The United States Department of Ag- -riculture does not have any regulation on the production and handling of milk for manufacturing purposes. Only re- | cently the United States Department of Agriculture has proposed a regulation with notice in the Federal Register which, should it ever be adopted, would prohibit the use of milk which was bloody, stringy or which contained ma- nure or other deleterious matter. This kind of milk is not prohibited now for - manufacturing milk and it is, therefore, presumed that-some of this kind of milk is in milk powders. That is why I have heretofore referred to it as slops. As long ago as 1931 the Legislature, realizing the need of putting the general public on notice if they were being sold milk reconstructed from milk powders, passed a law requiring large placards to be put on exhibit at every place where powdered milk was being sold in a form to deceive the public. These large pla- cards were required to show that pow- dered milk products were being sold or manufactured. This law proved totally ineffective for _ the reason that reconstructed milk is chemically the same as fresh fluid milk and it was impossible to prove whether samples taken represented reconstructed milk or not. It was for that reason that the Legis- lature, in February, 1950, passed Senate Bill 185, known as the Zellner~Act which requires that all milk, cream, buttermilk, chocolate milk and milk beverages in- tended for human consumption in fluid form must be Grade A. This most recent act of the Legislature made it possible for the Commissioner of Agriculture to take additional steps to protect the general public from being defrauded financially and from being ex- posed to hazards to public health. It was to accomplish this that the Commissioner of Agriculture promul- gated these rules and regulations requir- ing powdered milk and the other dairy products involved to be sold only. on permit. This was done so that bakers, packing houses and other institutions using pow- dered milk for purposes other than. to _miik has been contaminated or is other- | fi reconstitute milk could buy powdered miik since these uses were not prohibited by the law. , Some milk dealers have contested this law in the State Courts and the Federal Courts. I remember about two months ago when there were big headlines in the Atlanta newspapers stating that the acts of the Commissioner of Agriculture were unconstitutional. The Federal Court held that these laws and regulations are constitutional and are not in violation of the Interstate Commerce provisions, are reasonably necessary and are calculated to carry out the purpose intended by the . Legislature. There have been eight cases filed in State and Federal Courts on this subject. All eight have been tried and all eight have been decided in favor of the Com- missioner of Agriculture. There is only one case pending. That is the case of Mr Pat Crow, operating under the name of Creatwood Farms Dairy, Inc. This case was decided in favor of the Com- missioner of Agriculture by Judge Thom- as of the Brunswick Judicial Circuit and was appealed to the Supreme Court by theplaintiff. With all of this brushwood out of the way and with a shortage of Grade A milk in the state, there is no reason why any distributor should pay any farmer less than $6.20 a hundred for any Grade A milk. The Commissioner of Agriculture is not a member of the Milk Control Boar of Georgia and has no connection there with and, therefore, has nothing to do with fixing prices on milk and milk products. Neverthgless, it is entirely due to the strict enforcement of the milk laws and particularly with regard to powdered miik that has demonstrated the shortage of Grade A milk in the state and made it possible for milk producers to receiye top prices for their milk. In all: of the eight cases referred to above, the Commissioner of Agriculture ~ was represented by Mr. M. H. Black- shear, Jr., and Mr. Lamar W. Sizemore, Assistants Attorney-General of the state. These two gentlemen are _ outstanding lawyers as proven by the results obtained in these cases, as well as many other cases in the Federal and State Courts in which they have represented the state.
