Pursuant to a proclamation by His Excellency, Governor Sonny Perdue, the Senate met in Special Session in the Senate Chamber at 1:00 p.m. this day, and was called to order by Lieutenant Governor Mark Taylor, President of the Senate.
The following Proclamation by His Excellency, Governor Sonny Perdue, convening the General Assembly of Georgia in Special Session, was read by the Secretary:

A PROCLAMATION CONVENING THE GENERAL ASSEMBLY OF
GEORGIA IN SPECIAL SESSION
WHEREAS:
Article V, Section II, Paragraph VII of the Constitution of the State of Georgia grants to the Governor the power to convene a special session of the General Assembly, stating and thereby limiting its purposes; and
WHEREAS:
The Regular Session of the 2005 General Assembly adjourned sine die on March 31, 2005; and
WHEREAS:
Motor fuel prices have risen substantially since the adjournment of the 2005 General Assembly; and
WHEREAS:
Hurricane Katrina has caused major destruction and damage to properties in the states of Alabama, Mississippi and Louisiana, adversely affecting the motor fuel supply to the state of Georgia, which has had the effect of further increasing gas prices in the State of Georgia; and
WHEREAS:
The Governor has determined that certain purposes warrant the convocation of a special session; now
THEREFORE:
By virtue of the power and authority that the Constitution of the State of Georgia confers upon me, I, Sonny Perdue, Governor of the State of Georgia, do hereby convene the General Assembly of this State in Special Session at 1:00 p.m. on September 6, 2005, for the purposes and only the purposes stated as follows:

To ratify the Executive Order dated September 2, 2005 and
numbered 09.02.05.01 in the official records of the Office of
the Governor, which suspended the collection of all state
sales and use taxation, state excise taxation, and the second
motor fuel tax as those taxes apply to aviation gasoline, and
motor fuel used to propel motor vehicles for use on or off
public highways including gasoline, dyed fuel oils, liquid
propane gas, and other special fuels including but not limited
to gasohol, ethanol, liquefied natural gas, or compressed
natural gas, and excluding jet fuel, commencing with all
deliveries occurring immediately following the last moment
of September 2, 2005, until the General Assembly acts upon
this Order;
2.
To enact general law providing a temporary exemption on
motor fuel taxes due the state commencing with all deliveries
occurring immediately following the last moment of
September 2, 2005, and ending midnight September 30,
2005, and other related purposes;
3.
To amend Code Section 50-19-7 of the Official Code of
Georgia Annotated to change provisions relating to the
mileage reimbursement rate for traveling expenses for
officers, officials, and employees of the executive, legislative,
and judicial branches of state government.

A RESOLUTION
Adopting the Rules of the Senate for the 2005 Special Session of the General Assembly of Georgia; and for other purposes.
BE IT RESOLVED BY THE SENATE that the Rules of the Senate in force on March 31 of the 2005 Regular Session of the General Assembly are hereby adopted as the Rules of the Senate for the 2005 special session with the following exceptions:
Strike Rule 2-7.1 which reads as follows: "2-7.1 Process The Senate may resolve itself into a Committee of the Whole by a majority of those voting, provided that the total vote constitutes a quorum, on motion of a member made for that purpose; provided, further, that notice of intention to make such motion shall be given during the session of the preceding day. Individual speeches on such motion shall be limited to three minutes. If such notice shall not have been given, the motion shall prevail if it shall receive the affirmative votes of two-thirds of those voting; provided that the two-thirds shall constitute a majority of all the members elected to the Senate. Provided, further, that whenever the Senate, by its own vote, shall commit any bill or resolution to the Committee of the Whole, and, subsequently, a motion shall be made to resolve the Senate into a Committee of the Whole to consider such bill or resolution, and such motion shall be lost, the said motion shall not be again renewed; but it shall be the duty of the President to require the Secretary of the Senate to read the bill or resolution again at the following day's session under the order of introduction of new matter or reading of bills the first time, and to refer such bill or resolution to the appropriate committee as directed by the President Pro Tempore, unless otherwise ordered by the Senate."
and insert in lieu thereof a new Rule 2-7.1 to read as follows:

