Highlights of Major Senate Action 
For the Weeks of February 3 and 10, 2003 
last week was a short week for many Senators, but Appropriations Committee members stayed on the Hill to work on the FY 2003 Supplemental Budget. During three days of hearings, Senators met with agency department heads or their designees to determine where budgets could be cut and where increases were necessary in order to continue with their programs. 
On Monday, February 3rd, the Senate passed the first bill of the Session with Senate Bill 7 by Sen. Carol Jackson of the 50th. SB 7 relates to the regulation of air ambulance services. The bill passed 54-0. 
A week later, the Senate voted to send Senate Bill 6 back to the Public Safety and Homeland Security Committee. Senate Bill 6, by Sen. Mike Crotts of the 17th, would make it mandatory for anyone who is stopped by law enforcement to remain in his/her vehicle unless instructed to do otherwise, turn the interior lights on, and turn the engine off. 
On Tuesday, Senate Bill 14, by Sen. Faye Smith of the 25th passed unanimously. The bill addressed penalty provisions for Georgia Dairy Act violations. 
Wednesday, was a big day, as the Senate received visits from both Gen. James Oglethorpe, the man who founded Georgia, and University of Georgia head football coach Mark Richt. Richt and the UGA Bulldogs were honored by the Senate for their most recent winning season. 
Sen. Don Cheeks of the 23rd authored SB 53, an amendment to the Fair Lending Act of 2002. The law recently came under fire after Standard and Poor's, Moodys, and others that refused to rate mortgage loans that are subject to the law. The bill passed as amended by Sen. Vincent Fort of the 39th, 52-0 and was immediately transmitted to the House of Representatives. It becomes law upon the Governor's signature. 
Senate Bill 12, by Sen. Renee Unterman of the 45th, passed 54-0. The bill would make it a felony to abuse, neglect, or exploit an elderly or disabled person with imprisonment of not more than five and not less than one year. 
Sen. Michael Meyer von Bremen of the 12th introduced SB 83 which allows funds collected by county law libraries may be used to provide a law library for the district attorney of the judicial circuit, the solicitor-general of the state court, or the public

 defender. It also allows for excess funds to be used to provide legal representation for indigent defendants. The bill passed by committee substitute 52-1. Thursday proved to be a long day for most Senators as three important bills were up for a vote. Two of the bills were part of Gov. Sonny Perdue's legislative package.

 Sen. Dan Lee of the 29th, addressed the committee substitute of SB 91, the legislation that sets standards for redistricting. Much debate followed on both sides of the aisle. Sen. Peg Blitch of the 7th offered a friendly amendment which was accepted by the Governor's floor leader. The bill passed the Senate along party lines, 30-23. Gov. Perdue's other floor leader, Bill Stephens of the 51st, addressed SB 31, which is the first part of Governor Perdue's Ethics Reform Act of 2003. Several amendments were offered. Amendment 1, by Sen. George Hooks of the 14th, included a voluntary pledge for candidates running for public office in the Georgia General Assembly to engage in ethical campaigning. The amendment, which was agreed to by Sen. Stephens, passed 56-0. Sen. Sam Zamarripa of the 36th offered an amendment changing the language in the bill relating to the terms of the Ethics Commissioners and their appointments. The amendment, which was not found acceptable by the Governor's floor leader was defeated 25-31. The third amendment, offered by Sen. Meyer von Bremen, provides for the Ethics Commission's authority over liable and slander issues. Sen. Stephens took no position on this amendment. It passed 32-24. The bill passed the Senate by committee substitute as amended, 56-0. The final bill on Thursday, related to peremptory challenges in misdemeanor, felony, and death penalty cases. Senate Bill 27 is authored by Sen. of the 30th. After minimal debate, the bill passed by committee substitute 45-10. The Senate will be in Session Monday and Tuesday of next week, then will recess Wednesday  Friday, February 19-21 and Monday and Tuesday of the following week, February 24-25, and will reconvene on Wednesday, February 26. Budget hearings are scheduled for the days the Senate is recessed. Illness befell several Senators in the past few weeks, but all seem to be on the mend now. Sen. Terrell Starr of the 44th, who has served 34 years in the Georgia Legislature, missed his first day on Monday following heart surgery over the weekend. He was back a work in no time looking healthy and happy.

