The legislation states "the commission shall succeed to all rules, regulations, policies, procedures, and administrative orders of the Department of Education which are in effect on June 30, 1991, and which related to the functions transferred to the commission by this part or any other provisions of the 1991 Act which enacted this part. Such rules, regulations, policies, procedures, and administrative orders shall remain in effect until amended, repealed, superseded, or nullified by proper authority or as otherwise provided by law." The Georgia Professional Standards Commission adopted new rules on December 3, 1992 for the certification of education personnel, effective July 1, 1993. These rules replaced the previous Georgia Professional Standards Commission document of the same title, effective July 1, 1993; the "blue" notebooks containing these rules were disseminated to Georgia's education community in April of 1993. Since 1993, the Commission has periodically amended the rules for the certification of education personnel in accordance with the Georgia Administrative Procedure Act. In April, 1996, the education community in Georgia was notified of proposed amendments to the certification rules and afforded opportunity to submit data, views, or arguments. Certification rules were amended on June 20, 1996, by the Professional Standards Commission, to become effective July 1, 1996; the amended rules are enclosed in the "burgundy" notebooks. These notebooks are available in paper and/or diskette format. An order form has been included for your use. zCm) Oz "'Om :U:u 0 Or- c m:u cr- e:mUn emn Effective July 1, 1997 RULE 505-1-.04 EXCEPTIONS TO A REPORT OF THE HEARING TRIBUNAL OF THE PROFESSIONAL PRACTICES COMMISSION (1) Purpose. The purpose of this rule is to specify the procedures for consideration and final action by the Professional Standards Commission regarding exceptions filed by any party aggrieved by a report of the hearing tribunal of the Professional Practices Commission (PPC). (2) Procedures for Filing and Processing Exceptions. (a) Exception(s) must be filed with the Professional Practices Commission within thirty (30) days after service of the report and will become part of the record. The responsibility for filing transcripts of evidence rests with the party filing the exception(s). (b) Transmission to Professional Standards Commission. The Professional Practices Commission shall, within 10 days of receipt of the exception(s) and the transcripts (if applicable), transmit to the Executive Secretary of the Professional Standards Commission a copy of the exception(s), the original transcript of proceedings of the PPC hearing tribunal with exhibits, and a copy of the report of the PPC hearing tribunal. The exception(s) may be amended any time prior to transmission to the Executive Secretary of the Professional Standards Commission. (c) Briefing schedule. After a determination by the Executive Secretary that the exception(s) and the file are in proper form for review/hearing, the Executive Secretary shall notify the parties of the briefing schedule. Upon the close of the briefing period, the exception(s) shall be docketed and placed on the calendar for a review/hearing at the earliest possible regularly scheduled meeting of the Professional Standards Commission. (d) Oral arguments shall not be heard unless requested by a party or requested by the commission. Arguments will be limited to twenty (20) minutes per party. All oral arguments will be heard at the site of the commission's regularly scheduled meeting. (e) Procedure at Oral Argument. If oral argument is ordered or requested, the appellant "may be represented by counsel. The argument shall be confined to the issues in the record and the evidence transmitted from previous proceedings. No new evidence shall be received. The commission shall not consider any question not specifically raised in the written exception(s) or the statement of contentions, as the case may be. (f) Decision of commission. The commission shall render its decision in a written order to the parties of record within twenty (20) calendar days following the review/hearing. Any appeal of the decision is provided for in a.C.G.A. 50-13-19. (g) Dismissal of Exception(s). Failure to comply with any of the provisions herein may be grounds for dismissal. (h) Severability. The prOVISions of this rule are hereby declared to be severable, and the invalidation of any part hereof shall not affect or invalidate any other part. Authority: C.C.G.A. 20-2-989.01, ZQ-Z-1160, 50-13-41 (a) (Z) (1995 Supp.). -, . 'or 505-1-.04 REVIEW OF INITIAL DECISION OF HEARING OFFICER Effective 7/1 /98 (1 ) Purpose. The purpose of this rule is to specify the procedures for a review of the initial decision of a hearing officer pursuant to a request from the respondent or the Professional Standards Commission. (2) Either the respondent or the commission may seek review of the initial decision of the hearing officer pursuant to O.C.G.A. 50-13-17(a). If the respondent files a timely motion for review of the initial decision of the hearing officer, the respondent shall include therein a statement of the reasons for seeking review and alleged errors made by the hearing officer in the initial decision. The commission's review will be limited to those issues raised by the respondent in respondent's motion for review or by the commission in its order for review. (3) Upon the filing of a timely motion by the respondent seeking review, or upon the filing of a timely order for review by the commission on its own motion, notice of the date and time for the review shall be served on the respondent or counsel for the respondent and staff counsel for the commission. (4) The commission may appoint a hearing officer for review, other than the hearing officer who entered the initial decision, who shall preside over the review proceedings and control the conduct of the review hearing. In acting as presiding officer, the hearing officer for review shall rule on all procedural and evidentiary questions that arise during the course of the review. At the direction of the commission, the hearing officer for review shall draft the final decision for the commission. (5) On review, the commission shall have all the powers it would have in making the initial decision, and in its discretion shall have the power to take additional testimony or remand the case to the original hearing officer for such purpose, as provided in the Administrative Procedure Act O.C.G.A. 50-13-17 and in accordance with this rule. The respondent or respondent's counsel and counsel for the commission shall docket any motion, including motions to present additional evidence, at least fourteen (14) days before the date set for the review hearing. Responses to any such motions shall be docketed at least seven (7) days before the date set for the review hearing. (a) Motions to present additional evidence or to remand the case to the original hearing officer for such purpose shall be granted only if the additional evidence is material and there was good cause for failing to present such evidence before the original hearing officer. The hearing officer for review who acts as presiding officer over the review proceeding shall enter an order as to the legal sufficiency of all motions, including motions for the presentation of additional evidence, prior to the review hearing. (6) Oral argument up to 20 minutes per side is permitted in the review hearing. Additional time for argument must be requested in writing and docketed at least fourteen (14) days before the date set for the review hearing. (7) Once the review hearing is concluded, the commission shall deliberate as to the final decision. Neither the hearing officer for review, nor the respondent, nor his/her counsel, nor the staff counsel arguing the review shall be present during or participate in the deliberations or voting on the final decision. Provided, however, that during the course of the deliberations the commission may seek or obtain legal advice of the commission's counselor make an inquiry on the record concerning either procedure or the merits of the case in the presence of all parties. 505-1-.04 Page 2 ... .;(" (8) At the conclusion of the deliberations, the decision of the commission shall be announced in open session, unless the sanction imposed by the decision is made confidential by statute, in which case it shall be announced in camera to the respondent and counsel for the parties. The commission may take the matter under advisement and continue the deliberations until a date certain if deemed necessary due to the commission's agenda or the complexity of the issues. Authority a.C.G.A. 43-1-14 Effective 7/1/98 505-1-.05 PUBLIC INFORMATION (1) Requests for information concerning the files or documents of the Professional Standards Commission shall be pursuant to the requirements of the Georgia Open Records Act (O.C.G.A.50-18-70). Requests for copies of records that are routinely subject to public inspection may be charged a uniform copying/mailing fee of $.25 per page. Should the information request involve an unusual administrative cost or burden for commission staff, a reasonable additional charge for search and retrieval and other direct administrative costs also may be assessed. (2) Requests must be made in writing to the Executive Secretary of the Professional Standards Commission and must contain the name and address of the person requesting the documents and a description of the documents requested. Authority O.C.G.A. 50-13-70 ..... Effective 7/1/98 505-1-.06 PETITION FOR A DECLARATORY RULING (1 ) Any petition for a declaratory ruling as to the applicability of any statutory provision or any rule or order of the agency shall be in writing to the Executive Secretary of the Professional Standards Commission and shall contain the following: (a) name and address of the person making the request; (b) applicable rule(s), order(s), and/or statute(s); (c) proposed interpretation/application of the rule(s), order(s), and/or statute(s); (d) rationale for the proposed interpretation/application. (2) The Executive Secretary, in consultation with staff and acting on behalf of the commission, shall make a ruling on the petition. Authority a.C.G.A. 50-13-11 Effective 7/1/98 .-; .. 505-1-.07 PETITION FOR PROMULGATION, AMENDMENT. OR REPEAL OF RULE (1) Any petition for the promulgation. amendment. or repeal of any rule of the agency shall be in writing to the Executive Secretary of the Professional Standards Commission and shall contain the following: (a) name and address of the person making the request; (b) applicable rule(s); (c) nature of the request; (d) rationale for the proposed change. (2) The Executive Secretary, in consultation with staff and the commission, shall rule on the petition within 30 days after its submission and either deny the request in writing with reasons for the denial or shall initiate rulemaking proceedings in accordance with the Georgia Administrative Procedures Act. Authority C.C.G.A. 50-13-9 505-2-.01 PRIVACY OF INFORMATION (11 The Family Educational Rights and Privacy Act of 1974 (FERPAI, is a federal law regarding an individual's right to privacy; the Buckley/Pell amendment (Privacy Act) sets extensive guidelines for the release and subsequent use of information from postsecondary education records. (2) Education records, once released by an institution, are the property of the student and may be released only for a specific purpose (Le., employment or certification). The organization receiving the transcripts is responsible for protecting the document owner's privacy. The Certification Section. will not, without the applicant's written authorization, release any information not considered public record under Federal and State Law. (31 Information will not be released to the spouse, parent, sibling or children of an individual without specific written authorization. Confidential information, such as test scores and grades on transcripts, will not be released to an employer. (4) The Certification Section, while maintaining microfilm copies of original transcripts cannot copy or provide copies of transcripts to individuals or to other offices, agencies or institutions except in cases of criminal or Professional Practices Commission investigation. Authority a.C.G.A. 20-2-200 505-2-.02 APPEALS .:. (1) An appeal of an evaluator's decision is begun by requesting a review of the case by the appropriate certification supervisor. Further appeals follow four steps: (a) A review and decision by the Associate Executive Secretary of the Professional Standards Commission; (b) A review and decision by the Executive Secretary of the Professional Standards Commission; (c) A hearing by a certification appeals officer; (d) An appeal to the Professional Standards Commission. (2) Each avenue of appeal shall be exhausted before beginning the next level of appeal. (3) Appeals shall be in writing, filed within fifteen (15) days of the date of notification, and shall contain all of the following in order to be considered for review: (a) The question in dispute and/or the relief sought; (b) The decision of the evaluator; (c) A concise statement describing the nature of the appeal and why it should be granted; (d) Evidence of any kind which supports the appeal including transcripts, physician statements, etc.; and (e) If employed, a letter in support of the appeal from the employer. (4) official. (3) Appeals shall be in writing, filed within fifteen (15) days of the date of notification, and shall contain all of the following in order to be considered for review: (a) The question in dispute and/or the relief sought; (b) The decision of the evaluator; (c) A concise statement describing the nature of the appeal and why it should be granted; .... (d) Evidence of any kind which supports the appeal including transcripts, physician statements, etc.; and (e) If employed, a letter in support of the appeal from the employer. (4) Extensions of time for appeals may be granted to applicants at each level by the reviewing official. Authority a.C.G.A. 20-2-200 505-2-.03 SUSPENSION, REVOCATION, DENIAL, RECALL AND/OR REPRIMAND ..... (1) The Professional Standards Commission is authorized by law to suspend, revoke or deny certificates, licenses and permits, or to issue a written reprimand, for good cause after an investigation is held and notice and a hearing are provided to the certificate, license or permit holder. Anyone of the following grounds shall be considered good cause for suspension, revocation or denial of a certificate, license or permit, or the issuance of a written reprimand against the holder of a certificate, license or permit. (a) Obtaining or attempting to obtain a certificate, license or permit by fraudulent means or through misrepresentation of material facts; (b) Physical, mental or emotional incapacity or unfitness; (c) Commission of an act of moral turpitude; (d) Conviction, plea of guilty or a plea of nolo contendere for violation of a law punishable as a felony or misdemeanor other than a minor traffic violation; (e) Incompetency in discharging assigned duties in the field or fields for which the educator is certified; (f) Violation of ethical standards of the education profession; (g) Revocation of a teaching certificate in another state on grounds consistent with those specified in this rule; (h) Personal conduct that seriously reduces the certificate, license or permit holder's effectiveness in his or her employment position or conduct detrimental to the health, welfare, discipline or morals of pupils; (i) Breach of contract of employment by abandonment of the work assignment without release from the contract of employment by a local board of education. (The suspension for the first abandonment offense shall not exceed one year commencing on the day the order of the Professional Standards Commission is entered into record.); (j) Any other good and sufficient cause. (2) Suspension or revocation automatically applies to all Georgia certificate fields held by the individual, except when a certificate field has been suspended or revoked for incompetency in that area of certification. (3) A certificate, license or permit may be denied for the applicant's failure to meet the qualifications required by the commission or for any of the grounds for which a certificate may be revoked or suspended. If an application for a certificate is denied on the same grounds for which a certificate may be revoked or suspended, any subsequent application for a certificate will not be considered earlier than two years from the date of the initial denial. On appeal, the commission may exercise discretion on a case-by-case basis in considering the required time lapse before reapplication. (4) A certificate may be recalled if it was issued in error. .03-2 .."' .... ':~ :.~~ (5) The commission appropriately notifies local, state and national officials, including the NASDTEC Academ Clearinghouse, for appropriate dissemination of information regarding suspensions, revocations, denials, recalls and reprimands. Authority D.C.G.A. 20-2-200 Effective 7/1/98 ,.