Strike Rule 2-8.4 which reads as follows: "2-8.4 Time Limit; Discharge; Appointment of New Members After a Committee of Conference has been in existence for five (5) days and has failed to make a report to the Senate on the question under consideration, the Senate, on motion and by a majority vote of all members elected to the Senate, may discharge the Senate conferees and appoint new conferees, instruct said Senate conferees, or make any other motion not contrary to the Rules of the Senate. Provided, that during the last five (5) days of the session, the above motions may be made and passed at any time, but not more often than every twenty-four hours."
and insert in lieu thereof a new rule 2-8.4 to read as follows: "2-8.4 Time Limit; Discharge; Appointment of New Members After a Committee of Conference has been in existence for twenty-four (24) hours and has failed to make a report to the Senate on the question under consideration, the President Pro Tempore may discharge the Senate conferees and appoint new conferees, or, after forty-eight (48) hours, the Senate, on motion and by a majority vote of all members elected to the Senate, may discharge the Senate conferees and the President Pro Tempore shall appoint new conferees."
Strike Rule 3-1.2 (a) which reads as follows: "(a) No bill or resolution requiring the concurring vote of the House for passage shall be introduced unless the same shall have been filed in the office of the Secretary before 4:00 p.m. on the previous day."
and insert in lieu thereof a new rule 3-1.2 (a) to read as follows: "(a) On the first day of a special session a bill or resolution requiring the concurring vote of the House of Representatives for passage may be introduced if it has been filed with the Secretary prior to the time for First Reading and Reference of Senate Bills and Resolutions in the Order of Business."

Strike Rule 4-2.6 which reads as follows: "4-2.6 Order for Second (2nd) Reading; Second Reading After the 35th Day Any general bill or resolution shall be automatically passed to a second reading on the legislative day following the day the bill or resolution is reported by the committee to which it was referred. Except that after the thirty-fifth (35th) day of any regular session, every bill and resolution shall be read a second time on the same legislative day that the bill or resolution is reported by the committee to which it was referred. No debate shall be admitted upon any bill at the first or second reading."
and insert in lieu thereof a new Rule 4-2.6 to read as follows: "4-2.6 Order for Second (2nd) Reading; Second Reading After the 35th Day Every General bill and resolution shall be read a second time on the same legislative day that the bill or resolution is reported by the committee to which it was referred. No debate shall be admitted upon any bill at the first or second reading."
Strike Rule 4-2.14 which reads as follows: "4-2.14 Transmittal to the House No bill or resolution shall be transmitted to the House on the day of passage thereof unless two-thirds of the Senators voting, provided the total vote constitutes a quorum, shall so order. Provided, during the last three legislative days of any regular session, any bill, resolution or other matter which requires action by the House shall be immediately transmitted to the House by the Secretary of the Senate. The Secretary shall also immediately transmit Senate Bills and Resolutions requiring House action on the thirty-third (33rd) legislative day after any notice to reconsider is disposed of."
and insert in lieu thereof a new Rule 4-2.14 to read as follows: "4-2.14 Transmittal to the House No bill or resolution shall be transmitted to the House on the day of passage thereof unless a majority of the Senators voting, provided the total vote constitutes a quorum, shall so order."
Strike Rule 6-7.1 which reads as follows: "6-7.1 Timing and Notice (a) Before any action can be reconsidered, notice of intention to so move must be given to the Senate during the legislative day on which the action sought to be reconsidered took place. The notice cannot be withdrawn and any Senator can move for reconsideration the following legislative day. (b) When the Journal of the preceding day is read, any Senator may move for reconsideration of any matter therein contained, except such matter that has been previously reconsidered or transmitted to the House of Representatives. (c) A notice of motion to reconsider a bill or resolution shall take precedence over a motion to transmit and shall have the effect of defeating the motion to transmit; except on the thirty-third (33rd) day and during the last three (3) days of any regular session, a

Strike Rule 6-7.4 which reads as follows: "6-7.4 Effect of Motion; Return to General Calendar All bills and resolutions reconsidered shall take their place at the foot of the calendar of bills then in order for a third reading; however, during the last thirty-five (35) legislative days of each session, a reconsidered bill or resolution which was passed or adopted shall take its place at the foot of the Rules Calendar, and a reconsidered bill or resolution which was defeated shall be placed on the General Calendar."
and insert in lieu thereof a new Rule 6-7.4 to read as follows: "6-7.4 Effect of Motion; Return to General Calendar All bills and resolutions reconsidered shall take their place at the foot of the calendar of bills then in order for a third reading."
BE IT FURTHER RESOLVED that the Rules amendments adopted pursuant to this resolution shall be in effect for the 2005 Special Session of the General Assembly only.