Agriculture and Consumer Affairs 
On Monday, February 3rd, the introductory meeting of the committee was called to order by Chairman John Bulloch of the 11th. After adopting the committee rules and regulations, Sen. Faye Smith of the 25th presented SB 14, which relates to the imposition of certain penalties regarding the regulation of the dairy industry. Sen. Smith also requested an amendment to the bill, stating that, if passed, the law would go into effect immediately upon signature. The amendment was adopted as written and after some discussion, the bill passed out of committee unanimously. 
Appropriations 
The Appropriations Committee, chaired by Sen. Jack Hill of the 4th, met on Wednesday, February 12th to review Senate Bill 76, the legislation that will cut the salaries of legislators, the Lt. Governor, the Speaker of the House of Representatives, the President Pro Tempore of the Senate and the Speaker Pro Tempore of the House by 10 percent. The bill is sponsored by Sen. Tom Price of the 56th. The reduction will be enacted as of January 31, 2003 and will remain in effect until December 31, 2004. Sen. George Hooks of the 14th offered an amendment to the bill which would prohibit any member of the General Assembly who resides 50 miles or less from the State Capitol or the location of any committee meeting from receiving the lodging portion, unless a receipt for lodging was received by the legislative fiscal office, of the per diem allowed to members of the General Assembly. The amendment failed. Sen. Regina Thomas of the 2nd included commissioners, constitutional officers and other such officials in charge of a state department, as those who would be forced to take a 10 percent pay cut. Her amendment passed the Committee. The bill was passed as amended by committee substitute and now goes to the full Senate for a vote. 
Banking and Financial Institutions 
Tuesday, February 4th, Chairman Don Cheeks of the 23rd spoke to SB 53, which defines the meaning of creditor as a person who both regularly extends consumer credit that is subject to finance charges or is payable by written agreement in more than four installments and is a person to whom the debt arising from a home loan transaction is initially payable. Creditor also means any person brokering a home loan, a person who directly or indirectly solicits, processes, places, or negotiates home loans for others or who closes home loans which may be in the person's own name with funds provided by others and which loans are thereafter assigned to the person providing the funding of such loans. In addition, the bill provides for other provisions. Sen. Steve Thompson of the 33rd offered an amendment, which would require out of state banks doing business in Georgia to abide by Georgia's law. The bill passed out of committee as amended by substitute. Tuesday, February 11th, Chairman Cheeks opened the committee by presenting an amendment to SB 53, which changes provisions to the Georgia Fair Lending Act of 2002. The amendment makes the following changes to SB 53: Changes home loan to home loans and Federal preemptions that apply to federally chartered financial institutions would also serve to preempt the same type of institution that is state chartered - except that loans brokered by independent mortgage brokers, even if originally funded by a state chartered or federally chartered institution, are subject to the provisions of the chapter. The committee members agreed to sign the amendment, which would be offered on the floor. 
Children and Youth 
The committee, chaired by Sen. Ginger Collins of the 6th, met on Thursday, February 13th, to adopt committee rules and to discuss SB 24, which requires uninsured day care facilities to disclose such information in writing in a prominent area within the facility. SB 24 was presented by Sen. Don Cheeks of the 23rd. Speaking for the bill was Jacqueline Boatright, whose son's tragic accident was a motivation for writing the legislation. An amendment to the bill was offered, which would prevent day care facilities from being charged fines for minor clerical errors in reference to

 documentation of paperwork. The amended bill passed out of committee. There were many distinguished guests present at the committee, including Duaine Hathaway, Executive Director of Georgia CASA; Allyson Anderson, Office of the Child Advocate; Orlando Martinez, Commissioner of the Georgia Department of Juvenile Justice; and First Lady of Georgia Mary Perdue, who was present to advocate for foster parenting for children of all age groups. All guests supported the First Lady's position on foster care and provided evidence of a strong correlation between improved foster care and successful children and youth. 
