the consent of the parties to a judgment in a civil case has the effect of removing any issuable defenses and that after such a consent the court may render judgment without the verdict of a jury. Amends O.C.G.A. Section 9-12-23. Effective November 1, 1982. Act 1448; SB 325; p. 1578 Provides for the effect of judgments in attachment and for the lien created by an execution upon such judgments. Enacts O.C.G.A. Sections 18-3-70 through 18-3-75. Effective April 16, 1982. Act 1252; HB 1584; p. 871 Provides that hearings held under the "Georgia Administrative Procedure Act" may be conducted by means of remote telephonic communications with the consent of all parties. Amends O.C.G.A. Section 50-13-15. Effective April 13, 1982. CORPORATIONS Act 1388; HB 371; p. 1197 Provides that an instrument executed by a corporation to release a security interest shall be effective without the attachment of the corporation's seal if signed by one officer of the corporation or by an individual designated by a proper corporate resolution and that such execution of an instrument shall be conclusive evidence that the officer is authorized. to execute and deliver the instrument. Amends O.C.G.A. Section 14-5-7. Effective July l, 1982. Act 1259; HB 1706; p. 886 Increases from $16.00 to $18.00 the fee paid to clerks of superior court for filing articles of incorporation. Increases from $16.00 to $17.00 the fee for filing articles of amendment, - 7- CORPORATIONS (continued) restated articles, articles of merger or consolidation, and articles of dissolution. Amends O.C.G.A. Sections 14-2-172, 14-2-194, 14-2-196, 14-2-213, 14-2-282, and 14-3-216. Effective April 13, 1982. Act 836; SB 591; p. 156 Provides that shares of a corporation which are held in a fiduciary capacity by a subsidiary which is a financial institution authorized to exercise trust powers may be voted and may be counted in determining the number of shares outstanding. Amends O.C.G.A. Section 14-2-117. Effective February 19, 1982. Act 1208; HB 455; p. 694 Grants to shareholders a right to dissent from any amendment of the articles of incorporation of a corporation which would impose, alter, or abolish any restriction on the transfer of any of the shareholders' shares. Amends O.C.G.A. Section 14-2-250. Effective April 13, 1982. Act 1231; HB 454; p. 807 Makes regulations which are applicable to corporate takeovers also applicable to takeover bids directed at joint-stock associations and certain investment trusts. Amends O.C.G.A. Sections 14-6-1, 14-6-2, 14-6-5, 14-6-14, and 14-6-15. Effective April 13, 1982. Act 1209; HB 456; p. 696 Provides for confidential treatment of registration statements filed in connection with corporate takeovers and hearings held in relation to takeovers. Amends O.C.G.A. Sections 14-6-2 and 14-6-7. Effective April 13, 1982. - 8- COUNTIES AND MUNICIPALITIES Act 1562; HB 1444; p. 2483 Requires counties and municipalities which issue building permits to maintain certain records relating to permit applications and issuance of permits. Amends O.C.G.A. Section 43-15-24. Effective July 1, 1982. Act 1246; HB 1474; p. 853 Provides a formula for distribution to counties and county school boards of any proceeds received by the state from the federal government from sales of timber on military installations in such counties. Enacts O.C.G.A. Section 36-80-15. Effective April 13, 1982. Act 1251; HB 1563; p. 869 Authorizes municipalities which did not make timely application for general purpose grants for fiscal year 1982 funds to make the required filing on or before June 1, 1982. Amends Ga. L. 1967, p. 889. Effective April 13, 1982, and repealed effective November 1, 1982. Act 1234; HB 1205; p. 825 Provides that each militia district within a county must contain at least 200 persons 18 years of age or over, rather than 100 males over 21 years of age as formerly required. Amends O.C.G.A. Section 36-2-2. Effective November l, 1982. COURTS Act 1488; HB 1847; p. 1737 Enacts the "Courts of Limited Jurisdiction Compensation Act of 1982" and directs each county governing authority to select one of two salary compensation plans for compensating small claims court judges, justices of the peace, and certain other judicial officers formerly compensated on a fee basis. Requires such judicial officers to develop a written schedule which ensures that at least one such officer is available at all times for the purpose of issuing search warrants and arrest warrants. - 9- COURTS (continued) Enacts O.C.G.A. Chapter 15-22. Effective May l, 1982. Act 1297; HB 1328; p. 974 Increases from $200.00 to $500.00 the maximum fine which may be imposed by the superior courts for contempt of court. Amends O.C.G.A. Section 15-6-8. Effective April 13, 1982. Act 1274; HB 1327; p. 933 Provides that any court having jurisdiction over a proceeding in which an affidavit of indigence has been filed may on its own