- 505-2-.03 SUSPENSION, REVOCATION, DENIAL, RECALL AND/OR REPRIMAND (1 I The Professional Standards Commission is authorized by law to suspend, revoke or deny certificates, licenses and permits, or to issue a written reprimand or warning, for good cause after an investigation is held and notice and a hearing are provided to the certificate, license or permit holder. Anyone of the following grounds shall be considered good cause for suspension, revocation or denial of a certificate, license or permit, or the issuance of a written reprimand or warning against the holder of a certificate, license or permit. (a) Dishonesty. An educator shall not engage in conduct involving dishonesty, fraud, deceit, or misrepresentation in the performance of professional duties. (bl Misrepresentation or Falsification in the Course of Professional Practice. Any falsification or deliberate misrepresentation, including omission of a material fact by an educator concerning any of the following is an unethical act: 1. statement of professional qualifications; 2. application or recommendation for professional empoyment, promotion, or certification, not including a recommendation pursuant to a settlement of disputed facts; 3. application or recommendation for college or university admission, scholarship, grant, academic award, or similar benefit; 4. representation of completion of college or staff development credit; 5. evaluation or grading of students and/or personnel, not including an evaluation or recommendation pursuant to a settlement of disputed facts; 6. submission of financial or program compliance reports submitted to state, federal, or other governmental agencies; 7. submission of information in the course of an official inquiry by the employing school district or the Professional Standards Commission related to acts of unprofessional conduct; provided, however, that an educator shall be entitled to decline to give evidence against himself/herself if such evidence may tend to incriminate the educator as that term is defined by the Fifth Amendment to the United States Constitution and Article 1, Section 1, Paragraph 16 of the Georgia Constitution; or 8. submission of information in the course of an investigation by a law enforcement agency or by child protective services regarding school related criminal activity; provided, however, than an educator shall be entitled to decline to give evidence against himself/herself in any such investigation if the same may tend to incriminate the educator as that term is defined by the Fifth Amendment of the U.S. Constitution, and Article 1, Section 1, Paragraph 16 of the Georgia Constitution. (c) Improper Remunerative Conduct. The solicitation of students or parents of students to purchase equipment, supplies, or services from the educator in a private remunerative capacity is unethical. An educator shall not tutor for remuneration students assigned to his/her classes, unless approved by the local board of education or the superintendent. An educator shall not exploit professional relationships with students, colleagues, parents, school patrons, businesses or school board members for personal gain or private advantage. 505-2-.03 Page 2 . < .... (d) Abuse of Students. Unethical conduct includes the commission by an educator of any sexual exploitation or abusive act with or to a student as defined below: 1. any unlawful sexual act; 2. any solicitation of any unlawful sexual act, whether written, verbal, or physical; 3. any act of child abuse, as defined by law; 4. any act of sexual harassment, as defined by law; or 5. any soliciation, encouragement or consummation of a romantic or physical relationship with a student, or any sexual contact with a student. The definition of the term "romantic relationship" includes "dating" a student or otherwise being involved in an inappropriate social relationship. (e) Confidential Information. An educator shall keep in confidence personally identifiable information regarding students or their family members that has been obtained in the course of professional service, unless disclosure is required by law or is necessary for the personal safety of the student or others. (f) Failure to Make a Required Report. Unethical conduct includes the failure by an educator to make a report required by a.C.G.A. Section 20-2-795.1; Section 19-7-5 or 20-2-1184. Also included herein, the failure by an educator to notify the Professional Standards Commission of a professional colleague's conduct which clearly is in violation of the Standards of Conduct or conduct which constitutes a basis for the revocation, suspension, or denial of the educator's certificate, license or permit. (g) Alcohol or Controlled Substance Abuse. Unethical conduct includes: 1. being under the influence of, possessing, using or consuming on school premises or at school-sponsored activity a Schedule I controlled substance, as defined by a.C.G.A. Section 16-13-25; or a Schedule II, III, IV, or V controlled substance, as defined by a.C.G.A. Sections 16-13-26 through 16-13-29, without a prescription authorizing such use; 2. being under the influence of, possessing, using or consuming an alcoholic beverage on school premises or at a school-sponsored activity involving students; or 3. furnishing alcohol or controlled substance to any student(s). Unprofessional conduct includes the unlawful furnishing of alcohol or a controlled substance(s), as defined in a.C.G.A. Section 16-13-21, to any student by an educator. (h) Criminal Acts. Conviction, plea of guilty or a plea of nolo contendere for violation of a law punishable as a felony or misdemeanor other than a minor traffic violation. (i) Public Funds and Property. The misuse of public funds or property, or funds of a school related organization by an educator is unthical. The failure to account for funds collected by an educator from students or parents is unethical. The fraudulent submission of requests for reimbursement of expenses or for pay is unethical. (j) Abandonment of Contract for Professional Services. Unethical conduct includes the abandonment of a contract for professional services, or the willful refusal to perform the services 505-2-.03 Page 3 ...,.' required by a contract, without the prior approval of the employer, except in case of an emergency beyond the control of the employee. (k) Disciplinary Action Against a Certificate in Another State on Grounds Consistent With Those Specified in This Rule. (I) Non-Payment of Child Support. Drder from a court of competent jurisdition that the certificate should be suspended for non-payment of child support pursuant to D.C.G.A. Section 19-6- 28.1 or notification that the license should be suspended pursuant to D.C.G.A. Section 19-11-9.3. (m) Physical, Mental or Emotional Incapacity or Unfitness. (n) Personal conduct that seriously reduces the certificate, license or permit holder's effectiveness in his or her employment position or conduct detrimental to the health, welfare, discipline or morals of pupils. (0) Any other good and sufficient cause. (2) Suspension or revocation automatically applies to all Georgia certificate fields held by the individual. (3) A certificate, license or permit also may be denied for the applicant's failure to meet the qualifications required by the commission. (4) A certificate may be recalled if it was issued in error. (5) If an order is received according to the stipulations in 505-2-.03 (1) (I), suspension will be automatic and will be for an indefinite period of time. (6) The commission appropriately notifies local, state and national officials, including the NASDTEC Clearinghouse, for appropriate dissemination of information regarding suspensions, revocations, denials, recalls and reprimands. Authority D.C.G.A. 20-2-200 ~-.:. ~.: 505-2-.04 REINSTATEMENT OR RENEWAL OF A SUSPENDED OR REVOKED CERTIFICATE (1) A suspended certificate is automatically reinstated at the end of the suspension period, provided that it did not expire during that time. If the certificate expired during the period of suspension, a new certificate may be secured at the end of the suspension period by making application and by meeting the current applicable certification requirements of the Professional Standards Commission. (2) Any person whose certificate has been suspended may petition for early reinstatement of a suspended certificate or for early renewal of an expired certificate by submitting sufficient evidence to the Georgia Professional Practices Commission that the reason or reasons for the suspension have ceased to be a factor in the performance or conduct of the educator seeking reinstatement. The Professional Practices Commission will make a recommendation regarding reinstatement to the Professional Standards Commission. (3) Revocation of a certificate is permanent subject to the following provisions: (a) Any person whose certificate has been revoked may petition for the right to apply for a new certificate by submitting sufficient evidence to the Georgia Professional Practices Commission that the reason or reasons for the revocation have ceased to be a factor in the performance or conduct of the educator seeking a new certificate. The Professional Practices Commission will make a recommendation regarding the application to the Professional Standards Commission. (b) A period of three years must elapse from the date of the certificate revocation before a petition to apply for a new certificate will be considered by the Professional Practices Commission. If the initial petition to apply for a new certificate is denied, any subsequent petition to apply for a new certificate may not be filed earlier than two years from the date of the previous denial. The Professional Practices Commission reserves the right to consider the time to apply after the initial three-year period on a case-by-case basis. If the Professional Practices Commission recommends approval of the petition to apply to the Professional Standards Commission, and the Professional Standards Commission approves the recommendation, then the individual must satisfy all current certification requirements. Authority a.C.G.A. 20-2-200 Effective 7/1/98 ." 505-2-.04 REINSTATEMENT OR RENEWAL OF A SUSPENDED OR REVOKED CERTIFICATE (1) Reapplication following the denial of a certificate. (a) If an application is denied according to the stipulations of 505-2-.03 (1) (I), a certificate will automatically be granted upon notification by the court or DHR to do so provided current certification requirements are met. (b) If application for a certificate is denied on the same grounds for which a certificate may be revoked or suspended, except under stipulations addressed in 505-2-.03 (1) (I), any subsequent application for a certificate will not be considered earlier than two years from the date of the initial denial; however, the commission in its discretion may establish a shorter time period before reapplication. (2) Reinstatement of a suspended certificate. (a) If the certificate was suspended according to the stipulations of 505-2-.03 (1) (I), it will be reinstated automatically when the commission is notified by the court or DHR to do so provided the certificate has not expired during the period of suspension. If the certificate has expired, current applicable PSC certification requirements must be met prior to reinstatement. (b) A suspended certificate is automatically reinstated at the end of the suspension period, provided that it did not expire during that time. If the certificate expired during the period of suspension, a new certificate may be secured at the end of the suspension period by making application and by meeting the current applicable certification requirements of the Professional Standards Commission. (c) Any person whose certificate has been suspended may petition for early reinstatement of a suspended certificate or for early renewal of an expired certificate by submitting sufficient evidence to the Professional Standards Commission that the reason or reasons for the suspension have ceased to be a factor in the performance or conduct of the educator seeking reinstatement. (b) The applicant has been recommended for certification by the college official authorized to make such recommendations. 1. In order for a Georgia institution's recommendation for certification to be accepted for applicants completing Georgia approved programs on or after 7/1/93, all applicable Special Georgia Requirements (Rule 505-2-.08) and field-specific prerequisites shall be met at the time the college official completes the recommendation form and application for certification is made, including passing the required specific subject matter test and/or other assessment. (c) The recommendation for certification is in a field and at a degree level recognized by the Professional Standards Commission. If the recommendation is in an area recognized in Georgia as an endorsement only, the applicant will be issued a professional certificate in that field. (d) Prerequisites to higher certificates will not be specified if the individual has completed an approved teacher education program at a higher degree level. (2) College recommendations for certification are also honored when, as a post-degree student, an individual completes a non-degree preparation sequence based on college advisement. (3) Special Georgia Requirements, recency-of-study, and experience requirements specific to certain fields shall be required. If one or more of these are missing, a one-year certificate may be issued at the request of an employing Georgia superintendent except as excluded in paragraph (1) (b) 1. of this rule. (4) The Professional Standards Commission shall certify applicants in endorsement fields who have completed PSC approved staff development certification programs. (a) The applicant has been recommended for certification by the official authorized to make such recommendations. Authority a.C.G.A. 20-2-200 505-2-.07 CERTIFICATION BY EVALUATION (1) Evaluations for certification are provided only to determine or establish one's eligibility for a provisional certificate, to determine requirements needed to add a field, and to determine renewal requirements for previously held Georgia certificates. Effective 7-1-93, the commission will no longer outline specific professional education course work requirements to establish the initial professional certificate (except for level one and two Vocational Education certificate fields); however, any evaluation prepared prior to July 1, 1993, will be honored as long as the evaluation is valid. (2) Evaluations are not provided for certification beyond the current degree level held by the applicant. (3) Depending on the type of evaluation being prepared, five components may be considered: (a) General Education - the core curriculum in the undergraduate program, including: 1. 20 quarter hours in humanities with a minimum of 10 quarter hours in English; 2. 10 quarter hours in mathematics and 10 quarter hours in science; and 3. 20 quarter hours in social science. (b) Content Area - courses in the academic or professional area specific to the field of certification; (c) Professional Education - courses and practicum studies related to education foundations, curriculum, methods and practice; (d) Special Georgia Requirements; and (e) Any prerequisites or experience requirements specific to a field of certification. (4) Requirements needed to satisfy paragraph (3), subparagraphs (b) through (e), when applicable, will be outlined in the specific field rule; General Education requirements will be reviewed and possibly outlined only when an evaluation for a provisional certificate is being processed. (5) After the transcripts and other documentation have been reviewed, a letter is sent to the applicant outlining course work and/or other requirements that must be satisfied in order to become eligible for the requested certification field. (6) Evaluations, as well as other correspondence from the certification section, shall be valid for three years from the date prepared. Any evaluation for certification prepared prior to 7-1-93, will be honored as long as the evaluation is valid when application for certification is made and is included as part of the certification application package. (7) An evaluation to detennine one's eligibility for a provisional certificate may be done under the following conditions: (a) The applicant possesses a bachelor's (or higher) degree from a regionally accredited college or university (except for level one and two Vocational Educational Education fields); (b) The applicant has a grade point average of 2.5 or higher on a 4.0 scale OR has been admitted to or completed a master's degree or higher from a regionally accredited college or university. Authority O.C.G.A. 20-2-200 505-2-.08 SPECIAL GEORGIA REQUIREMENTS ... , ~. (1) All applicants for certification in Georgia shall satisfy certain Special Georgia Requirements. These requirements do not apply to individuals holding Georgia certification in fields with valid life status unless their certification status changes. (a) Certification Assessment Program. An applicant for certification in Georgia must pass content knowledge assessments appropriate to the field of certification and/or other assessment(s) as required by the Professional Standards Commission. Specific assessments have not been developed for all fields. 1. An applicant may be exempt from passing the PSC content knowledge assessment(s) for one of the following reasons: (i) holding or having held a professional certificate in another state, and having passed the appropriate statewide or national content knowledge assessment(s) required in that state for that certificate field. (ii) holding National Board for Professional Teaching Standards (NBPTS) valid certification in a specific field. 