Georgia Senate Legislative Wrap-up 2003 Senate Highlights January 13 April 25, 2003 The 2003 Session of the Georgia General Assembly was the most historic legislative gathering since Georgia's founding fathers first met in 1780 at Heard's Fort in Wilkes County outside of Washington, Georgia. When the General Assembly convened at 10:00 a.m. on January 13, 2003, the Senate Republicans were in the majority for the first time in more than 125 years and would elect the first Republican President Pro Tempore, Eric Johnson of the 1st. Across the Capitol, Democrats maintained their control of the House of Representatives, but they would elect a new Speaker of the House after 30 years Terry Coleman of Eastman. Hours later, the first Republican Governor since Reconstruction, and a former member of the Georgia Senate, George E. "Sonny" Perdue would be sworn in as the 81st Governor of Georgia. The Senate would grapple with many controversial issues during its 40-day session that lasted longer than any other gathering of the state's General Assembly in 114 years. A new Georgia flag would be proposed, ethics laws would come under consideration, new Senate maps would be voted on, new funding was needed for indigent defense, tort reform was deliberated by the body, as were water resources, abortion laws, homeland security plans, changes in predatory lending practices, proposed laws to protect Georgia's children, education reforms, and of course the 2004 state budget which includes a $128 million "revenue enhancement" on tobacco. By the 40th day, 389 Senate bills and 517 Senate resolutions were introduced for contemplation by the 56 Senators, but only 115 Senate bills and 21 resolutions would make it to the Governor's desk. More than 280 House bills were debated and passed and await Gov. Perdue's signature. After several years of revenue declines in the state the legislature adopted a $16 billion budget, but not before agreeing to an additional tax on tobacco. The FY 2004 budget is balanced, and makes over $1 billion in state agency cuts. It also provides $523 million in retirement income tax relief over a three year period, makes the $380 million homestead exemption permanent, continues the sales tax holiday (July 31 August 3, 2003), gives an income tax exemption to military personnel, offers more than $65 million in economic development incentives across Georgia, and increases the tobacco user fees, which is expected to generate $180 million in state revenues. "The effect on our state Governmental has been a record two straight years of declining state revenues and budget shortfalls. That hasn't happened since the Great Depression," Gov. Perdue told a joint session of the Senate and House of Representatives early in the Session. "No modern governor has ever faced such a budget process." 2003 Senate Wrap-up Senate Information Office Page 1 of 78 When all was said and done, in the waning hours of the 40th legislative day, House Bill 43, which includes Georgia's Economic Stimulus Act of 2003, passed both Chambers and with the additional revenue, the 2004 State Budget was balanced. While many speculated that an additional shortfall in anticipated budget revenues may require a Special Session of the Georgia legislature, a definite return to the state Capitol was alleviated when the budget passed the Senate at 11:05 p.m. a mere 55 minutes before Lt. Gov. Mark Taylor declared the 2003 Session of the Georgia General Assembly Sine Die, Latin for "without day." Earlier in the Session, the Senate passed a supplemental budget for the 2003 fiscal year which used $138 million from the Revenue Shortfall Reserve, $700 million from the FY 2001 appropriations, and nearly $50 million in new revenue or agency lapses to provide additional revenues to various state agencies which depend on the additional revenues due to growth. While many state agency programs were cut, each state agency was asked to make a three to five percent austerity adjustment to keep the 2003 budget balanced. Several pieces of legislation that generated a great deal of interest among Georgians included: Senate Bill 1 Legislation to punish parents, guardians, and other caretakers of children who don't protect the charges in their care. Sen. Michael Meyer von Bremen of the 12th related several instances where, under current law, adults could not be prosecuted for the willful, wanton, and reckless disregard for a child's safety. The legislation, part of Lt. Gov. Mark Taylor's legislative package, passed the Senate 54-0, but failed to pass the House of Representatives. View Senate Bill 1 Senate Bill 31 A measure to strengthen Georgia's ethics laws was debated in the Senate early in the Session. In a spirit of