The 1998 Georgia General Assembly passed Senate Resolution 144, which provided for an amendment to the Constitution of the State of Georgia to authorize the General Assembly to create additional penalties for the offenses involving driving under the influence ofalcohol or drugs w~ich shall be allocated to a Brain and Spinal Injury Trust Fund; and
Said constitutional amendment was placed on the ballot and ratified by the voters in General Election on November 2, 1998; and
Senate Bill 110 was passed by the General Assembly concurrent with Senate Resolution 144 in order to establish the collection of additional penalty assessments for violations involving driving under the influence of alcohol or drugs and to create the Brain and Spinal Injury Trust Fund; and
Senate Bill 110 created the Brain and Spinal Injury Trust Fund Authority for the purpose ofadministering the distribution of such funds collected to the Brain and Spinal Injury Trust Fund to meet the costs of care and rehabilitative services for citizens of this state with brain or spinal cord injuries; and
Senate Bill 110 provides that the Brain and Spinal Injury Trust Fund Authority shall consist of fifteen members, with eleven to be appointed by the Governor, and one to be appointed by the Division of Rehabilitation Services of the Department of Human Resources, one to be appointed by the State Board of Education, one to be appointed by the Department of Public Safety and one to be appointed by the Department of Medical Assistance (which was subsequently amended in 1999 by Senate Bill 241 to be appointed by the Department of Community Health), and that such members shall be appointed initially for terms of one, two or three years and shall serve thereafter for two-year terms of office; and
Senate Bill 110 was signed by the Governor on April 6, 1998, as Act 809 and became effective January 1, 1999;

as Chairperson of the Brain and Spinal Injury Trust Fund Authority.
IT IS FURTHER
That, whereas Senate Bill 110 provides that the Authority shall utilize existing state resources and staff of participating departments whenever practicable, the Division ofRehabilitation Services has designated Mr. Alan Morris to assist the Authority.
