The Bulletin and Reports will be sent free of charge to all citizens of Georgia on application to the Commi ioner of Agriculture, Atlanta, Ga. 3 Remarks of the Commissioner I wish to call your attention to the contents of th's bulletin, which shows the analy es of all feeding-stuffs sold in Georgia during the year 1913. You will note first the law and rulings by the Commissioner, which clearly indicate our duties in the matter. It is my policy to enforce the law as laid down, and I wish to call your especial attention to the law and assure you that the inspections by the in pector and analy es made by the State Chemist and reported to me shall govern my actions entirely as to whether a feeding-stuff is branded and guaranteed as it should be. The enforcement of thi law means a great deal to the consumers, and, as we all know to people who are not in po ition to know really just what they are buying. I am very sorry, indeed, to note that I have been forced to seize and prevent the sale of a lot of inferior feeding-stuffs that was shipped into Georgia, and I do mo t earnestly call the attention of every purchaser to this and a k that he be careful in e.xamining the printed tag on the bag which shows the analysis of the goods and ingredients of the same which he is purchasing. The reports of the State Chemi t and Pure Food Inspector follow, to which I call your attention. J. D. PRICE, Commis ioner of Agriculture. 4 Report of Inspector Hon. J. D. Price, Commissioner, December 1, 1913. Atlan ta, Ga. Dear Sir: I beg to submit to you herewith inspection report on feedingstuff sold in "Georgia since April 1, 1912: We have visited and inspected the stocks in all the distributing places in the State, besides numerous smaller towns and villages where feeds were sold. There are registered with this Department 983 brands of feedstuffs, being distributed by 229 manufacturers and manipulators. However, all of these brands are not shipped into the State. We have taken samples of 867 lots of feeds and sent them to the State Chemist for analysis, and his reports to you show the result of this work. I call your attention to the fact that but a small per cent. of these feeds fall below the standard required by you and in the main are of good quality. Your ruling requiring the ingredients used in these feeds be shown on . the analysis tags, informing the users as to just what the feed contains, together with its analysis, gives the buyer an insight to the value of the feed and better enables him to judge for himself the quality of the feed he is buying. It has been necessary to condemn many lots of feed, not altogether on account of it being of poor quality or, unfit for feeding, but on account of the requirements as to registration, tagging and branding not being met by the manufacturer. We have found it necessary to stop the sale of quite a number of lots of feeds on account of the lack of proper inspection ta" stamps being attached, which in practically every case was an oversight on the part of the shipper. I am of the opinion that the rescinding of ruling nine, on this subject, will almost, if not entirely, overcome this trouble. 5 \lYe have paid particular attention to the molasses feeds in which "oat-clips" and "oat-feeds" were used. There are a number of these feeds of high quatity, while some of them are of cheap material and require close attention to keep them within the requirements. In the matter of whole grain corn: I am pleased to report that this product has been of better quality during the past season than during any time since the Pure Food Law has been in effect and believe the next season's shipments will be still better on account of the agitation of this matter by the National Government. '.lYe have had but little trouble with feed oats on account of foreign grain and elevator mixtures, bleaching, bin-burnt, etc., and the number of seizures on this account have been small. We have experienced very little trouble in the matter of hay being sold in the State. We have found quite a lot of low grade hay, but in nearly every instance it was sound and would not be injurious as a feed. Your attention is e pecially called to the advisability of recommending to the General ssembly the enactment of a bill placing cottonseed-meal, when used as a feed, under the same requirements as are other feed-stuffs. There is an immense amount of this product sold and used as feed- tuff, yet our present feeding-stuff laws have no jurisdiction over it since it is manufactured and tagged under the fertilizer laws. We have found some trouble with incorrect weights in feed , and investigation brought out the fact that these were not intentional, and I believe the warning given in this connection will have its good effect in the future. With my experience in handling feed- tuffs, and from reading the procedure followed by other States and the results of their work, I belteve that Georgia is receiving as good feeds, if not better, as any other State and the people of the State are giving their co-operation in the enforcement of the feed-stuff law Respectfully submitted, P. METHVli\'", State Food Inspector. 