RE P O R T OF THE INSURANCE DEPARTMENT OF THE STATE OF GEORGIA FOR THE YEAR ENDING DECEMBER 31 1922 xy 2762 UBHfttfiS Byrd Printing Co Atlanta iI REPORT OF THE I INSURANCE DEPARTMENT OF THE STATE OF GEORGIA FOR THE YEAR ENDING DECEMBER 31 1922 Byrd Printing Co Atlanta INSURANCE DEPARTMENT OF THE STATE OF GEORGIA Atlanta Georgia January 1 1923 To His Excellency Thomas W Hardwick Governor Sir In compliance with the law of the State of Georgia I have the honor to submit herewith the annual report of the Insur ance Department for the year ending December 31 1922 The report given shows the results of the operations of the several insurance companies associations and fraternal socie ties licensed to transact business in this State and their finan cial condition at the close of the year In the preparation of this report I have followed the plan adopted last year con densing the compilation as much as possible and yet including all important data concerning the business transacted and the financial condition of each company The information is clearly set forth in a convenient manner but if among those persons or insurance companies finding use for the report there are some who need more detailed information than is here given this may be had very quickly by inquiry of the Department VOLUME OF BUSINESS In former reports attention has been called to the steady growth of the insurance business in the State of Georgia The year 1920 still holds the record for volume of premiums col lected but the year 1922 is very nearly equal to it in most respects and surpasses it in some There is a steady and re markable development in amount of life insurance written upon citizens of Georgia This branch of the insurance busi ness largely surpassed in 1922 all records of previous years and yet with a decided decrease in the amount of death claims and other policy obligations incurred The casualty group shows smaller amounts both of premiums collected and losses paid than in 1921 Special attention was directed last year to thew results shown in the report of fire and marine insurance for 1921 during which year there was shown to he nearly 3000 000 less premium income on Georgia business than in 1920 but with losses almost double those of 1920 the ratio of losses reported in 1921 being 10853 of the total premium income It is a pleasure to report that during 1922 with an increase in premium income paid by Georgia citizens of over 267000 the losses have diminished from 13567260 in 1921 to 7890803 in 1922 showing a loss ratio to premium income of 6177 as against a ratio of 10853 in 1921 This is indeed encourag ing and inasmuch as fire losses throughout the country inevit ably run parallel with business conditionsadversely affected by business depression and lessened by business prosperity the results here shown may very safely be taken as a sure indi cation of decidedly better business conditions throughout the State There is still considerable room for improvement how ever in the matter of prevention or lessening of fire losses There is a tremendous waste of property that could otherwise be saved to the citizens of the State and it would be well I be lieve to consider ways and means of diminishing such waste The tables following summarize the business of the three larger groups of companies reporting to this Department and make comparison of volume over a series of years No com parative tables have been made up in connection with the smaller groups of companies industrial life and health as sessment fire and fraternal societies but the financial state ments submitted by these organizations and the examinations made by this Department show fair development where the companies are properly managedSTATISTICAL REPORT Showing Business year investigations were made in connection with seventyone fires reported to this Department as being of suspicious origin Full reports of these investigations are now in your hands and a brief summary thereof is attached The work of the office continues to increase The number of investigations mentioned do not by any means represent the number of calls received by the office but since an assistant was given me in September 1922 we have been able to cover more fully the calls for investigations It is yet however physically impossible to meet all demands Each investigation consumes a great deal of time if they are to be made worth while and the preparation of cases for court and the attendance at court trials of the eases presented keep this office very active I append herewith a summary of the results of the investiga tions of myself and of my assistant 32 Indictments returned in 20 cases Cases Persons Convictions of Arson 7 12 Acquittals of Arson 3 3 Arson cases pending 8 13 suspicion of arson directed against some indi vidual or individuals in each instance Thorough investigation was made in each case in some instances as much time as two or three weeks being devoted to running down the various lines of evidence or suspicion Where the facts warranted it each matter was laid before the Solicitor General of the district and he advised as to whether or not the evidence was of sufficient value to be presented to the Grand Jury In many cases not sufficient evidence to warrant prosecution could be found even where there had been much cause for suspicion and these cases togetherwith other cases where suspicion had been misdirected were dropped The cases in which prosecution followed investigation are given below together with the outcome of each Griffin One arrest and indictment trial pending Dublin Two arrestsGrand Jury returned no bill Statesboro Two indictments cases nol prossed for cause so far not recorded Carrollton Eight negroes arrested and indicted for Case not yet tried Haralson County This case brought over from 1921 Evi dence presented at trial resulted in conviction and a sentence of five years Sandersville This case mentioned in 1921 report One per son was tried in 1921 and acquitted Five other persons in cluded in indictments returned by the Grand Jury were nol prossed by Solicitor General Center Two cases held over from 1921 and reported during that year are still pending in court the accused both being a fugitive from justice Tifton As shown in 1921 report nine indictments were ob tained in three closely connected cases In one case we re ported confession as being followed by acquittal The remain ing eight cases then pending have not yet been brought to trial by the Solicitor General of that district and we have so far been unable to get action thru his office COMMENTS In the report of the preceding year mention was made of the difficulty of obtaining convictions in the cases brought to trial the reasons then stated being those given me by prosecuting at 15 Ill torneys and jurors who gave their impression that the existing arson laws provide too severe sentence following conviction of arson the average jury in the country districts particularly being unwilling to