bi-partisanship, the proposal, which was part of Gov. Sonny Perdue's legislative package, was amended by Sen. George Hooks of the 14th and Sen. Michael Meyer von Bremen of the 12th. The bill, authored by the Governor's administration floor leaders, Sen. Bill Stephens of the 51st and Sen. Dan Lee of the 29th, passed the Senate 56-0. The bill made it to the floor of the House of Representatives, but was then recommitted to the House Judiciary Committee. View Senate Bill 31 Senate Bill 133 One of the most anticipated bills in 2003, Tort Reform, did not fare well this year. As originally written, the bill backed by Georgia physicians but demonized by trial lawyers would have capped non-economic awards for punitive damages and for pain and suffering in medical malpractice suits. The legislation was amended by the Senate Judiciary Committee and the cap was removed. It was amended twice on the floor of the Senate by Sen. Charlie Tanksley of the 32nd and the bill's author, Sen. Tom Price of the 56th. The amended version passed the Senate 53-1. The Senate bill remains in the House Judiciary Committee, however House Bill 792, which does include provisions discouraging frivolous litigation passed both chambers and is awaiting the Governor's signature. View Senate Bill 133 Senate Bill 193 This bill restores "fair dismissal rights" to public school teachers. Under the Education Reform Act of 2000, teachers who began teaching in Georgia's public schools after June 30, 2000, lost all access to a hearing if they were terminated or their contract wasn't renewed. This legislation, authored by 2003 Senate Wrap-up Senate Information Office Page 2 of 78 Sen. Dan Moody of the 27th, was amended by Sen. Horacena Tate of the 38th, and restores those rights to a fair dismissal hearing for public school teachers. The measure passed the Senate 53-0 and the House of Representatives 160-7, and awaits the Governor's signature. View Senate Bill 193 House Bill 237 The "water" bill was another controversial piece of legislation that lawmakers had to debate this year. Transferability of water permits between permit holders with the consent of the Environmental Protection Division (EPD) in areas of the state where there is a moratorium on the issuance of additional permits proved to be the sticking point that probably kept the bill from reaching the Governor's desk. The bill, which was the result of recommendations from a Joint Comprehensive Water Plan Study Committee, also addresses interbasin transfers of surface or ground water that crosses more than three adjacent counties except to satisfy critical needs affecting public health and safety. The legislation also would have created a Comprehensive State Wide Water Management Planning Act, which requires the EPD to develop a plan within three years to document state wide water policies and guide river basin management plans, regional water planning efforts, and local water plans; and would have required the State Soil and Water Conservation Commission to install and operate meters on all permitted farm irrigation equipment by July 1, 2009 (if adequately funded by the General Assembly). Only the water metering portion for farmers actually saw the light of day. The "watered-down" version of the bill passed the legislature as House Bill 579. View Senate Bill 237 View House Bill 579 House Bill 380 Possibly the most contentious piece of legislation on the calendar this year, the original bill called for a March 2, 2004 referendum on the flag adopted in 2001 (Should it be changed?), and then a vote on the pre-1956 flag and the flag adopted by the Georgia Legislature in 1956 with the Confederate battle emblem. Soon it would be amended to adopt a completely new flag, but one similar to the pre-1956 flag. Then, a referendum would be held on March 2, 2004, asking if the public would like to keep the 2003 state flag. If the will of the people was to keep the 2003 flag, that would have ended the debate. However if the people voted against the 2003 flag, there would have been a second referendum on July 20, 2004 on bringing back either the pre-1956 flag or the 1956 flag. The House of Representatives passed the amended version of the bill, but once it got to the Senate, it was discovered that there were some problems with the dimensions of the proposed 2003 flag. The dimensions were changed through an amendment by Sen. George Hooks of the 14th, and made more "historically accurate" by removing the state seal and replacing with the coat of arms as the flag bore in its original state. It also removed the words "In God We Trust" from the white stripe in the flag and put them under the coat of arms in the blue canton of the flag. The vote taken on March 