2. Required Assessments, Administration Procedures, and Assessment Development. (i) The required assessment(s) for all Georgia teaching, service, leadership, and vocational fields are outlined annually in PSC-adopted materials (e.g., policies, procedures, bulletins, etc.). (ii) Assessment requirements, outlined in PSC-adopted materials (e.g., policies, procedures, bulletins, etc.), including registration procedures, administration and participation requirements, and scoring and reporting procedures shall be followed. Special administration procedures may be arranged for examinees with documented handicaps. (iii) All assessment development work and standard setting procedures will be in accordance with accepted testing practice as outlined by appropriate professional bodies (e.g., National Council on Measurement in Education, American Psychological Association, American Educational Research Association). The Professional Standards Commission has the ultimate authority for setting passing standards on each assessment. (b) Standards of Conduct. An applicant for certification in Georgia must comply with the ethical standards of the profession. (Refer to Rules 505-2-.03, 506-5-.01 and.02.) (c) Recency of Study/Experience. An applicant for certification in Georgia must verify recent study or experience within five years preceding the date of application. (Refer to Rule 505-2-.37.) (d) Special Education. (D.C.G.A. 20-2-201). Any person certified in a teaching field, the leadership field of Educational Leadership, and/or the service fields of Media Specialist and School Counseling shall complete course work, approved by the Professional Standards Commission, in the identification and education of children who have special educational needs, or the equivalent through a Georgia approved staff development program. Holding National Board for Professional Teaching Standards (NBPTS) valid certification will satisfy the special education requirement. .08-2 (e) Teaching of Reading. Any person certified in the fields of Elementary Education, Early Childhood Education, Middle Grades, Mental Retardation, Learning Disabilities, Behavior Disorders, Interrelated Special Education, Interrelated Special Education/Early Childhood, and English shall complete course work, approved by the Professional Standards Commission, in the Teaching of Reading, or the equivalent through a Georgia approved staff development program. Holding National Board for Professional Teaching Standards (NBPTS) valid certification in a specific field for which the teaching of reading is required will satisfy the reading requirement for that field. "I, 505-2-.09 INFIELD STATEMENT (1) The Professional Standards Commission recognizes that practicing in-field is both desirable and necessary for the effective and efficient operation of local school systems. Recognizing that the children and youth of Georgia are entitled to a high quality educational program, and that it is more likely to be achieved through practicing in-field, the commission shall assure that all educators are certified and have the appropriate competencies to be assigned in their particular area of expertise. (a) Professional personnel shall be considered as being in-field if they hold a valid certificate and are assigned the majority of the school day on the grade level(s) and in the field(s) for which they are certified. These individuals may be used for the minor part of the school day in other grade levels or subject areas provided they have at least twenty (20) quarter hours of course work in each area taught. (b) Professional personnel employed in local systems who are performing duties "out-of-field" may be considered in-field (e.g., for purposes of state funding, assignment, salary, etc.) provided they meet the requirements to qualify for a probationary certificate. (2) Several areas of assignment do not require a specific certificate field in order to meet in-field requirements, although a certificate in some field is required. These fields include: (a) Computer Science - An individual with a full-field professional teaching certificate is in-field to teach computer science in grades P-12. (b) Hospital/Homebound - An individual with a full-field professional teaching certificate is infield to teach hospital/homebound students in grades P-12. (c) In-School Suspension - An individual with a valid certificate is in-field to teach in-school suspension students in grades P-12. (3) Several areas of responsibility do not require a certificate of any type to meet in-field requirements. These areas of responsibility include but are not limited to: finance, transportation, public relations, personnel, staff development, facilities, planning, evaluation, research, assessment and technology coordination. (Curriculum and instruction are specifically excluded from this list. Individuals with these responsibilities must be appropriately certified.) For areas in which the commission does not issue a specific certificate, local units of administration may employ individuals without certification. If, however, a certificate is held in any field, the individual can be listed on the Certificated Personnel Information (CPI) Report. (4) Local school systems are authorized to employ individuals to work in pre-kindergarten regular education programs who do not hold commission certification or licensure. Authority a.C.G.A. 20-2-200 505-2-.10 CLASSIFICATION: TYPE, TITLE, LEVEL, FIELD, CATEGORY (1) Certification is classified according to type, title, level, field, and category. The commission has authorized the issuance of certificates under the following classification system. (a) Types of certification recognize three school personnel functions defined as teaching, leadership and service. All fields shall be grouped under one of these functions. 1. Teaching certificates are issued in fields that prepare an individual to teach the subject matter offered as a part of the school curriculum. These certificates are identified by the letter "T." 2. Leadership certificates are issued in fields that prepare an individual to administer or supervise a school system, school or school program. These certificates are identified by the letter "L." 3. Service certificates are issued in fields that prepare an individual to provide support services to students, school personnel and school operations. These certificates are identified by the letter "S." (b) Titles of certificates recognize an individual's status and indicate the extent to which the requirements for current and continued certification have been satisfied. The commission authorizes the issuance of certificates under seven titles, with a condition attached to the first three. This condition requires that an employer in Georgia request the certificate jointly with the applicant. Not all titles are issued for all types or fields of certification 1. Provisional certificates are issued to individuals who have satisfied the minimum job-entry level requirements for a specific field. Provisional certificates are identified by the letter "B." 2. Probationary certificates are issued to professionally certified individuals. who are completing ....... requirements to add a new field of certification while they are employed in the field being added. Initial probationary certificates are not issued in certain fields. Probationary certificates are identified by the letters "PA." 3. Emergency certificates are issued to teachers who lack renewal credit, recent study, and/or the appropriate assessment(s) under certain conditions. Such certificates are issued in teaching or service fields only. Emergency certificates are identified by the letter" E." 4. Nonrenewable professional certificates recognize initial preparation for certification in the field. During the validity period of the certificate, the individual must upgrade to the next education level in a specific field as specified in the evaluation that accompanies the certificate. Nonrenewable professional certificates are identified by the letter "N." 5. Professional renewable certificates are issued to individuals employed in all school personnel functions who completed applicable requirements Professional renewable certificates are identified by the letters T, S or L, depending on the type of certificate. 6. Performance-based certificates recognize professionally prepared school personnel who have satisfied special Georgia course requirements and performance requirements. Performance-based certificates are applicable to most teaching fields and the service field of speech and language pathology and are identified by the letters "PB." .10-2 7. Life professional certificates were issued to individuals who qualified for life certification before July 1, 1974, and may be issued as duplicates to those who have continued to earn the acceptable school experience required to maintain life certification. The life status remains in effect as long as the holder is not absent from acceptable experience for any seven consecutive years from the date of issue. Individuals who have not met the appropriate experience requirements to maintain a life certificate may obtain a renewable certificate in their field. Individuals who currently hold active life status in a field may maintain life status in that field when a higher certificate level is earned. No new life certificates shall be issued nor shall fields be added to the life certificate category. Life certificates are identified by the letter "D. H (c) Level of certification - Prior to July 1, 1993, certificates were issued in field by level. Certificates were issued on the basis of earned degrees and the level of certification recognized the degree level attained in a particular field. Individuals with certification in more than one field often had multiple certification levels. Effective July 1, 1993, fields of certification will be established upon the completion of minimal formal requirements for the field including earned degrees. (Nonrenewable fields will continue to require a higher level of education in the field to reach clear renewable status). The commission shall assign a single certification level to accompany all fields held by an individual. Level of certification shall recognize the commission's determined equivalent of an individual's level of educatior:. The commission shall determine equivalent certification levels for various degrees and majors. The assignment of a certification level to various degrees and majors is contingent on the following: 1) a valid certificate field being held; 2) the degree being from a regionally accredited institution (Rule 505-2-.35); and 3) the degree and/or major meeting the commission's rules on acceptable credits and degrees (Rule 505-2-.36). Generally, the rationale for the assignment of certification level recognizes the academic hierarchy of degrees awarded within a discipline. Not all academic disciplines have a full range of levels. and the length and number of hours in degree programs vary. Traditionally, degrees within a discipline are granted at initial, intermediate and terminal levels. The commission's determined certification level may be equal to or less than an individual's highest recognized level of education. 1. General requirements for recognizing levels of education follow. (i) Level One - (Vocational Education fields only) a minimum of the completion of a high school diploma or the GED equivalent. (ii) Level Two - (Vocational Education fields only) a minimum of an associate's degree or one of the following options: (I) an associate's degree or 90 quarter hours of acceptable college credit; (II) a two-year program consisting of a minimum of 2,000 clock hours through a regionally accredited postsecondary vocational/technical school in the field in which certification is requested; (III) a minimum of 45 quarter hours of acceptable college credit or university credit and a minimum of 1,000 clock hours through an accredited vocational/technical school in the field in which certification is requested. (iii) Level Four - generally, a minimum of a bachelor's degree or the commission's determined equivalent (e.g., B.A., Pharm.D., D.C.). (iv) Level Five - generally, a minimum of a master's degree or the commission's determined equivalent (e.g., M.Ed., M.S.W., J.D., 0.0.1. . ') .10-3 (v) Level Six - generally, a minimum of an education specialist's degree; completion of all requirements for a level seven doctoral degree except the dissertation and unconditional admission to candidacy; or the commission's determined equivalent (e.g., Ed.S., Diploma of Advanced Study in Teaching, D.B.A., M.D.). (vi) Level Seven - generally, a minimum of a Ph.D. or Ed.D. degree or the commission's determined equivalent (e.g., J.S.D.). Degrees with "doctoral" or "doctorate" in the degree title may result in a certification level of four, five, six, or seven. 2. Certification levels assigned to various degrees and majors. Effective July 1, 1993, please be advised that individuals who currently hold active life status in a field may maintain life status in that field when a higher certificate level is earned. These individuals, if they are just changing level, should not be called for any Georgia special requirements (course work or TCT). Currently, conditional certificates exist where individuals upgrading a level in the same life field have been called for the special education course. Please be advised that if these individuals apply for a certification transaction where they have not met the Georgia special requirements which we are no longer calling them for effective July 1, 1993, these certificates are to be issued. 2. If an individual is adding a new field to an existing field that has valid life status, the individual must meet special Georgia requirements, including course work and the TCT for the new field being added. NOTE: If either Early Childhood Education or Middle Grades Education is added to an existing field of Elementary (life status), both Early Childhood and Middle Grades Education are considered as new fields. 3. Endorsement teaching fields can be issued as life certificate fields if the base field it endorses holds current life status; however, no other new life certificates, other than endorsements, shall be issued nor shall fields be added to the life certificate category. 4. Please be advised that in order to honor a college recommendation where an individual is achieving a higher degree in a certificate field that holds current life status, the college should be responsible for putting an asterisk on the TCT section and stating that life status is still in effect and attaching an experience verification form. The only exception would be if the college has read on the certification channel screen that a certificate has been issued within the last twelve months. CJN/jpc ) . ".-:. 't" .' . ./ 505-2-.11 VALIDITY PERIODS AND DATING OF CERTIFICATES (1) Validity periods for certificate fields are used in conjunction with types and titles to determine one's certification classification category. Certificate fields are issued with specific validity periods depending upon this classification. (a) The initial Clear Renewable certificate will be valid for five years and will determine one's renewal cycle. Fields added to the Clear Renewable category will retain the same expiration date as the original; the beginning validity may vary depending upon the date requirements for the field are completed. (b) The validity period for conditional certificates will vary depending on the outstanding conditions required to obtain the Clear Renewable. These requirements will be outlined in correspondence from the certification office at the time of issue as well as on the field-page rules. (2) The dating of certificates rule regulates the effective date of a certification level or field validity period. The following general rules are governed by the date the complete application package is received by the Certification Section of the Professional Standards Commission. (a) Certificates shall not be backdated prior to July 1 regardless of the date requirements are met if the complete application package for the transaction is received on or after July 1. In order for the validity period to be prior to July 1, the complete package must be received in the certification office prior to that date. (b) The beginning date of Clear Renewable and Life certificates will be determined by the method of certification . 1. Certificates based on completion of an approved degree program shall be effective from the date the institution certifies on the official transcript that all degree requirements were completed or July 1, whichever is more recent 2. Certificates based on completion of an approved program (subsequent to the degree) shall be effective from the date all program requirements were completed or July 1, whichever is more recent. 