Superior court judges hear all felony cases, as well as, divorce cases and other civil matters. The superior courts are organized into 49 judicial circuits created by act of the General Assembly. The number of superior court judges per circuit is also determined by the state Legislature. Circuits are made up of one or more counties. Superior court judges are constitutional officers who are elected to four-year terms in circuit-wide nonpartisan elections. Superior court judges who have retired and taken senior status may hear cases as assigned in any circuit at the request of a local judge or the governor. 7 Superior Court Caseload Calendar Year 2002 (docket entries) Circuit Number of Judges Total Criminal Filed Disposed Alapaha 2 Alcovy 4 Appalachian 2 Atlanta 19 Atlantic 4 Augusta 7 Bell-Forsyth 2 Blue Ridge 2 Brunswick 4 Chattahoochee 6 Cherokee 3 Clayton 4 Cobb 9 Conasauga 4 Cordele 2 Coweta 5 Dougherty 3 Douglas 3 Dublin 2 Eastern 6 Enotah 2 Flint 2 Griffin 4 8 Gwinnett 8 Houston 2 Lookout Mountain 4 Macon 5 Middle 2 Mountain 2 Northeastern 4 Northern 3 Ocmulgee 5 Oconee 2 Ogeechee 3 Pataula 2 Paulding 2 Piedmont 3 Rockdale 2 Rome 4 South Georgia 2 Southern 4 Southwestern 3 Stone Mountain 10 Tallapoosa 2 Tifton 2 Toombs 2 Towaliga 2 Waycross 3 Western 3 Total 188 2,923 4,801 1,927 15,061 1,677 3,916 760 1,503 2,954 3,539 6,141 ,807 6,123 2,174 1,788 3,263 2,850 2,087 1,836 4,075 1,307 1,107 2,735 5,212 1,810 1,721 3,603 992 1,332 1,870 1,725 4,060 1,314 1,690 1,380 1,121 2,004 757 3,373 1,214 3,373 1,965 6,420 952 696 1,330 1,103 1,968 1,359 131,698 2,923 4,802 2,141 17,251 1,789 4,305 760 1,645 3,154 4,081 6,141 3,100 8,387 2,174 1,843 3,791 3,063 2,087 1,936 4,075 1,391 1,314 2,752 5,546 1,958 1,721 3,983 992 1,457 2,024 1,803 4,306 1,341 1,750 1,434 1,269 2,139 810 3,722 1,300 3,701 2,024 8,817 1,030 765 1,397 1,276 2,114 1,359 108,255 Average per judge* 701 576 Unified Appeals Defendants Filed 1 3 0 2 4 0 0 0 1 0 0 1 1 0 1 0 0 8 1 2 2 1 0 5 0 4 1 0 1 1 2 1 0 0 0 2 2 0 1 0 0 0 1 0 0 0 0 3 0 52 0 Felony Filed Disposed 994 1,576 703 11,104 1,146 1,093 468 784 1,459 2,365 1,168 1,863 3,748 1,164 652 2,616 1,522 1,479 735 2,747 577 869 1,906 3,346 992 980 1,452 809 601 1,421 830 1,511 613 1,177 732 390 1,092 492 1,288 758 2,461 669 4,179 335 368 349 596 1,125 1,139 72,443 994 1,576 832 13,294 1,245 1,420 468 923 1,642 2,876 1,168 2,156 6,012 1,164 692 3,131 1,735 1,479 812 2,747 651 1,071 1,923 3,680 1,118 980 1,811 809 711 1,567 902 1,732 623 1,237 786 483 1,214 545 1,502 844 2,779 707 6,576 391 437 401 740 1,255 1,139 84,980 385 452 Misdemeanor Filed Disposed 1,689 1,742 718 0 214 649 34 272 1,198 538 1,035 70 36 764 647 361 0 130 844 52 578 52 283 0 419 737 457 16 379 388 312 1,190 472 79 380 664 634 0 1,498 47 125 714 0 550 106 747 380 221 146 22,567 1,689 1,743 803 0 227 711 34 275 1,215 569 1,035 70 36 764 662 374 0 130 867 52 588 57 283 0 441 737 478 16 394 396 318 1,215 489 79 380 719 647 0 1,633 47 135 735 0 572 106 762 409 237 146 23,275 120 124 Superior Court Caseload Calendar Year 2002 (docket entries) Probation Revocation Cases Filed Total Civil Cases Filed General Civil Cases Filed Domestic Relations Cases Filed Total Criminal & Civil Cases Filed Circuit 239 1,480 506 3,955 313 2,174 258 447 296 636 3,938 873 2,338 246 488 286 1,328 470 256 1,274 150 185 546 1,861 399 0 1,693 167 351 60 581 1,358 229 434 268 65 276 265 586 409 787 582 2,240 67 222 234 127 619 74 36,636 2,237 5,685 2,613 16,251 3,462 9,268 2,002 2,773 4,664 7,895 4,422 4,880 10,587 4,276 2,405 7,007 3,548 2,781 2,791 3,752 2,294 3,951 5,147 14,243 3,136 4,598 5,860 2,703 2,396 4,366 3,385 4,395 2,884 3,545 