motion inquire into the truth of the affidavit and require payment of costs or deny the relief sought if it finds that the costs can be paid. Amends O.C.G.A. Section 9-15-2. Effective November 1, 1982. Act 1356; HB 1421; p. 1106 Provides that notary public commissions may be renewed in person or by mail in the discretion of the clerk of superior court. Requires that a duplicate original of the certificate of appointment be issued to the notary public and presented to the supplier of the notary's seal. Provides that embossment of documents by the notary's seal shall be authorized but not necessary. Amends O.C.G.A. Sections 45-17-5 and 45-17-6. Effective November 1, 1982. Act 1354; HB 1403; p. 1103 Provides that if the board of trustees of a county law library determines that it has funds in excess of those required for the law library then such funds shall be paid to the county governing authority and used for the purchase of furnishings for the courthouse. Amends O.C.G.A. Sections 36-15-7 and 36-15-9. Effective November 1, 1982. - 10 - COURTS (continued) Act 1519; SB 4; p. 2199 Creates a juvenile court in each county in the state and provides for establishment of circuit-wide juvenile court judgeships. Provides for partial state funding for the salary of juvenile court judges. Requires juvenile court referees who are appointed after July 1, 1983, to be law school graduates. Authorizes juvenile courts to suspend the driver's license of or prohibit the issuance of a driver's license to a child who has been adjudicated delinquent. Amends O.C.G.A. Sections 15-11-3, 15-11-10, and 15-11-35. Effective July 1, 1983. Act 1471; SB 655; p. 1659 Increases the sheriff's fees for serving process and for executing and serving warrants from $15.00 to $20.00. Amends O.C.G.A. Section 15-16-21. Effective July 1, 1982. Act 1255; HB 1631; p. 877 Provides that the provisions under which a chief deputy clerk of superior court shall fill a vacancy in the office of clerk of superior court shall apply only to the office of clerk of superior court and not to other county offices. Amends O.C.G.A. Section 15-6-56. Effective April 13, 1982. Act 1380; HB 1714; p. 1180 Provides that the state minimum salary required to be paid to each clerk of superior court who is compensated on a salary basis shall not be reduced if any other court for which a clerk of superior court is serving as clerk is abolished. Amends O.C.G.A. Section 15-6-89. Effective November 1, 1982. Act 1440; HB 1293; p. 1486 Changes the compensation of secretaries of superior court judges and district attorneys. Amends O.C.G.A. Sections 15-6-25 and 15-18-17. Effective July 1, 1982. - 11 - COURTS (continued) Act 1381; HB 1729; p. 1181 Provides that county public defenders may engage in the practice of criminal law outside the duties of their office with the written approval of the senior judge of superior court of the judicial circuit. Amends O.C.G.A. Section 17-12-7. Effective April 14, 1982. Act 1218; HB 823; p. 779 Makes all elected officers and officials ineligible to serve on grand juries while holding elective office and for two years thereafter. Amends O.C.G.A. Section 15-12-60. Effective July 1, 1982. Act 1301; HB 1358; p. 9~2 Provides that the minimum amount payable to law enforcement officers for court attendance shall be the greater of $20.00 or the per diem paid grand jurors during the preceding term of superior court. Amends O.C.G.A. Section 24-10-27. Effective July 1, 1982. Act 1398; HB 1776; p. 1230 Increases the compensation paid to jury commissioners and to clerks of boards of jury commissioners to a minimum of $25.00 for each day's service and authorizes county governing authorities to further increase such compensation by not more than $10.00 for each day's service. Amends O.C.G.A. Section 15-12-24. Effective April 14, 1982. Act 1214; HB 732; p. 718 Provides that the compensation of jurors at coroner's inquests shall be fixed at not less than $5.00 nor more than $25.00 per diem. Amends O.C.G.A. Section 45-16-36. Effective July 1, 1982. - 12 - COURTS (continued) Act 1261; HB 1783; p. 892 Changes requirements as to past volumes of the official reports of the Georgia Court of Appeals and the Georgia Supreme Court which are required to be maintained by the publisher of the reports. Amends O.C.G.A. Sections 50-18-32, 50-18-35, and 50-18-36. Effective April 13, 1982. Act 1211; HB 629; p. 702 Provides that the chief judge of superior court of any judicial circuit may for any county within the circuit discontinue or restore the distribution of any of the Georgia Laws, House and Senate Journals, or Supreme Court and Court of Appeals reports. Provides that at least one set of the appellate reports and session laws shall be distributed to the law library and probate court of each county. Amends O.C.G.A. Sections 50-11-10 and 50-18-31. Effective July 1, 1982. Act 1443; HB 1724; p. 1502 