One of these bills is to protect, farmers in the purchase of planting seed. Th other bill is to protect farmers who buy feed. There has been a great deal of opposition raised to . the seed bill. This opposition has come from the Seed Dealers Associations i in and out of Georgia. Many of these Seed Dealers of course have opposed the bill because they did not know what was in the bill. Many wild rumors have been circulated regarding it. 24 I believe, however, that we have now worked out lan- ~ uage in the bill which is satisfactory to any reasonable ind person whether farmer or dealer. The bill is too long to carry in full, but the high points the seed bill are as follows: 6 This bill puts teeth in the ae law and is sup- Jemental to the existing law. 4 2. This bill exempts farmers on seed nat the eee rs raise themselves. | 3. This bill requires all our Seed ee to. name a agent in the State of Georgia on whom service can be ad in case of litigation. This brings out of State Seed alers into Georgia Courts and eliminates the necessity : haying to go to other states to bring suit on account of inferior seed. 4. Each Seed Dealer must register with the Commis- sioner of Agriculture before selling seed, but there are no rges for registration and there is no tax or stamp of y kind required. This is not a revenue law, but simply puts teeth in the existing law. _ 5. This bill provides that the Gaientetone: of Agri- ulture can protect farmers who have purchased seed by having hearings and making findings in case of damage where seed i been sold in violation. of the law. The findings of the Commissioner is prima facie evidence in eourts of law. This will make it unnecessary for the indi- vidual farmer to hire a lawyer and go into costly litigation to have his rights determined in case the seed law has been violated. -6. The Gonaneionct of Agriculture. is authorized to eize seed that are being sold in violation of the law in Some cases and to require a bond before releasing them. 7%. This bill in connection with the existing seed law, in my opinion, will make it possible to protect the interest | Georgia farmers in buying seed. eo This bill also gives full protection to Local Seed ealers as Local Seed Dealers who buy seed from whole- alerg will have no responsibility provided they keep suf- ieient records to show from whom they purchased seed that are found to be in violation of the law. Succey farming than laving cood peed. | FEED f There is also a bill which has been passed unanimously, by the Senate and now comes to the House of Representa- ives to put teeth in the feed laws of the State. This bill riginally met very active opposition from Feed Millers in ne out of the State, but it has been worked out in such a X eS ability. State so-as to bring them under jurisdiction of Georgia This bill puts a oe of 50% of the price of ihe feed where the protein shows a shortage of 10% or more, sue - penalty to be collected by the Commissioner of Agricul _and paid to the consumer of the feed, in the same ma that penalties are now eollected on commercial ferti zer The feed bill requires the registration with the Con missioner of Agriculture and _ puts certain powers al duties on the Commissioner to carry its terms into eff There is nothing in either of these bills that gives | Commissioner of Agriculture any arbitrary power, or any way destroys the rights of parties to appeal their. to court and have it judicially determined if they are ni satisfied with the ruling of the Commissioner.