Economic Development and Tourism 
Thursday, February 13th, Chairman Jeff Mullis of the 53rd called the meeting to order. Sen. Robert Brown of the 26th introduced SB 88, consolidating the Georgia Sports Hall of Fame Advisory Committee with the Board of Community Affairs. The bill would also require the chairperson of the Georgia Music Hall of Fame Advisory Committee to be a member of the Georgia Music Hall of Fame Authority, and would create a Sports Hall of Fame Advisory Committee. After some discussion, the bill was passed out of committee unanimously. 
Education 
The Committee, chaired by Sen. Joey Brush of the 24th, met on February 4, to hear Senate Bill 29 by Sen. Valencia Seay of the 34th and SB 19 by Sen. Horacena Tate of the 38th. SB 29 would allow for local boards of education to determine if electronic devices, such as pagers and cell phones are allowed on school property during the school day. Current law prohibits this practice. Following a hearing, the bill was remanded to a sub-committee. SB 19, is backed by the major education associations, the Georgia Association of Educators (GAE) and the Professional Association of Educators (PAGE). The bill will reinstate the Georgia Fair Dismissal Act which was eliminated in 2000 as part of Gov. Barnes' Education Reform Act of 2000. Following a hearing, the bill was sent to a sub-committee for further study. On Tuesday, February 11, Sen. Brush called the meeting to order for the purposes of discussing SB 29. Sen. Don Thomas of the 54th offered his amendment to SB 29. Deana Hoch, President of PAGE, stated that PAGE supports the bill and any amendments that would strengthen the legislation. Bob Cribbs of GAE, Linda McIntyre of the Georgia Parent Teacher Association (PTA), and Merchuria Chase Williams, President of GAE, all spoke in favor of both the amendment and the bill. Sen. Seay was in attendance to clarify the intent of the bill and speak on its behalf. After much discussion, SB 29 passed out of committee as amended by a vote of 6-2. Also, Ms. Hoch addressed the members of the committee, thanking them for their hard work and dedication to education in Georgia and to invite the committee to the PAGE reception to be held that evening. 
Ethics and Government Reform 
The Ethics Committee, chaired by Sen. Mike Crotts of the 17th, met on February 4, to hear Senate Bill 31. The bill is part of Gov. Sonny Perdue's Ethics Reform Act of 2003. Sen. Bill Stephens of the 51st reviewed the bill with the Committee, and Sen. Bill Hamrick of the 30th offered a friendly amendment to the legislation. There was a great deal of discussion about the make up of the Ethics Commission and the appointments of the Commissioners. Sen. Dan Lee of the 29th, who is a coauthor of the bill, advised the Committee that Gov. Perdue has doubled the Ethics Commission's budget so that a "different job will be done." The legislation also restricts the contact legislators may have with the Georgia Department of Pardons and Paroles regarding prisoners and prison transfers. The bill passed by committee substitute. The Committee also heard Senate Bill 73, by Sen. Joey Brush of the 24th. The legislation will restrict the legislatures ability to name roads, bridges, intersections, interchanges, etc., after an elected official who has been out of office for more than five years or for any citizen who is deceased. The bill passed as amended by Sen. Brush.

 The Committee met again on February 13th to hear Senate Bill 40, by Sen. Robert Lamutt of the 21st. The legislation would require a labor union to advise its members at least once a year that they can opt out of political action committee contributions if they so desire. Sen. Lamutt accepted a friendly amendment from Michael Kramer, an attorney for the Georgia Association of Educators. After hearing from representatives of other labor unions, including the AFL-CIO, the Committee asked Sen. Lamutt to work with the labor unions to clarify some language in the bill. The Committee is expected to vote on the bill next week. 