2, 2004 will ask voters to decide between the 2001 flag and the 2003 flag. The legislation passed the Senate 36-20 and the House 111-67. Gov. Sonny Perdue signed the legislation on May 8, 2003 and the new state flag currently flies over the Georgia Capitol. View House Bill 380 Senate Bill 205 This proposal will make it a felony to possess and/or transport anhydrous ammonia, the ingredient used for making methamphetamine. The penalties will include imprisonment and up to $100,000 in fines. In addition, a person will be charged with a felony if he or she is found in violation of possessing, controlling, manufacturing, delivering, distributing, dispensing, 2003 Senate Wrap-up Senate Information Office Page 3 of 78 administering, purchasing, selling, or possessing-with-the-intent-to-distribute any substance containing any amounts of ephedrine, pseudoephedrine, and/or phenylpropanolamine that has been altered from its original condition so as to be powdered, liquefied, or crushed. The legislation was authored by the Governor's administration floor leaders, Sen. Bill Stephens of the 51st and Sen. Dan Lee of the 29th, and passed the Senate 55-0 and the House of Representatives 151-1. Governor Perdue signed this measure on May 15, 2003. View Senate Bill 205 Senate Bill 23 The Woman's Right To Know Act passed the Senate 34-18, but not before hours of debate and amendments galore. Authored by Sen. Don Cheeks of the 23rd, the legislation would have required women seeking an abortion to wait 24 hours after their initial consultation with their physicians, and would have required doctors performing the abortion to provide the women with detailed information about the risks involved, alternatives to abortion (such as adoption), and pre-printed brochures with pictures of developing fetuses. The bill remains in the Judiciary Committee of the House of Representatives. View House Bill 23 Down but not out . . . Three Senators missed a few days during the long session, but all were back before Sine Die. Sen. Faye Smith of the 25th suffered a brain aneurysm in February, Sen. Terrell Starr of the 44th had surgery on his heart, and Sen. Valencia Seay of the 34th also suffered from heart problems. All were back at work looking healthy and happy in no time. Fiscal Year 2003 Supplemental Budget Each year, the members of the Georgia General Assembly must revisit the current budget and make changes and additions. State agencies often need more money than first anticipated during the crafting of the original budget, and need additional revenues. For instance, the Georgia Department of Education must readjust their numbers once the counts are in for the number of students enrolled in Georgia's public schools. After much debate in the Senate and the House of Representatives, the FY 2003 Amended Budget was passed by the General Assembly on March 24, 2003. It currently is awaiting the Governor's signature. HB 121 FY 2003 Amended Budget Revenues In order to adjust the $620 million reduction in the Governor's FY 2003 revenue estimate, the General Assembly appropriated: ! $138 million from the Revenue Shortfall Reserve ! $704 million from FY 2001 which was appropriated in House Bill 1002 ! $48 million in new revenues and agency lapses In addition to using alternative revenue sources, agencies and programs were cut. All agencies were given an austerity adjustment of between 3 and 5 percent depending on the size of the agency. Fiscal Year 2004 General Appropriations Budget Passing a budget for the state of Georgia is no easy matter, since both the Senate and the House must agree on what should be included in or deleted from the budget. State funds are raised through taxes, fees, and fines, and when the revenues do not meet expectations, as was the case this year, legislators must find ways to cut spending and/or increase these revenues. Once the appropriations bill has passed both the Senate and the House of Representatives, it goes to Governor Sonny Perdue for his signature. The Governor, who has line item veto privileges, has 40 days to sign 2003 Senate Wrap-up Senate Information Office Page 4 of 78 or veto portions of or all of the state expenditures for next year. The state's new budget year will begin on July 1, 2003. HB 122 FY 2004 Budget Revenues The Governor's projected expenditures for the FY 2004 Budget were estimated at $16.1 billion, however, projected revenues amounted only to $14 billion. Additional revenues were expected to be generated from increased taxes on tobacco and alcohol, and the Georgia Lottery. Both the House and the Senate, after looking closely at the revenue raising options available, agreed to the following line items with the goal of not overly burdening