6 The Law Regulating the Sale of Feed-stuffs The following extracts from the Food and Drugs Act of Georgia, approved August 21, 1906, containing provisions of the Act concerning the sale or distribution of concentrated commercial feeding-stuffs: Sec. 12. Be it enacted, That every lot or parcel of concentrated commercial feeding-stuff and condimental Registration, feed used for feeding domestic animals or poultry, sold, Branding, Weight of offered or exposed for sale within this State, shall be package. registered annually with the Commissioner of Agri- culture, and shall have affixed thereto, or printed on the bag, or other package, in a conspicuous place, on the outside thereof, a legible and plainly printed state- ment, clearly and truly certifying the number of net pounds of feeding-stuffs contained therein; provided, that all concentrated commercial feeding-stuffs shall be in standard weight bags or packages of fifty, sev- enty-five, one hundred, one hundred and twenty-five, one hundred and fifty, one hundred and seventy-five, or two hundred pounds each; also the name, brand, or trade-mark under which the article is sold, the name and address of the manufacturer, importer, or jobber, and a statement of the maximum percentage it con- tains of crude fibre, and the minimum percentage it contains of crude fat and crude protein, allowing one per cent. of nitrogen to equal six and one-quarter per cent. of protein; both constituents to be determined by the method in use at the time by the Association of Agricultural Chemists of the United tates. 7 Defining Feedlngstuffs. Sec. 13. Be it enacted, The term "concentrated commercial feeding-stuff, 'a u ed herein, shall include cottonseed-meal, linseed-meal, corn- and cob-meal, cocoanut-meal, gluten feed, gluten-meal, germ feeds, corn feeds, starch feeds, sugar feeds, dry brewer's grains, malt sprouts, dried distiller grain, dried beet refuse, hominy feed, cerealine feed , rice-meals, ricebrans, rice-polish, peanut-meal, oat feeds, corn and oat feeds, corn-bran, wheat-bran, wheat-middlings, wheatshorts, ground beef or fi h scraps, mixed feeds, clovermeal, alfalfa-meal and feeds, peavine-meal, cottonseedmeal feeds, whole seeds and grain and meal, mixed or unmixed, made from such seeds or grain , and all other materials of a imilar nature. Registratiou, Analysis. Sec. 14. Be it enacted, That each and every manufacturer, importer or jobber, agent 01' seller, before selling or exposing for sale in this tate, any concentrated commercial feeding-stuff , as defined in section 13 of this Act, shall, for each and every feeding-stuff bearing a distinct name or trade-mark, file with the Commissioner of griculture a copy of the statement named in section 12 of this Act, and accompany said statement, when so reque ted by the Commissioner of Agriculture, by a sealed glass jar or bottle containing at least one pound of the feeding-stuffs to be sold, e..xposed or offered for sale, which sample shall correspond within reasonable limits to the feeding-stuff which it represents in the percentage of protein, fat and fiber which it contain. That the Commis ioner of griculture shall cause at least one sample of each distinct brand of feeding-stuff sold in this State to be analyzed annually by or under the direction of the tate Chemist. aid analysis shall include determination of crude fat and of crude protein, and such other determinations a may at any time be deemed advisable by the State Chemist. Tax. Products Exempt trom Tax. Sec. 15. Be it enacted, That each and every manufacturer, importer, jobber, agent, or seller of any concentrated commercial feeding-stuff, as defined in sec- 8 tion 13 of this ct, shall pay to the Commissioner of Agriculture an inspection tax of twenty cents per ton for each ton of such concentrated feeding-stuffs sold, offered or exposed for sale in this State, and shall affix to each car shipped in bulk and to each bag, barrel or other package of such concentrated feeding-stuff, a stamp, to be furnished by said Commissioner of Agriculture, indicating that all charges had been paid; provided, that the inspection tax of twenty cents per ton shall not apply to cottonseed-hulls, hays and straws, whole seeds and grains and pure meals made from whole grains and seeds; not mixed with other substances, but sold separately as distinct articles of commerce. Should any of these materials otherwise exempt be mixed or adulterated with any substance for the purpose of sale, the package which contains it, or in which it is offered for sale, must have plainly marked or indicated thereon the true composition of the mixture, or the character of the adulteration. Tax stamps shall be in denominations as follows: one-half cent, three-quarters cent, one cent, one and one-quarter cents, one and one-half cents, one and three-quarter cents, two cents, or multiples thereof. The Commissioner of Agriculture may prescribe the f rm of such tax stamps. Whenever a manufacturer, importer, or jobber of a concentrated feeding-stuff shall have filed the statement named in section 12 of this Act and paid the inspection tax, no agent or seller of said manufacturer, importer or jobber shall be required to file such statement or pay such tax. Sec. 16. Should such materials as referred to above be registered, and it is afterwards discovered that they are in violation of the above pro- vision, the Commissioner of Agriculture shall have the 9 po, er to cancel the registration. \ hen the pecial inspector provided for in this Act is unable to cover the territory ufficiently, the ommissioner of Agriculture may utilize the oil and fertilizer inspectors in taking ample of drua , feed- tuffs or food product, without other compen ation than that now received. Sale of Damaged Feedingstuffs, Defining Adulternnts. eizure of Feeds. Sec. 17. Be it enacted, That the ale of mouldy and damaged feeding-stuff is prohibited as feeds, except on full notice in writing to the purcha er of the nature and extent of the damage. ny manufacturer, importer jobber, agent, or seller who shall sell, offer or expo e for sale or di tribution in thi tate any concentrated c mmercial feeding- tuff a defined in this Act, without complying with the requirements of the preceding ection of thi Act, or who hall sell, offer or expose for sale or di tribution any concentrated commercial feeding- tuff which contain ubstantially a smaller percentaae of con tituents than are certified to be contained, or who hall