bring in a verdict upon which such a heavy sentence can be imposed During my investigations of 1922 I have met many other at torneys and jurors who have the same opinion expressing their belief that a less drastic law say one providing for a penalty of from one to five years would be equally effective and I respect fully repeat my suggestion for the adoption of the Model Ar son Law of the Fire Marshals Association of North America with such modifications as may fit conditions in the State of Georgia As stated last year I do not believe that the State of Georgia should be without a law on its statute books whereby a person can be punished for setting fire to his own property of whatever nature outside of corporate limits Just now there is no such law and provided a person does not damage or endanger the property of others he cannot be prosecuted for setting fire to his own property regardless of whether or not it is done with intent to defraud the insurance companies carrying the fire in surance upon such property The absence of such a law makes it extremely difficult to follow up such a case with the idea either of punishment or of deterring others from similar acts The result of this years work is encouraging As I go a bout the State in the conduct of my duty I find a greater in terest being taken in the work for which this office was created Solicitors General are more ready than before to help many of them realizing keenly the importance of the work in which this office is engaged I find also that the public is be coming more educated to the ideas of fire prevention that we are striving to impress upon them and as our work becomes better known to the citizens of Georgia we look forward con fidently to greater cooperation on the part of the public both in the attempt to discourage fire waste and in the effort to bring to punishment those who disregard the property rights of others by the attempt to burn 16The help given me during the latter part of 1922 by the appointment of an assistant has been most valuable in further ing the conduct of my work and in expediting the investiga tions A glance over the summary heretofore given will re veal considerable delay in the earlier part of the year in reach ing the scene of a fire in order to conduct investigation Up to the time of the appointment of my assistant it was physically impossible many times to reach the scene of a fire with suffi cient promptness to be of much service in ascertaining the cause and those responsible The dividing up of the work how ever has rendered it possible to respond more promptly to calls and with so many old cases now out of the way we shall be able to render more effective service hereafter The foregoing is presented for your information and the suggestions for such action as you deem wise Respectfully submitted J ALBERT SHARP State Fire Inspector The additional help requested last year to assist the Fire In spector in a more prompt investigation of suspicious fires has resulted iu a decided improvement in the handling of this phase of the work By authority of the Legislature an assist ant fire inspector was engaged and put to work early in Sep tember 1922 and while there are so many calls as to keep both the State Inspector and his assistant well occupied all the time they are able to answer more promptly the demands for investigation where their services are required As mentioned in previous reports the law providing for the appointment of fire inspectors defines their duty to be that of making investigation after a fire occurs I again submit for consideration the suggestion that it would be better for the State to enlarge those duties so as to encourage fire prevention Both State and people would reap the benefit of any lessening of the present enormous losses just as both now pay the pen 17 alty incident to the present experience I believe it would be well to grant the fire inspector and any assistants he might be given authority to go upon any premises for the purpose of examination to see if local or State laws or ordinances or regulations for the purpose of lessening or removing the fire hazard are being strictly observed reporting to the proper au thorities any violation of such laws ordinances or regulations recommending to the owners of properties examined the adop tion of such precautionary measures as will diminish the risk of fire and thus better not only their own condition but also de crease the hazard to adjoining property Measures might also well be taken to compel the adoption of such recommendations unless good and sufficient reason could be presented to the contrary and where no local laws or regulations exist the State should require the adoption of some standard of safety and its enforcement The required investigations of suspicious fires and the prosecution of those guilty of arson are right and proper and should be most vigorously conducted but the pre vention of fires or the lessening of losses is of far more im portance to the State and its people and proper means taken to bring these about will most certainly be worth while to all I 18 REVENUE RECEIVED FROM INSURANCE COMPANIES The following statement is submitted showing the revenue collected thru the Insurance Department from companies licensed December 31 19221040431 In the matter of revenue from insurance companies there is approximately 20000 withheld by eleven different com panies pending decision of the Court in a suit brought by one of them to determine the extent of the exemption or deduction allowed by law If the State is sustained this amount with ac crued interest will of course be collected Attention is directed to the very nominal amount of funds expended for the maintenance of the Insurance Department As a matter of information I looked into the reports of more than onefourth of the Insurace Departments of the United States with no attempt at selection but taking the States at random and in no instance was I able to find any Department 20where percentage of expense of operation to revenue collected for the State could in any way approach the Insurance De partment of the State of Georgia on the basis of economical administration This Department during all the years of its existence has been actuated solely by the desire to render good serviceadequate protection to the citizens of Georgia and proper prompt and intelligent service to those insurance com panies placing themselves under its supervision The same spirit will continue to actuate it as long as I am permitted to hold office Such close economy of administration however has tremendous drawbacks and renders good service difficult to obtain and more difficult to maintain This is especially true in connection with the item of salary to my deputy and a time and condition have been reached when attention must be given this particular matter Reference to the law creat ing the Insurance Department in the year 1912 and the author ization of the appointment of a