3. Certificates based on an evaluation from the PSC shall be effective from the date the final requirements for the certificate are completed or July 1, whichever is more recent. (i) If experience requirements for a certificate are completed during the school year, the certificate will be effective from the following July 1. (c) The beginning validity date of Conditional certificates will follow the rules outlined for Clear Renewable certificates with the following exception 1. Any Conditional certificate (excluding nonrenewable fields) issued to an individual who becomes employed on after January 1, will be valid from the first day of the month in which employed. (d) Certificates are dated to expire on June 30 of the last year of validity (which will vary depending on the certification classification/category). Authority a.C.G.A. 20-2-203 - 20-2-200 505-2-.12 Reserved 505-2-.13 STANDARD RENEWAL REQUIREMENTS (1) Clear Renewable certificates shall be renewed by earning 10 quarter hours of acceptable resident college credit or Georgia staff development credit specifically approved for certification renewal and by passing an appropriate assessment{s). Renewal credit for certificates that are currently valid must have been completed within the five-year period preceding the expiration of the certificate and within the established validity period for the individual. If renewing a certificate expired for five years or less, the credit must be completed within the five years preceding the date application for renewal is made. (a) Refer to Rule 505-2-.38 Reinstatement of Certificates if the certificate has been expired for more than five years. (b) Achieving National Board for Professional Teaching Standards (NBPTS) certification during a renewal cycle will renew all clear renewable fields for either the next cycle or the subsequent five-year cycle. (c) Submission of a valid State of Georgia license issued by the Examining Boards Division of the Office of the Secretary of State, O.C.G.A. Title 43 (e.g., Speech/Language Pathologist, Audiologist, Psychologist), will renew all PSC clear renewable field(s). (2) Ten quarter hours or staff development units will renew all clear renewable fields as long as the credit is taken with the five-year renewal cycle as determined by the expiration date. Any course taken within the five-year period prior to expiration can be used to renew unless the course work was required to convert an Emergency certificate from the conditional category to the clear renewable ',.t.' category. (3) Applications for standard renewal will be accepted after October 1 of the school year in which the certificate expires. (4) The following types of credit are acceptable for renewing clear renewable certificates provided the course work is completed during the appropriate time frame as outlined earlier. Any combination of these is acceptable. (a) Any of the special Georgia courses required to extend a certificate may be used to meet renewal requirements. Any Special Georgia Requirement course that has not been completed must be completed as part of the credit required to renew the certificate. (b) Course work taken to add a new field or type of certification to an existing certificate. (c) Course work earned to renew a probationary certificate. (d) Course work earned specifically for renewal with the approval of an employing Georgia superintendent. (e) Course work taken in the content of the certificate field{s) or professional education course work addressing the certification or the age level of the learners covered by the certificate, provided that it does not duplicate previously taken course work. (f) Course work earned as part of a degree program at a regionally accredited college or university in education with the approval of a college advisor. .13-2 (5) A qualifying score on the appropriate assessment(s) approved by the PSC is required for each field of certification being renewed in accordance with Rule 505-2-.08. (2) A professional certificate is defined as one for which the applicant has met all course requirements in the state of issuance. Requirements of experience and assessment (unless required for a degree) are not included in the definition. (e.g., Some states do not issue a "professional" certificate until the individual has earned five years of acceptable experience on that certificate; if the five years of experience is the only requirement lacking to obtain a "professional" title, Georgia will accept the certificate.) A letter of eligibility for a professional certificate may be substituted for the actual certificate if the transferring state requires employment for issuance. (a) The applicant holds a bachelor's or higher degree (b) The applicant meets all applicable Special Georgia Requirements. 1. Those applicants who are otherwise eligible for certification except for the Special Georgia Requirements, may be issued a professional certificate for one year if requested by a Georgia employer. 2. All Special Georgia Requirements must be completed within the first year of employment and certification for continued Georgia certification. (c) The Georgia certificate issued will be a comparable certificate (type/field) to the certificate held in the other state, District of Columbia, U.S. territory, NBPTS or DODDS. 1. Certification level will be determined by the Professional Standards Commission. 2. Applicants holding out-of-state certification in areas recognized as endorsements only in Georgia will be issued a professional certificate in that field. 3. Applicants holding certification in fields not recognized for certification in Georgia must meet minimum standards for a recognized Georgia field. (1) Permitted personnel are defined as those persons who may not qualify for professional certificates, including retired teachers, but who function in the same manner as certificated personnel. Such personnel qualify for their positions on the basis of experience rather than formal education. (O.C.G.A. 20-2-204) (a) Permitted personnel may be retired educators; military or government personnel; business or professional persons (banker, lawyer, doctor, etc.); foreign language native speakers; college teachers; performing artists; or others. (b) Permitted personnel will not be considered as certified personnel for the purpose of coaching athletics. (c) The individual must have a minimum of three years of work or related experience in the field/area where he or she will serve; or, in the case of a foreign language native speaker, must have received an "advanced" or higher rating on the Oral Proficiency Interview (OPI) or have passed the appropriate assessment(s) per Rule 505-2-.08 applicable to the foreign language field. (d) The individual must have, as a minimum, a bachelor's degree from a regionally accredited institution, except for performing artists. In the case of the foreign language native speaker, the degree from the foreign country must be, at a minimum, equivalent to the bachelor's degree in the United States. (e) There must be verified extenuating circumstances, including verification that no acceptable certified personnel are available to serve in this capacity. (f) Permits may be granted in the teaching fields and the field of superintendent only. O.C.G.A. 20-2-101 authorizes the PSC to define acceptable business or management experience as an option to the minimum certificate required to qualify for appointment as county or independent school superintendent. (2) A foreign language native speaker, or an individual with native fluency, may receive a permit to teach a language or ESOL under the following conditions. (a) The applicant is proficient in English. (b) The applicant must have received a rating of at least" Advanced" on the Oral Proficiency Interview (OPI) administered in the declared language. The OPI is a nationally accepted measurement of oral language skill and is used by the federal government to assess one's ability to function using oral language. The OPI must be administered by a certified examiner from the American Council on the Teaching of Foreign Languages (ACTFL). The validation of "native-speaker ability" through the OPt is completely the responsibility of the applicant and the school system. (3) Resource Support: Each school shall establish a mentor system in order to provide permitted personnel with orientation to the school, guidance for basic principles of classroom management, and induction support as they adjust to the school situation. A professional development plan shall be developed and implemented for permitted personnel. This plan shall address the development and assessment of teacher competence in the areas of learner characteristics, curriculum and methods specific to the age level and certificate field requested. It is appropriate for the plan to include prescribed course work. Example: A course in methods for teaching foreign languages in grades P-8 might be required for native speakers permitted to teach foreign languages. (4) Validity: Permits are renewable annually upon the request of the local school system. (a) The appropriate assessment(s) must be passed before the permit may be renewed, if available in the field. (5) Aoolication: The local school system superintendent or designee shall complete Form 0242 (Request for Permit) supplied by the Professional Standards Commission. Submission of this form verifies the following: (a) There are no acceptable, qualified (certified) teachers available for this position. (b) Requests for permitted personnel must be made after July 1 prior to the school year in which they will be employed. (c) The Executive Secretary of the Professional Standards Commission shall approve or disapprove the request for permitted personnel. (d) Permits are not transferable from one local system to another. (e) A level of four, five, six, or seven will be posted on the permit based on the permitted individual's determined certification level. (f) field. Authority a.C.G.A. 20-2-204 505-2-.18 SUBSTITUTE TEACHERS (1 ) Definitions (a) Substitute teacher - an individual employed to serve in the absence of the regularly employed teacher. The term substitute teacher also applies to a person temporarily employed to teach a class that does not have a regular teacher. (b) Substitute teacher list - a list of persons approved by the local board of education or its designee to serve as substitute teachers. (2) Requirements (a) Each local unit of administration shall maintain and employ from a substitute teacher list. (b) Priority shall be given to persons with the highest qualifications. The qualifications are ranked as follows: 1. Possession of a valid or expired professional teaching certificate (or letter of eligibility for the same) based on a baccalaureate degree or higher; 2. Completion of a baccalaureate degree or higher; 3. Completion of at least one or more years of postsecondary training beyond a high school diploma ranked in order of number of years completed; ....... 4. Possession of a high school diploma; 5. Possession of a GED certificate. (c) A substitute teacher having qualifications lower on the priority list may be employed if that person has performed effectively on previous occasions, and/or has the appropriate in-field expertise. (d) As a minimum, each substitute teacher shall hold a high school diploma or its equivalent (GED certificate) and have participated in at least four hours of initial substitute teacher training provided by a local unit of administration (LUA). (e) Any classroom-teacher absence or vacancy that lasts 46 or more consecutive days in a school year shall be filled with a certified in-field teacher, except in situations where longer periods of time are required by state or federal law. (f) Substitute teachers who hold only a high school diploma or GED certificate shall not work in anyone classroom more than 10 consecutive days. (g) School leadership personnel shall ensure that instructional leadership and classroom management are maintained by the substitute teacher to assure minimal interruption of student progress. (h) Prior to placing any individual on the substitute teacher list, the LUA shall provide four hours of initial substitute training. Those individuals who possess a valid or expired professional teaching certificate (or letter of eligibility for the same) are exempt from this requirement. Authoritye.C.G.A 20-2-216 ..~: :. 505-2-.19 PARAPROFESSIONALS AND AIDES (1 ) Definitions (a) Aide - a person with less than a professional training who takes no independent actions and has no decision-making authority but performs routine tasks assigned by personnel with higher certification. (b) Paraprofessional - a person who relates in role and function to a professional and who does a portion of the professional's job or task under the supervision of a professional. The paraprofessional has some decision-making authority as limited and regulated by his or her relationship with the professional. (2) Requirements (a) Local school systems shall provide to each paraprofessional a minimum of 50 clock hours of job-related training within the first year of employment. A minimum of 10 clock hours shall occur within the first 30 school days of employment. (b) Local school systems shall provide to each media paraprofessional 50 clock hours of jobrelated training within the first year of employment. Ten clock hours of this training shall be specific to the media center and its routines. (c) Local school systems shall provide a minimum of 30 clock hours of job-related training within the first year of employment of an aide. A minimum of 10 clock hours shall occur within the first 30 school days of employment (d) Those individuals employed as paraprofessionals or aides who hold a valid Georgia professional teaching certificate may be exempt from the job-related training within the first year of employment. (e) Upon completion of appropriate training, local systems shall issue to aides and paraprofessionals licenses that shall have a validity period of five years from date of issue. (f) Local school systems shall provide a minimum 20 clock hours of job-related training for license renewal prior to expiration of the current license. Authority a.C.G.A. 20-2-215 1":. '.' 505-2-.20 GENERAL PROCEDURES FOR CERTIFICATION APPLICATION (1) Application for certification may be made as soon as all requirements for certification have been completed and should be made if employment is being sought or has been accepted in Georgia schools. (2) Application forms may be obtained from a school system, a Georgia teacher education institution, or the Professional Standards Commission. (3) The commission utilizes a complete package application procedure. The application is considered complete when all required, signed documentation and fees have been received. It is the responsibility of the individual to submit a complete package. Incomplete packages will be returned for correction or completion. (a) All supporting documents must be complete and official. 1. Official transcripts are those with imprinted college or university seals or special seals used by the institution for certification purposes and the stamp or signature of the registrar. Transcripts must include course numbers, titles, grades and credit earned, and when appropriate, must also bear a degree statement and date that specifies the month, day and year the degree was awarded. 2. College recommendation forms must bear the seal of the college or university or a notary seal in addition to the appropriate signatures. 3. Any official documents may be released to the student and submitted to the certification section by the student, provided appropriate seals and signatures are on the documents. (b) Correct forms must be used for each transaction. (c) On all requests to the certification section, these items must be included and legible: full name, return address, social security number, and the nature of the request. (d) All documents submitted become the property of the commission. The certification section does not establish files for individuals who are not issued a certificate. Incomplete files and files in which certificates are not issued are returned to the applicant. Transcripts and other documents on which certificates are issued and files established, are microfilmed, and then destroyed. Copies of these documents may not be obtained from the certification section. Regardless of the agency selected, the most detailed report available is required. Should the report obtained not be sufficient for our purpose, or not detailed enough, the application material will be returned for further information. (4) Once the detailed report has been received it must be submitted with the application for certification, official transcripts from any colleges attended in the United States, and the appropriate fee to the Professional Standards Commission. Authority O.C.G.A. 20-2-200 505-2-.22 CORRECTION OF CERTIFICATES (1) When a new certificate is received, it should be examined carefully. If an error is detected, both copies (original and superintendent's copy) of the certificate should be returned to the certification section with a letter of explanation. (2) If the certification section discovers an error, it will take measures to make the necessary correction. An incorrectly issued certificate may be recalled. A correction that improves the certificate may not be retroactive for more than one year; therefore, the corrected certificate will be valid from the previous July 1 (the beginning of that fiscal year). A correction that lowers or reduces the certificate level must be made in the school year in which the error is detected. Authority a.e.G.A. 20-2-200 ..... 505-2-.23 CERTIFICATION FEES (1) Requirements (a) An applicant for certification shall be required to pay a $20 fee for: 1. A higher-level certificate when the applicant holds a Georgia certificate but is NOT currently employed in a Georgia public or private school or state agency. 2. Adding a field or endorsement to a certificate if the applicant is NOT currently employed in a Georgia public or private school or state agency. 3. Initial certification (first Georgia certificate) if the applicant is not currently employed in a certified position in a Georgia public or private school or state agency. 4. Renewal of any professional certificate if the applicant is not currently employed in a certified position in a Georgia public or private school or state agency. 5. Conditional certificates except as exempted from fees in item (c) 2. 6. Evaluations of completed college degree programs or other credentials to determine eligibility for a Georgia certificate and/or to identify requirements to qualify for a Georgi~ certificate (a fee is required for each field or endorsement.) 