Energy, Utilities & Telecommunications Committee HB 159 State Cybersecurity Review Board; establish Bill Summary: HB 159 establishes the State Cybersecurity Review Board, which consists of six members: the adjutant general of the Georgia Department of Defense or his/her designee; an individual who works for the state in the area of information security or his/her designee to be appointed by the governor; the director of the Georgia Bureau of Investigation or his/her designee; the director of the Georgia Emergency Management and Homeland Security Agency or his/her designee; a leader in cyber innovation and coordination between public and private sectors or his/her designee to be appointed by the governor; and the governor or his/her designee. The board will meet at least once a quarter and review the cybersecurity of all agencies, establish and oversee cybersecurity training for all agencies, and provide an annual report of the state of cybersecurity in Georgia to the governor, lieutenant governor, the speaker of the House, and the chairpersons of the Senate Regulated Industries and Utilities Committee; the House Committee on Energy, Utilities, and Telecommunications; the Senate Veterans, Military, and Homeland Security Committee; and the House Committee on Public Safety and Homeland Security. The report shall not be subject to public inspection or disclosure. The board, in conjunction with the Georgia Technology Authority, will establish cybersecurity training for all agencies, which shall be required on at least a semiannual basis. Any employee who fails to complete the training per the board's schedule may be subject to formal disciplinary action, up to and including termination. An employee or his/her supervisor may submit to the board for approval a written request for an extension not to exceed 60 days. Authored By: House Committee: Rep. Don Parsons (44th) Energy, Utilities & Telecommunications Committee Action: 01-25-2022 Do Pass by Committee Substitute Health & Human Services Committee HB 752 Psychiatric Advance Directive Act; enact Bill Summary: House Bill 752 provides for a psychiatric advance directive for competent adults to set their mental health preferences. The bill allows patients to establish their wishes related to treatment, medications, and establish an agent to make decisions on their behalf if they are unable to do so. The directive is effective upon signature of the patient as witnessed by two competent adults. The provider or facility shall comply with the directive to the fullest extent possible, and providers acting in line with the directive are protected from certain liabilities. The additional judge shall be appointed by the governor for a term beginning July 1, 2022, until December 31, 2024. In lawsuits against one or more defendants, following a reduction of damages attributed to any non-party, the damages shall be apportioned to the liable person or persons according to each person's percentage of fault. Chuck Efstration (104th) Judiciary Committee Action: 01-25-2022 Do Pass Retirement Committee HB 385 Teachers Retirement System of Georgia; employ beneficiaries; permit public school systems Bill Summary: House Bill 385 allows retired members of the Teachers Retirement System of Georgia, who have obtained 30 years of creditable service, to return to work full-time, providing instruction as a certified teacher of pre-kindergarten through grade 12, while receiving their full postretirement benefit. Retired members can return to work in an "area of highest need," as designated by the Department of Education in consultation with the Professional Standards Commission. The "areas of highest need" will vary across Georgia based on the Regional Education Service Agency in which the school system resides. The school system must pay the employer and employee contribution rate, and the member cannot accrue additional creditable service. The member must wait one year from the date of retirement for their return to work. The state auditor is required to provide a performance audit on the value and necessity of full-time employment of retired members and the impact on school systems. The return to work provision is valid from July 1, 2022, to June 30, 2026. Authored By: House Committee: Rep. The commission shall consist of one member of the Georgia House of Representatives appointed by the speaker of the House; one member of the Senate appointed by the president of the Senate; and five discretionary members who represent entities that provide sustainability and employee wellness certifications of which two are appointed by the president of the Senate, two are appointed by the speaker of the House, and one appointed by the governor. The bill also appoints the following, who may name a designee: the executive director of the Georgia Municipal Association; the executive director of the Association County Commissioners of Georgia; the executive director or chairperson of the Georgia Economic Developers Association; the president or chairperson of the Georgia Chamber of Commerce; the president or chairperson of the Metro Atlanta Chamber of Commerce; and the commissioner of the Georgia Department of Economic Development.