1,814 3,084 2,044 2,123 4,365 1,766 7,859 3,828 14,230 2,151 2,906 2,524 2,444 4,261 3,249 224,850 998 2,344 1,252 3,685 1,092 2,304 575 530 1,484 2,262 2,418 722 2,464 1,607 922 1,629 1,319 1,424 839 1,779 893 1,241 1,583 4,268 660 1,269 1,281 828 692 1,535 1,085 1,707 896 804 755 1,506 836 635 1,709 599 2,058 1,489 2,222 1,075 894 653 1,129 1,332 1,089 68,372 1,239 3,341 1,361 12,566 2,370 6,964 1,427 2,243 3,180 5,633 2,004 4,158 8,123 2,669 1,483 5,378 2,229 1,357 1,952 1,973 1,401 2,710 3,564 9,975 2,476 3,329 4,579 1,875 1,704 2,831 2,300 2,688 1,988 2,741 1,059 1,578 1,208 1,488 2,656 1,167 5,801 2,339 12,008 1,076 2,012 1,871 1,315 2,929 2,160 156,478 5,160 10,486 4,540 31,312 5,139 13,184 2,762 4,276 7,618 11,434 10,563 7,687 16,710 6,450 4,193 10,270 6,398 4,868 4,627 7,827 3,601 5,058 7,882 19,455 4,946 6,319 9,463 3,695 3,728 6,236 5,110 8,455 4,198 5,235 3,194 4,205 4,048 2,880 7,738 2,980 11,232 5,793 20,650 3,103 3,602 3,854 3,547 6,229 4,608 356,548 Alapaha Alcovy Appalachian Atlanta Atlantic Augusta Bell-Forsyth Blue Ridge Brunswick Chattahoochee Cherokee Clayton Cobb Conasauga Cordele Coweta Dougherty Douglas Dublin Eastern Enotah Flint Griffin Gwinnett 9 Houston Lookout Mountain Macon Middle Mountain Northeastern Northern Ocmulgee Oconee Ogeechee Pataula Paulding Piedmont Rockdale Rome South Georgia Southern Southwestern Stone Mountain Tallapoosa Tifton Toombs Towaliga Waycross Western Total 195 1196 364 832 1,897 10 State Courts State courts are county courts that exercise limited jurisdiction. 16 Juvenile Courts Jurisdiction of the juvenile courts extends to delinquent and unruly children under 17 years of age and deprived and neglected children under 18 years of age. Juvenile court judges have jurisdiction over minors who commit traffic violations or request consent to marry or enlist in the armed forces. Juvenile courts have concurrent jurisdiction with supe- rior courts in child custody and child support cases and in proceedings to terminate parental rights. The purpose of juvenile courts is to protect the well- being of children, provide guidance and control con- ducive to child welfare and the best interest of the state, and secure care for children who have been 17 removed from their homes because of abuse or neglect. Juvenile court judges are appointed by the superior court judges of the circuit to four-year terms. All probate court judges administer oaths of office and issue marriage licenses. They may hold habeas cor- pus hearings or preside over criminal preliminary hear- ings. Unless a jury trial is requested, probate court judges may also hear certain misdemeanors, traffic cases and violations of state game and fish laws in counties where there is no state court. When authorized by local 24 statute, probate judges serve as election supervisors and make appointments to certain local public offices. Magistrate Courts Magistrate court jurisdiction includes: civil claims of $15,000 or less; certain minor criminal offenses; distress warrants and dis- possessory writs; county ordinance violations; deposit account fraud (bad checks); preliminary hearings; and summonses, arrest and search warrants. A chief magis- trate, who may be assisted by one or more magistrates, presides over each of Georgia's 159 magistrate courts. The state legislature created the Judicial Council in 1973; in 1978 the council officially became an administrative arm of the Supreme Court of Georgia. The council considers requests for new judgeships and oversees the activities of the Administrative Office of the Courts and the Board of Court Reporting. Twenty-four representatives of the