Enumerates the powers and duties of probate courts as assigned by other specific provisions of law. Amends O.C.G.A. Section 15-9-30. Effective November 1, 1982. Act 1460; SB 582; p. 1617 Authorizes probate courts to combine records relating to wills, letters of administration and guardianship, bonds given by administrators and guardians, appraisements, inventories, schedules, accounts, marriage licenses and returns thereon, official bonds, and court minutes into one or more suitable books. Amends O.C.G.A. Section 15-9-37. Effective April 16, 1982. Also requires completion of additional training during each year in which a probate judge is in office. Provides that habeas corpus relief shall not be granted if no timely motion or objection was made at trial unless a show of cause for such noncompliance is made. Amends 0.C.G.A. Act 1472; SB 661; p. 1661 Regulates the operation of real estate promotions and other business promotions in which individuals are notified that they have won a prize and are required to visit a real estate development or other place of business in order to determine which prize has been won. Extensively amends the law relating to racketeering influenced and corrupt organizations (RICO) so as to redefine the term "pattern of racketeering activities", to change the procedures for forfeiture of property, and to provide for RICO liens against property and their foreclosure and effect. Requires foreign corporations to maintain a registered office and registered agent in the state in order to acquire or hold real property in the state. Makes other changes in the RICO law. Act 1554; HB 1349; p. 2370 Redefines the term "counterfeit substances" for purposes of regulation of controlled substances. Creates the crime of distributing a noncontrolled substance upon the express or implied representation that the substance is a controlled substance and provides penalties. Amends O.C.G.A. Act 1550; HB 1283; p. 2359 Creates the felony offense of using mails, telephone, radio or other communication facilities in the commission of a felony offense relating to controlled substances. CRIMINAL PROCEDURE Act 1291; HB 1299; p. 959 Provides that if any person has been admitted to a hospital or morgue as a result of any casualty and is unable to consent to the taking of a blood sample then the peace officer in charge of the investigation may request any licensed physician, registered nurse, or qualified medical or laboratory technician to withdraw blood for analytical purposes. Act 1433; HB 218; p. 1373 Provides for detainers to be filed with the Department of Offender Rehabilitation in cases of inmates awaiting final disposition of appeals and other motions which are pending on any outstanding sentence. Act 1503; SB 579; p. 1807 Authorizes the sentencing of criminal defendants to a term of confinement as a condition of being afforded first offender benefits. Provides for the release to law enforcement agencies of the records of discharge under the first offender law upon certification by the law enforcement agency that the records are needed for a pending criminal investigation. Amends O.C.G.A. Sections 42-8-60 et seq. Effective November 1, 1982. Act 1410; SB 503; p. 1257 Authorizes courts to require defendants who are sentenced to probation to perform community service as a condition of probation. Enacts O.C.G.A. Act 1536; SB 720; p. 2283 Provides that a special term of probation shall be imposed in addition to any other sentence entered in criminal cases involving certain controlled substances violations relating to Schedule II substances and trafficking offenses. Enacts O.C.G.A. Section 42-8-35.1. Effective April 22, 1982. Act 1470; SB 644; p. 1658 Provides that no judgment shall be rendered decreeing the forfeiture of an appearance bond if the defendant has not been brought to trial within a period of three years after the date of posting bond and eliminates provisions relating to forfeiture of bonds of prosecutors to prosecute. Act 1408; SB 482; p. 1254 Changes the amount which may be charged by sureties on criminal bonds to 10 percent of the principal amount of the bond. Amends O.C.G.A. Section 17-6-30. Act 1366; HB 717; p. 1136 Makes current provisions of law relating to cash bonds and deposits of drivers' licenses in lieu of cash bonds in traffic cases also applicable to cases involving violations of motor vehicle and driver licensing laws, size and weight of vehicles and loads, and motor carrier regulations. Amends 0.C.G.A. Sections 17-6-5, 17-6-8, and 17-6-11. Effective July 1, 1982. - 21 - CRIMINAL PROCEDURE (continued) Act 1395; HB 1636; p. 1224 Changes the procedure for forfeiture of appearance bonds so that a bond forfeiture hearing is set immediately upon the failure to appear for a date at least 90 days after failure to appear. Provides that execution shall issue immediately if it is determined at the hearing that