SB 1EX. By Senators Grant of the 25th, Johnson of the 1st, Williams of the 19th, Kemp of the 46th, Cagle of the 49th and others:
A BILL to be entitled an Act to amend Chapter 19 of Title 50 of the Official Code of Georgia Annotated, relating to state travel services, so as to change the rate of mileage reimbursement to state officers and employees traveling on state business in their personal motor vehicles; to provide an effective date; to repeal conflicting laws; and for other purposes.
Senator Williams of the 19th gave notice and asked unanimous consent that SB 1EX be engrossed.
There was no objection and SB 1EX was engrossed.
The President referred SB 1EX to the Committee of the Whole Senate.
Senator Williams of the 19th moved that the Senate resolve itself into the Committee of the Whole Senate for the purpose of hearing testimony on and to consider SB 1EX.
Senator Douglas of the 17th asked unanimous consent that Senator Chapman of the 3rd be excused. The consent was granted, and Senator Chapman was excused.
Senator Reed of the 35th asked unanimous consent that Senator Zamarripa of the 36th be excused. The consent was granted, and Senator Zamarripa was excused.

On the motion, the yeas were 50, nays 0, the motion prevailed; and the Senate resolved into the Committee of the Whole Senate.
Senator Eric Johnson, President Pro Tempore, assumed the Chair.
The President Pro Tempore appointed Senator Williams of the 19th to serve as Chairman of the Committee of the Whole Senate.
At 2:25 p.m. Senator Eric Johnson, President Pro Tempore, announced that the Committee of the Whole Senate would stand in recess until 2:45 p.m.
At 2:45 p.m. Senator Eric Johnson, President Pro Tempore, called the Committee of the Whole Senate to order to hear testimony on SB 1EX.
The President Pro Tempore announced the Committee of the Whole Senate dissolved at 3:12 p.m.
The President resumed the Chair, and the Senate reconvened.
Senator Williams of the 19th, Chairman of the Committee of the Whole Senate, rose and reported that the Committee of the Whole Senate had under consideration SB 1EX and recommended that SB 1EX do pass.

Dear Colleagues,
My bid to become Georgia's first Republican Secretary of State became formal last Friday upon the filing of the appropriate campaign papers. This Campaign will be a future focused, tough, disciplined, winning effort and I believe you will be proud of what we do and how we do it. As you know, I don't believe in dress rehearsals and we are going to do this right while making some history once again.
I look forward to being out on the road and seeing what few parts of Georgia I haven't already represented courtesy of redistricting and the federal courts.
In the meantime, there is an important matter that needs to be addressed. The Caucus Rules we put in place upon taking the Majority in January 2003 are very clear. Article 6, Section one states, "In the event of a vacancy in any Caucus leadership office caused by death, retirement, resignation, or filing for another office, the office shall be filled for its unexpired term by a Caucus election".
Well, I'm not dead or retiring or resigning. Rest assured I intend to remain an active part of our Caucus right up until the Inaugural Ceremonies in January 2007. However, I have filed for another office and the rules are clear. Therefore, Chairman Balfour will be in touch with you with the timeline for a Caucus election to fill my unexpired term as your Majority Leader.
You will probably stop reading at this point, but I hope you don't....because I want you to know what an honor it has been to be a part of this Caucus Leadership Team for the past five years. I hope history will record that I had some small part in working with you all to make the historic transition from controlling 40 % of the Senate to having flipped that to exactly the opposite, with our Republican Caucus now controlling 60% of the Chamber. During that time you gave me the honor of serving you as Caucus Chair, Administration Floor Leader and then Majority Leader. I will be forever grateful for that privilege.

