Under the Anti-Trust Law, the op- erators of the broadcasting companies would be subject to prosecution were it shown that they were getting together and fixing uniform rates. We are in the ridiculous position of having laws that prohibit them from fixing uniform rates and at the same time we do not have any law under - which uniform rates are prescribed by law. December 9, 1947 Dear Mr. Linder: We have uniform rates to all custo- mers for like service, and we do not make different charges for different customers. Walter Winchell and Drew Pearson are not on CBS. People who make single broadcasts of speeches are not charged for time. We give them the time and facilities for nothing. No news broadcaster or analyst may appear in a sustaining or commercial series on CBS unless he is an employee of the Columbia Broad- _ casting System. If the news broadcast is sponsored, the rates for the news broadcast are the same as if it were not a news broadcast. During -the height -of political campaigns, for in- stance after the national conventions, we do charge for the use of time on the network because we cannot afford to give away the-amount of time re-~ quired in such circumstances. I assume that this would also be true of other broadcasting systems, although I do not know. Walter Winchell is sponsored by the makers of Jergens Lotion. The Jer- gens is an old family of Holland. They, were the first makers of margarine. J. Jergens and Anton Jergens were the founders of the family fortune. About 1920 they combined with the Van den Berghs, and today this is part of the great Unilever combine. In Atlanta alone, there are four broadcasting stations connected with four principal broadcasting companies. These four broadeasting stations to- gether have approximately three hun- dred 15 Spaces each 24 hours. The great majority of these spaces carry, national advertising matter. There are comparatively few local sponsors.
