MOORE, JAMES E. |ALD, TOM LINDER, COMMISSIONERS COUNCIL ATIONAL FARM COMMITTEE, DEFENDANTS : ORDER n consideration of the motion to _ to strike, and for a bill of par- , oral argument, and the brief Governments oral motion to e defendants motion to dis- upon further consideration of | overnments filing information in the above entitled matter = this 31 st day of Au- ERED, adjudged and decreed defendants motion to dismiss same are hereby granted. ED. M. CURRAN, Judge _ United States Couct z FORMATION FILED y the farmers. retand from reading the news- the Government Attorneys | Information. According to | this Tnformation charges bbying to get better farm ee how it would be possible, law, when an indictment is the Court.for Government around. and make -a iolating the same law by | Washington and asked for a copy of the ~Tnformation to be sent me by Air Mail and will probably be able to give next issue of the Bulletin. If you will turn to the last page of this _issue and read the reproduction from the Market Bulletin of Wednesday, Septem- ber 1, 1948, it will refresh your mind about the origin of this case. the report of Honorable Hugh Howell, dated August 24, 1948, to the Acting Governor and you will see how accurate _Mr. Howells forecast of the law and the -outeome of this indictment was. I would like at this time to express -| again my deep appreciation to Honor- _ able Hugh Howell, Honorable Victor Davison, Honorable Allen Post and each and every one of my friends who have stood so staunchly by me and the farm- ers of the State and Nation in this fight. This was an attack on the funda- mental guarantees of our Constitution and an attempt to destroy the right of freedom of speech and the right to pe- tition our Government for redress of grievances. This has been an attack against every American citizen. CRUCIFY HIM Through the ages, whenever an attack has been made ag painst truth, the method ~ employed has heen along the same line. _ The facts which I have brought to the at- tention of Senators, Congressmen and the general public through the pages of the Market Bulletin, through statements to Congressional Committees, through writing letters and otherwise, have been unanswerable facts. Those who have sought to persecute - you full information concerning it in the . Also read ~ NOTICE Read the reproduction on back waae of article dated. Wednesday, September 4 1948, relative to the Washington case, TOM LINDER | me have done it because they were un- able to answer these facts. The people whe have been behind this persecution have always had one ery when they, wished to silence the truth and the er y 5 has been crucify him, crucify him. Truth erushed to earth will rise again. The eternal years of God are here, But wounded error writhes in pain And dies among her worshipers. PITIFUL ee Tn the different counts of the indict- _ ment I was charged with working for | higher prices for farmers and against lower prices for farmers. Because the majority of negroes in | this country are on American farms,I was making a fight which if successful meant more to the welfare of the negro as well as the white people on the farms of this country than anything that any: bureaucrat in Washington was yg to do. Notwithstanding that fact, twelve ne groes were used on the Grand Jury t6 indict meseven negro women and five negro men. We hear so much agitation every day abeut equal rights for negroes and the effort, even here in the South, to provide higher living standards for them, and yet when these twelve negroes had it in their hands to do something to really help their own race, they ignored the op- portunity and indicted me for my efforts to get better prices for farm products, much of which is produced by negroes on the farm. It also dey Signed that 14 members of the Grand Jury were Government em- ployees who under our laws would have been ineligible to sit on the jury any- where in the United States except in the District of Columbia. Brown, ~ = i she Gs HO Editorial By TOM LINDER : There is a great deal of agitation at Yhe present time about prices. Be. There appears to be a _ concerted goovement to blame the farmers of the ation for the high cost of living. _ I was indicted in Washington, D. C., by a bunch of Internaticnalists under the leadership of one Kaufman for - working for higher prices for farmers. - Lets see how this price business works on farm products. ; < _ Congress passed the law putting a floor of 90 per cent of parity under the E<* price of wheat. . At first glance, this would look like m law to raise the price of wheat. But, lets look further. Because of _ the floor under the price of wheat, the wheat farmers planted bumper crops. Wnstead of producing five hundred mil- lion bushels of wheat as they had been doing, the farmers produced one billion bushels of wheat. In Argentina, where there was no Government floor under the price of wheat, the Argentine farmers-continued to produce their normal crops of wheat. IAs a result, the-price of wheat in Ar- ee on account of war-time con- - @itions and war's aftermath. went to five and six dollars per bushel. At the same time here in the United States, the price of wheat never went above three dollars per bushel. The bumper crops of wheat in the United States that were produced as a result of the Government floor under the price States to about one-half the price of wheat in Argentine. _. This is not all of the story because the price of wheat in the United States - would have been at or below the Gov- ernment floor had it not been for tre- -mendous exports of wheat across the aed. _ Those of you who read THE. TIP- OFF in last weeks Market Bulletin will remember that it was clearly shown that the bull market on wheat in the United States was the direct result of Government buying of wheat. It is a matter of record that the of wheat kept the price in the United |. United States Government was buying POSITIONS WANTED POSITIONS WANTED per bushel to give to the countries of Europe, and at the same time the United States Government was paying less than three dollars per bushel to the American farmers for wheat to send across the sea. The truth is that had it not been for the Government floor under the price of wheat that the American farmer would have produced smaller crops and would have received five or six dollars bushel for it just as was the case. i Argentine. This being the case, it should be ap- ; parent to a tenth grade pupil that no one can tell in advance just what the effect of any given legislation will be. One thing we do know, which is, that seven times the farm income Hon. Hugh | Howell Report The following preliminary report. made by the Hon. Hugh Howell to Governor Thompson is self explanatory: August 24, 1948 - Governor M. E. Thompson, : State Capitol, Atlanta, Georgia. - a Dear Governor Thompson: - On the 13th day of July, 1948, you ap- pointed me special attorney for the Exec- utive Department of Georgia, to represent Honorable Tom Linder, Commissioner of Agriculture and in that order I was instruct- ed to do two things: : (1) Look into the indictment that was returned by the Federal Grand Jury in Washington, D. C., and report back to you _ immediately, and, KNO tory pay roll will be substantial , S "/ (2) Represent the case of Mr. Linder to a successful conclusion. 3 In obedience to your request, I beg to ad- _ vise that I have been to Washington and have consulted the attorneys who repre- sent the other defendants in the case. Senator Burton K. Wheelers law firm of Washington represents one of the de- fendants, Honorable Howard Dailey of Texas and the Attorney General of Texas, _represent Honorable J. E. McDonald, Com- missioner of Agriculture of Texas and Mr. William E. Leahys law firm of Washing- ton represents another defendant. All of these are outstanding lawyers and I have been in consultation with all of them. I am convinced, after a study of the in- dictment and the law on which it is based and after extended conferences with all of these attorneys, that the charge against Mr. Linder will fall. He-is charged in a ten count indictment | - among other things, with, (a) _ Wheat in Argentine at near six dollars } gress of the United States, the passage of POSITIONS WANTED Advocating legislation in the Con- : POSITIONS WANTED many dollars per year as the f recelves per year.