the bond should be forfeited. Provides that appearance bonds shall have entered on them the mailing address of the principal and each surety and that a copy of the defendant's notice of arraignment shall be mailed to each surety on the bond as well as to the principal. Enacts O.C.G.A. Section 17-6-73 and amends O.C.G.A. Sections 17-6-31 and 17-7-91. Effective January 1, 1983. Act 1266; HB 723; p. 910 Lists certain serious felonies and prohibits the granting of bail to a person charged with one of those felonies if the defendant has previously been convicted of one of those felonies, is on probation or parole with respect to a previous conviction of one of those felonies, or is on bail or has been released on his own recognizance for one of those felonies. Provides an exception whereby such persons may be released on bail or their own recognizance only if the superior court makes certain required findings after a petition and hearing. Amends 0.C.G.A. Section 17-6-1. Effective November 1, 1982. DOMESTIC RELATIONS Act 1421; SB 624; p. 1287 Authorizes retired state court judges and emeritus state court judges to perform marriage ceremonies. Act 1288; HB 1281; p. 950 Provides that a married person may use as a legal surname his or her spouse's surname, his or her own surname, or his or her surname in conjunction with the - 22 - DOMESTIC RELATIONS (continued) surname of his or her spouse. Provides that applicants for marriage licenses shall designate on the license application form the surnames which will be used by them after their marriage. Enacts O.C.G.A. Section 19-3-33.1. Effective April 13, 1982. Act 1230; HB 307; p. 805 Provides that the domicile of a married person shall not be presumed to be the domicile of that person's spouse. Amends O.C.G.A. Section 19-2-3. Act 1539; HB 993; p. 2300 Authorizes the court in actions for the prevention of family violence to require one or more parties to receive appropriate psychiatric or psychological services. Act 1386; HB 94; p. 1189 Provides that the court in an action involving determination of the award of child custody between the parents of the child may investigate whether child abuse or other acts adversely affecting the health and welfare of the child have occurred upon its own motion as well as upon motion of a party. Act 1431; HB 48; p. 1369 Provides that probate courts shall not have jurisdiction over actions alleging that parental custody of children should be terminated. Amends O.C.G.A. Section 15-9-30. Act 1296; HB 1324; p. 970 Provides that interference with custody of a child shall not constitute the offense of kidnapping but shall constitute the separate offense of interference with custody and provides penalties. - 23 - DOMESTIC RELATIONS (continued) Amends O.C.G.A. Act 1391; HB 1408; p. 1207 Authorizes the Department of Human Resources to provide child support enforcement services in cases where the child does not receive public assistance. Amends O.C.G.A. Sections 19-11-6, 19-11-8, and 19-11-21. Effective April 14, 1982. Act 1390; HB 1407; p. 1204 Provides that unemployment compensation shall be included in earnings subject to recovery under the "Child Support Recovery Act." Authorizes county and circuit child support receivers to bring actions for contempt of court against persons who do not make required payments to them. Amends O.C.G.A. Section 19-11-19 and enacts 0.C.G.A. Section 15-15-4.1. Effective April 14, 1982. Act 1355; HB 1406; p. 1105 Provides that information obtained by the Department of Human Resources pursuant to the "Child Support Recovery Act" may be made available for purposes of enforcing child custody determinations or of enforcing any state or federal law relating to the unlawful taking or restraint of a child. Amends O.C.G.A. Section 9-11-9. Effective April 13, 1982. Act 1394; HB 1547; p. 1221 Provides that in proceedings for the appointment of a guardian of an incapacitated adult the examination of the proposed ward may be performed by a physician authorized to practice medicine in a federal facility if the proposed ward is a patient in that federal facility. Effective April 14, 1982. - 24 - DOMESTIC RELATIONS (continued) Act 1225; HB 1179; p. 796 Provides that the guardian ad litem of a person alleged to be incompetent and in need of a guardian may also be the attorney appointed to represent the alleged incompetent and may be compensated both as guardian ad litem and as the attorney. Provides that guardians ad litem shall receive for each day of service the same fee as is paid to witnesses for attendance at superior court. Amends O.C.G.A. Section 29-5-6. Effective April 13, 1982. EDUCATION Act 1199; SB 253; p. 603 Changes provisions relating to the furnishing of state and local capital outlay funds for educational facilities for local school systems. Amends O.C.G.A. Act 1217; HB 782; p. 776 Amends the "Adequate Program for Education in Georgia