adulterate any feeding-stuff with foreian mineral or other imilar ub tance or ub- tance , such as rice-hulls or chaff, peanut-shells, corncob, oat-hull, r other similar material of little or no feeding value, or with ubstances injurious to the he'alth of domestic animal hall be guilty of a violation of the provisions of this ct and the lot of feeding- tuff in question shall be subject to eizure condemnation and sale or destruction by the ommissioner of griculture, and it shall be the duty of the sheriffs of the countie of 'thi tate to eize and ell by public sale each and every bag. packaae r lot of commercial concentrated feedin a- tuff old, or offered for sale, or for di tribution in thi tate which shall not have -ecurely attached the stamp mentioned in section 15; provided, that should the owner or agent show to the satisfaction of the sheriff that such stamps had been attached and the ame had become detached, the sheriff shall release the same without cost to the owner or agent. All moneys or proceeds derived from the seizure and sale of concentrated commercial feeding-stuffs hall be cm'ered into the tate treasury. 10 Sec. 18. Be it enacted That the Commi ioner In pection. Agriculture i hereby authorized to have collected a sample not exceeding t" 0 pound in weight, for analyis, from any lot, parcel or package of concentrated feeding-stuff as defined in ection 13 of this ct, which may be in the possession of any manufacturer, importer, agent or dealer; but said sample shall be taken from not Ie s than ten per cent. of the whole lot inpected. Sec. 19. Sec. 20. Be it enacted, That any manufacturer. Collection dealer or other per on who hall impede obstruct, of Samples. hinder or otherwi e preyent or attempt to prevent an inspector or other per on in the performance of his duty in collectinrr amples or therwi e in connection with thi ct, hall be guilty of a misdemeanor, and hall upon conviction, be fined not Ie s than ten dollars nor more than fifty dollar, and any violation of the provi ion of the ection of thi Act relating to feed- ing- tuffs for dome tic animal hall be punished by a fine not exceeding fifty dollars, or impri onment not 11 exceeding thirty day , or both, in the discretion of the court. Fixing Standards. Sec. 21. Be it enacted, That it shall be the duty of the Commissioner of Agriculture and the State Chemist to fix standards of purity for food products where the same are not fixed by this Act, in accordance with those promulgated by the ecretary of Agriculture, the Secretary of the Treasury and the ecretary of Commerce and Labor of the United States, when such standards have been published; and when not yet published, the Commissioner of Agriculture and the State Chemist shall fix such standards. Analysis. Prosecutions. henever the State Chemist may find, by analysis, that adulterated, misbranded, or imitation drugs, liquors or food products have been manufactured for sale, or put on sale in this State, he shall forthwith furnish a certificate of analysis to that effect to the Commissioner of Agriculture, who shall transmit the ame to the State Solicitor in the county where the aid adulterated, misbranded, or imitation drugs;iiquor or food product was found. It shall be the duty of the tate olicitor to prosecute all per ons violating any provisions of this Act as soon as he receives the evidence transmitted by the Commi sioner of gricuIture. Sec. 25. Be it enacted, That this ct shall be in force and effect from and after the first day of August, 1907. 12 SYNOPSIS OF THE LAW 1. The law requires that all commercial feeding-stuffs be registered annually with the Commissioner of griculture. 2. The following ingredients must be registered: Protein, Fat and Fibre, together with the ingredients of which the feed is composed. 3. Where standards are established, the feeds must meet these standards. 4. All commercial feeding-stuff must haye the requisite number of stamps attached. 5. No feed can be adulterated with substances of little or no feeding value, such as corncobs, peanut-shells, oat-hulls and chaff and rice-hulls. 6. Where no standard is established, the manufacturer may make his own guarantee, but is required to live up to his guarantee. RULES AND REGULATIONS The following Rules and Regulations have been prescribed by the Commissioner of Agriculture, which are designed to explain and facilitate the execution of the various sections of the Act relating to feed-stuffs: Registration First-All manufacturers, agents or dealers who propose to ell or offer for sale any feed-stuffs in this State must apply to the Commissioner of Agriculture for blank forms on which they will be ,required to register the name or brand of the feeding-stuff which the) propose to sell, their own names and addresses, and also the place where their goods are manufactured; provided, a person desiring to so regi ter is not the actual manufacturer, he may be permitted to register and guarantee the product, using the words, "manufactured for or guaranteed by." They must also 13 give the guaranteed analysis of their goods, stating the minimum percentage of protein and fat whLch they contain, and the maximum percentage of crude fibre. They must also register the various ingredients of which their feeding-stuffs are composed. Branding and Tagging Second....,...All feeding-stuffs must be offered for sale in sacks or packages of uniform capacity as prescribed in section 12 of the Act; that is, bags or packages must contain 50, 75, 100, 125, 150. 175 or 200 pounds each. Manufacturers or dealers will be required to furnish tags, which must be attached to these packages. On these tags must be clearly printed all the essential information given in the registration above, as illustrated below. Guarantee tags must be printed in plain type with black ink.