Finance 
On Tuesday, February 11th, Chairman Casey Cagle of the 49th called the meeting to order. Sen. Eric Johnson of the 1st introduced SB 11, which changes the provisions regarding the designation of counties as less developed areas for the purposes of certain income tax credits provided to specified business enterprises. Specifically, this bill pertains only to Bryan County, which is divided into two district areas by a federal military base and would not be considered for classification as a whole. The bill passed out of committee. 
Health and Human Services 
Monday, February 10th, Chairman Don Thomas of the 54th assigned SB 85 to a sub-committee chaired by Sen. Bill Hamrick of the 30th. In addition, Chairman Thomas appointed Sen. Preston Smith of the 52nd and Sen. Faye Smith of the 25th to serve on the sub-committee. On Wednesday, February 12th, Sen. Ross Tolleson of the 18th spoke to SR 55, which creates a joint study committee on prescription drugs for senior citizens. The resolution passed unanimously. Chairman Thomas appointed a study committee for SB 96, chaired by Sen. Renee Unterman of the 45th and is further composed of Chairman Thomas and Sen. Tom Price of the 56th. Sen. Smith spoke to SB 71, which provides an exemption from licensing requirements for professional counselors, social workers, and marriage and family therapists who are currently licensed to provide professional services within their area of expertise as defined by the laws of their state. Further, they have to be enlisted, screened, and assigned by the American Red Cross to provide disaster relief services. Exemption does not apply to any one individual for any continuous period in excess of 30 days. The bill passed out of committee unanimously. 
Higher Education 
Tuesday, February 11th, Higher Education Committee Chairman, Bill Hamrick of the 30th, and other committee members listened to a presentation by Bill Bowes, Vice Chancellor of Fiscal Affairs at the Board of Regents of the University System of Georgia. The presentation addressed the tough economic times being faced by the University System of Georgia, including budget cuts and possible tuition increases. Mr. Bowes stressed the need for the continuation of state funding and affordable tuition for college and university students, despite the current harsh economic times. Mr. Bowes fielded questions from committee members regarding measures being taken to increase cash flow and stretch tuition dollars. Thursday, February 13th, Wayne Clough, President of the Georgia Institute of Technology, made a presentation to the committee outlining the effect of proposed budget cuts on the institute and underscoring the importance of funding for higher education. He encouraged committee members not to make any more budget cuts for higher education, saying investment in this area significantly stimulates the state's economic growth through business development and research. Bruce Grube, President of Georgia Southern University, gave a similar presentation, stating that his school also needed sufficient funding to cover increased enrollment. Grube described Georgia Southern's significant contributions to scientific research and economic development in Georgia and suggested that further cuts in the higher education budget would raise the prospect of actual layoffs instead of the current hiring freezes that exist.

 Monday, February 3rd, the committee, chaired by Sen. Robert Lamutt of the 21st, met to discuss SB 50. This piece of legislation, which was introduced by Sen. Mitch Seabaugh of the 28th, authorizes insurers to offer one or more individual or group (100 employees or less) health benefit plans, which, either in whole or in part, do not provide state mandate health benefits, in addition to a policy that must contain state mandated health benefits. After hearing from several advocates for women's groups, cancer victims, physicians, and consumers, the bill passed out of committee. 
