The amendment requires that a person who acquires by transfer or assignment a mortgage on a consumer's principal dwelling must send the consumer a notice within 30 calendar days of receiving the mortgage that informs the consumer of the identity of the new holder and a contact person representing the new holder, plus the acquisition date. The notice must also identify the location where the transfer will be recorded. The regulatory requirement took effect immediately, but compliance is optional until January 19, 2010. "Safeguarding Georgia's Financial Services" Page 2 FFIEC Proposed Reverse Mortgage Guidance On December 17, 2009, the Federal Financial Institutions Examination Council published in the Federal Register proposed Reverse Mortgage Products: Guidance for Managing Compliance and Reputation Risk. The guidance is designed to help financial institutions ensure that their risk management and consumer protection practices adequately address the compliance and reputation risks raised by reverse mortgage lending. The proposed guidance discusses the general features of, certain legal provisions applicable to, and consumer protection concerns raised by reverse mortgage products. In addition, it focuses on the need to provide adequate information to consumers about reverse mortgage products; to provide qualified independent counseling to consumers considering these products; and to avoid potential conflicts of interest. The proposed guidance also addresses related policies, procedures, and internal controls and third party risk management. Georgia Residential Mortgage Act $6.50 Fee Reminder The $6.50 per loan fees required by O.C.G.A. Section 7-1-1011(b)(2) and Department Rule 80-5-1-.04 are due no later than March 1, 2010 for residential mortgage loans closed during the period July 1, 2009 through December 31, 2009. A $6.50 fee will be due if the loan is a residential mortgage loan as defined in the Georgia Residential Mortgage Act (GRMA), and if a security deed, a modification of a security deed or other form of modification of a security interest is recorded. Financial institutions and mortgage licensees and registrants who act as the collecting agent (including brokers who table fund and collect the fee) have been notified regarding the $6.50 fee payment and information regarding accessing the online fee payment and reporting system. This information is sent to the primary contact for the financial institution or mortgage licensee or registrant, according to the Department's records. Remittal of the GRMA $6.50 Loan Fees and Report are required to be made on-line by entities who have been assigned an ID# in the Department's database, even if no residential mortgage loans were made and no fees are due. With the on-line payment process, the Department accepts either ACH drafts on your checking account or Visa, MasterCard, AmericanExpress, or DiscoverCard credit cards. Reporting and fee payment must be done online from our secure website at: https://bkgfin.dbf.state.ga.us/GRMAFee.html. Annual Assessment for State-Chartered Financial Institutions The annual assessment fee letters were e-mailed to banks and credit unions early in December, and the fees will be assessed by February 1, 2010. Page 3 Amendments to Regulation E Regarding Overdraft Fees for Certain Transactions On November 12, 2009, the Federal Reserve Board finalized amendments to Regulation E that prohibit financial institutions from charging consumers fees for paying overdrafts on automated teller machine (ATM) and one-time debit card transactions, unless the consumer affirmatively consents, or opts-in, to the overdraft service for those types of transactions. This rule applies to any fee charged for overdrawing an account, regardless of what the fee is called (e.g., "NSF" fee). Before opting in, the consumer must be provided a notice that explains the financial institution's overdraft services, including the fees associated with the service, and the consumer's choices. The final rule does not apply to the payment of overdrafts for other types of transactions, including checks, ACH transactions, or decoupled debit card transactions (as they are processed by account-holding institutions as ACH transactions). The final rules, along with a model opt-in notice, are issued under Regulation E, which implements the Electronic Fund Transfer Act. The final rule is effective on January 19, 2010, with a mandatory compliance date of July 1, 2010.
