SECRET NUMBERS The inaictment charges me with having some kind ot secret number to an account for trad- ing in futures and the Govern- ment lawyer said it was so clev- erly concealed that even the F. B. I. had been unable to find it. Since I have never in my life traded in futures, I was natural- - ly curious to find out what this was all about. I talked with a young Attorney from the New York Cotton Exchange who ex- plained it as follows: It seems that under the rules of the New York Cotton Ex- change, anyone is permitted to trade by number instead of name if they so desire. Now, keep in mind that the rules of the New York Exchange must have the approval of THE BOARD. - THE BOARD under Feder- al Law consists of the Attorney General of the United States, - the Secretary of Agriculture of the United States and the Sec- _ retary of Commerce: of the '| United States. Therefore any rules in effect on the New York Exchange must have heen ap- proved by the Attorney General. - This Lawyer from New York also told me that every num- bered account on the Exchange was well known to the Income Tax Division of the Federal Gov- ernment. It is evident that this would be true. It therefore fol- lows that while a numbered ac- count might be secret from other traders, that it would not be secret from the Government. The Government knows, at all times, according to this At- torney, to whom the number of each account belongs. . Judge Curran also informed us that a three Judge Court had been constituted to pass on the question of the Constitutionality of the so-called Lobbying Act. At this hearing, only questions of law were considered and'no question of fact has been gone into. The matter of legal ques- tions is now in the Courts and nothing will be done until the Court decides these Motions and legal questions before it. If the Court sustains our motions, that will be the end of the case. If the Court over-rules our motions, then further hearings will be -had. I will keep you posted through the Bulletin on any fur- ther developments. Let me again repeat that re- gardless of the outcome of this particular case, if this Act is held Constitutional every citizen of the United States would be pro- hibited by law from contacting his Congressman or Senator or from writing letters or making news releases or doing anything that the Government could con- strue as having some effect on egislation.
