Friday, April 13, 2007 The thirty-sixth day of the 2007 legislative session was called to order by President Pro Tempore Eric Johnson of the 1st. Senator Don Balfour of the 9th stated that the journal had been read and was found to be correct. Senate Bills 324 and 325 were read for the first time and assigned to committee. Sen. Mitch Seabaugh of the 28th moved that the rules be suspended so that more Senate bills could be read. There was no objection. SB 326-333 were then read for the first time and assigned to committee. House Bills 687, 792 and 796 were read for the first time and assigned to Senate committees. The clerk of the Secretary then read the reports of standing committees and second readers. Majority Leader Tommie Williams the 19th moved to dispense with the morning roll call and there was no objection. Sen. Johnson led the Senate in the Pledge of Allegiance. He then introduced the Chaplain of the Day and guest of Lieutenant Governor Casey Cagle, Pastor George Dillard of Peachtree Christian Church, who led the Senate in the daily devotional. Sen. Kasim Reed of the 35th took the well on a Point of Personal Privilege to deliver a message to the Senate from the daughter of Sen. Steve Thompson of the 33rd, thanking members for their support during the loss of his mother. The Senate Local Consent Calendar, consisting of HB 553-554, 616, 660, 688, 738, 775 and 782, was adopted by a vote of 46 to 0. Gail Davenport of the 44th took the rostrum to speak to the resolution. Sen. Chip Pearson of the 51st took the well on a Point of Personal Privilege to discuss the current tax issues. Sergeant-at-Arms Lorenzo Wallace escorted Sen. Nancy Schaefer of the 50th and her guests to the rostrum. SR 440 was read which celebrates the Toccoa Falls College on the occasion of its centennial anniversary. Sen. Schaefer took the rostrum to speak to the resolution and gave a brief history of the college. The Secretary read HB 128, which establishes the annual sales tax holiday. Sen. Chip Rogers of the 21st took the well to explain the bill. HB 128 passed by a vote of 44 to 0. The Secretary read HB 155, which authorizes the Department of Human Resources (DHR) to obtain a criminal history of owners of private home care and child welfare agencies. Sen. Renee Unterman of the 45th took the well to speak to the bill's substitute. The Committee Substitute was adopted by a vote of 31 to 0. HB 155 passed by substitute by a vote of 46 to 0. The Secretary read HB 171, regarding the sale of vehicles for scrap metal or parts. Sen. Judson Hill of the 32nd took the well to present the bill. HB 171 passed by a vote of 48 to 0. The Secretary read HB 282, which provides for a sales tax exemption for repair equipment used in the maintenance of aircrafts. Sen. Seabaugh presented the bill and Amendment 1, which removes certain language regarding the flyaway clause. He yielded to question from Senators Steve Henson of the 41st, Pearson and Bill Heath of the 31st. Amendment 1 was adopted by a vote of 34 to 0. HB 282 passed as amended by a vote of 41 to 4. The Secretary read SR 600, which recognizes the East Hall High School Vikings Girls' Basketball Team. Sen. Lee Hawkins of the 49th took the well to speak to the resolution. The Secretary read HB 357, which incorporates certain federal tax laws into Georgia law. Sen. Rogers took the well to present the Committee Substitute and to emphasize that the bill contains a retroactive tax measure. He yielded to questions from Sen. Reed. Seth Harp of the 29th moved that the Senate adhere to its disagreement to the House Substitute to SB 17 and that a Conference Committee be appointed. There was no objection. Sens. Joseph Carter of the 13th, Harp and Don Thomas of the 54th were appointed to the Conference Committee on SB 17. Sen. Seabaugh moved to immediately transmit HB 282 back to the House. There was no objection. HB 443 was read, which is an annual bill removing the surcharge of unemployment tax. Sen. Ralph Hudgens of the 47th took the well to explain the bill. The Committee Substitute was adopted by a vote of 29 to 1. HB 443 passed by a vote of 42 to 1. HB 497 was read which establishes a pre-birth surrender of rights for the biological father of a child who is being adopted. Sen. Bill Hamrick of the 30th took the well to explain the bill. The Committee Substitute was adopted by a vote of 30 to 0. HB 497 passed by substitute by a vote of 41 to 4. The Secretary read HB 529, which makes minor changes to the code section that created the Senate and House Budget offices. Sen. Jack Hill of the 4th took the well to present the bill and to recognize the exemplary efforts of the Senate Budget and Evaluation Office during the 2007 session. HB 529 passed by a vote of 45 to 2. The Secretary read HB 551, which establishes the State False Medicaid Claims Act. Sen. Harp took the well to speak to the bill. HB 551 passed by a vote of 46 to 0. House Resolution 369 was read, which authorizes the conveyance of state owned property in Baldwin, Charlton, Chatham, Coffee and Columbia counties. Sen. Rogers moved that the Senate insist on its substitute to HB 366. There was no objection. Sen. John Douglas of 17th the moved that the Senate disagree to the House Amendment to the Senate Amendment to HB 81. There was no objection. Sen. Hamrick moved that the Senate agree to the House Substitute to SB 70. There was no objection. Sen. Hamrick took the well to speak to the House Substitute to HB 70. HB 70 passed by substitute by a vote of 45 to 0. The Senate stood in recess for thirty minutes. After the Senate reconvened, Lt. Gov. Cagle took the gavel to preside. Sen. Rogers moved to suspend the rules to allow for the reading of a Committee Report and there was no objection. The Secretary read the report of the Finance Committee. Sen. Hill of the 4th moved that the Senate adopt the Conference Committee Report on HB 94. He then took the well to speak to the FY 07 amended budget. The report of the Conference Committee was adopted by a vote of 48 to 0. Majority Leader Williams moved that the rules be suspended to allow for the second reading of Senate bills. HB 30, 193, 148, 162 and 186 were then read for a second time.