Act" so as to establish a system of allotment of state funds to local school systems for services of school food and nutrition personnel. Act 1376; HB 1641; p. 1175 Provides that the certification of appointment or election of county school board members and county school superintendents shall be made by the clerk of superior court in the case of members appointed by the grand jury and by the secretary of the board of education when members are or the superintendent is appointed by the board. Act 1517; HB 1436; p. 2188 Changes procedures for termination or demotion of public school teachers and professional personnel and provides that such procedures shall apply both in the case of an employee who has accepted a contract for four consecutive years from one local school board and an employee who has accepted a contract from a local board of education for two years after having previously accepted contracts for four consecutive years from another local board. Act 1358; HB 1433; p. 1110 Provides that teachers and other professional educators who have held life certificates shall be entitled to retain that lifetime status upon becoming qualified for a next higher level of certification in the same field. Act 1509; SB 710; p. 1860 Establishes a program of grants to Georgia residents for attendance at colleges of osteopathic medicine to be administered by the Georgia Student Finance Authority and the board of regents. Act 1483; HB 589; p. 1699 Authorizes the Georgia Student Finance Authority to make tuition equalization grants to certain Georgia residents who live within 50 miles of an institution of higher education located outside the State of Georgia and who do not live within 50 miles of the nearest four-year institution of the University System of Georgia. Provides for per diem compensation to the members of the Private Colleges and Universities Facilities Authority. Amends O.C.G.A. Sections 20-3-202, 20-3-410, and 20-3-411. Effective June 1, 1982. Act 1262; HB 153; p. 896 Excludes certain emergency, temporary, and other employees from coverage under the health insurance plan for public school employees. ELECTIONS Act 1245; HB 1470; p. 850 Increases the minimum compensation of county voting registrars to $30.00 per day or $225.00 per month for the chief registrar and $27.00 per day or $200.00 per month for the other registrars. Act 866; HB 1410; p. 442 Provides that places used as voter registration places may include but shall not be limited to churches, public housing facilities, public social agencies, public child care centers, public recreation centers, public buildings, shopping centers, multi-family apartment complexes, child care centers, and educational facilities. Act 1206; HB 56; p. 688 Changes the rules for determining residence of married voters so that a person's residence for voting purposes is not required to be the same as that of his or her spouse. Amends 0.C.G.A. Section 21-2-241. Effective April 13, 1982. Act 1400; HB 1825; p. 5040 Amends numerous Acts based on population relating to county boards of elections and county boards of registration and elections so as to update the population criteria upon which the laws are based. Effective July 1, 1982. Act 1425; SB 689; p. 1292 Authorizes the General Assembly by local Act to create a board of elections or board of elections and registration in any county in the state. Provides - 28 - ELECTIONS (continued) that in counties where the voting registrars do not maintain a full-time office any county officer (rather than only the tax commissioner or tax collector) may be appointed to serve as chief deputy registrar. Changes the form of voter registration cards for regular and absentee registration. Provides that in municipalities which do not use the county voter registration system, the county voting registrars shall require completion of voter registration cards in duplicate and shall forward one card to the municipality to be effective as a municipal registration. Provides that municipal registrars shall be appointed as deputy county registrars. Enacts O.C.G.A. Section 21-2-40 and amends O.C.G.A. Sections 21-2-212, 21-2-213, 21-2-217, 21-2-231, 21-2-288, and 21-2-350. Effective November 1, 1982. Act 1474; SB 685; p. 1670 Provides a form of oath for municipal election superintendents. Provides that the dates of municipal elections and qualifying dates shall be fixed by municipal ordinance only if not fixed by the municipal charter. Requires publication of notice of municipal qualifying dates. Removes the requirement that municipal registrars be electors of the municipality and provides that county registrars shall be appointed as deputy municipal registrars of those municipalities which maintain their own registration lists. Provides that registration to vote with a municipality which maintains its own registration list shall be completed in duplicate and that