VETO NUMBER 1
HB 264 HB 264 significantly expands the authority of the Georgia Commission on Interstate Cooperation to include all interstate and international relations and expands the type and number of organizations that are considered joint governmental agencies. This new authority is vague and overbroad; I therefore VETO HB 264.
VETO NUMBER 2
HB 367 HB 367 includes many unrelated provisions including regulation of ignition interlock device providers, re-plating of license plates, changes for hazardous material transportation and requirements for driver training schools. The fatal flaw in this bill, however, is the provision that prohibits the operation of public driver improvement clinics in any county in which a private clinic is located. This provision would even require a public clinic to shut down whenever a private clinic begins operating in the same county. This provision is inconsistent with free market competition. I therefore VETO HB 367.
VETO NUMBER 3
HB 444 HB 444 changes the educational and professional requirements for engineers and land surveyors, essentially phasing-out the acceptability of apprenticeship experience and requiring a bachelor's degree. This legislation would ultimately, unnecessarily and inappropriately shut out many individuals from land surveying and likely result in increased costs to consumers. I believe that the underlying purpose of this bill can be better addressed through considering scope of practice as opposed to educational requirements. Therefore, I VETO HB 444.

SB 68
Among other things, SB 68 expands the authority of the Georgia Board of
Real Estate Appraisers and the Georgia Real Estate Commission to regulate continuing
education instructors and the schools offering continuing education courses. These are
privileges not given to similar professional boards and I see no demonstrated need for
such expanded authority or regulation; I therefore VETO SB 68.
VETO NUMBER 5
SB 98
SB 98 authorizes local boards of education to provide life, disability,
liability insurance, retirement or pension coverage, social security and employment
security coverage for local board members. Such benefits would inevitably expand
service on local school boards to full-time engagements. These wide-ranging benefits are
beyond the scope of what is appropriate. I therefore VETO SB 98.
VETO NUMBER 6
SB 254 SB 254, among other things, relaxes the standards for the annual audit of legislative funds and expenditures by removing the requirement for detail. Because such relaxation is inappropriate, I VETO SB 254.
VETO NUMBER 7
SB 328 SB 328 is local legislation applicable to DeKalb County. This bill, among other things, would impose a $5.00 surcharge to fines levied by the State Court or Recorders Court in DeKalb County for the purpose of creating a technology fund for use in the offices of the clerk of the Superior Court, State Court, Magistrate Court and other courts in DeKalb County. In recent years, there has become an over-proliferation of court fines and fees as a means of funding various services at the state and local levels. The proliferation has occurred without a concurrent ability to track, account for and manage receipts to ensure efficiencies. I am unwilling to expand court fines for technology funds for the State and Superior Courts which have greater access to resources than other local courts. I therefore VETO SB 328.

SB 338 SB 338 is local legislation applicable to Clayton County. The Clayton County Board of Commissioners has requested that it be vetoed. Section 8, pertaining to the Prosecuting Attorneys, page 5 of 85: In the appropriations for the Prosecuting Attorneys, the Prosecuting Attorney's Council Program is to be appropriated $5,465,257. This program can be funded through the transfer of funds from the District Attorneys Program within the Prosecuting Attorneys Budget Unit. Therefore, the $5,465,257 for the program (page 5 of 85, lines 74 through 76) in the provisions relative to Section 8, Prosecuting Attorneys is vetoed.
Section 10, pertaining to the Superior Courts, page 6 of 85: In the appropriations for the Superior Courts, the Council of Superior Court Judges Program is to be appropriated $882,809. This program can be funded through the transfer of funds from the other programs within the Superior Courts Budget Unit. Therefore, the $882,809 for the program (page 6 of 85, lines 90 through 92) in the provisions relative to Section 10, Superior Courts is vetoed.
Section 23, pertaining to the Employees' Retirement System of Georgia, page 28 of 85: Language relative to the Public School Employees' Retirement System, a program of the Employees' Retirement System of Georgia reads: "It is the intent of the General Assembly that the employer contribution for Public School Employees' Retirement System shall not exceed $23.35 per member for State Fiscal Year 2005." The appropriations in HB 85 increased the benefit accrual rate per member by $0.50, from $13.00 to $13.50. However, the actuarial study to determine the actual employer contribution for the upcoming fiscal year 2006 has not been complete. Therefore, this language (page 28 of 85) in the provisions relative to Section 23, Employees' Retirement System of Georgia is incorrect and must be vetoed.
Section 33, pertaining to the Department of Motor Vehicle Safety, page 50 of 85, lines 1265 through 1267: In the appropriations for the Department of Motor Vehicle Safety, the Motorcycle Safety Program is to be appropriated $100,000. This program is currently funded through fees paid by applicants. The department did not requests these funds. Therefore, the $100,000 for this program (page 50 of 85, lines 1265 through 1267) in the provisions relative to Section 33, Department of Motor Vehicle Safety is vetoed.
Section 48, pertaining to the General Obligation Debt Sinking Fund, page 74 of 85, BOND #12: This language authorizes the appropriation of $192,360 to finance projects and facilities of the Board of Regents of the University System of Georgia, specifically for library and classrooms expansion to Building A at Waycross College, through the issuance of not more than $2,290,000 in principal amount of General Obligation Debt for 20 years. His sentencing has not yet been scheduled. I am the lead prosecutor on this case.