the people of Georgia and by dipping into the state's "rainy day fund." The FY 2004 budget was adopted by the Senate and House of Representatives on April 25, 2003. The revenues to support the appropriation beyond the Governor's Revenue Estimate include: ! $12.8 million in new revenues from increased fees ! $180 million from the 25 cent increase in tobacco tax ! $142 million from the Revenue Shortfall Reserve (rainy day fund) ! $132 million in revenues pulled forward from FY 2005 by employers filing state income tax withholdings on the same schedule as required by the federal Governmental No Funding Provided in the FY 2004 Budget ! Workers' Compensation Fund: Currently has sufficient funds for claim pay out (no monies contributed in the FY 2004 Budget.) ! Group Term Life Insurance Fund: Currently over-funded (no contributions in the FY 2004 Budget.) Preserved in the Budget: ! $10 million for green space. ! $10 million for school improvement teams. ! Borrowed and returned $30 million used to fund school nurses (from tobacco funds) to draw down federal money to offset a 10 percent reduction in reimbursement rates for hospitals providing Medicaid services. Programs Funded under the FY 2004 Budget Department of Community Affairs F $550,000 to increase funding to the Georgia Regional Transportation Authority to support the expanded operations of the Clayton County Transit System and to qualify for matching federal grants F $30.7 million to fund a local assistance grant to the Savannah Economic Development Authority for the "megasite" in Pooler F Chairman Rules PRESIDENT PRO TEMPORE The 2003 Session Brought Historic Changes To The Senate On Inauguration Day in January 2003, the first Republican Governor in 130 years was sworn into office. In the state House of Representatives, the first new Speaker was elected in 29 years and, in the state Senate, Republicans took the majority for the first time ever. A two-party system had finally arrived in Georgia. In the midst of this historic shift in political power, we faced a war and the worst recession since the Great Depression. This was Georgia's first exposure to the benefits of a two-party system. It was bound to be awkward and uncomfortable. Sir Winston Churchill said, "Many forms of Governmental have been tried, and will be tried in this world of sin and woe. No one pretends that democracy is perfect or all-wise. Indeed, it has been said that democracy is the worst form of Governmental except all those others that have been tried from time to time." In spite of a session that was forced to deal with tough choices and a learning curve for leaders, members and staff, the Senate faced the process in a bi-partisan manner that reflected the demands of the people of Georgia. In a dramatic finish to the longest session in 114 years, we dealt with the budget, the economy, the state flag, indigent defense, education, the protection of our "invisible" children, and civil justice reform. This did not happen by accident. The groundwork was laid on Inauguration Day. As promised, the new Republican majority reached out in partnership. Four committees were offered to Democrats and three were accepted. This tripled the number of committees chaired by the minority party in the past. The three Chairmen, Senators Rene Kemp, Regina Thomas and Hugh Gillis, did an outstanding job. Legislation authored by the Minority party was seriously considered for the first time. Of the 214 bills passed by the Senate, 65 were Democratic bills (30 percent). The Minority Leader was a part of discussions on the legislative schedule and the Rules calendar. For the first time, Republicans chaired a majority of the committees in the Senate. Each chair took their charge seriously and worked hard to perfect legislation through the committee process rather than when the bill came to the floor for debate. I am proud of each one of the Republican Senators that chaired a committee during this historic time. The Lt. Governor was generous with his patience and advice throughout this historic transfer of power. Daily meetings with him helped guide the new leadership in uncharted territory. Former President Pro Tempore Terrell Starr and the Dean of the Senate, Hugh Gillis, also helped with their wisdom. Former Committee Chairs like Senators Peg Blitch and George Hooks were very helpful to the rookies who took their places. Behind the scenes, there was far more cooperation between the two parties than ever before. We were partisan when it was appropriate and bi-partisan when necessary. We stumbled some in the opening weeks, but settled down in mutual respect and the sobering mantle of our public duties. We had a job to do and it was best done together.