7. Duplicate copies of certificates. 8. Each type of certificate requested, Le., teaching, service, leadership. 9. All other applications for certification, except as exempted in items under (c). (b) For any transaction that requires a fee, the application or request shall be accompanied by a cashier's check or money order made payable to the State of Georgia in the correct amount. (c) An applicant shall be exempt from paying a certification fee for: 1. Initial certification (first Georgia certificate) if the applicant graduated from a Georgia institution that has a state-approved preparation program. 2. Initial certification (first Georgia certificate) if the applicant provides verification of employment in a Georgia local unit of administration, a Georgia private school or other Georgia government agency that requires a certificate for employment. (Employment must be within the validity period of the certificate sought. This exemption applies to all types, titles, fields, and levels of certification. ) .23-2 (i) To qualify for exemption of the certification fee, the applicant shall provide employment verification complete with identification of the employing Georgia local unit of administration or private school and the signature of the employing superintendent or his or her designee on the appropriate application form. If employment is with a state agency, the signature of the agency director, designee, or chief personnel officer shall be affixed. 3. Renewal of any professional certificate if the applicant is employed in a Georgia local unit of administration, Georgia private school or state agency. 4. Duplicate evaluation if the evaluation is still valid. (An evaluation is valid for three years.) 5. A higher-level certificate when the applicant holds a Georgia certificate and is employed in a Georgia public or private school or state agency. 6. Adding a field or endorsement to a certificate if the applicant is employed in a Georgia public or private school or state agency. (2) If a master's or higher-level degree was earned at an institution not regionally accredited, it will not be accepted for certification purposes under any conditions. These degrees cannot be validated. (3) To validate a bachelors degree earned at a college not regionally accredited, the applicant shall earn 15 quarter hours of acceptable graduate credit at a regionally accredited graduate school. All course work for validation must be earned with a grade of "B" or better in each course. The course work must be earned in the field in which certification is sought or toward a planned master's or higher degree program. (4) Standards for acceptable college credit as defined by commission policy follow. (a) Course work at the bachelor's level must be earned with a minimum grade of "C," a 2.0 on a 4.0 scale, for each course. Graduate level course work that is not completed within a degree program which is used to add or establish a field that specifically requires graduate level credit must be earned with a grade of "B" or better on each course or an overall average of 3.0 on all graduate course work attempted applicable to the field of certification. Graduate level course work used for other purposes will be acceptable with a grade of "C" or better on each course. (b) For certification purposes, three semester hours equal five quarter hours. (c) Content courses may be taken at any regionally accredited college or university. (d) A maximum of one quarter of all credit for the content of any certification field may be earned through correspondence courses sponsored by a regionally accredited college or university. (e) Acceptable experience may be used to satisfy student teaching, internship and/or practicum requirements when required on an evaluation from the certification section under certain conditions. Experience earned out-of-state may be substituted for student teaching, internship, and/or practicum, provided that a valid teaching certificate in the field for which certification is requested was held at the time the experience was earned. Experience earned in a Georgia school, while holding a valid certificate in the field of requested certification, may only be substituted for practicum required to add a field. Credit for experience is granted at the rate of five quarter hours for each year taught under these conditions. (f) Junior college credit is acceptable for certification requirements under these conditions. 1. The junior college is regionally accredited. 2. The grade earned equals a 2.0 or better on a 4.0 scale (C or better). 3. The credit earned meets the requirements of a certification evaluation. Renewal credit must be approved by the applicant's employing Georgia superintendent. .36-2 4. The certification evaluation does not specify that the credit must be earned above the sophomore level. No junior college credit will apply above the sophomore level. (g) Acceptable college or university credit, regardless of when it was taken, may be used to establish a teaching field. (h) Continuing Education Units (CEUs) and staff development credit earned out-of-state may not be used to establish or renew certification unless translated into and presented to the commission on transcripts as college or Georgia staff development unit credit. (i) Developmental Studies course work and course work that is audited and/or exempted without credit shall not be accepted for meeting certification requirements. (j) The certification section is authorized to accept appropriate college or university teaching experience as a substitute for college or university course work required for certification. This authorization extends across all types, titles, levels and fields of certification. The following guidelines will be applicable in the consideration and acceptance of college or university teaching experience. 1. The college or university must be regionally accredited at the time of the teaching experience. 2. If accepting college teaching experience in lieu of professional education course work, the college or university must have a state-approved or NCATE-approved preparation program. 3. The course shall have been taught for two or more quarters or semesters. 4. No more than 10 quarter (6 semester) hours of professional education course work requirements shall be credited through college/university teaching. 5. No more than 10 quarter (6 semester) hours of content course work requirements shall be credited through college/university teaching. 6. Verification that the applicant successfully taught a course at the college or university level must be provided by the institution's chief academic officer, dean or department chair, and include the following information: quarter/semester/year the course was taught; course prefix/number/title; statement that the course was taught for resident credit; credit hours awarded to students completing the course. 7. The following will not be acceptable as college teaching experience to substitute for course work required for certification. (i) Teaching or supervising course work as independent study. (ii) Supervising student teaching, internships or practica. (iii) Teaching courses for continuing education credit, staff development credit or through correspondence. Authority O.C.G.A. 20-2-200 505-2-.37 RECENCY-Of-STUDY REQUIREMENT (1) Recency of study. An applicant seeking initial certification in Georgia or reinstatement of a Georgia certificate (refer to Rule 505-2-.38 - Reinstatement of Certificates) must satisfy recency of study through one of the following routes. (a) Completion of resident college or Georgia staff development unit credit for 10 quarter hours or 10 staff development units earned within the five years preceding the date of application. (b) Completion of at least one full year of acceptable school experience within five years preceding the date of application while working in another state on a valid certificate issued by that state. (c) Completion of at least one full year of acceptable college experience within five years preceding the date of application. (d) Holding National Board for Professional Teaching Standards (NBPTS) valid certification. (e) Submission of a valid State of Georgia license issued by the Examining Boards Division of the Office of the Secretary of State, O.C.G.A. Title 43 (e.g., Speech/Language Pathologist, Audiologist, Psychologist) . Authority O.C.G.A. 20-2-200 505-2-.38 REINSTATEMENT OF CERTIFICATES (1) Professional certificates that have been expired for more than five years shall be reinstated by passing the appropriate assessment(s) for each field(s) and by satisfying one of the following options. (a) Completion of resident college or Georgia staff development unit credit for 10 quarter hours or 10 staff development units earned within the five years preceding the date of application. (b) Completion of at least one full year of acceptable school experience while working in another state on a valid certificate issued by that state within five years preceding the date of application. (c) Completion of at least one full year of acceptable college experience within five years preceding the date of application. (d) Holding National Board for Professional Teaching Standards (NBPTS) valid certification. (e) Submission of a valid State of Georgia license issued by the Examining Boards Division of the Office of the Secretary of State, O.C.G.A. Title 43 (e.g., Speech/Language Pathologist, Audiologist, Psychologist) . (2) Individuals will be required to meet Special Georgia Requirements appropriate to the field being reinstated. (3) Professional certificates that have been expired for more than five years may be reinstated in the field and at the level previously held, unless the field of certification is no longer issued for initial professional certification at the time application for reinstatement is made. (4) Professional certificates that have been expired less than five years must be renewed as outlined in Rule 505-2-.13 - Standard Renewal Requirements. Authority O.C.G.A. 20-2-200 505-2-.39 CERTIFICATE EXTENSION FOR ACTIVE MILITARY DUTY (1) Purpose. The purpose of this rule is to provide a mechanism for certified personnel to receive an extension of the validity period of a certificate when called to active military duty. (2) Any Georgia educator who has been called to active military duty and who holds a conditional certificate shall have this certificate renewed without penalty, even if renewal requirements have not been met, under the following conditions. (a) The individual was employed in a Georgia Local Unit of Administration (LUA) or private school when called to active duty. (b) The individual is employed in a Georgia LUA or private school within the same year or the year following active military duty. (c) The conditional certificate is requested by a Georgia education employer. Authority D.C.G.A. 20-2-200 505-2-.40 EXPERIENCE REQUIREMENTS FOR CERTIFICATION PURPOSES (1) Applicants for certification shall report experience to the certification section for the following reasons. (a) Acceptable school or teaching experience to establish eligibility for specific fields. (b) Acceptable work experience required to meet content of the teaching field in vocational education. (c) Acceptable school experience required to verify that the life status of a certificate field is still in effect. (d) Experience which may be used to meet recency-of-study requirements. (2) The Professional Standards Commission shall verify and evaluate satisfactory experience for certification purposes. Local units of administration are responsible for verifying and evaluating satisfactory experience for salary purposes in accordance with State Board of Education rules. (3) Experience recognized for certification purposes is determined according to the following regulations. (a) Unit of Experience 1. Credit for one year of experience may be earned for any of the following: (i) The standard unit of experience for professional school personnel is full-time employment for a regular school term. (ii) At least 120 days while under contract and eligible for state salary in a regular school term or fractions of school terms representing 120 days of consecutive service. (Example: January to June; September to December of consecutive years.) (iii) Two one-half years of experience credit earned in regular school terms may be combined to constitute one year of experience when earned in consecutive years. One-half year of experience may be earned by: (I) 90 days of full-time employment under contract during one school year, or (II) One year of one-half time employment under contract (120 days minimum). I. One-half time employment is defined as a minimum of four hours of employment daily. Any time between one-half and full-time (eight hours) is considered one-half time for experience purposes. (iv) Six months of active military service combined with two or more months of teaching experience, provided the military service interrupts continuous teaching or prevents entrance into teaching immediately following college graduation. 2. Not more than one year of experience may be credited for any 12-month period. 3. year. Experience earned during a school year will be credited at the beginning of the next contract .40-2 (b) In order for the following experience to be recognized for certification, an individual must have held a valid certificate or professional license related to the field of employment during the period in which the experience was acquired. 1. Serving in a local unit of administration (i.e., public elementary or secondary schools or regional education service agencies) in any professional position for which certification is required. 2. Teaching in elementary or secondary schools in foreign countries while a United States citizen and while holding a valid certificate recognized per Rule 505-2-.15. 3. Teaching in a foreign country provided that: (i) the applicant had completed the equivalent of a United States' bachelor's degree prior to the time the experience was earned. (ii) the applicant held a valid professional teaching license issued by the country's governing body appropriate to the field and subject taught at the time the experience was earned. (iii) the school was organized and conducted with approximately the same curriculum as the public schools in the United States. 4. Teaching in kindergarten, pre-kindergarten, or a Head Start program, provided they are under the legal jurisdiction of a public school board of education or are regionally/state accredited. 5. Teaching elementary and secondary school subjects and trade subjects to children or to adults (including veterans), provided teaching was on a full-time basis and was under the direction of a local board of education, the Georgia Department of Education, or any other state agency. 6. (JTPA). Full-time teaching for minimum of eight months under the Job Training Partnership Act 7. Full-time experience in speech and hearing centers. 8. Serving in a training school or youth development center in any professional position for which certification is required. 9. Serving an internship or practicum sponsored cooperatively by an institution of higher education and a cooperating agency (clinic, local school, or agency of government) or an internship sponsored by a local unit of administration (i.e., local school system or RESA) through an approved staff development program, on a full-time basis for a period of nine months or longer. 10. Serving as a full-time librarian in a bookmobile or public library, provided it serves primarily schools and school-age children. (Regional library experience earned on a public librarian's certificate will be accepted.) 11. Employment by a governmental agency when the work is primarily with school-age children. This applies to such areas as a social worker attached to a court or other related field. 12. Work in a clinical situation related to reading, psychology, or a field of special education, provided the individual holds a certificate or license. .40-3 (c) The following experience is recognized for certification if the individual had a bachelor's or higher degree from a regionally accredited college during the period in which the experience was acquired. 1. Full-time teaching in a regionally accredited college or university as a regular faculty member, provided the person holds academic rank (instructor, assistant professor, associate professor, or professor). Full-time is defined as teaching 15 quarter hours per quarter for three consecutive quarters and/or the individual holds a full-time contract from the institution. 2. Serving in a full-time professional position such as president, dean, counselor, or librarian in a regionally accredited college or university. 3. Teaching in the Peace Corps. 4. Serving in professional employment in the U.S. Department of Education or in a state department of education. 5. Serving in a private elementary or secondary school in any professional position, so long as the school was regionally/state accredited at the time the experience was earned. 6. Experience in the administration of the Child Nutrition Program in the U.S. Department of Agriculture is creditable experience for school nutrition directors. 7. Experience in a professional position which required the individual to organize, manage, or teach in a formal training program/environment (i.e., school business managers, school personnel directors, school facilities planners, or school plant directors). 8. Serving in a food service management supervisory position in a public or private organization is creditable experience for school nutrition directors. This includes the American Dietetic Association approved internship. 