appellate and trial courts make up the Judicial Council. The chief justice and presiding justice of the Supreme Court act as the chairperson and vice chairperson, respectively. The 45 chief judge and another judge of the Court of Appeals; the presidents and presidents-elect of the superior, state, juvenile, probate and magistrate court councils; and the 10 superior court district administrative judges complete council membership. Members of the Judicial Council met on August 29, 2002, to discuss issues such as recommendations for judgeships, budget concerns, and other matters. The Council's December 4, 2002, meeting involved legisla- tive agendas and budget requests for the upcoming General Assembly session. The last meeting of FY 2003 was held on June 11, 2003, where budget matters were discussed. Serving the Courts Judgeships -- On July 1, 2002, the Paulding Judicial Circuit, created by the General Assembly, began opera- tion. The new circuit, made up of Paulding County, leaves the Tallapoosa Circuit with two counties: Haralson and Polk. Each of these circuits is assigned two superior court judgeships. Also on July 1, the Alcovy Circuit gained a fourth superior court judgeship per legislation passed during the 2002 session of the General Assembly. The Judicial Council approved recommendation of new judgeships in the Gwinnett and Cherokee Judicial Circuits at its meeting on August 29, 2002. The Council's recommendation was forwarded to the gover- nor and the legislature for consideration during the 46 2003 session. However, the enabling legislation failed and no new superior court judgeships were created. Serving the Courts Administrative Office of the Courts The Administrative Office of the Courts provides support services to judges and other court personnel in each class of court: appel- late, superior, state, juvenile, probate, magistrate and municipal. The agency documents caseload informa- tion annually for the courts, provides information tech- nology support, promotes the work of judges' councils, coordinates annual judicial branch appropriations requests, and assists with funding for drug courts and similar efforts. Publications produced by the AOC keep the judiciary and the public up-to-date on activities and issues affecting court administration. The AOC operates under the direction of the Judicial Council of 47 Georgia, a policy-making body chaired by the Chief Justice of the Supreme Court of Georgia. The office is a liaison to other state and national judicial agencies. Serving the Courts Commission on Indigent Defense -- The commission presented its final report to the Supreme Court on December 12, 2002. The report recommends that the state assume full responsibility for providing legal representation to indigents. A new public defender system, based in the 49 judicial circuits, would be administered by a board representative of all areas of the state and made up of people with expertise in the area of indigent defense. The board would establish and enforce caseload standards for operation of local indigent defense programs. Georgia Public Defender Standards Council -- The Georgia General Assembly passed a bill creating a new 48 statewide public defender system during the 2003 leg- islative session. Governor Perdue signed the measure into law on May 22, 2003. The new system, supported by the Chief Justice, is similar to the recommendations made by the Commission on Indigent Defense. A cir- cuit public defender will be hired in each of the 49 judicial circuits to be funded by the General Assembly. Details of the funding mechanism are still to be deter- mined by the legislature.