Judiciary 
Senate Judiciary Committee, Chaired by Senator Charles Tanksley of the 32nd, reviewed a series of bills over the last several days which included SB 27, 102, 44, and 48. SB 27 seeks to amend the Official Code of Georgia Annotated (O.C.G.A.) in the area of impaneled trial juries in misdemeanor, felony, and death penalty cases, as well as peremptory challenges to jurors. SB 27 was previously unanimously voted on then sent back to the subcommittee for language modification. The committee substitute to SB 27, presented by Sen. Bill Hamrick of the 30th, states that the state will be the first party to exercise their first peremptory challenge, followed by the defendant. SB 27 was voted do pass by the committee. Sen. Chuck Clay of the 37th presented SB 102, which addresses the uniform legal representation for indigent defendants via the creation of a Georgia Indigent Defense Board. The committee listened to presentations by both proponents and opponents to SB 102. The bill received a unanimous vote and passed by committee substitute. Sen. Clay next presented SB 44, which provides limited immunity from liability for damages to a person who is appointed as a guardian ad litem. The bill passed unanimously. SB 48 concerns juvenile records and hearings and will allow the disposition of a child and evidence adduced in a juvenile court hearing to be used against the child by a defendant in a civil action brought by the child and based upon factual circumstances surrounding the juvenile court proceeding. The bill passed unanimously. 
Public Safety and Homeland Security 
Sen. Rooney Bowen of the 13th, Chairman, called the meeting to order on Tuesday, February 11, and announced that SB 22, which was on the agenda for the meeting, would be held for a later date. Sen. Jeff Mullis of the 53rd introduced SB 89, which would require Georgia drivers' licenses to indicate U.S. citizenship. After some questions, the bill passed out of committee by a 5-0 vote. Sen. Chuck Clay of the 37th presented SB 46, which specifies that funds collected as police fines would be directed toward training programs, per the requirement of the constitutional amendment creating the fund. After some discussion, the bill was passed out of committee by a 5-0 vote. Sen. Carol Jackson of the 50th then presented SB 81, which would create a Georgia Emergency Medical Services Medical Directors Advisory Council. The bill passed out of committee by a unanimous vote. On Thursday, February 13, Chairman Rooney Bowen of the 13th called the meeting to order. Sen. Tommie Williams of the 19th introduced SB 120, regarding prestige license plates for Purple Heart recipients. The bill would allow veterans with Purple Heart citations to request free standard plates in lieu of special plates. After some questions, the bill was passed out of committee with a 4-0 vote. Sen. Williams then introduced SB 121, calling for state regulation of non-consensual towing services. After discussion, the bill was passed out of committee by a 6-0 vote. Sen. Gloria Butler of the 55th introduced SB 22, which would authorize the Georgia Crime Information Center to release certain criminal records of potential employees at children's and elderly care facilities relating to sexual offenses and other crimes. After debate and comments from senators, health care industry advocates and other audience members, Sen. Jeff Mullis of the 53rd moved that the bill be tabled for further discussion at a later date. 
Reapportionment and Redistricting 
The Reapportionment and Redistricting Committee met for the first time on February 10. Senate Bill 91 was introduced by Sen. Bill Stephens of the 51st. The bill, which is part of Gov. Sonny Perdue's legislative package addresses the principles of redistricting. Sen. Stephens amended the bill to add some language that was left out of the original draft. The Committee members discussed

 incumbency protection, deviation percentages, the Voting Rights Act of 1965, the splitting of counties and communities, the legal definition of "bizarre shapes," the legal definition of "cultural factors," and "memberships in political parties." Sen. Peg Blitch of the 7th offered an amendment to the bill which failed. SB 91 passed as amended by the author. The Committee, chaired by Sen. Dan Lee of the 29th, also adopted the rules for the Committee. 
Rules 
Chairman Don Balfour of the 9th called the meeting to order to place bills on their committee calendar. SR 85, HB 103-105, and SB 33 will be heard on Friday, February 14th. SB 102, 11, 44, 29, 46, and 48 are scheduled to be heard on Monday, February 17th. 