9. Serving as a cooperative extension service agent provided the experience is full-time. (d) Experience that shall not be recognized for certification purposes follows. 1. Supply or substitute teaching. 2. Clerical or nonprofessional experience in an education institution. 3. Service as a member of a board of education. 4. Service as a teacher aide or paraprofessional. 5. Teaching experience in private elementary or secondary schools not holding regional/state accreditation. 6. Teaching in a college or university not holding regional accreditation. (b) Validity Period. The professional renewable certificate has a standard validity period of five years. The validity period begins on the date all requirements for the certificate are met or July 1, whichever is more recent, and expires June 30 five years later, provided that the Special Georgia Requirements have been completed. If any are missing, the certificate may be issued with a validity period of one year upon the request of an employing Georgia superintendent, and extended for an additional four years after all requirements are met. (c) Renewal Requirements. The standard requirement to renew all clear renewable certificate fields with five year validity periods is 10 quarter hours of college credit or 10 Georgia staff development units completed per Rule 505-2-.13. (2) Emergency Certificate (a) To qualify for an Emergency certificate in Agriculture Education, an applicant shall: 1. be employed in a Georgia school and have the certificate requested by the employing superintendent; 2. be eligible for a Professional certificate in the field but not meet recency-of-study requirements for an initial Georgia certificate, or not meet course renewal or reinstatement requirements for an expired Georgia certificate; 3. have passed the appropriate assessment(s) if a Georgia certificate is being renewed or reinstated. (b) If one or more special Georgia course requirements are needed in addition to recency-ofstudy, renewal or reinstatement requirements, the necessary course work shall be completed during the validity of the Emergency certificate. This course work may also be used toward the recency-ofstudy, renewal or reinstatement requirements. (c) Validity Period. The Emergency certificate is valid for one year. The validity period begins on the date eligibility for the certificate is established or July 1, whichever is more recent, and expires June 30 of the following year. If the applicant is employed after January 1, the validity period begins the first day of the month of employment and expires June 30 of the following year. (d) Renewal Requirements. Emergency certificates cannot be renewed or extended. All requirements to remove the emergency factor shall be completed during the validity period of the certificate. An Emergency certificate cannot be issued for consecutive validity periods or issued after a previously held one-year certificate . AG ED .50-2 (3) Provisional Certificate (a) To qualify for the Provisional certificate in Agriculture Education, an applicant shall: 1. have passed the appropriate assessment(s); 2. have graduated with a cumulative undergraduate grade point average of 2.5 or higher on a 4.0 scale OR have been admitted to or completed a master's degree or higher from a regionally accredited college or university; 3. be employed in a Georgia school and have the certificate requested by the employing superintendent; 4. satisfy minimum job entry content requirements by meeting one of the following conditions: (i) hold a bachelor's or higher degree from a regionally accredited college with a major in agriculture; (ii) hold a bachelor's or higher degree from a regionally accredited college with a major in any field and have completed a minimum of 65 quarter hours in the following areas: (I) 50 quarter hours with at least 10 quarter hours in three of these five areas: agribusiness, forestry, agriculture power and mechanics, production agriculture, or horticulture; (II) 15 quarter hours in science selected from plant pathology, entomology, bacteriology, genetics, botany, or biology. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) To add Agriculture Education to an established Professional certificate in any teaching field, an applicant shall: 1. complete an approved program in Agriculture Education or earn 65 quarter hours of acceptable college credit as described in section (3) (a) 4. (ii) (1)-(11) of this Rule; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Agriculture Education. (b) To add Agriculture Education to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. AG ED .50-3 (5) Probationary certificate (a) To qualify for the Probationary certificate in Agriculture Education, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in Agriculture Education content. (bl Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. The beginning validity date will be the date requirements for the certificate are met or July 1, whichever is most recent, and will expire June 30 three years later. If the base certificate is not valid for an additional three years, the probationary certificate will expire with the base certificate. (c) Renewal Requirements. To renew the probationary certificate for an additional two years, a minimum of 30 quarter hours toward requirements to add the field shall be earned during the threeyear validity period. When 30 or fewer quarter hours are required to add the field, all requirements shall be completed during the three-year validity period. If the probationary certificate is issued for less that three years because the base field is not valid for the additional three years, the probationary certificate can be extended when requirements to renew or extend the base certificate have been satisfied. If the base certificate is an initial certificate in Georgia, and an assessment(s) is required, the assessment(s) in either the base field or for the field of Agriculture Education will be accepted to renew the probationary certificate. (6) In-Field Statement. An individual certified in Agriculture Education is in-field to teach all courses in Agriculture Education in grades 7-12. Authority a.C.G.A. 20-2-200 505-2-.51 ART EDUCATION (1 ) Professional Certificate (a) shall: To qualify for a Professional certificate in the teaching field of Art Education, an applicant 1. have completed an approved program in the field per Rule 505-2-.06 or have an out-of-state certificate in the field per Rule 505-2-.15; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Art Education. (b) Validity Period. The professional renewable certificate has a standard validity period of five years. The validity period begins on the date all requirements for the certificate are met or July 1, whichever is more recent, and expires June 30 five years later, provided that the Special Georgia Requirements have been completed. If any are missing, the certificate may be issued with a validity period of one year upon the request of an employing Georgia superintendent, and extended for an additional four years after all requirements are met. (c) Renewal Requirements. The standard requirement to renew all clear renewable certificate fields with five year validity periods is 10 quarter hours of college credit or 10 Georgia staff development units completed per Rule 505-2-.13. ART .51-2 (3) Provisional Certificate (a) To qualify for the Provisional certificate in Art Education, an applicant shall: 1. have passed the appropriate assessment(s); 2. have graduated with a cumulative undergraduate grade point average of 2.5 or higher on a 4.0 scale OR have been admitted to or completed a master's degree or higher from a regionally accredited college or university; 3. be employed in a Georgia school and have the certificate requested by the employing superintendent; 4. satisfy minimum job entry content requirements by meeting one of the following conditions: (i) hold a bachelor's or higher degree from a regionally accredited college with a major in art; (ii) hold a bachelor's or higher degree from a regionally accredited college with a major in any field and have completed 50 quarter hours in art content to include 15 quarter hours in art history and criticism and 35 quarter hours in producing art (production of two- and three- dimensional art must be included, along with drawing and design) with a minimum of 25 quarter hours earned above the sophomore level. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) To add Art Education to an established Professional certificate in any teaching field, an applicant shall: 1. complete one of the content options outlined in section (3) (a) 4. of this rule or complete an approved program in Art Education; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Art Education. (b) To add Art Education to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. (5) Probationary certificate (a) To qualify for the Probationary certificate in Art Education, an applicant shall: 1. hold a valid professional Georgia certificate in any field; ART .51-3 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in Art content. (b) Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. If the base certificate is an initial certificate in Georgia, and the assessment(s) is required, the assessment(s) in either the base field or for the field of Art Education will be accepted to extend the probationary certificate. (6) In-Field Statement. An individual with a certificate in art is in-field to teach art, drawing, painting, graphics, crafts, sculpture, three-dimensional art, and art history and appreciation in grades P-12. Authority a.C.G.A. 20-2-200 505-2-.52 BEHAVIOR DISORDERS (1 ) Professional Certificate (a) To qualify for a Professional certificate in the teaching field of Behavior Disorders, an applicant shall: 1. have completed an approved program in the field per Rule 505-2-.06 or have an out-of-state certificate in the field per Rule 505-2-.15; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Behavior Disorders. (b) Validity Period. The professional renewable certificate has a standard validity period of five years. (3) Provisional Certificate (a) To qualify for the Provisional certificate in Behavior Disorders, an applicant shall: 1. have passed the appropriate assessment(s); 2. have graduated with a cumulative undergraduate grade point average of 2.5 or higher on a 4.0 scale OR have been admitted to or completed a master's degree or higher from a regionally accredited college or university; 3. be employed in a Georgia school and have the certificate requested by the employing superintendent; 4. satisfy minimum job entry content requirements by meeting one of the following conditions: (i) hold a bachelor's or higher degree from a regionally accredited college with a major in behavior disorders or psychology; (ii) hold a bachelor's or higher degree from a regionally accredited college with a major in any field and have completed 35 quarter hours of acceptable credit to include 5 quarter hours (or 5 staff development units) in the identification and education of children who have special educational needs, 5 quarter hours (or 5 staff development units) in the teaching of reading, 5 quarter hours in characteristics of students with behavior disorders, 5 quarter hours in abnormal psychology, 5 quarter hours in tests and measurements, 5 quarter hours in behavior modification or classroom management, and 5 quarter hours in methods for teaching students with behavior disorders. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) To add Behavior Disorders to an established Professional certificate in any teaching field, an applicant shall: 1. complete an approved program in Behavior Disorders or earn the 35 hours of acceptable credit as described in section (3) (a) 4. (ii) plus a 5 quarter hour supervised practicum or internship in Behavior Disorders; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Behavior Disorders. BD .52-3 (b) To add Behavior Disorders to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. (5) Probationary certificate (a) To qualify for the Probationary certificate in Behavior Disorders, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 10 quarter hours of acceptable credit selected from requirements to add the field of Behavior Disorders. (b) Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. The beginning validity date will be the date requirements for the certificate are met or July 1, whichever is most recent, and will expire June 30 three years later. If the base certificate is not valid for an additional three years, the probationary certificate will expire with the base certificate. (c) Renewal Requirements. The probationary certificate in Behavior Disorders cannot be renewed. All requirements shall be completed during the three-year validity period. If the probationary certificate is issued for less than three years because the base field is not valid for the additional three years, the probationary certificate can be extended when requirements to renew or extend the base certificate have been satisfied. If the base certificate is an initial certificate in Georgia, and the assessment(s) is required, the assessment(s) in either the base field or for the field of Behavior Disorders will be accepted to extend the probationary certificate. (6) In-Field Statement. An individual with a certificate in Behavior Disorders is in-field to teach students with behavior disorders in grades P-12 in self-contained and resource settings. (This certificate holder is also in-field to teach remedial Math/English P-12.) Authority a.C.G.A. 20-2-200 505-2-.53 BIOLOGY (1 ) Professional Certificate (a) To qualify for a Professional certificate in the teaching field of Biology, an applicant shall: 1. have completed an approved program in the field per Rule 505-2-.06 or have an out-of-state certificate in the field per Rule 505-2-.15; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Biology. (b) 'validity Period. The professional renewable certificate has a standard validity period of five years. The validity period begins on the date all requirements for the certificate are met or July 1, whichever is more recent, and expires June 30 five years later, provided that the Special Georgia Requirements have been completed. If any are missing, the certificate may be issued with a validity period of one year upon the request of an employing Georgia superintendent, and extended for an additional four years after all requirements are met. (c) Renewal Requirements. The standard requirement to renew all clear renewable certificate fields with five year validity periods is 10 quarter hours of college credit or 10 Georgia staff development units completed per Rule 505-2-.13. BIO .53-2 (3) Provisional Certificate (a) To qualify for the Provisional certificate in Biology, an applicant shall: 1. have passed the appropriate assessment(s); 2. have graduated with a cumulative undergraduate grade point average of 2.5 or higher on a 4.0 scale OR have been admitted to or completed a master's degree or higher from a regionally accredited college or university; 3. be employed in a Georgia school and have the certificate requested by the employing superintendent; 4. satisfy minimum job entry content requirements by meeting one of the following conditions: (i) hold a bachelor's or higher degree from a regionally accredited college with a major in biology; (ii) hold a bachelor's or higher degree from a regionally accredited college with a major in any field and have completed 40 quarter hours in biology content with a minimum of 20 quarter hours earned above the sophomore level. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) shall: To add Biology to an established Professional certificate in any teaching field, an applicant 1. complete one of the content options outlined in section (3) (a) 4. of this rule or complete an approved program in Biology; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Biology. (b) To add Biology to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. (5) Probationary certificate (a) To qualify for the Probationary certificate in Biology, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; BID .53-3 3. have completed 20 quarter hours of acceptable college credit in biology. BUS ED .54-2 (3) Provisional Certificate (a) To qualify for the Provisional certificate in Business Education, an applicant shall: 1. have passed the appropriate assessment(s); 2. have graduated with a cumulative undergraduate grade point average of 2.5 or higher on a 4.0 scale OR have been admitted to or completed a master's degree or higher from a regionally accredited college or university; 3. be employed in a Georgia school and have the certificate requested by the employing superintendent; 4. satisfy minimum job entry content requirements by meeting one of the following conditions: (i) hold a bachelor's or higher degree from a regionally accredited college with a major in general business or business administration; (ii) hold a bachelor's or higher degree from a regionally accredited college with a major in any field and have completed 60 quarter hours in business content, with a minimum of 30 quarter hours earned above the sophomore level, to include the following: (I) 45 quarter hours to include 10 quarter hours in accounting; 10 quarter hours in economics; 5 quarter hours in business law/legal environments; 5 quarter hours in keyboarding/typing/word processing; 5 quarter hours in office administration, management or procedures; 5 quarter hours in computer applications. (II) 15 quarter hours selected from advanced computer applications, advanced word processing, desktop publishing, computer programming, and information/data management and processing. