However, there is no law against doing go and the United States Government itself, by Act of Congress, licenses and controls every exchange and there is no law against any citizen patronizing such exchanges. As you know, from reading the Geor- gia Harmers Market Bulletin, I have very vigorously opposed the operation of these futures exchanges for the reason that the rules under which they operate are unfair to the farmers who grow the crops. I have from time to time criticized the Attorney General, the Secretary of Agriculture and the Secretary of Commerce for the way the exchanges are operated, because, under the Fedetal statute, the Attorney Gen- eral, the Secretary of Agriculture and the Secretary of Commer are consti- tuted THE BOARD for the regula- tion of such exchanges. The lobbying. law specifically exempts from its provisions, public officials acting in the discharge of their duties. - Therefore, Conimissioners of Agricul- ture who are doing their official duty _ in lobbying are exempt from the pro- visions of the law. Each count of the indictment began with substantially the same language. Each count charges me and other de- fendants with lobbying for measures that would increase. farm prices and | with working against measures that would lower farm prices. This language was used by the of- ea ~ficials who drew the indictment, purely, with it. for the purpose of prejudicing the. minds of a jury of city consumers. This language could not have been used to set up any crime, because it is no viola- tion of law to lobby for higher prices or-against lower prices, or vice versa. The lobbying law makes it a crime to lobby | without registering. What you lobby for or against has nothing to do It was entirely immaterial whether I lobbied for high prices or. against high prices insofar as the law, is concerned. Under the existing law, the Federal Court for the District of Columbia must necessarily draw its jurors from the District of Columbia. Therefore, Tt, necessarily follows that a jury in the District of Columbia is necessarily a jury composed of consumers with no producers on the jury. It is for this reason that the use of the language, charging the defendants for working eae - the passage of measures to raise farm prices and against measures to reduce farm prices, is highly prejudicial. A the same time, it has no legal place in the indictment as set out above be- cause there is no law against. working for higher prices and against low prices, whether it be for farmers, industrial workers or anyone else. = I have never been offered any re- muneration of any kind by anybody, for the work that T have done in the in- terest of the farmer and his prices. On the other hand; each of the defendants and I have spent money out of our own pockets to pay necessary expenses in connection with carrying out this work.