a copy shall be forwarded to the county registrars and shall be effective as a registration to vote with the county registrars. Requires that voters' lists filed by municipal registrars include the addresses and ZIP codes of the voters and a certification of the number of electors by race in each precinct. Revises procedures for challenging qualifications of municipal voters and contesting the results of municipal primaries and elections. Amends O.C.G.A. Chapter 21-3. Effective November 1, 1982. - 29 - ELECTIONS (continued) Act 1445; HB 1900; p. 1512 Substitutes the term "precinct" for the term "election district" in the "Georgia Election Code" and the "Georgia Municipal Election Code." Provides that all precincts established or altered on or after July l, 1983 must be bounded on all sides only by readily distinguishable geographic features which are indicated upon official Department of Transportation maps or by county and municipal boundaries. Requires county and municipal election superintendents to adjust the boundaries of all precincts so as to conform to such requirements no later than January 1, 1984. Requires county and municipal superintendents to file with the Secretary of State current maps of all precincts no later than February l, 1984, and to thereafter file with the Secretary of State maps, court pleadings, federal Voting Rights Act communications, and other documentation necessary to allow the Secretary of State of maintain a current list of all precincts. Amends O.C.G.A. Title 21. Effective January l, 1983. Act 1263; HB 364; p. 897 Changes the distribution of qualifying fees paid to state and county political parties so that 50 percent is retained by the political party and SO percent is paid to the state and county treasuries. Act 1469; SB 639; p. 1653 Changes the law governing recall of public officials so as to require recall petitions to state reasons why the recall is sought. Requires that recall petitions contain statements relating to criminal penalties for bribery with regard to petitions and the effect of petitions and requires that each signer of a petition must read such statements or have them read to him. HEALTH Act 1529; SB 581; p. 2248 Provides for the establishment by the Department of Human Resources of a community care service system having as its primary purpose the prevention of unnecessary institutionalization of functionally impaired elderly persons through the provision of community-based services. INSURANCE Act 1401; SB 207; p. 1234 Provides that optional no-fault motor vehicle insurance benefits must be explained to the insured at the time the insured makes initial application for a policy and eliminates the requirement that such optional coverages be separately accepted or rejected in writing by the insured. Provides that persons insured under policies in effect on November 1, 1982, shall be deemed to have signed the required statement that such optional coverages have been explained to them. Changes the time period of revocation of and procedures for revocation of drivers' licenses and motor vehicle licenses of persons convicted of operating a vehicle without required insurance or falsely certifying that required insurance is in effect. Requires each owner of a motor vehicle to keep proof of required insurance coverage in the vehicle at all times during its operation and requires law enforcement officers to request production of such proof of insurance each time that production of a driver's license is requested. Act 1463; SB 593; p. 1624 Requires all motor vehicle liability insurance policies to contain a provision which requires the insured to send to the insurer copies of all summonses and other processes relating to policy coverage. Changes procedures under which employers cease to be subject to the "Employment Security Law." Prohibits disqualification for benefits of claimants in approved training under the federal Trade Readjustment Act. Effective April 13, 1982. - 40 - LABOR (continued) Act 1201; SB 379; p. 644 Revises provisions relating to use of rating systems by workers' compensation insurers and to filing of rates and rating systems by such insurers with the Insurance Commissioner. Amends O.C.G.A. Sections 33-9-3, 33-9-9, 33-9-21, 33-9-23, and O.C.G.A. Chapter 34-9. Effective January 1, 1984. Act 1563; HB 1464; p. 2485 Provides that determination of disability and bodily loss ratings for purposes of workers' compensation shall be based upon "Guides to the Evaluation of Permanent Impairment" or other recognized medical books or guides. Increases from $115.00 to $135.00 the maximum weekly workers' compensation benefit for total disability. Freezes basic rates charged by workers' compensation insurers until April 1, 1983 unless the insurer proves at a hearing before the Insurance Commissioner that its earned premiums would not equal its incurred loss or expenses or that