The Rules Committee will next meet on Tuesday, March 26, at 9:00 a.m., to set the Rules Calendar for the 40th Legislative Day. SB 37 Sheriffs; qualification requirements for the office of sheriff; revise Bill Summary: SB 37 provides for a sheriff who serves in more than one court to receive a salary for up to two courts, and that salary would not be increased by any state cost-of-living adjustment (COLA) or general performance-based increase. The bill prohibits the use of flashing or revolving blue lights by emergency vehicles outside of the jurisdiction of their agency, except when responding to an emergency call or when in pursuit of an actual or suspected violator of the law. SB 37 authorizes jailers who have been certified by the Georgia Peace Officer Standards and Training Council as having successfully completed the course of training require by the Georgia Peace Officer Standards and Training Act to arrest any person who is in violation of a criminal law that occurs in the jail or within the perimeter of the guardlines of the jail. The jailer may also arrest anyone who has a complaint or arrest warrant pending and surrenders themselves. Authored By: House Committee: Sen. The bill provides for deadlines, as well as a provision that no party can require another to waive O.C.G.A. 9-11-67.1 in a contract. Sally Harrell (40th) Public Health Rule Applied: Committee Action: Modified-Structured 03-20-2024 Do Pass by Committee Substitute SB 358 State Election Board; remove the Secretary of State; authorize the board to investigate Bill Summary: SB 358 prohibits the State Ethics Commission from accepting, rejecting, or issuing a complaint against a candidate in the 60 days prior to the election in which they are a candidate. The bill requires local elected officials to file campaign and personal finance disclosure reports to the State Ethics Commission, beginning after December 31, 2025. The bill sets campaign contribution disclosure report deadlines for all candidates on certain dates during nonelection years and certain dates during election years. It exempts specified individuals from certain registration and reporting requirements. The bill requires certain political action committees to establish a bank account, register in the same manner as campaign committees, and file campaign contribution disclosure reports on certain dates. SB 358 specifies certain dates for supplemental campaign contribution disclosure reports in certain instances. It sets requirements for certain financial disclosure statements, and requires the State Ethics Commission to redact any identifiable home addresses from certain records. The bill creates a new misdemeanor for detonating fireworks within 150 feet of an emergency medical technician, firefighter, or law enforcement officer when detonation is for the purpose of hindering or disrupting that first responder's duties. SB 417 revises licensing requirements relating to the display of fireworks and pyrotechnics, requires a license for the use of certain special effects in production of a motion picture or television production, and prohibits certain fire-propelled devices. The legislation revises inspection and certification requirements relative to boilers and pressure vessels. Kim Jackson (41st) Intragovernmental Coordination Local Committee Action: 03-25-2024 Do Pass Judiciary Committee SB 425 Notaries Public; modernization of certain legal, notarial, and court services using electronic means; provide Bill Summary: SB 425 authorizes attorneys to conduct real estate closings using electronic means, with attorneys required to obtain consent from all participants to use electronic means, confirm a signatory's identity through presenting identification, and the participants are physically located in the Page 4 of 7 House of Representatives Daily Report for March 25, 2024 Committee Actions state at the time of the closing. The witness and notary public will be in the same physical location as the signatory, able to witness the signatory electronically sign the document, and immediately sign the document as a witness. Any attorney conducting any real estate closing will be licensed in the state at the time of closing, directly supervise and be responsible for the entirety of the closing, and comply with all relevant law if conducting a closing using electronic means. For residential closing attorneys, they will be present in the state at the time of the closing. The attorney general is authorized to seek injunctive relief, including civil penalties of at least $20,000 per violation, as well as restitution. A party to a real estate closing where someone engaged in the unauthorized practice of law will be entitled to pursue a civil action to recover damages. Notarial acts performed remotely will meet certain requirements. The notary public will use real-time two-way audio-video communication. The signatory will be physically located in the United States or one of its territories or overseas facilities. The notary public will witness the signature.
