RECENT COURT FINDINGS ON TYPE 14 TOBACCO PRINTED BELOW IS THE OUTLINE OF THE COURT'S FINDINGS TO DATE ON THE TOBACCO NATIONAL MARKETING QUOTA CASE. THIS IS THE SUIT FILED BY THREE GEORGIA FARMERS PROTESTING ACREAGE CUTS FOR TYPE 14 TOBACCO, THE PRINCIPAL TYPE GROWN IN GEORGIA. L Federal Courts, under Administrative Procedure Act, 5 USCA, Sec. 1009, have jurisdiction to review the action of the Secretary of Agriculture in the allocation of the National Marketing Quota. 2. That as a condition precedent to the announcement of the National Marketing Quota, the Secretary of Agriculture must make the determination as to whether or not one or more of the types of flue-cured tobacco must be determined as a separate kind of tobacco because of difference in supply and demand conditions amongst the types of flue-cured tobacco. 3. That the Secretary of Agriculture is not authorized to type flue-cured tobacco based on the area where the market is located at which the tobacco is sold. 4. That the Secretary of Agriculture departed from what is required of him by statute: to keep statistics and consider the latest available statistics in making the determination as to kind when arriving at marketing quotas. 5. The Fifth Circuit Court of Appeals has ordered the District Court to enter an order directing the Secretary to reconsider within a reasonable time the question of treating Type 14 as a separate kind of flue- cured tobacco in the line of all available and material facts including such statistics as he may have or which may be reasona- ble derived from presently available facts or statistics to the end of making a con- sidered and fair judgement, in the exercise of his discretion, as to the question present- ed. The Court ordered the Secretary to make his decision on statistics which are presently available to him or which may be compiled from other statistics, documents and other evidence presently available. This evidence may be obtained from the Department or elsewhere, such as from records that may be maintained by purchasers of tobacco from producers. The Secretary must make a decision and his decision, if reviewed after he follows the statutory mandates, will be on the basis of whether he has abused his discretion in the decision. 6. In compiling the statistics as to supply and demand amongst the various types of flue-cured tobacco, said types of tobacco must be based on the area of production as provided for in the Statutory and Regulatory Announcement 118. Agricultural Adjustment Act of 1938, 7 USCA, Sec. 1282, et seq., The Tobacco Stocks and Standards Act of 1929, as amended, 7 USCA, Sec. 501, et seg., and the Tobacco Inspection Act., as amended, 7 USCA, Sec. 551, et seq.