such rates jeopardize the solvency of the insurer. Makes byssinosis an occupational disease for purposes of workers' compensation. Amends O.C.G.A. Sections 34-9-1, 34-9-261, 34-9-280, and 34-9-281 and enacts O.C.G.A. Section 34-9-130. Effective April 14, 1982. - 41 - MOTOR VEHICLES AND TRAFFIC Act 1424; SB 667; p. 1290 Provides a maximum motor vehicle speed limit of 40 miles per hour in any location which is within or adjacent to a construction or maintenance area if a sign prescribing that speed limit is displayed. Amends O.C.G.A. Section 40-6-181. Effective April 14, 1982. Act 1250; HB 1554; p. 867 Removes the offense of reckless driving from the list of offenses considered in determining who are habitual violators under the driver licensing laws. Amends O.C.G.A. Act 1482; HB 580; p. 1694 Changes the definition of the crime of homicide by vehicle so that failure to stop and render aid at an accident which results in a death constitutes the crime of homicide by vehicle and so that a habitual violator who causes the death of another person by operation of a motor vehicle while his license is in revocation is guilty of the crime of homicide by vehicle. Provides that the offense of homicide by vehicle must be charged as a state law violation rather than as an ordinance violation and that a court which does not have jurisdiction over the state offense of homicide by vehicle shall not have jurisdiction over any other offense arising out of the same conduct which leads to a charge of the state offense of homicide by vehicle. Amends 0.C.G.A. Sections 40-6-376 and 40-6-393. Effective July 1, 1982. Act 1454; SB 506; p. 1601 Increases from six months to 12 months the period of suspension of the driver's license of a person who has been charged with homicide by vehicle and who refuses to submit to tests for determining the alcohol or drug content of his blood. Effective April 16, 1982. - 42 - MOTOR VEHICLES AND TRAFFIC (continued) Act 1465; SB 599; p. 1633 Requires that points which have been assessed against a person's driver's license record must be deducted if the points resulted from a speeding violation based on the use of a radar speed detection device during a period of time in which the Commissioner of Public Safety has determined that the local government was operating the speed detection device unlawfully. Amends O.C.G.A. Section 40-5-57. Effective April 16, 1982. Act 1510; SB 519; p. 1862 Provides that special distinctive driver's licenses shall be issued to persons 16 or 17 years of age and provides for automatic suspension of such licenses upon conviction of driving under the influence or driving 25 or more miles per hour in excess of the speed limit. Provides a minimum fine of $750.00 to be imposed upon persons convicted of operating a motor vehicle after having been declared to be an habitual violator. Amends O.C.G.A. Sections 40-5-26 and 40-5-58. Effective November l, 1982. Act 848; HB 1459; p. 403 Provides that a rejected application for first certificate of title to a motor vehicle shall be returned to the holder of the first security interest or lien named in the application or to the owner. Effective February 16, 1982. - 43 - MOTOR VEHICLES AND TRAFFIC (continued) Act 1475; SB 696; p. 1676 Requires that as a condition of the issuance of a certificate of title for a rebuilt motor vehicle the word "rebuilt" must be permanently affixed to the motor vehicle in a clear and conspicuous manner. Act 1293; HB 1307; p. 964 Increases from 50 cents to $1.00 the additional fee charged to applicants for purchasing motor vehicle license plates or revalidation decals by mail. Amends O.C.G.A. Section 40-2-28. Effective November 1, 1982. Act 1450; SB 489; p. 1584 Eliminates the $2.00 fee for the replacement of lost or defaced county decals for motor vehicle license plates. Provides that it shall be a misdemeanor to operate a motor vehicle without a valid county decal and provides penalties. Provides that special bicentennial motor vehicle license plates issued in 1976 may continue to be used after December 31, 1982. Prohibits the attachment to a motor vehicle of any apparatus which obstructs or hinders the clear display and legibility of the license plate. Amends O.C.G.A. Changes certain provisions relating to required equipment on motor vehicles and authorizes law enforcement officers to inspect without a warrant motor vehicles suspected of equipment violations. Provides for the conditional repeal of the "Georgia Motor Vehicle Emission Inspection and Maintenance Act" upon the effective date of any amendment to the Federal Clean Air Act which would allow the discontinuation of the emission inspection program without a resulting loss of federal funds. Provides, however, that the convicted defendant shall not be so transferred if his attorney files a written request with the court stating that the presence of the convicted person is