SUBJECT: Fiscal Note Senate Bill 1EX (LC 18 4734-EC)
This bill would change the rate of mileage reimbursement to state officers and employees traveling on state business in their personal motor vehicles. Currently, the rate is set in statute at $0.28 per mile. This bill would set the rate at the same mileage rate established by the U.S. General Services Administration for federal employees pursuant to Federal Travel Regulation Amendment 2005-01 as of July 1, 2005, or subsequently amended.

The fiscal impact of this bill is approximately $4.9 million. Amounts reported by state agencies for employee mileage reimbursement for FY 2005 were recalculated based upon the federal reimbursement rate. An adjustment was made to reflect the estimated percentage of state mileage reimbursement that was reimbursed from other funding sources (i.e., federal funds). The amount above includes $1.2 million estimated by the Board of Regents for mileage reimbursement to University System employees.

I understand that a full floor vote will take place on the above referenced Senate Bill, and that this will occur on September 8, 2005, the third day of the Special Session. As you can see from the accompanying, I am under a Notice to take deposition of my client in a Federal Court case pending in the Middle District of Georgia. I was under the Notice before the call for the session was made by the Governor. The deposition is noticed for September 8, 2005 at 2:30 P.M. whereby I cannot attend the session on that date.

SUBJECT: Fiscal Note House Bill 1EX (LC 18 4735-EC)
This legislation would temporarily suspend the collection of motor fuel taxes. This moratorium would apply to both the excise tax and the 4% prepaid sales tax. The prepaid tax is split 3% to motor fuel revenue which is dedicated to the Department of Transportation and 1% to the state General Fund. This suspension would last for approximately 30 days.
The Georgia State University Fiscal Research Center estimates the overall impact of this moratorium is to reduce state revenues by approximately $75.5 million in FY 2006. This decrease would consist of approximately $66.1 million in motor fuel revenue that will impact the state in FY 2007 and $9.4 million in General Fund revenue that will impact the state in FY 2006. The Fiscal Research Center provided the following narrative regarding this estimate:
The starting point of this analysis was the Department of Revenue's report on FY 2005 motor fuel tax receipts. These receipts were approximately $461 million

from the excise tax and $330 million from the first 3% of the prepaid sales tax. The excise tax revenue was divided by the 7.5 cent per gallon excise tax rate to estimate gallons consumed in Georgia.
For FY 2006, it was assumed that gallon consumption grows by 1% over FY 2005. This consumption quantity was multiplied by the excise tax rate and the current prepaid sales tax rate which is 7.5 cents per gallon for gasoline. This calculation yields annual totals of $466.0 million in excise tax, $349.5 million from the first 3% of the prepaid sales tax and $116.5 million from the last 1% of the prepaid sales tax rate.
Based on recent average monthly receipts, September's motor fuel revenue is expected to equal about 8.1% of the annual total. This yields estimates of the revenue reduction from a September moratorium. These estimates are approximately $37.8 million in excise tax revenue, $28.3 million from the first 3% of the prepaid sales tax and $9.4 million from the last 1% of the prepaid sales tax. The combined impacts are a $66.1 million decrease in motor fuel revenues and a $9.4 million decrease in general fund revenues for a $75.5 million overall decrease in state revenues.
