The Chair of the Judiciary Committee of the Georgia Senate and the Chair of the Judiciary Committee of the Georgia House of Representatives shall serve as ex officio members of the Commission. The Commission shall design a structured sentencing system for the state, monitor and evaluate the performance of the system, and develop other sentencing and correctional recommendations, policies and programs as requested by the Governor. The goals of the structured sentencing system are: To establish certainty in sentencing by ensuring that sentences imposed by the courts will determine the sentences offenders actually serve; To maintain meaningful judicial discretion in the imposition of sentences and sufficient flexibility to permit individualized sentences based on the circumstances of each case; To concentrate current and planned prison capacity on the incarceration of violent, sex and career offenders; To establish a comprehensive range of correctional options in each region of the state that ensures offenders receive the most appropriate penalties; and To ensure that there exist no unwarranted differences in sentences between offenders who have committed similar offenses and have similar criminal histories. Judge Walter J. Matthews, Judge Penny Brown Reynolds, and District Attorney Robert E. Keller shall serve as Co-Chairs of the Commission. Meetings of the Commission shall be held at such times and places as designated by the Co-Chairs. Staff support will be provided by the Office of the Governor, the Office of Planning and Budget, the Criminal Justice Coordinating Council, the Georgia Department of Corrections, the State Board of Pardons and Paroles, the Georgia Bureau of Investigation, the Mental Health, Mental Retardation and Substance Abuse division of the Georgia Department of Human Resources, the Department of Juvenile Justice, and may be provided by the Administrative Office of the Courts, the Council of Superior Court Judges, and the Office of the Attorney General. The Commission shall be administratively attached to the Criminal Justice Coordinating Council. Commission members shall serve without compensation but shall be reimbursed for actual expenses in accordance with state regulations.