Deputy Insurance Commisioner will show that the salary then allowed 3000 per annum has not since been increased notwithstanding the enormous in crease in living costs since that period and the further fact that within that same period wages salaries and incomes of almost every class of worker have generally much more than doubled This is particularly so with relation to the only class qualified by education and experience to fill adequately and acceptably the office of deputy insurance commisioner of the State of Georgia I have always had difficulty in secur ing the services of a competent deputy for the salary allowed under the laws of the State such difficulty increasing as the years have gone by and invariably my deputies have gone elsewhere after a more or less brief term of service to receive higher and more adequate compensation I am frank to say that in my opinion my present deputy Lewis A Irons is the most capable man that has filled that office since the Insurance Department was organized His experience and personality most admirably qualify him for the office and it is the gen erally expressed opinion in insurance circles by company of ficials and representatives and such of the public as have come in contact with this work that the State of Georgia is indeed fortunate in his appointment In this I most sincerely 21concur but I am confronted with the knowledge of the fact that unless his salary is without delay made more nearly com mensurate with the quality of his service it will not be pos sible to keep him and the State will be the loser It is only at my earnest solicitation that he has consented until now to remain with the Department and this solicitation on my part was made in the hope that ihe Legislature at its coming ses sion would see fit to allow an adequate increase in salary in his behalf I am certain that nothing less than a salary of 4500 will suffice and it is my earnest recommendation that this sum or as much more as the Legislature sees fit to allow be appropriated for this purpose It might not be out of place here to say that by reason of a change of style adopted in the publication of the annual report of the Insurance Department my deputy last year saved the State an expense of 4000 with a similar saving this year and continuously as long as this form of report may continue to be used 22 COMPANIES IN PROCESS OF LIQUIDATION The only company now in the hands of the Insurance De partment for liquidation is the Empire Life Insurance Com pany As stated in previous reports at the time the Court placed the Company in the care of the Insurance Commissioner March 16 1916 the policies then in force with the exception of a few held by dissenters were reinsured by the Inter national Life Insurance Company of St Louis Mo under a reinsurance contract approved by the Court the contract guaranteeing for seven years the payment of the face of the policies at maturity without deduction for deficiency in re serve upon any policy The largest asset of the company its home office building in Atlanta known as the Flatiron Build ing was sold by me as previously reported and the proceeds of this and other assets of the company now on deposit at interest with interest payable semiannually will be ready for distribution upon Court order after the expiration of the seven year period from the time of the taking over of the companys affairs The question of priority of creditors will be decided by the Court and the Supreme Court has held that living and deceased policy holders must be treated on a parity as to claims A payment of fifty per cent on death claims was made in 1918 whereupon the Court held that until assets are re alized sufficient to make a similar payment on claims of living policy holders no further distribution can be made on death claims I append hereto Insurance Commissioner Atlanta Georgia Dear Sir I present for your information and consideration report of the State Mutual Life Insurance Company for the year 1922 in cluding Exhibit showing Income and Disbursements during the calendar year and the assets and liabilities of the Company us shown by its books at the close of the year This Exhibit or Statementattached hereto and marked Exhibit Ashould be considered in connection with this letter though most if not all of the items will probably be found selfexplanatory Referring particularly to the item of Real Estate 17946403 appearing under heading ASSETS and to the item of 4705000 included under Disbursements as reduction in valuation of Real Estate the subject of the Companys real estate holdings having been fully discussed in previous reports I refer to same at this time only to say that we have kept in mind the purpose to dispose of such holdings in accordance with your in structions as rapidly as it may be done at fair prices in the meantime adjusting book valuations to market or investment values as same can be more accurately determined During the year 1922 the book valuations of several of the Companys real estate holdings were reduced to meet these conditions As point ed out in a previous report this does not mean that there was a loss or depreciation of any such amount during the year cov ered by the report but only that the valuation at which the real estate is now carried more correctly represents the actual market or investment value of such holdings which as investi gation showed were carried on the books of the Company at a much inflated figure when you took charge 27 Quite a number of small sales were made during the year but general business conditions and the lack of demand for this character of real estate at reasonable figures made it impracti cable to dispose of more of the Companys holdings However the income from real estate was increased by approximately 1600 the gross rental received being 1877374 An analsysis of the results for the year shows that substantial gains were made from both mortality savings and interest earn ings The actual mortality experienced during the year was only 6467 of the expected based on the American Experience Table This very favorable result considering the fact that the Company has written no new business during recent years evidences the good quality of the Companys outstanding busi ness All death claims accruing were settled promptly by full payment on receipt of proofs of death and claim We have pursued the same policy as heretofore in regard to in vestment of the Companys funds seeking the largest interest return consistent with safety with the result that for the fourth successive year there was an increase in the rate of interest realized on the Companys Assets The business in force at close of the year was 732710425 the decrease through deaths lapses cancellations etc being only 855 of the business in force January 1 1922 The year closed with much for which to be thankful and we have entered 1923 with what we consider well warranted but conservative optimism as to the Companys future Yours very truly