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) To add Business Education to an established Professional certificate in any teaching field, an applicant shall: 1. complete an approved program in Business Education or complete 60 quarter hours in business content as described in section (3) (a) 4. (ii) of this rule; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Business Education. (b) To add Business Education to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. BUS ED .54-3 (5) Probationary certificate (a) To qualify for the Probationary certificate in Business Education, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in business content. (b) Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. (b) Validity Period. The professional renewable certificate has a standard validity period of five years. The validity period begins on the date all requirements for the certificate are met or July 1, whichever is more recent, and expires June 30 five years later, provided that the Special Georgia Requirements have been completed. If any are missing, the certificate may be issued with a validity period of one year upon the request of an employing Georgia superintendent, and extended for an additional four years after all requirements are met. (c) Renewal Requirements. The standard requirement to renew all clear renewable certificate fields with five year validity periods is 10 quarter hours of college credit or 10 Georgia staff development units completed per Rule 505-2-.13. This course work may also be used toward the recency-ofstudy, renewal or reinstatement requirements. (c) Validity Period. The Emergency certificate is valid for one year. The validity period begins on the date eligibility for the certificate is established or July 1, whichever is more recent, and expires June 30 of the following year. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) To add Chemistry to an established Professional certificate in any teaching field, an applicant shall: 1. complete one of the content options outlined in section (3) (a) 4. of this rule or complete an approved program in chemistry; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Chemistry. (b) To add Chemistry to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. (I) a maximum of 10 quarter hours may be allowed for courses in history and culture of the country or for competency acquired in high school or through residence in a foreign country in which Chinese is the official language. (One year will be the equivalent of 5 quarter hours.) (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. (a) shall: To add Chinese to an established Professional certificate in any teaching field, an applicant 1. complete one of the content options outlined in section (3) (a) 4. of this rule or complete an approved program in Chinese; (i) if adding the field of Chinese (P-12), the applicant shall complete 5 quarter hours or staff development units in the area of P-B or P-12 foreign language methods, materials, and curriculum. 2. complete Special Georgia Requirements per Rule 505-2-.0B applicable to the field of Chinese. (b) To add Chinese to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. CHINESE .56-3 (5) Probationary certificate (a) To qualify for the Probationary certificate in Chinese, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in Chinese content. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. A minimum of 20 quarter hours shall be taken above the sophomore level. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) To add early childhood education to an established Professional certificate in Elementary Education (P-8), an applicant shall: 1. complete 10 quarter hours, or the equivalent in a Georgia approved staff development program, to include: (i) 5 quarter hours in human growth and development; (ii) 5 quarter hours in general curriculum and methods for early childhood education or practicum/internship/workshop in early childhood education or one year of acceptable teaching experience in grades P-5 while holding a valid certificate in the range of P-5. 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Early Childhood Education. (b) To add Early Childhood Education to an established Professional Georgia certificate in any teaching field other than Elementary Education (P-8), an applicant shall: 1. complete an approved program in Early Childhood Education or complete 40 quarter hours designed for the teacher of the young child with 5 quarter hours in each of the following areas: (i) human growth and development; (ii) general curriculum/methods for early childhood education or a college-supervised practicum/internship in grades P-5 or one year of acceptable teaching experience in grades P-5 while holding a valid certificate in the range of P-5; (iii) communication arts for the young child; (iv) socio-behavioral sciences for the young child; (v) creative arts for the young child; (vi) science for the young child; (vii) mathematics for the young child; (viii) health and physical education for the young child. 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Early Childhood Education. (5) Probationary certificate (a) To qualify for the Probationary certificate in Early Childhood Education, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in Early Childhood Education content. (b) Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. The beginning validity date will be the date requirements for the certificate are met or July 1, whichever is most recent, and will expire June 30 three years later. If the base certificate is not valid for an additional three years, the probationary certificate will expire with the base certificate. (c) Renewal Requirements. The probationary certificate in early childhood education cannot be renewed. All requirements shall be completed during the three-year validity period. If the probationary certificate is issued for less than three years because the base field is not valid for the additional three years, the probationary certificate can be extended when requirements to renew or extend the base certificate have been satisfied. If the base certificate is an initial certificate in Georgia, and the assessment(s) is required, the assessment(s) in either the base field, or for the fields of Early Childhood or Middle Childhood will be accepted to extend the probationary certificate. (6) In-Field Statement. An individual with a certificate in early childhood education is in-field to teach any subject in grades P-5 and remedial reading and mathematics in grades 4-8. The validity period begins on the date all requirements for the certificate are met or July 1, whichever is more recent, and expires June 30 five years later, provided that the Special Georgia Requirements have been completed. If any are missing, the certificate may be issued with a validity period of one year upon the request of an employing Georgia superintendent, and extended for an additional four years after all requirements are met. (c) Renewal Requirements. The standard requirement to renew all clear renewable certificate fields with five year validity periods is 10 quarter hours of college credit or 10 Georgia staff development units completed per Rule 505-2-.13. (2) Emergency Certificate (a) To qualify for an Emergency certificate in Earth/Space Science, an applicant shall: 1. be employed in a Georgia school and have the certificate requested by the employing superintendent; 2. be eligible for a Professional certificate in the field but not meet recency-of-study requirements for an initial Georgia certificate, or not meet course renewal or reinstatement requirements for an expired Georgia certificate; 3. have passed the appropriate assessment(s) if a Georgia certificate is being renewed or reinstated. (b) If one or more special Georgia course requirements are needed in addition to recency-ofstudy, renewal or reinstatement requirements, the necessary course work shall be completed during the validity of the Emergency certificate. This course work may also be used toward the recency-ofstudy, renewal or reinstatement requirements. (c) Validity Period. The Emergency certificate is valid for one year. The validity period begins on the date eligibility for the certificate is established or July 1, whichever is more recent, and expires June 30 of the following year. If the applicant is employed after January 1, the validity period begins the first day of the month of employment and expires June 30 of the following year. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. (I) a maximum of 10 quarter hours may be allowed for courses in history and culture of the country or for competency acquired in high school or through residence in a foreign country in which French is the official language. (One year will be the equivalent of 5 quarter hours.) (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) shall: To add French to an established Professional certificate in any teaching field, an applicant 1. complete one of the content options outlined in section (3) (a) 4. of this rule or complete an approved program in French; (i) if adding the field of French (P-12), the applicant shall complete 5 quarter hours or staff development units in the area of P-8 or P-12 foreign language methods, materials and curriculum. 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of French. (b) To add French to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. Authority a.C.G.A. 20-2-200 505-2-.65 GEOGRAPHY (1 ) Professional Certificate (a) To qualify for a Professional certificate in the teaching field of Geography, an applicant shall: 1. have completed an approved program in the field per Rule 505-2-.06 or have an out-of-state certificate in the field per Rule 505-2-.15; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Geography. (b) Validity Period. The professional renewable certificate has a standard validity period of five years. The validity period begins on the date all requirements for the certificate are met or July 1, whichever is more recent, and expires June 30 five years later, provided that the Special Georgia Requirements have been completed. If any are missing, the certificate may be issued with a validity period of one year upon the request of an employing Georgia superintendent, and extended for an additional four years after all requirements are met. (c) Renewal Requirements. The standard requirement to renew all clear renewable certificate fields with five year validity periods is 10 quarter hours of college credit or 10 Georgia staff development units completed per Rule 505-2-.13. (b) If one or more special Georgia course requirements are needed in addition to recency-ofstudy, renewal or reinstatement requirements, the necessary course work shall be completed during the validity of the Emergency certificate. This course work may also be used toward the recency-ofstudy, renewal or reinstatement requirements. (c) Validity Period. The Emergency certificate is valid for one year. The validity period begins on the date eligibility for the certificate is established or July 1, whichever is more recent, and expires June 30 of the following year. A minimum of 20 quarter hours must be earned above the sophomore level. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whicheyer is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. (5) Probationary certificate (a) To qualify for the Probationary certificate in Geography, an applicant shall: 1. hold a valid professional Georgia certificate in any field; GEOG .65-3 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in geography content. (b) Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. The beginning validity date will be the date requirements for the certificate are met or July 1, whichever is most recent, and will expire June 30 three years later. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (5) Probationary Certificate (a) shall: To qualify for the Probationary certificate in Health Occupations Education, an applicant 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in health occupations education content (determined by the approved program official where the applicant is enrolled). (b) Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. The beginning validity date will be the date requirements for the certificate are met or July 1, whichever is most recent, and will expire June 30 three years later. If the base certificate is not valid for an additional three years, the probationary certificate will expire with the base certificate. (c) Renewal Requirements. To renew the probationary certificate for an additional two years, a minimum of 30 quarter hours toward requirements to add the field shall be earned during the threeyear validity period. When 30 or fewer quarter hours are required to add the field, all requirements shall be completed during the three-year validity period. If the probationary certificate is issued for less that three years because the base field is not valid for the additional three years, the probationary certificate can be extended when requirements to renew or extend the base certificate have been satisfied. If the base certificate is an initial certificate in Georgia, and the assessment(s) is required, the assessment(s) in the base field must be passed in order to renew the probationary certificate. Authority O.C.G.A. 20-2-200 505-2-.70 HEALTH AND PHYSICAL EDUCATION (1 ) Professional Certificate (a) To qualify for a Professional certificate in the teaching field of Health and Physical Education, an applicant shall: 1. have completed an approved program in the field per Rule 505-2-.06 or have an out-of-state certificate in the field per Rule 505-2-.15; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Health and Physical Education. (b) Validity Period. The professional renewable certificate has a standard validity period of five years. The validity period begins on the date all requirements for the certificate are met or July 1, whichever is more recent, and expires June 30 five years later, provided that the Special Georgia Requirements have been completed. If any are missing, the certificate may be issued with a validity period of one year upon the request of an employing Georgia superintendent, and extended for an additional four years after all requirements are met. (c) Renewal Requirements. The standard requirement to renew all clear renewable certificate fields with five year validity periods is 10 quarter hours of college credit or 10 Georgia staff development units completed per Rule 505-2-.13. (2) Emergency Certificate (a) To qualify for an Emergency certificate in Health and Physical Education, an applicant shall: 1. be employed in a Georgia school and have the certificate requested by the employing superintendent; 2. be eligible for a Professional certificate in the field but not meet recency-of-study requirements for an initial Georgia certificate, or not meet course renewal or reinstatement requirements for an expired Georgia certificate; . 3. have passed the appropriate assessment(s) if a Georgia certificate is being renewed or reinstated. (b) If one or more special Georgia course requirements are needed in addition to recency-ofstudy, renewal or reinstatement requirements, the necessary course work shall be completed during the validity of the Emergency certificate. This course work may also be used toward the recency-ofstudy, renewal or reinstatement requirements. (c) Validity Period. The Emergency certificate is valid for one year. The validity period begins on the date eligibility for the certificate is established or July 1, whichever is more recent, and expires June 30 of the following year. If the applicant is employed after January 1, the validity period begins the first day of the month of employment and expires June 30 of the following year. (d) Renewal Requirements. Emergency certificates cannot be renewed or extended. All requirements to remove the emergency factor shall be completed during the validity period of the certificate. An Emergency certificate cannot be issued for consecutive validity periods or issued after a previously held one-year certificate . H&PE .70-2 (3) Provisional Certificate (a) To qualify for the Provisional certificate in Health and Physical Education, an applicant shall: 1. have passed the appropriate assessment(s); 2. have graduated with a cumulative undergraduate grade point average of 2.5 or higher on a 4.0 scale OR have been admitted to or completed a master's degree or higher from a regionally accredited college or university; 3. be employed in a Georgia school and have the certificate requested by the employing superintendent; 4. satisfy minimum job entry content requirements by meeting one of the following conditions: (i) hold a bachelor's or higher degree from a regionally accredited college with a major in health and physical education; (ii) hold a bachelor's or higher degree from a regionally accredited college with a major in any field and have completed 70 quarter hours in health and physical education content (of which a minimum of 35 quarter hours must be earned above the sophomore level) distributed as follows: (I) 25 quarter hours in health education, including the following: I. 5 quarter hours in health education methods, materials and curriculum; II. 20 quarter hours selected from nutrition; human sexuality; alcohol, tobacco and drugs; psychological and social health; and first aid, including cardiopulmonary resuscitation. (II) 45 quarter hours in physical education including the following: I. 20 quarter hours selected from 4 of the following 6 areas: history and principles of physical education; measurement and evaluation in physical education; physiology of exercise; kinesiology; adaptive physical education; and human anatomy or physiology; II. 5 quarter hours in elementary or children's physical education; III. 10 quarter hours in physical education activities such as individual sports, team sports, aquatics, dance, fitness, and outdoor activities. