The bill specified that the payment to the estate would be allowed only in the event that the deceased or organically brain-damaged individual had no surviving unmarried spouse, dependents of the spouse, or dependents of the deceased or organically brain-damaged person. Qualifying members, those with at least two years of membership service, would be required to show proof of service and pay an amount equal to the full actuarial cost of creditable service. This bill has been certified by the Georgia Department of Audits and Accounts as a fiscal retirement bill. Ellis Black (8th) Retirement Committee Action: 03-07-2018 Do Pass SB 197 Employees' Retirement System of Georgia; chairperson of the board of trustees; provision; change Bill Summary: SB 197 prohibits any law, rule, regulation, resolution or ordinance to pass allowing for creditable service unless the individual is required to pay the full actuarial cost of the service granted. This does not apply to creditable service that an individual accrues while a member of that system. The bill limits the amount of creditable service received to 120 months. Lastly, the Georgia Municipal Employees Benefit System is excluded from these provisions. This bill has been certified as a non-fiscal retirement bill by the Georgia Department of Audits and Accounts. Also, this legislation allows employers to establish automatic enrollment arrangements; currently, employees must request participation and determine the contribution level.
