Organization and Staff The organizational structure during FY 1995 for the administration of OCR guidelines was as follows: William P. Johnson Division Director Vocational/Applied Technology Dr. Martha Staples Director and Team Leader Intervention Completion Unit William H. Tyus Vocational Equity Coordinator On February 1, 1993 Mr. William H. Tyus was appointed Vocational Equity Coordinator and became the official coordinator of the MOA Compliance Program. Relevant information was collected and coordinated with Vocational enrollment data from the Vocational MIS data base program which was used to conduct the Agency Level Review (ALR) for selection of those systems to receive an on-site visit for F.Y. 1995. Contracted employees were employed to help conduct the on-site reviews. Time allocation to MOA related activities were as follows: William P. Johnson 2.0% 20 hours per year Dr. Martha Staples 4.0 % 80 hours per year William H. Tyus 20.0% 800 hours per year On-Site Teams (15 people x 30 hours) 450 hours per year On-Site team training (15 people x 6 hours) 90 hours per year On-Site monitoring (14 visits at 30 hours) 420 hours per year Total = 1860 hours per year Training provided to MOA staff included a four hour workshop, and two hours of additional training. Presenters included OCR staff, the Georgia MOA Compliance coordinator, the Sex Equity Coordinator, and Georgia DOE staff responsible for Title IX and Section 504 compliance. All trainees were provided with a copy of the evaluation instrument, review items and other related documentation to review prior to serving on an evaluation team. In addition, all teams were lead by experienced MOA evaluation team leaders who provided team members with on-site training and supervision. 3 II. STATE POLICY REVIEW All rules, policies and executive procedures of the Georgia Board of Education and the State Superintendent of Schools have been reviewed for equity and discrimination issues and have been found to contain no biased or stereotyped language. Policies are reviewed on an annual basis in addition to the initial review they go through as they are being developed. The review process takes the policies through a comprehensive department-wide review that includes legal, equity, program process and impact reviews. Policies are forwarded to the Equity Coordinator for review (see Appendix A). The coordinator sends copies to all individuals responsible for reviewing items for equity issues and prepares a response based on the reports received. When any problems are found the policy proposal is changed before any action by the State Board using standards of Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act and the American Disabilities Act, as well as the Carl D. Perkins Vocational Education Act of 1990. III. REVIEW OF STATE OPERATED SCHOOLS The state operated institutions function under the policies and procedures of the Georgia State Board of Education. All policies and procedures adopted for the State Schools are reviewed as outlined in Section II, State Policy Review, and they received on-site reviews during the appropriate year of the 5 year cycle. State operated schools include the: * Atlanta Area School for the Deaf, 890 North Indian Creek Drive, Clarkston, GA 30021 * Georgia Academy for the Blind, 2895 Vineville Avenue, Macon, GA 31204. * Georgia School for the Deaf, P.O. Box 98, Cave Springs, GA 30124 4 IV. SUB RECIPIENTS RECEIVING AGENCY LEVEL OFF-SITE REVIEW A. 180 Local school systems in Georgia have been divided into five groups of thirty-six. (Note: This number may vary from year to year due to exemptions, requests for delay, etc.), Each group receives an on-site Vocational review once in the five year cycle. All thirty-six systems up for review each year receive an agency level review for compliance with civil rights responsibilities. This ensures meeting the OCR requirement that 100% of the state LEA's receive an ALR during the five year cycle. (See Appendix B for a complete list of LEA's receiving an ALR). Six criteria are used to evaluate the sub recipients. The criteria include: 1. the gender and race composition of the population of the local system; 2. the gender and race composition of the local labor force; 3. the gender and race of the total staff, as well as vocational staff; 4. the gender, race and handicapped/disabled student enrollments and their ratios to the composition of the districts' population, as well as the composition of the communities labor force. 5. the fifth area of criteria reviewed were handicapped/disabled enrollments by race and gender; and 6. the sixth criteria was composition of membership on the Vocational Advisory Council. Each local system was assessed and given a plus or minus score which were added to arrive at a total score for each recipient. The 25 % with the lowest score, including ties, received an on-site review/evaluation. (See Appendix C) B. In addition to the 25% of the subrecipients selected to receive an onsite review/evaluation, additional subrecipients (LEA's) whose ALR scores suggested indicators of concern, areas of vulnerability or potential violations were also selected for on-site reviews. 5 C. Evaluation Criteria 1 and 2. Local Population and Local Labor Force Criteria The local population and labor force criteria was the initial review for each sub recipient. Each system was reviewed to establish the percentage of minorities living within the service area; as well as working in the local labor force. These percentages were then compared to student enrollments in vocational/academic classes as well as all work-study programs. Those systems that showed enrollment etc., within the plus or minus 20% range were given a plus. Those systems showing enrollments outside those ranges were given a minus. Local systems could obtain a score within a range of plus two to minus two. 3. Staff Composition Information on the race and gender composition of total, as well as, vocational staff was used as an indicator. The staff composition of each LEA was reviewed and evaluated by comparing the most current staff data to the composition of the local population as provided by the Georgia County Guide. The LEA received a plus, if the vocational education, and/or the total staff, was between plus or minus 20% of the percentage of females found in the community; and another plus for having vocational education and/or total staff between plus or minus 20% of the percentage of minorities in the community. A combination of scores gave a range of plus four to minus four. 6 4. Student Enrollment Composition The composition of student enrollment in each vocational education program was the fourth criterion used in the Agency Level Review. The enrollment evaluation was conducted by comparing the number of female and minority students in each major program to the overall enrollment in the program. Scores of plus or minus are assigned, and the scores are totaled to produce an overall score between plus two to minus two. To receive a score of plus for program, an LEA must have between 30 and 70 percent male\female enrolled in each program area. To receive an additional plus, the minority enrollment in each program has to be within plus or minus 20 percent of the school system's minority population. 