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. H&PE .70-3 (4) To Add the Field. (a) To add Health and Physical Education to an established Professional certificate in any teaching field, an applicant shall: 1. complete the content option outlined in section (3) (a) 4. (ii) of this rule or complete an approved program in health and physical education; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Health and Physical Education. (b) To add Health and Physical Education to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. (5) Probationary certificate (a) shall: To qualify for the Probationary certificate in Health and Physical Education, an applicant 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in Health and Physical Education content. (b) Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. The beginning validity date will be the date requirements for the certificate are met or July 1, whichever is most recent, and will expire June 30 three years later. If the base certificate is not valid for an additional three years, the probationary certificate will expire with the base certificate. (c) Renewal Requirements. To renew the probationary certificate for an additional two years, a minimum of 30 quarter hours toward requirements to add the field shall be earned during the threeyear validity period. When 30 or fewer quarter hours are required to add the field, all requirements shall be completed during the three-year validity period. If the probationary certificate is issued for less than three years because the base field is not valid for the additional three years, the probationary certificate can be extended when requirements to renew or extend the base certificate have been satisfied. If the base certificate is an initial certificate in Georgia, and the assessment(s) is required, the assessment(s) in either the base field or for the field of Health and Physical Education will be accepted to renew the probationary certificate. (6) In-Field Statement. An individual certified in Health and Physical Education is in-field to teach all courses in health and physical education in grades P-12. HEARING IMP .71-2 (3) Provisional Certificate (a) To qualify for the Provisional certificate in Hearing Impaired, an applicant shall: 1. have passed the appropriate assessment(s); 2. have graduated with a cumulative undergraduate grade point average of 2.5 or higher on a 4.0 scale OR have been admitted to or completed a master's degree or higher from a regionally accredited college or university; 3. be employed in a Georgia school and have the certificate requested by the employing superintendent; 4. satisfy minimum job entry content requirements by meeting one of the following conditions: (i) hold a bachelor's or higher degree from a regionally accredited college with a major in hearing impaired; (ii) hold a bachelor's or higher degree from a regionally accredited college with a major in any field and 35 quarter hours in hearing impaired content (with a minimum of 15 quarter hours earned above the sophomore levell to include 5 quarter hours in each of the following areas: the introduction to exceptional children or psychology of the exceptional child; the psychology of the deaf; the structure and function of hearing and vocal mechanisms; audiology; teaching communication skills to the hearing impaired; methods of teaching speech reading to the deaf; and methods and materials for teaching hearing impaired children. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) To add Hearing Impaired to an established Professional certificate in any teaching field, an applicant shall: 1. complete an approved program in hearing impaired and obtain the professional recommendation from the preparing institution or complete the 35 quarter hours in hearing impaired content as described in section (3) (a) 4. (ii) plus a practicum or internship in hearing impaired; 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Hearing Impaired. (b) To add Hearing Impaired to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. HEARING IMP .71-3 (51 Probationary certificate (al To qualify for the Probationary certificate in Hearing Impaired, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in hearing impaired content. (bl Validity Period. The maximum number of years one may hold a probationary certificate is five. The standard validity period of the initial probationary certificate is three years. The beginning validity date will be the date requirements for the certificate are met or July 1, whichever is most recent, and will expire June 30 three years later. If the base certificate is not valid for an additional three years, the probationary certificate will expire with the base certificate. (cl Renewal Requirements. The probationary certificate in Hearing Impaired cannot be renewed. All requirements shall be completed during the three-year validity period. If the probationary certificate is issued for less than three years because the base field is not valid for the additional three years, the probationary certificate can be extended when requirements to renew or extend the base certificate have been satisfied. If the base certificate is an initial certificate in Georgia, and the assessment(sl is required, the assessment(sl in either the base field or for the field of Hearing Impaired will be accepted to extend the probationary certificate. (61 In-Field Statement. An individual with a certificate in hearing impaired is in-field to teach hearing impaired children in grades P-12 in self-contained classrooms and resource settings. (I) a minimum of 10 quarter hours may be allowed for courses in history and culture of the country or for competency acquired in high school or through residence in a foreign country in which Hebrew is the official language. (One year will be the equivalent of 5 quarter hours.) (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July 1, whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January 1, the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. The provisional certificate cannot be renewed. The approved program and all applicable Special Georgia Requirements must be completed during the validity period. (4) To Add the Field. (a) shall: To add Hebrew to an established Professional certificate in any teaching field, an applicant 1. complete one of the content options outlined in section (3) (a) 4. of this rule or complete an approved program in Hebrew; (i) if adding the field of Hebrew (P-12), the applicant shall complete 5 quarter hours or staff development units in the area of P-8 or P-12 foreign language methods, materials, and curriculum. 2. complete Special Georgia Requirements per Rule 505-2-.08 applicable to the field of Hebrew. (b) To add Hebrew to a Professional leadership or service field when no teaching field has been established, an approved program must be completed. HEBREW .72-3 (5) Probationary Certificate (a) To qualify for the Probationary certificate in Hebrew, an applicant shall: 1. hold a valid professional Georgia certificate in any field; 2. be employed in a Georgia school and have the certificate requested by the employing superintendent; 3. have completed 20 quarter hours of acceptable college credit in Hebrew content. An individual with a certificate in Hebrew (P-1 2) is in-field to teach Hebrew in grades P-12. (b) Validity period. The initial Provisional certificate will be valid for three years. The beginning validity date will be the date requirements for the certificate are completed or July', whichever is most recent, and will expire June 30 three years later. If the applicant is employed after January', the validity period will begin on the first day of the month of employment and expire June 30 three years later. (c) Renewal Requirements. TorreyM/VtT SUBJECT: PSC Rule Amendments On April 3, 1997, the PSC authorized its Executive Secretary to initiate amendments to Rules 505-1-.04, 505-2-.02, 505-2-.36, 505-2-.74, 505-2-.99, 505-2-.118,505-2-.121, and 505-2-.136, to become effective July 1, 1997. The notice of proposed rulemaking was distributed to the state's education community for review. On June 19, 1997. the Commission adopted the proposed amendments as distributed in April. Attached are copies of the amended rules for insertion in your 1996 Rules for Certification of Education Personnel in Georgia notebooks behind the current rules . Discussion: General Requirements PSC Exceptions - Any educator under investigation by the Professional Practices Commission (PPC) may request a hearing before a PPC hearing tribunal. If the educator disagrees with the final report of this hearing tribunal, they may file an exception to the report with the PSC. Based on a review of the entire record, the PSC then takes a final action in the case. The amendment to Rule 505-1-.04 clarifies procedures for appealing the PSC's decisions regarding exceptions. Certification Appeals - A formal process allows an educator to appeal an evaluator's decision regarding certification. The amendment to Rule 505-2-.02 changes the wording of this appeal process to coincide with current PSC staff alignment. Acceptable Credit - Current restrictions on acceptable college credit allow one quarter of all content credit for a certification field to be earned through correspondence courses. Most college transcripts do not differentiate correspondence courses; courses completed toward an approved preparation program are approved by the institution and not the Certification Division. The amendment to Rule 505-2-.36 removes this restriction. Specific Field Requirements Home Economics - At the 1994 annual conference of the American Home Economics Association, the name of the profession of home economics was changed to the profession of family and consumer sciences to better reflect what professionals in the field really do. Since that time, colleges and universities, as well as professional organizations associated with this field, have changed their names to reflect the change in the profession. The amendments to Rules 505-2-.74, 505-2-.99, 505-2-.118, and 505-2-.136 reflect this change in the name of the profession. Additionally, an error in the number of hours required to add the field of family and consumer sciences has been corrected . E\VEO AUG 04 1998 Docl tents ~RII="C;: Page 2 PSC Rule Amendments Speech and Language Pathology - Currently, the two routes to professional certification in Speech and language Pathology include the completion of an approved program in this field and reciprocity of a professional SLP certificate. The amendments to rule 505-2-.121, at the suggestion of the Georgia Council of Administrators of Special Education SlP Task Force and the Georgia Speech-language-Hearing Association, allow a third route: submission of a valid State of Georgia license issued by the Examining Boards Division of the Office of the Secretary of State in Speech and language Pathologist. Requirements for this license are equal to or greater than requirements in approved SLP preparation programs, necessitate American Speech and Hearing Association (ASHA) membership, and provide for experiences working with school-aged children. Rules in chapter 505-3 (Teacher Education) should be inserted behind the corresponding certification rule (505-21. Discussion: The proposed rule amendments and adoptions are recommended to provide for clarification and further definition in existing certification and teacher education rules and to create and implement a standards-based program approval and certification process for teaching and service certification endorsements. Certification in Endorsement Fields - Currently, the certification endorsement fields may be completed through approved programs in colleges and universities, staff development courses and/or a mix of college credit courses and staff development courses to meet courses specified in the certification rules. The staff development and credit course approach does not provide an integrated program. The proposed amendments to certification Rules 505-2-.06, 505-2.100, 505-2-.101 through .108 and 505-2-.124 eliminate coursework-only approaches and establish a standards-based program approval delivery system for both colleges/universities and other approved staff development providers. Probationary Certification in Endorsement Fields - The current probationary certification rule for endorsement fields requires 10 quarter hours or semester equivalent with the remaining requirements to be completed within a school year. The standards-based program approval model specifies knowledge and skill standards rather than required course work and is not compatible with the existing endorsement probationary certification rule. The proposed change in the probationary certification rule accommodates a standards-based delivery system by allowing a probationary certificate to be obtained if requested by an employing superintendent along with evidence of a candidate's enrollment in a PSCapproved endorsement program to be completed within the validity of the probationary certificate. This change provides local education agencies with more flexibility in providing certified teachers to meet the needs of students in the certification endorsement fields. Program Standards for Endorsement Fields - Changes to Rules in Chapter 505-3 strengthen and update existing program approval standards for endorsement fields and, for Career Exploration (PECE) and Related Vocational Instruction (RVI), establishes program approval standards. Discussion: Professional Practice - With the passage of Senate Bill 535, effective July 1, 1998, the functions of the current Professional Practices Commission (PPC) are transferred to the Professional Standards Commission (PSC). These functions include the investigation, advisement, monitoring, and due process of cases associated with educator discipline. The amendments to certification Rules 505-1-.04, 505-2-.03, 505-2-.04, and 505-2-.05 update current PSC rules to comply with Senate Bill 535. Information Requests and Dissemination - The amendments to Rule 505-1-.05 and the adoption of Rules 505-1-.06 and 505-1-.07 introduce and clarify procedures for handling requests through the Georgia Open Records Act, petitions for declaratory ruling pertaining to PSC statutes or rules, and petitions for PSC rule changes. These rule amendments/adoptions are implemented to comply with Georgia law. Permitted Personnel - Permitted personnel are defined as those persons who qualify for their positions on the basis of experience rather than formal education. Currently, permits are requested by employing school systems/agencies and are renewable annually at the request of the employer. The amendments to Rule 505-2-.17 now allow permitted personnel who meet the following conditions during the first year to renew the permit for three years: 1) the appropriate assessment(s) applicable to the field have been passed; 2) the professional development plan for the first year has been completed; and 3) the renewal is requested by the employing school system/agency. Regional Accreditation - Currently, credit earned for Georgia educator certification must be completed at an institution that is regionally accredited (Southern Association of Colleges and Schools, Western Association of Schools and Colleges, Middle States Association of Colleges and Schools, etc.) The Association of The%gical Schools fATS) is a national accrediting organization; more than 80% of schools accredited by ATS are also accredited by one of the regional associations. A review of the ATS standards reveals a rigorous review process and a strong correlation with regional standards. On November 1, 2001; the Commission rescinded/adopted the aforementioned rules, effective December 1, 2001. Discussion: The purpose of the changes to Chapter 505-3 is to bring the standards for approval of educator preparation programs in line with recent changes in Georgia (new technology requirement; Georgia Teacher Alternative Preparation Program) as well as with new standards for Unit and Program Approval adopted by the National Council for the Preparation of Teacher Education (NCATE). Two categories of ch~1 '\19S in the new rules are as follows: 1. Revision of 505-3-.01. Requirements and Standards for Approving Professional Education Units and Programs Preparing Education Personnel. The effect of the changes is to: a. Expand the definition of Professional Education Unit to include Local Education Agencies, Regional Educational Service Agencies, and other agencies who might propose alternative initial preparation prqgrams or endorsement programs for approval by the Professional Standards Commission b. Clarify the relationship between the Professional Standards Commission and the National Council for Accreditation of Teacher Education (NCATE) with respect to unit approval (provide for joint rather than concurrent NCATE/PSC reviews). Update the Georgia Specific Requirements to include new legislative requirements. 2. Revision of field-specific program approval rules to inoorporate standards published by the national specialty organizations, when these are available.
