The owner agref'.d to increase . the amount of .food and water for the horse and provide sufficient shelter and pasture. He also explained his plans to have a barn ready with pasture in the country and was only keeping the horse. there in .the meantime. .In addition, the . owner said he intended to fence in the small lo.t ~ehind his mother!s house to provide'some grazing room for the horse. However, during a follow up inspection he found the horse tied again to the stake bemnd the vacant house with no Jood or water. The mare was standing . against the house for protection from the elements.