5. Handicapped/Disabled and Special Populations Data Data gathered reflected local system's handicapped/disabled and special population enrollments in vocational classes and programs. Female and minority student enrollments in these categories were compared to local population percentages to see if the comparison fell within the plus or minus 20% range. Handicapped/disabled students in each major program area were compared to the previous year's percentages to check for accessibility. If all programs had appropriate enrollments, and if accessibility was established the system received a plus one, if not, minus one. 7 6. Local Advisory Council The percentage of females and minorities on the Local Advisory Council were reviewed and evaluated. If an LEA had been between 35 and 65 percent of females on it's advisory council, it received a plus, if minorities fell within plus or minus 20 percent of adult minority population in that system's service area it received a plus. If percentages were outside those ranges the system received a minus. The combined responses gave a numerical score ranging from plus two to minus two. 7. Scoring for Selection of On-Site Reviews All sub recipients involved in the Agency Level Off-Site Review received a composite final score composed of the total number of plus and minus marks received. Scores were awarded on the basis of review of marks received for comparison of student enrollments to local population percentages, (Scores ranged from plus one to minus one); comparison of student enrollment to local labor market percentages, (Scores ranged from plus one to minus one); vocational and total staff data and their comparison to local population data, (Scores ranged from plus two to minus two); student enrollment data, (scores ranged from plus four to minus four; handicapped/disabled and special population enrollments and their comparison to local population percentages, (scores ranged from plus two to minus two). The sixth criterion used was the composition of the Vocational Advisory Committee and the female and minority membership. (Scores raged from plus two to minus two). Local system scores ranged from plus eleven to minus eleven and each LEA was ranked according to their scores. The lowest 25 percent of the local systems, plus ties, were selected for on-site vocational equity compliance reviews. In addition to the 25 % of the sub recipients with the lowest score selected to receive an on-site review/evaluation, additional sub recipients (LEA's) whose ALR scores suggested indicators of concern, areas of vulnerability or potential violations were also selected for onsite reviews. 8 V. SYSTEMS RECENING ON-SITE REVIEWS The on-site reviews/evaluations were conducted from December 12, 1994 through March 24, 1995. Fourteen LEAs received on-site vocational equity compliance reviews. The on-site review evaluation team members were selected from a pool consisting of trained staff from the Georgia Department of Education, Regional Educational Service Agencies or Contracted consultants. Appendix C contains the list of the LEA on-site reviews and their reviewing teams. Appendix E includes the Vocational Equity Compliance Review Final reports and Corrective Action Plans of those systems visited. VI. TECHNICAL ASSISTANCE PROVIDED Appendix F contains an outline and summary of the technical assistance that has been provided to the Local Education Agencies. In addition, several LEAs that received on-site reviews/evaluations requested, and were provided, technical assistance in the development of their corrective action plans. VII. MONITORING ACTNITIES The Division of Vocational/Applied Technology Instruction is divided into four teams which work individually and collectively in the monitoring of LEAs and have implemented intensive efforts to work with each LEA toward total achieving compliance. Each of the fourteen systems that received an on-site review/evaluation were contacted regarding each finding and technical assistance was provided including additional on-site visits when necessary or as requested by the LEA. VIII. FINDING 5: There is evidence of disproportionate enrollment of middle school students in exploratory classes. students in two of the middle schools of Floyd County do not have the opportunity to enroll in all exploratory classes offered by the system. Interviews with staff and students indicate that there are enough single pregnant females within the system to warrant a program that addresses their needs. Interviews with high school staff, the vocational school staff, and counselors from all sites indicate that recruitment of students for vocational programs is weak, confusing, and not articulated. The high school staff told us the vocational school staff did it, the vocational school staff told us that the high school staff did it, and the counselors were unable to tell us who was assigned responsibility for recruitment. Several students indicated that they had encountered harassment and did not know where to seek help or to whom to report. The autonomy of schools to choose whether or not they participate in middle school exploratories. The review team interviews with personnel indicated that students who were not proficient with the english language and attending Floyd County Schools had difficulty assimilating, and that it was not a problem for teachers and staff. The system's handbooks and brochures were consistent in having disclaimers in their publications, they were often in small print and inconsistent in their location. It is suggested that they be more visible and consistent in their location. The review team was impressed by the course descriptions, lack of admission criteria, and the exploratory program at the middle school. Thomasville City Schools, its work study coordinators and vocational staff are to be commended for the diversity of jobs and students participating in the work-study programs. The coordinators have done an exceptional job of arranging work opportunities for students. Interviews with the students were the highlight of the visit. Questions the team had about accessibility, course selection, and the quality of key personnel were openly discussed in student interviews. This unique group of young people were very candid and positive about the teachers and administrators in the system. students pointed out to the team that teachers, counselors, and administrative staff went the extra mile to prepare them for the world of work and post secondary education. Students were forthcoming both at the high school and middle school about process, policy and support of staff. The team was very impressed.