Special Judiciary 
On Tuesday, February 4th, Sen. Renee Unterman of the 45th spoke to SB 12, which raises the penalties for persons found guilty of abusing, neglecting or exploiting any disabled adult or elderly person from a misdemeanor of a high and aggravated nature to a felony, punishable by imprisonment for not less than one nor more than five years. After answering questions from members of the committee, Sen. Unterman yielded the floor. Chairman Rene' Kemp of the 3rd then opened the floor to the audience, and heard from Cas Robinson, representing The Presbytery of Greater Atlanta, who spoke in favor of the bill. The bill passed unanimously. Sen. Michael Meyer von Bremen of the 12th introduced SB 83, which would add district attorneys of the circuit in which their county is located to the board of trustees of the county law library. The bill also provides for other provisions. After answering questions from members of the committee, Sen. Meyer von Bremen and Chairman Kemp both proposed amendments to the bill. The bill then passed unanimously by committee substitute. Legislative Counsel Wayne Allen introduced House Bills 103, 104, and 105 which are general housekeeping bills correcting typographical, stylistic, spelling, capitalization, and other errors and omissions in previously passed legislation. The bills passed out of committee unanimously. On Tuesday, February 11th, Sen. Nadine Thomas of the 10th spoke to SR 35, which establishes the Blue Ribbon Commission to undertake a study on response, investigation, and prosecution of sexual offenses, and to recommend appropriate actions or legislation. Chairman Kemp proposed two amendments to the bill. The resolution passed unanimously as amended. Sen. Vincent Fort of the 39th spoke to SB 77, which makes the penalties for a person convicted of keeping a place of prostitution for a person under the age of 18 the same as the penalties for a person convicted of pimping or pandering when the offense involves persons under the age of 18. After questions from committee members, Chairman Kemp opened the floor to members of the audience. Ati Cusmeef Muhammad, of the Coalition Against Sexual Exploitation and Trafficking, and Alesia Adams, Project Coordinator for the Center to End Adolescent Sexual Exploitation, spoke in support of the bill. Chairman Kemp then instructed Sen. David Adelman of the 42nd and Sen. Fort to explore the possibility of condemning the houses that are used as places of prostitution. The bill passed out of committee unanimously. 
State and Local Governmental Operations 
On Tuesday, February 11th, Senator Renee Unterman of the 45th called the committee meeting to order to adopt committee rules and to discuss SB 84, authored by Senator Regina Thomas of the 2nd. This bill reimburses the county for the cost of collecting school taxes. After the committee rules were adopted, there was discussion on SB 84, which was eventually passed unanimously out of committee. 
State Institutions and Property 
Chairwoman Regina Thomas of the 2nd convened the committee on Tuesday, February 11th, with introductions by committee members and visitors, including representatives of the Department of Paroles and Corrections and the State Properties Commission. Following the adoption of the

 committee rules, Sen. Thomas presented SB 20, which prohibits persons that are infected with HIV or Hepatitis from assaulting peace or correctional officers with infectious bodily fluids or feces. Sen. Thomas announced that SB 20 was not included on the daily agenda. SB 20 would be presented to the committee for discussion only and would be added to next week's schedule so that opposing parties would have a chance to speak against the bill. Sen. Thomas assigned SB 20 to a subcommittee, chaired by Sen. Vincent Fort of the 39th. The sub-committee includes Sen. Liane Levetan of the 40th, Sen. Sam Zamarripa of the 36th, and Sen. Valencia Seay of the 34th. Later, a representative from the Department of Corrections spoke in favor of SB 20 and answered the committee member's questions. 
Transportation 
The committee met Monday, February 10th, to consider SB 37. Sen. Steve Thompson of the 33rd spoke to the bill, which regulates the use of electric personal assistive mobility devices. Following a question and answer session, Sen. Don Cheeks of the 23rd moved to make two amendments to SB 37 regarding grammatical errors. The motion carried. Sen. Liane Levetan of the 40th then moved to make one amendment to SB 37, which prohibits persons under the age of 16 years from operating an electric assistive personal mobility device on the highway. The motion carried. The bill passed out of committee unanimously by committee substitute as amended.