required within the county of the conviction in order to prepare and - 48 - PENAL MATTERS (continued) prosecute an appeal. Increases from $5.00 to $7.50 per day the amount paid by the state to a county for each day on which a convicted defendant is held by the county after the county has given notice that the convicted defendant is eligible for transfer to the state penal system. Effective November 1, 1982. - 66 - RETIREMENT (continued) Act 1458; SB 555; p. 1610 Changes the formula for computation of interest required to be paid by teachers who are employed by certain independent school systems in order to become members of the Teachers' Retirement System. Act 1387; HB 291; p. 1192 Provides creditable service under the Teachers' Retirement System for certain prior service as a member of certain local retirement funds. Enacts 0.C.G.A. Section 47-3-87.1. Act 1292; HB 1300; p. 961 Provides that any person who is a member of the Trial Judges and Solicitors Retirement Fund who is also required to participate in a county retirement plan may withdraw from either the state retirement plan or the county retirement plan. REVENUE Act 1353; HB 1351; p. 1101 Requires that any person entitled to a freeport exemption from ad valorem taxes file an application for exemption on or before March 1 of the year in which the exemption is sought. Provides that failure to properly apply shall constitute a waiver of the exemption for that year. Enacts Section 48-5-48.1. Effective November l, 1982. Act 1357; HB 1424; p. 1108 Changes from April 1 to March 1 of each year the date by which property must be returned for ad valorem taxation and applications for homestead exemptions must be filed. Effective November l, 1982. - 67 - REVENUE (continued) Act 1558; HB 1375; p. 2382 Authorizes developers of major industrial projects to enter into ad valorem tax prepayment agreements with counties, municipalities, and school boards. Authorizes such local governments as a part of such prepayment agreements to undertake certain programs of public improvements and provides that the total amount of taxes prepaid shall be granted as a credit against taxes otherwise due after completion of the industrial project. Enacts O.C.G.A. Section 48-5-30. Effective April 22, 1982. Act 1566; HB 1742; p. 2497 Provides for tax years beginning on or after January l, 1983, a credit against Georgia income tax to employers for making work place modifications which permit the employment of handicapped persons. Act 1361; HB 1502; p. 1116 Provides that if the fiscal note required to be attached to proposed state legislation affecting state revenues and expenditures cannot contain a dollar estimate as to the effect of the legislation then the fiscal note shall contain an example which provides an indication of the effect of the legislation and shall note the assumptions used to develop the example. Authorizes the legislative committee ta which retirement bills are referred to determine the cost of and contract for actuarial investigation necessary to determine the cost of legislation by vote of a majority of a quorum of the committee. Act 1423; SB 663; p. 1288 Directs the State Auditor at the end of each fiscal year, to the extent that funds are available, to reserve an amount equal to 1 percent of the net revenue collections for the fiscal year to be used as a midyear adjustment reserve fund. Provides that changes in the boundary of an area planning and development commission may be changed only with the approval of a majority of the board members of each affected commission. Act 1512; SB 764; p. 1867 Gives the sonsent of the State of Georgia to the cession of concurrent jurisdiction to the United States of America over lands that are owned by the United States or over which such concurrent jurisdiction is necessary for the effective management of lands owned by the Unite~ States. Provides that cession of concurrent jurisdiction as to individual lands shall be made by the Governor upon application by the United States. Enacts O.C.G.A. Section 50-2-23.1. Act 1267; HB 856; p. 913 Authorizes local public school superintendents and state administrative officials to display durable posters or framed copies representing the national motto, the American flag, and the state flag in public buildings to the extent that such copies or posters are donated or may be purchased with donated funds. Enacts O.C.G.A. Section 50-3-4.1 Effective April 13, 1982. Act 1499; SB 693; p. 1789 Revises the law requiring that public records be open to public inspection so as to provide that the custodian of such - 75 - STATE GOVERNMENT (continued) records shall upon request for access to such records have a reasonable time to determine whether or not such request is required to be granted. Provides that pistol license and firearms possession records maintained by probate judges shall not be open to public inspection.
